Defense of civil actions against public officers, employees or agents; payment of judgments or settlements. (a) Defense of civil actions. The city shall provide an attorney to defend any civil action arising from a complaint for damages or injury suffered as a result of any act or omission of action of any of its officers, employees, or agents for an act or omission arising out of and in the scope of his or her employment or function, unless, in the case of a tort action, the officer, employee or agent acted in bad faith, with malicious purpose, or in a manner exhibiting willful disregard of human rights, safety, or property. Supp. No. 26 155 § 2-1 ATLANTIC BEACH CODE agent for an act or omission under color of state law, custom or usage, wherein it is alleged that such officer, employee, or agent has deprived another person of his rights secured under the Federal Constitution or laws. Legal representation of an officer, employee, or agent of the city may be provided by the city attorney. However, any attorney's fees paid from public funds for an officer, employee, or agent who is found to be personally liable by virtue of acting outside the scope of his employment, or was acting in bad faith, with malicious purpose, or in a manner exhibiting wanton and willful disregard of human rights, safety, or property, may be recovered by the city in a civil action against such officer, employee, or agent. If the city fails, pursuant to this section to provide an attorney to defend a civil action arising from a complaint for damages or injury suffered as a result of any act or omission of action of any of its officers, employees, or agents and fails to provide such attorney, the city shall reimburse the defendant who prevails in the action for court cost and reasonable attorney's fees. (b) Payment of judgments or settlements against certain public officers or employees. When the city fails to provide insurance coverage for action set forth in subsection (a) and is not participating in the State Insurance Risk Management Trust Fund it will pay: (1) Any final judgment, including damages, costs, and attorney's fees, arising from a complaint for damages or injury suffered as a result of any act or omission of action of any officer, employee, or agent in a civil or civil rights lawsuit described in subsection (a). If the civil action arises under section 768.28, Florida Statutes, as a tort claim, the limitation and provision of section 768.28 governing payment shall apply. If the action is a civil rights action arising under 42 U.S.C. 1983, or similar federal statutes, payments for the full amount of the judgment may be made unless the officer, employee, or agent has been determined in the final judgment to have caused the harm intentionally. (2) Any compromise or settlement of any claim or litigation as dPserihed in paragraph (1) subject to the limitations set forth in that paragraph. (3) Any reimbursement required under subsection (a) for court costs and reasonable attorney's fees when the city has failed to provide an attorney and the defendant prevails. (Ord. No. 95-88-34, §§ 1, 2, adopted March 14, 1988, did not specifically amend the Code; therefore, inclusion as § 2-1 was at the discretion of the editor. Sec. 2-2. Charitable contributions prohibited. The city shall not contribute city funds to any charitable, nonprofit, or other worthy cause. However, the city may contribute city funds or other support to artistic, recreational, or cultural programs, events or projects which benefit the residents of Atlantic Beach, as follows: (1) Requests for contributions to such programs, events or projects shall be submitted to the cultural arts and recreational advisory committee. Supp. No. 26 156 ADMINISTRATION § 2-15 (2) The cultural arts and recreational advisory committee will make recommendations on any such requests to the city commission, who will then make the final decision on funding the request. (3) Any request for contributions which are not artistic, recreational, or cultural in nature shall be submitted directly to the city commission for consideration. (Ord. Supp. No. 26 156.1 ADMINISTRATION § 2-367 monthly log of the actual miles traveled and a monthly request for reimbursement. Travel occurring outside county or travel in conjunction with the authorized traveler receiving reimbursement for meals and lodging expense or for travel to and from home shall not be included in the log. (Ord. No. 5-83-11, § 8, 1-9-84) Sec. 2-364. Reimbursable incidental expenses. An authorized traveler may be reimbursed for incidental travel expenses incurred during the course of travel. These incidental travel expenses include but are not limited to the following: (1) Taxi, ferry and airport limousine fares; (2) Bridge, road and tunnel tolls; (3) Storage and parking fees; (4) Telephone and telegraph charges relating to city business; (5) Registration, convention or tuition fees not prepaid by the city. (Ord. No. 5-83-11, § 9, 1-9-84) Sec. 2-365. Auditing. A travel expense report or voucher as developed by the city manager shall be submitted to the director of finance within thirty (30) days after the travel expense. Each approved travel expense report will be audited by the director of finance when received. (Ord. No. 5-83-11, § 10, 1-9-84) Sec. 2-366. Fraudulent claims. Claims submitted pursuant to this division shall be signed by the authorized traveler and shall be verified by a written declaration that it is true and correct as to every material matter. Any individual who makes or aides in the making of a false or fraudulent claim shall be guilty of a violation against the city and upon conviction thereof shall be punished as provided by section 1-11 or in the city's personnel rules and regulations. In addition, any person who received a travel allowance, advance or reimbursement by means of a false claim shall be civilly liable for the repayment of the amount into the public fund from which the claim was paid. (Ord. No. 5-83-11, § 11, 1-9-84) DIVISION 4. SERVICE AND USER CHARGES Sec. 2-367. Authorization. The City of Atlantic Beach hereby authorizes the establishment of service charges and user fees for services provided by the city not otherwise paid for by ad valorem taxes and as set and approved from time to time by the city commission. No. 5-02-38, § 1, 9-23-02) Supp. No. 26 196 [The next page is 245] Chapter 3 ALCOHOLIC BEVERAGES* Sec. 3-1. Definitions. For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section. Alcoholic beverage license shall mean that license issued to a person or location by the state division of alcoholic beverages and tobacco of the department of business regulations. All other words used in this chapter shall be as defined in The Beverage Law (F.S. Chs. 561-568). (Ord. (a) It shall be unlawful for any person licensed to sell alcoholic beverages in the city to sell, offer for sale, serve, give away, dispense or dispose of alcoholic beverages or permit the same to be consumed upon his premises during the days and times listed below: (1) Between the hours of 2:00 a.m. on Christmas Day and 7:00 a.m. on the day following Christmas Day. (2) Between the hours of 2:00 a.m. and 7:00 a.m. on all other days. (b) The premises in which any of the alcoholic beverages are kept, except such premises as are primarily used and conducted as grocery stores, markets or primarily for the sale and serving of prepared foods for consumption thereon shall be securely closed during such hours, and no person shall be permitted therein during such hours for any purpose whatsoever, except to clean up the premises, to perform necessary functions for closing the establishment, or to perform necessary maintenance. It shall be unlawful for any person operating for profit, but not licensed to sell alcoholic beverages in the city, to serve, give away or dispense alcoholic beverages or permit the same to be consumed upon his premises between the hours of 2:00 a.m. on Christmas Day and 7:00 a.m. on the day following Christmas Day, and between the hours of 2:00 a.m. on Sundays and 1:00 p.m. on Sundays, and between the hours of 2:00 a.m. and 7:00 a.m. on all other days. Premises where sales permitted. Sales of alcoholic beverages are permitted on the following premises: (1) The premises commonly known as Le Chateau; (2) The clubhouse site