Dear Mr. Beavers:
The Planning and Building Departments have reviewed the revisions to your application for a Sign
Permit to allow for the addition of a reader board to the existing sign for Beach Diner, located at
501 Atlantic Boulevard. As you are aware, the existing Beach Diner sign is a Nonconforming
Sign. Chapter 17-14 (3) of the City Code requires Nonconforming Signs to be brought into
compliance when any change to the structural supports of the sign are made.
While the proposed new portion of the sign is within the eight (8) foot height limit, and the size of
both the existing and proposed portions of the sign are within the allowable sign size for this
property, the addition of the reader board is not consistent with the nonconforming provisions of
Chapter 17-14 in that an additional foundation and structural support is required to meet windload
and engineering requirements. Accordingly, a permit cannot be issued for the proposed changes to
the existing Sign. There are two options available to seek redress to this decision. You may
appeal denial of the permit to the City Commission, or alternatively, you may seek a waiver from
the sign regulations under the provisions of Section 17-15 of the Code. If it your intent to pursue
either of these options, please notify the City Clerk in writing, so that the request can be scheduled
for hearing by the City Commission.
