Thank you for placing HB 105, Regulation of Smoking by Counties and Municipalities by
Representative Randy Fine on the agenda for the January 25, 2022 meeting of the House
Professions & Public Health Subcommittee.
I write in support of HB 105 by Representative Fine.
As you know, Florida Statutes Chapter 386.209 provides that the regulation of smoking is
preempted to the State of Florida. The youth of our community and communities throughout the
State currently play on playgrounds, athletic fields, skate parks, and aquatic facilities with
inconsiderate adults smoking around these children providing them with unhealthy secondhand
smoke. The current law prohibits municipalities and counties from setting up a reasonable smoke-
free zone so that our young people can enjoy playing on public playgrounds, at recreation
facilities, on athletic fields, or watching a sibling play youth sports on such athletic fields.
I stand in support of Representative Fine's HB 105 and commend him for helping to provide a
healthy environment for our youth. I urge you to support this legislation.