and pro shop site of the Selva Marina Country Club; (3) The premises commonly known as the Sea Turtle; (4) The premises located and fronting on Atlantic Boulevard from a point two hundred (200) feet east of the center line of a street designated Sylvan Drive, west to the city limits; (5) All premises located and fronting on the Mayport Road and in compliance with chapter 24; (6) The premises commonly known as Letizia's Italian Restaurant so long as the sale for consumption on premises of alcoholic beverages is incidental to the sale of' food. Locations where on -premises sales prohibited. No vendor of alcoholic beverages containing alcohol of not more than fourteen (14) percent by weight and wines, regardless of alcoholic content, for consumption on premises, shall be permitted to conduct his place of business in the CC zone east of a line two hundred (200) feet east and parallel to the center line of a street designated as Sylvan Drive, unless such place of business is a restaurant or delicatessen and the sale of beer and wine is incidental to the sale of food. Restrictions on location of establishments. (a) Notwithstanding the provisions of this chapter, no location shall be approved for an alcoholic beverage license, whether for on or off -premises consumption, unless the location is not less than: (1) One thousand five hundred (1,500) feet from any other location where there exists a current alcoholic beverage license; or (2) One thousand five hundred (1,500) feet from any established school or church. No inspection shall be made by the city electrical inspector until after a permit for electrical construction or alterations has been obtained by the master electrician from the building official of this city. The city electrical inspector or his duly authorized assistants shall have the right, during reasonable hours, with the consent of the owner or occupant, to enter any building or premises in the discharge of his official duty or for the purpose of making any inspection or test of the electrical wiring, apparatus or fixtures contained therein. If the owner or occupant shall refuse to give such consent, entry shall be made only pursuant to authority granted by a properly issued search warrant. There is hereby adopted the Standard Plumbing Code, 1997 edition, as published by the Southern Building Code Congress International, Inc., for the purpose of establishing rules and regulations for the construction, maintenance and repairs on plumbing, including permits and penalties. (a) Every master or journeyman plumber before carrying on his trade or business in this city, shall present to the city clerk a certificate as to his competency issued by the state or the board of examiners of plumbers of the City of Jacksonville, or an existing certificate previously issued by the city. (b) It shall be unlawful for any person, not a certified plumber in accordance with the provisions of this section, to do any plumbing construction or to make any repairs, alterations, additions or changes to an existing system, within the city. (Code 1970, § 17-4) Sec. 6-58. Permits—Determination of ownership of secondhand fixtures prior to issuance. Before the issuance of any plumbing permit, the plumbing inspector shall ascertain whether new or secondhand fixtures are to be used in the work. Whenever secondhand fixtures are proposed, the plumbing inspector shall require of the applicant satisfactory evidence in writing of the ownership of such fixtures and keep a record of the same. Supp. No. 26 417 § 6-59 ATLANTIC BEACH CODE Sec. 6-59. Same—Fees. A fee of seven dollars ($7.00) per fixture, including washing machines, water heaters and dishwashers, shall be paid to the city when a plumbing permit is issued. The minimum charge for any permit shall be thirty-five dollars ($35.00) in addition to the rate per fixture. The charge for reinspection shall be thirty-five dollars ($35.00) per inspection. (Code 1970, § 17-12; Ord. No. 36-82-1, § 1, 7-26-82; Ord. No. 25-02-33, § 2, 9-23-02) Sec. 6-60. Same—To whom issued. Plumbing permits shall be issued to master plumbers. A homeowner who lives on the premises may take a homeowners test through an accepted [testing] agency. Upon passing the homeowners test, a permit will be issued to the homeowner for premises occupied by the homeowner. Accepted testing agencies are the City of Atlantic Beach, the City ofJacksonville Building and Zoning Department, the City of Jacksonville Beach Building and Zoning Department, and the Standard Building Code Congress International. (c) The use of standard flush toilets may be allowed when, in the opinion of the building official, the configuration of the building drainage system requires a greater quantity of water to adequately flush the system. Supp. No. 26 418 BUILDINGS AND BUILDING REGULATIONS § 6-77 (d) Any person desiring to install any device or appliance as set out shall be required to submit to the building official a manufacturer's data sheet defining the water use character- istics of the plumbing devices or appliances prior to final inspection. (e) If a particular fixture listed above is not available from at least two (2) suppliers, the building official may accept a signed, notarized certification of nonavailability from the plumbing contractor and allow a standard plumbing fixture to be used. There is hereby adopted by the city for the purpose of establishing rules and regulations for mechanical construction, maintenance, and repair, including permits and penalties that certain code known as the Standard Mechanical Code, 1997 edition, published by the Southern Building Code Congress International, Inc., including changes and amendments, for the purpose of establishing a comprehensive performance code for the minimum design and Installation requirements for heating, ventilating and air conditioning systems in all build- ings. Terms and conditions set forth within the booklet are hereby adopted and incorporated as fully as if set out at length in this article and the provisions contained therein shall control within the limits of the city. Every building, place of residence or place of business in the city which fronts on any public street shall have a number according to the system set forth in this article. (Code 1970, § 6-12) Sec. 6-107. Attachment of numbers to buildings. The number assigned to any building shall be permanently attached in a suitable manner, as determined by the building official, and shall be attached to the outside of the building in a conspicuous place easily discernible from the street upon which the building faces. (Code 1970, § 6-13) Sec. 6-108. Duties of building official. It shall be the duty of the building official to assign each building a number, to attach or to have attached the assigned number or numbers, and to do all things necessary and practical to carry into effect the intent and provisions of this article. (Code 1970, § 6-14) Sec. 6-109. Street numbering districts designated. The city is hereby divided into street numbering districts as follows: (1) First district. All that part of the city lying east and south and including both sides of the following streets: Sherry Drive between Atlantic Boulevard and Twelfth Street; Twelfth Street between Sherry Drive and East Coast Drive; East Coast Drive between Twelfth Street and Sixteenth Street. (2) Second district. All that part of the city lying in the subdivision known as Saltair, except Sherry Drive (in the first district) and The Plaza (in the third district). (3) Third district. All that part of the city not within the first and second districts. (Code 1970, § 6-15) Sec. 6-110. System of numbering. The building official shall assign street numbers within the street numbering districts as follows: (1) In the first district according to the system of numbering as follows: a. On streets running from south to north and more northerly than easterly or westerly, only odd numbers (not evenly divided by 2) shall be assigned to buildings on the easterly side and only even numbers (evenly divided by 2) shall be assigned to buildings on the westerly side. IN GENERAL Sec. 17-1. Intent. The city commission recognizes that there are various persons and entities that have an interest in communicating with the public through the use of signs that serve to identify businesses and services, residences and neighborhoods, and also to provide for expression of opinions. The commission is also responsible for furthering the city's obligation to its residents and visitors to maintain a safe and aesthetically pleasing environment where signs do not create excessive visual clutter and distraction or hazards for pedestrians and vehicles; where signs do not adversely impact the predominantly residential character of the city and where signs do not conflict with the natural and scenic qualities of the city. It is the intent of the commission that the regulations contained in this chapter shall provide uniform sign criteria, which regulate the size, height, number and placement of signs in a manner that is compatible to the residential scale and character of the city, and which shall place the fewest possible restrictions on personal liberties, property rights, free commerce, and the free exercise of Constitutional rights, while achieving the city's goal of creating a safe, healthy, attractive and *Editor's note -Section 1 of Ord. For purposes of this chapter, the following terms shall have the meanings as set forth within this section. Where appropriate, definitions contained within other chapters of this Code, including chapter 6, building and building regulations, and chapter 24, zoning, subdivision and land development regulations, shall also apply to this chapter. Advertising message: The letters and graphics on a sign intended to directly or indirectly promote the sale of a product, service, commodity, entertainment or real or personal property. This definition shall also be deemed to include political copy intended to directly or indirectly promote a candidate or issue. "Advertising message" shall not include signs or portions of signs that are defined as a public sign. Animated sign: Any sign or part of a sign, including the advertising message, which changes physical position by any means of movement. Automatic changeable message device: Any sign, which through a mechanical, electrical, solar, or other power source is capable of delivering messages, which rotate or appear to rotate, change or move at any time and in any way, including tri -vision or any multi -prism sign faces. Awning sign: (See also Marquee sign.) A sign painted onto or adhered to a marquee or awning type structure constructed of an open frame covered by fabric, vinyl, plastic, metal, or similar material. Awning sign shall include canopy sign. Banner sign: A temporary sign made of lightweight fabric or similar material intended to promote special seasonal, civic or community events. Bracket sign: Any single or double-faced sign mounted on brackets, poles or beams projecting at angles from the front or side of any building and supported solely by such brackets, poles or beams. Building sign: Any sign that provides the name or address of a building, as opposed to the name of the occupants or services located within that building. Canopy sign: See Awning sign. Development parcel: For the purposes of this chapter, a development parcel shall be a parcel of land, a lot or a combination of lots upon which uses regulated by these sign provisions are located. This definition may include a single use or business, or a collection of uses or businesses developed in a unified manner. Directional sign: Any sign that solely serves to designate the location of, or provides direction to, any place or area. Signs, which contain logos, or graphics commonly associated with a service or business shall be included in the signs allowed for that site or business. Supp. No. 26 996 SIGNS AND ADVERTISING STRUCTURES § 17-2 Double-faced sign: A sign with two (2) sides that are usually but not necessarily parallel. Exempt signs: Signs as set forth within section 17-26 of this chapter, which are exempt from certain requirements of this chapter. Fascia sign: Any sign attached to or installed against a wall of a building. "Fascia sign" includes wall signs, and cabinet and panel type signs, and signs located on the fascia of a roof, or affixed to a roof plane, provided such sign does not extend above the height of the roof. Flag: A piece of cloth or similar material having a distinctive size, color, and design used as a symbol, standard, signal and other similar items of recognition and may include insignias of governmental, religious, charitable, fraternal or other organizations. Any flag and pole or attachment that frequently holds a flag shall be deemed a permanent flag. This definition of flag shall not include the flag of the United States of America. Flashing sign: Any sign which uses an external or internal intermittent light source, which results in changing light intensity (including on -off -on), brightness or color, or which is constructed and operated so as to create an appearance of illusion of motion or creates movement by any means. Freestanding sign: Any sign, which is incorporated into or supported by structures or supports in or upon the ground, independent of support from any building. Freestanding sign includes pole sign, pylon sign, ground sign or monument sign. Ground sign: See Freestanding sign. Height of sign: The vertical distance measured from the lowest grade adjacent to the sign extending to the topmost portion of the sign structure, including any frame, embellishment or other type of upward extension from the sign. Marquee sign: Any sign adhered or attached to a permanent roof -like structure, including awnings and canopies projecting beyond a building wall at an entrance to a building or extending along and projecting beyond the building wall and generally designed and constructed to provide protection against the weather. Marquee signs shall include all signs placed upon any type of marquee, canopy, awning, or similar structure. Monument sign: A type of freestanding sign placed upon the ground independent of support from the face of a building that generally has greater width than height and typically constructed of a solid material such as wood, masonry or high-density urethane. Non -conforming sign: Any sign, which was lawfully erected with properly issued sign permits, but which does not comply with the land use, setback, height, size, spacing, and lighting or other provisions of these regulations or other laws, as may be amended. Obscene sign: Any sign containing statements, words, pictures or symbols of an obscene nature. The word obscene shall be as defined in F.S. 847.001, as may be amended from time to time. Supp. No. 26 997 § 17-2 ATLANTIC BEACH CODE Pennants: Any small, single flag -like piece of cloth, plastic or paper attached to any staff, cord, building, or other structure at only one (1) or two (2) edges, the remaining hanging loosely; lacking the insignia of a flag. Personal expression sign: Any sign containing a message of non-commercial opinion or endorsement and not containing a commercial advertising message. Pole sign: See Freestanding sign. Political campaign sign: Any temporary sign, as may be authorized under this chapter, erected or displayed for the purpose of advertising a qualified candidate on any primary, general, or special election ballot within the City of Atlantic Beach. Portable sign: A sign that may be mobile and has no permanent attachment to a building or to the ground by means of a footing, including signs with wheels designed to be pulled or towed on a trailer or similar towing device. Projecting sign: See Bracket sign. Public sign: Any sign placed and maintained by the City of Atlantic Beach, Duval County, the State of Florida, the United States Government, a public utility, school district, or other duly authorized public agency. Public signs may be placed in locations as determined necessary and appropriate by the public agency and shall include public information signs, public identification signs, public directional signs, banner signs, and street name signs installed by a public agency, traffic control signs, warning signs and similar signs. Pylon sign: See Freestanding sign. Roof sign: Any sign attached to a building or the roof structure of a building by any means, which extends above the height of the roof or roof plane. Sign: Any identification, description, illustration, or device illuminated or non -illuminated, which is visible from any outdoor place, open to the public and which directs attention to a product, service, place, activity, person, institution, or business thereof, including any permanently installed or situated merchandise; or any emblem, painting, banner, pennant, placard, designed to advertise, identify, or convey information, with the exception of customary window displays, official public notices and court markers required by federal, state or local regulations; also excepting, newspapers, leaflets and books intended for individual distribu- tion to members of the public, attire that is being worn, badges, and similar personal gear. "Sign" shall also include all outdoor advertising displays as described within Section 3108.1.1, Florida Building Code, and all signs shall conform to the requirements of Section 3108 of the Florida Building Code. Sign display area: The sign display area shall be defined as the area enclosed within any geometric figure, which would enclose all parts of the advertising message of the sign. The structural supports for a sign, whether they are columns, pylons, or a building or part thereof, shall not be included in the sign display area. Supp. No. 26 J98 SIGNS AND ADVERTISING STRUCTURES § 17-26 Sign face area: The part of the sign, including all frame, trim and background, which contains the sign display area, advertising message or informative contents. Sign permit: A development permit authorizing erection, placement or installation of a sign as permitted by this chapter in accordance with the requirements of Section 3108 of the Florida Building Code and article V of this chapter. Sign structure: Any structure that supports, has supported, or is capable of supporting a sign, including decorative covers and embellishments. Snipe sign: Any sign of any material, including paper, plastic, cardboard, wood or metal when tacked, nailed or attached in any way to trees, poles, stakes, fences, the ground, or other objects where such sign may or may not be applicable to the present use of the property upon which such sign is located. Vehicle sign: Any sign placed within, upon or affixed to a motorized vehicle, other than a registered logo, trademark or service mark that is attached to a motorized vehicle. Vehicle signs shall not include political campaign signs, personal expression signs, bumper stickers, decorative decals and the like, provided these are otherwise in compliance with the provisions of this chapter. Wall sign: See Fascia sign. Width of sign: The horizontal distance measured from one (1) edge of the sign structure extending to the opposite edge of the sign structure, including any frame, embellishment or other type of extension from the sign. Window sign: Any sign placed inside a window of a building, facing the outside and which is intended to be seen from the exterior. Window signs shall be included in the signs allowed for that site, activity or business. (Ord. No. 60-02-12, § 2, 9-9-02) Secs. 17-3-17-25. Reserved. ARTICLE II. SIGNS PERMITTED Sec. 17-26. Exempt signs. (a) Within all non-residential zoning districts, the following signs shall be considered as permitted signs and shall be exempt from the requirement to obtain a sign permit as set forth within article V of this chapter: (1) Decals, limited to those as required by law, which are affixed to or painted upon store windows, store equipment, fuel pumps or other types of vending equipment used for dispensing retail products. Supp. No. 26 999 § 17-26 ATLANTIC BEACH CODE (2) Lettering only, for the purpose of providing ownership, licensing and emergency contact information, when placed upon doors and windows of lawfully licensed businesses, with letters not exceeding three (3) inches in height and limited to a maximum area of two (2) square feet. (3) Signs within a building that are not visible from the exterior of the building. This shall not include window signs affixed to the interior of windows, which are visible from the exterior. (4) Building signs, historical markers, memorial signs, tablets or plaques, or the name of a building and the date of erection, when the same are cut into any masonry surface or when constructed of bronze or other similar noncombustible material. (5) Professional nameplates for physicians, surgeons, dentists, musicians, lawyers, archi- tects, teachers and other like professional persons placed on the premises occupied by the person(s), not exceeding one (1) square foot in sign face area, provided such professional has a valid occupational license as may be required for the particular profession to operate on those premises. (6) Signs denoting only the name and profession of an occupant of a building, placed flat against the exterior surface of the building and not exceeding three (3) square feet in sign face area, provided such occupant has a valid occupational license as may be required to operate on those premises. (7) Signs depicting only time and temperature. (b) Within all zoning districts, the following signs shall be considered as permitted signs and shall be exempt from the requirement to obtain a sign permit as set forth within article V of this chapter: (1) Not more than one (1) real estate sign advertising the sale, rental or lease of only the premises on which the sign is located. Such signs shall not exceed six (6) square feet in area, and five (5) feet in height. Signs advertising the sale, rental or lease of property exceeding this size and height shall not be considered as exempt signs and shall be subject to the provisions of section 17-29(d). (2) Signs noting the architect, engineer or contractor for a development project when placed upon work under construction, provided the sign shall be removed within fifteen (15) days of completion of construction. Such signs shall not exceed six (6) square feet in size or eight (8) feet in height. (3) Signs as required by law to display building permits or other similar required public notices. (4) Public signs, banner signs, traffic signs, street name signs, legal notices, danger signs and temporary emergency, informational or non -advertising signs, when erected by city, county, state or federal authorities. Supp. No. 26 1000 SIGNS AND ADVERTISING STRUCTURES § 17-26 (5) No trespassing and private property signs not exceeding two (2) square feet in area. Such signs shall not be displayed from or attached to trees, utility poles or any type of utility structure or equipment, including lift stations, fire hydrants and the like. (6) Vacancy or no vacancy signs not exceeding two (2) square feet in area. (7) Temporary political campaign signs announcing the candidacy of a qualified candidate for public office not exceeding four (4) square feet in area may be placed wholly within the boundaries of any property, at the discretion or consent of the legal owner andlor occupant of the property, provided such signs conform with all traffic, electrical, maintenance, fire and safety regulations of the city. The placing of political campaign signs on city property, other public property or on public rights-of-way shall be prohibited. Political campaign signs displayed within motor vehicles conducting routine business activities on city or other public property shall not be prohibited, provided that no such vehicle shall be parked on city property, other public property or on public rights-of-way for the sole purpose of displaying political campaign signs. Illegally placed political campaign signs shall be removed by the code enforcement officer without notice to the candidate or abutting property owner or occupant. Political campaign signs shall not be placed on property prior to qualification of the candidate to run for office, and all such signs shall be removed within seventy-two (72) hours after the last election. If such signs are not removed within this period of time, the city may remove such signs and may charge the candidate the actual cost for such removal. Collected funds shall be deposited into the city general revenue. Failure to remove signs is a violation of this Code and is enforceable pursuant to F.S. Chapter 162, Code Enforcement. (8) Personal expression signs limited to one (1) per lot or parcel, or in the case of multi -family uses, one (1) per dwelling unit, expressing personal views or opinions not exceeding four (4) square feet in area, providing such signs are otherwise in compliance with applicable local, state and federal laws. (9) Religious symbols. (10) Garage sale signs or open house signs within residential zoning districts, not exceeding four (4) square feet in size, limited to two (2) per site and located only at the location of such event. Such signs may be displayed one (1) day before the garage sale or open house and shall be removed immediately after conclusion of the event. No garage sale sign or open house sign may be erected upon any public right-of-way. (11) Signs placed within interior courtyards, the inside fence line of recreational fields and on golf courses, provided such signs are visible only to those persons visiting such place and are otherwise in compliance with this chapter. (12) Address and street number signs not exceeding two (2) square feet. (13) Holiday and seasonal decorations shall not be construed as signs, providing that these contain no commercial advertising message. (Ord. No. 60-02-12, § 2, 9-9-02) Supp. No. 26 1001 § 17-27 ATLANTIC BEACH CODE Sec. 17-27. General provisions applying to all permitted signs. All signs shall be subject to the following general provisions. (1) No sign shall be installed, erected or placed prior to issuance of a sign permit as required by article V of this chapter, except for exempt signs as set forth in section 17-26. (2) All signs shall be engineered and constructed as required by these regulations and the Florida Building Code. Signs shall be professionally designed, lettered and con- structed. (3) No sign shall create a traffic or fire hazard, or be dangerous to the general welfare or interfere with the free use of public streets or sidewalks. (4) No sign shall be attached to or placed against a building in any manner which impedes or blocks ingress or egress through any door or window of any building, nor shall any sign obstruct or be attached to a fire escape. (5) No sign shall be erected at the intersection of any street in such a manner so as to obstruct free and clear vision, or at any location where, by reason of position, shape or color, it may interfere with, obstruct the view of, or be confused with any authorized traffic sign, signal or device, or which makes use of any word or words commonly used on traffic -control signs or signals. (6) Where the rear of any sign structure is visible from any street or from any adjoining residential zoning district, all exposed structural and electrical components of any such sign shall be concealed in a manner as approved by the city manager. (7) Fascia or wall signs, shall be mounted directly upon the surface of the building, and shall not be mounted upon exposed raceways, or other type of protrusions from the surfacc f the building. (Ord. No. 60-02-12, § 2, 9-9-02) Sec. 17-28. Signs permitted within residential zoning districts. (a) Except for exempt signs as provided for in section 17-26, signs within residential zoning districts, shall be limited to those as set forth below. (1) For single-family and two-family residential subdivisions and developments contain- ing ten (10) or more residential lots, where individual lots are accessed from a common internal roadway, one (1) sign identifying the name of the subdivision shall be allowed at each entrance from a collector or arterial street, not to exceed two (2) signs. a. Size permitted: Thirty-two (32) square feet of sign face area. b. Maximum height of sign: Eight (8) feet. c. Type allowed: Freestanding ground or monument style. Where more than one (1) sign is allowed, each such sign erected shall be constructed and designed in the same manner. Supp. No. 26 1002 SIGNS AND ADVERTISING STRUCTURES § 17-29 d. Illumination: These signs shall be externally illuminated with ground mounted lighting only. Any lighting shall project from the ground onto the sign only, and shall not be directed towards any street or residential lot. (2) For multi -family residential uses, one (1) sign identifying the name of the multi -family development shall be allowed at each entrance not to exceed two (2) signs. Internal directional signs and signs identifying buildings shall also be allowed limited to three (3) feet in height and eight (8) square feet in sign face area. a. Size permitted: Sixty (60) square feet of sign face area. b. Maximum height of sign: Eight (8) feet. c. Type allowed: Freestanding ground or monument style. Where more than one (1) sign is allowed, each such sign erected shall be constructed and designed in the same manner. d. Illumination: These signs shall be externally illuminated with ground mounted lighting only. Any lighting shall project from the ground onto the sign only, and shall not be directed towards any street, vehicular drive or residential unit. (b) Signs, as set forth with above paragraph (a), that are located within public or dedicated rights-of-way shall be approved by the city commission. Such signs may be approved at the time of final plat approval as set forth by section 24-202 of this Code, or alternatively, such signs may be approved upon specific application to the commission. Approval of the city commission shall be required prior to the issuance of a sign permit. Such signs shall complement and conform to the "WELCOME TO ATLANTIC BEACH" signs in features including lettering, color, composition, structural materials, finished surface, and shall be constructed of wood or similar material giving the finished appearance of carved or sand- blasted wood, as described within section 17-32. (Ord. No. 60-02-12, § 2, 9-9-02) Sec. 17-29. Signs permitted within commercial and industrial zoning districts. (a) Subject to the provisions as set forth within this section, the following signs shall be permitted within commercial professional office (CPO), commercial limited (CL), commercial general (CG), central business district (CDB), and industrial, light and warehousing (ILW) zoning districts. Except as specifically exempted in section 17-26, and further subject to issuance of a sign permit, no other sign or advertising device shall be displayed or erected within the City of Atlantic Beach. (1) Fascia signs for buildings with a single business or occupant. a. Size permitted: One (1) square foot of sign face area for each linear foot of the building width that faces the front of the lot, as defined section 24-17 of this Code, provided that no single fascia sign on any one (1) side of a building shall exceed sixty (60) square feet of sign face area. (For example, if the width of the building facing the front of the lot is fifty (50) feet wide, the maximum total sign face area for all fascia signs is fifty (50) square feet.) Supp. No. 26 1003 § 17-29 ATLANTIC BEACH CODE b. Number of fascia signs permitted: Not more than three (3) fascia signs shall be allowed on any one (1) side of a building. Where fascia signs are placed upon more than one (1) side of the building, the combined sign face area, shall not exceed the amount permitted by subparagraph (1)a. above. (2) Fascia signs for buildings with multiple businesses or occupants. a. Size permitted: One (1) square foot of sign face area for each linear foot of the unit(s) occupied by one (1) business or occupant, provided that no such fascia sign shall exceed forty-eight (48) square feet of sign face area for any one (1) business. (For example, if the width of a unit or several units occupied by one (1) business is twenty-four (24) feet, then one (1) sign, a maximum of twenty-four (24) square feet of sign face area, is permitted.) b. Required spacing between signs on buildings with multiple occupants. Fascia signs for different occupants shall be separated by a minimum distance or thirty-six (36) inches. (3) In lieu of the above-described fascia signs, a business or authorized use may install a single bracket sign or a single marquee sign in accordance with the following provisions. a. Size permitted: The maximum size of a bracket sign or a marquee sign shall be determined in the same manner as a fascia sign, provided that no such sign shall have more than sixty (60) square feet of projected sign face area. b. There shall be not more than twelve (12) inches of clear space adjacent to the building wall, and such signs shall not extend or project from the face of the building more than ten (10) feet. c. No portion of such sign shall extend above the height of the roof. d No portion of such sign shall be closer than eight (8) feet to any sidewalk or pedestrian walkway, and no closer than five (5) feet from any street side property line. All such signs shall be securely anchored to a wall and shall in no manner be connected to or suspended from the roof of any building. (4) Freestanding signs. In addition to the above signs, freestanding signs may be erected as set forth below: a. Size permitted. Freestanding signs, including pole, pylon and monument and ground type signs shall be limited to one (1) square foot of sign face area for each linear foot of frontage of the development parcel on which the sign(s) are placed, provided no such sign shall exceed eighty (80) square feet of sign face area. b. Permitted height of freestanding signs. For the following zoning districts the maximum height of freestanding signs shall be: i. Commercial professional office (CPO): Eight (8) feet. ii. Commercial limited (CL): Eight (8) feet. iii. Central business district (CDB): Eight (8) feet. Supp. No. 26 1004 SIGNS AND ADVERTISING STRUCTURES § 17-29 iv. Commercial general (CG): Eight (8) feet. v. Industrial, light and warehousing (ILW): Eight (8) feet. c. Permitted width of freestanding signs. The maximum width of freestanding signs in any zoning districts shall be ten (10) feet. d. Number of freestanding signs permitted: i. On a development parcel with frontage upon a single street, one (1) freestanding sign shall be permitted. ii. On a development parcel that has frontage upon more than one (1) street, one (1) freestanding sign shall be permitted on each street side of the development parcel, provided that such secondary freestanding signs shall be limited to fifty (50) percent of the maximum size and height as allowed by paragraphs a. and b. above. e. Required distance from property lines: No portion of any freestanding sign shall be located closer to the property line than five (5) feet. Freestanding signs shall not be located so as to interfere with clear vehicular or pedestrian sight distance. Signs determined by the director of public works to interfere with safe sight distance for pedestrians or vehicles shall be immediately removed. (b) Requirement for a unified sign plan. After the initial effective date of these regulations, all new non-residential development, which shall contain space or units for more than one (1) business or occupant, shall provide a unified sign plan with the application building permits. All subsequent applications for sign permits shall comply with the approved unified sign plan. The unified sign plan shall comply with the provisions of this chapter and shall also demonstrate a consistent theme and design with respect to each of the following: (1) Manner and type of construction, including materials to be used, installation method and mounting details; (2) Means of illumination, if any, and hours of illumination. (3) Size, color, lettering and graphic style. (c) Pre -development signs. Signs for the purposes of announcing a coming development project may be placed within commercial and industrial zoning districts subject to the following provisions. (1) Issuance of a sign permit shall be required, and no such sign shall remain on any development parcel for a period of time exceeding one (1) year from the issuance date of the sign permit. (2) Complete and proper applications for building permits for the related development project must be submitted within sixty (60) days of the placement of any such sign, or the sign shall be removed. In the case that the sign is not removed, the sign shall be considered an abandoned sign, subject to the provisions of section 17-33(c). Supp. No. 26 1005 § 17-29 ATLANTIC BEACH CODE (3) Such sign shall be removed within thirty (30) days of the issuance of any certificate of occupancy, or at any time when construction ceases for a period of time longer than thirty (30) consecutive days. In the case that the sign is not removed within these periods of time, the sign shall be considered an abandoned sign, subject to the provisions of section 17-33(c). (4) Only one (1) such sign shall be placed upon the development parcel and shall not exceed the height or size as permitted by preceding paragraph (a). (d) Within non-residential zoning districts, one (1) sign per lot or development parcel advertising the sale or lease or the property limited to eight (8) feet in height and a maximum of twenty-four (24) square feet of sign face area. A sign permit shall be required for such signs, and these signs shall be removed within ten (10) days of sale or lease of the property. (e) Requirement to display street number. All business and activities regulated by the requirements of section 17-29 shall display the street number in a manner that is prominent and clearly readable to vehicular and pedestrian traffic, as appropriate. Street numbers shall be displayed on all freestanding signs and over front doors or primary entryways. (Ord. No. 60-02-12, § 2, 9-9-02) Sec. 17-30. Signs within special purpose (SP) and planned unit development (PUD) zoning districts. The size, height, width and number of signs permitted within special purpose districts and planned unit development districts shall be established within the ordinance creating such district as determined by the city commission to be appropriate for the nature and character of the use within these districts. (Ord. No. 60-02-12, § 2, 9-9-02) Sec. 14-31. Signs within conservation (UON) zoning districts. As set forth by section 24-103(b) of this Code, all uses in the conservation districts shall require approval as a use -by -exception. The size, height, width and number of signs permitted within conservation districts shall be established during the use -by -exception process in accordance with the provisions of section 24-63. Signs within conservation districts shall not adversely impact the environmentally sensitive qualities of these areas, shall be non - illuminated, shall contain no electrical components and shall be constructed of wood, brick, masonry, high-density urethane or similar material, which is consistent with the natural surroundings of these districts. (Ord. No. 60-02-12, § 2, 9-9-02) Sec. 17-32. Signs placed on public buildings and structures and within public parks. All signs displayed within City of Atlantic Beach parks and upon the exterior of any public building or structure shall conform with design of the "WELCOME TO ATLANTIC BEACH" signs displayed on such properties as of the effective date of this chapter, or as such design may be later modified by city commission. Such signs shall display the City of Atlantic Beach logo, Supp. No. 26 1006 SIGNS AND ADVERTISING STRUCTURES § 17-33 as depicted in Figure 1, and shall be similar in appearance with respect to color, lettering, composition, and materials used for construction. Materials used shall be wood, high-density urethane, or similar material, which may be given a sandblasted -type finished surface. Public notice, parking and traffic signs shall be exempt from this provision. Figure 1—City of Atlantic Beach Logo (Ord. No. 60-02-12, § 2, 9-9-02) Sec. 17-33. Banner signs. (a) The purpose of banner signs shall be to promote special seasonal, civic or community events that occur on a temporary basis. A sign permit shall not be required for banner signs; however, all banner signs shall be registered with City of Atlantic Beach. No banner sign shall be hung, placed or erected prior to registration on a form as provided by the planning and zoning department, and payment of fees as may be established by the city commission. (b) Banner signs may be displayed subject to registration verifying compliance with the following provisions: (1) Display of banner signs for any event shall be limited to thirty (30) consecutive or cumulative days within one (1) calendar year. (2) Banner signs shall be limited in size to a maximum of sixty (60) square feet in size. (3) Banner signs shall not contain an advertising message. (4) Banner signs shall not hang over or extend into rights-of-way. (5) Banner signs shall be securely anchored to buildings, poles or suitable structural supports and shall not be attached to trees, public buildings or structures, utility poles or any type of utility structure or equipment, including lift stations, fire hydrants and the like. (6) Property owner's authorization to install and display such banner sign. (Ord. No. 60-02-12, § 2, 9-9-02) Supp. No. 26 1007 § 17-34 ATLANTIC BEACH CODE Secs. 17-34-17-40. Reserved. ARTICLE III. CAUSE FOR REMOVAL OF SIGNS, ABANDONED SIGNS AND PROHIBITED SIGNS Sec. 17-41. Removal of unsafe, damaged or poorly maintained, and abandoned signs. (a) Unsafe signs. In the event that any sign, including an exempt sign, is determined by the building official to be unsafe, such sign shall be immediately removed upon written notice from the building official ordering removal. Such notice shall be sent by certified mail to the property owner of record. If not removed within ten (10) days, the sign shall be considered a hazard to public safety and shall be removed at the property owner's expense. (b) Damaged signs and poorly maintained signs. All signs, including exempt signs, shall be kept in a structurally sound condition, with a neat appearance and in a generally good state of repair. Further, signs shall be maintained in accordance with Section 3108.1.7, Florida Building Code, which requires that all signs for which a permit is required, together with supports, braces, guys, and anchors shall be kept in repair and, unless of galvanized or non -corroding metal, shall be painted at least once every two (2) years. Any sign destroyed or damaged beyond reasonable repair in the determination of the building official, shall be immediately repaired or removed at the property owner or occupant's expense. A new sign permit shall be required for any replacement sign. If not repaired or replaced within thirty (30) days after written notice from the building official, the sign shall constitute a public nuisance and shall be removed at the property owner's expense. (c) Abandoned signs. Signs shall be removed by the owner or occupant within (30) thirty days of cessation of the business or activity conducted on the property where the sign is located. A business or activity shall be considered to have ceased when the premises are vacated, or in the absence of a valid occupational license or active utility service account. Signs not removed in accordance with these provisions shall be considered as abandoned and shall be removed at the property owner's expense. (Ord. No. 60-02-12, § 2, 9-9-02) Sec. 17-42. Prohibited signs and devices. The following signs and devices shall be prohibited within the City of Atlantic Beach. In the case of any conflict with other provisions of this Code, the prohibitions set forth below shall supersede such other conflicting provisions. (1) Animated signs. (2) Automatic changeable message device signs, except for signs depicting time and temperature. (3) Flashing signs. (4) Signs containing beacon or tracker lights or similar lighting components. Supp. No. 26 1008 SIGNS AND ADVERTISING STRUCTURES § 17-51 (5) Signs containing fluorescent colors or materials designed to be mirror-like or reflective. (6) Obscene signs. (7) Roof signs. (8) Snipe signs. (9) Portable and mobile signs. (10) Temporary signs, except as otherwise authorized herein. (11) Pennants, ribbons, balloons, streamers, wind -operated devices and similar elements that are intended to draw attention to a business or activity, either when used alone or incorporated into a sign. (12) Vehicle signs. (Bumper stickers, decorative decals and the like, customary and registered logos, trademarks or service marks that are attached to a motorized vehicle shall not be considered as vehicle signs; however, such vehicles shall not be parked off of the property from where a business is located or in the required front yard of any property for the sole purpose of advertising.) (13) Private signs on any public property, other than as specifically approved by the city commission. (14) All signs prohibited by Chapter 479.11, Florida Statutes. (15) Signs not in compliance with all applicable provisions of this chapter and this Code. (Ord. No. 60-02-12, § 2, 9-9-02) Secs. 17-43-17-50. Reserved. ARTICLE IV. NONCONFORMING SIGNS AND WAIVER TO CERTAIN PROVISIONS Sec. 17-51. Nonconforming signs. All signs, which were lawfully in existence and constructed or installed with properly issued sign permits as of the effective date of these amended regulations, and which are made nonconforming by the provisions herein shall be allowed to remain in accordance with the following conditions: (1) Freestanding signs, permitted pursuant to section 17-29, made nonconforming upon the initial effective date of these amended regulations, which are not in compliance only with respect to the minimum required distance of five (5) feet from any property lines shall be allowed to remain in the existing location provided that no portion of the sign is located within any publicly owned right-of-way or utility easement and that no interference with clear sight distance exists, and further provided that such signs are otherwise in compliance with the terms of this chapter. Supp. No. 26 1009 § 17-51 ATLANTIC BEACH CODE (2) Freestanding signs, permitted pursuant to section 17-29, made nonconforming upon the initial effective date of these amended regulations, which are not in compliance with respect only to maximum width, height or size shall be allowed to remain, provided that such signs are otherwise in compliance with the terms of this chapter. (3) Nonconforming signs, including those as described in preceding paragraphs (1) and (2) shall be made conforming with all provisions of this chapter when any of the following changes are made: a. Any change to the structural supports or structural materials, including tempo- rary relocation associated with routine maintenance of a property. b. Any change which increases the illumination. c. Any change which increases the height of a sign. d. Any change, which alters the material used for the display area or face area by more than twenty-five (25) percent. e. Any replacement required as the result of an accidental act or a weather-related act. f. Any replacement of an abandoned sign. g. Any change necessary for compliance with Florida Building Code requirements. (4) The provisions of this section shall not be construed to apply to signs that are abandoned, deteriorated, dilapidated, or in a general state of disrepair, or which are determined to create a hazard to public safety. Such signs shall be subject to the provisions of section 17-33. (Ord. No. 60-02-12, § 2, 9-9-02) Sec. 17-52. Requests to waive certain terms of this chapter. Requests to waive terms of this chapter may be made upon specific application to the city commission, with proper public notice required, provided that no waiver shall be requested that would allow a prohibited sign, or any otherwise unlawful sign. The applicant requesting such waiver shall have the burden of demonstrating the need for the requested waiver, and that the waiver is not in conflict with the intent of this chapter. The terms of any waiver to the provisions of this chapter shall be established by order of the city commission. (Ord. No. 60-02-12, § 2, 9-9-02) Secs. 17-53-17-60. Reserved. ARTICLE V. SIGN PERNIITS Sec. 17-61. Permit required. It shall be unlawful for any person to install, erect, place, alter or relocate any sign without first obtaining a sign permit with payment of the required fee to the city. Sign permits shall be Supp. No. 26 1010 SIGNS AND ADVERTISING STRUCTURES § 17-63 required for any sign requiring a permit under the provisions of Section 3108.1.3, Florida Building Code. A sign permit shall not be issued prior to issuance of the appropriate occupational license as required for the activity on the property for which the sign permit is sought, except as set forth in section 17-29(c) of this chapter. (Ord. No. 60-02-12, § 2, 9-9-02) Sec. 17-62. Application. Before a sign permit shall be issued, a design and stress diagram containing necessary information to enable the building official to determine compliance with the provisions of Section 3108 of the Florida Building Code shall be submitted. Such information shall be included as part of the sign permit application and shall be submitted to the City of Atlantic Beach Building Department using a sign permit application as provided by the city. The application for sign permit shall contain or have attached thereto the following information: (1) The name, mailing address and telephone number of the applicant. (2) If applicable, a copy of a valid and current occupational license for the property where the sign shall be placed. (3) In the case that the applicant is not the property owner, an owner's authorization to apply for a sign permit. (4) A survey depicting the location of the requested sign(s) and the location of all structures and access points on the property. An elevation drawing, with dimensions, depicting the size, height, location and relation to other existing signs. Plans shall be drawn at a legible scale, depicting materials to be used, method of construction, attachment or installation as appropriate and type of illumination, if any. (5) The name and contractor information of the person erecting or installing the sign. (6) An electrical permit, if required. (7) Registered engineer's drawings as may be required by Section 3108, Florida Building Code. (8) Such additional information as may be required by the building official to determine compliance with this chapter, any other applicable laws and ordinances of the City of Atlantic Beach and the requirements of Section 3108, Florida Building Code. (Ord. No. 60-02-12, § 2, 9-9-02) Sec. 17-63. Calculation of permitted sign size. Sign face area, sign display area, width of sign and height of sign shall be calculated as defined within article I of this chapter. In the case of freestanding, fascia and projecting signs, the sign face area shall be used in calculating the permitted size of sign. In the case of marquee, canopy or awning signs, the sign display area shall be used in calculating the permitted size of the sign. Supp. No. 26 1011 § 17-63 ATLANTIC BEACH CODE When computing sign face area and sign display area, only one (1) side of a sign containing two (2) sides shall be included in the calculation of the permitted sign size. ADDITIONAL HOMESTEAD EXEMPTION Sec. 20-80. Exercise of municipal powers. This article represents an exercise of municipal powers by the city commission, pursuant to Section 9(12) of the Atlantic Beach Charter. This article shall apply throughout the City of Atlantic Beach, but only to taxes levied by Atlantic Beach. (Ord. No. 70-00-14, § 1, 6-26-00) Sec. 20-81. Definitions. As used in this article, the term: Household means a person or group of persons living together in a room or group of rooms as a housing unit, but the term does not include persons boarding in or renting a portion of the dwelling. Household income means the adjusted gross income, as defined in Section 62 of the United States Internal Revenue Code, of all members of a household. (Ord. No. 70-00-14, § 1, 6-26-00) Sec. 20-82. Additional homestead exemption authorized. Commencing January 1, 2001, and annually thereafter, pursuant to Article VII, Section 6(0, Florida Constitution, and Section 196.075, Florida Statutes, an additional homestead exemp- tion of twenty-five thousand dollars ($25,000.00) is hereby authorized for any person who has the legal or equitable title to real estate and maintains thereon the permanent residence of the owner, who has attained the age of sixty-five (65) and whose household income does not exceed twenty thousand dollars ($20,000.00), adjusted by the cost -of -living index for the year 2000. (Ord. No. 70-00-14, § 1, 6-26-00) Supp. No. 26 1178 TAXATION § 20-84 Sec. 20-83. Annual adjustment to household income. Commencing January 1, 2001, the household income limitation shall be adjusted annually, on January 1, by the percentage change in the average cost -of -living index in the period January 1 through December 31 of the immediate prior year compared with the same period for the year prior to that. The index is the average of the monthly consumer -price -index figures for the stated 12 -month period, relative to the United States as a whole, issued by the United States Department of Labor. (Ord. No. 70-00-14, § 1, 6-26-00) Sec. 20-84. Annual filing of household income statement. Any taxpayer claiming the additional homestead exemption must submit annually, not later than March 1 of each year, to the Duval County Property Appraiser, a sworn statement of household income on a form prescribed by the Florida Department of Revenue. Each residential unit of multifamily property shall be considered as 0.6 ERU for billing purposes. Monthly utility fees for each ERU shall be established in section 22-335 of this chapter. (c) Non-residential Property. The monthly utility fee for all non-residential properties shall be calculated in accordance with the following formula: Impervious Area (Sq. Ft.)/1,790 = Number of ERUs Monthly Fee = (Number of ERUs) x (Rate per ERU) A minimum value of one (1.0) ERU shall be assigns to each non-residential property. The impervious area of each non-residential property shall be determined by the city manager or designee. The value of one thousand seven hundred ninety (1,790) square feet of impervious area per ERU is a median value obtained from data for Atlantic Beach. Monthly utility fees for each ERU shall be established in section 22-335 of this chapter. (Ord. No. 80-90-44, §§ 2.1-2.3, 4-22-91) Sec. 22-335. Fees. (a) ERU rate. The fee per ERU billing unit shall be four dollars ($4.00) per month. (b) Capital improvement. At such time as a stormwater management master plan is completed and capital improvement projects are identified, project expenditures will be approved by the directors each budget year. (c) Undeveloped property. Initial SMU fees shall not be levied against undeveloped property that has not been altered from the natural state, as evidenced by a complete lack of impervious surface as defined in this division. Farmland, gardens, and landscaped areas also shall be exempt except for roads, parking, or structures associated therewith. Results of a stormwater management master plan for Atlantic Beach when completed, can be used to adjust the exemption for undeveloped property, when specific benefits to undeveloped property are possible to quantify. (d) Credit factors. Property owners who have provided stormwater management facilities in excess of the requirements of the Atlantic Beach land development code, and that are consistent with the stormwater management master plan, when completed, may request a reduction in the SMU fee. Determination of the credit to be allowed shall be made by the city manager or designee. The credit shall apply only to the portion of the fee above that required to cover common fixed costs of the SMU program. (Ord. No. 8-90-44, §§ 3.1-3.4, 4-22-91; Ord. No. 80-02-65, § 2, 9-23-02) Supp. No. 26 1307 § 22-336 ATLANTIC BEACH CODE Sec. 22-336. Enforcement and penalties. Pursuant to state law, the City of Atlantic Beach shall have a lien for delinquent or unpaid stormwater management service charges. Enforcement and foreclosure of said lien(s) shall be as provided by law. Interest on the unpaid balance shall be the highest rate as authorized by state law. (Ord. No. 80-90-44, § 4.0, 4-22-91) Sec. 22-337. Appeal process. Any customer or property owner who feels that the SMU fee for their property has been assigned or computed incorrectly may petition in writing to the city manager or designee for a review of said charges. If not satisfied with the determination of the city manager or designee, the petitioner may ask for a hearing before the city board of adjustment whose decision shall be final. (Ord. No. 80-90-44, § 5.0, 4-22-91) Supp. No. 26 1308 [The next page is 1351] ZONING, SUBDIVISION AND LAND DEVELOPMENT REGULATIONS § 24-66 (7) No nonconforming use of neighboring lands, structures or buildings in the same zoning district and no permitted use of lands, structures or buildings in other zoning districts shall be considered grounds for approval of a variance. (8) If an application for a variance is denied by the community development board, no further action on another application for substantially the same request on the same property shall be taken for three hundred sixty-five (365) days from the date of denial. (9) When a variance is approved by the community development board, the work to be performed pursuant to the variance shall commence within three hundred sixty-five (365) days from the date of approval unless otherwise authorized by the community development board, or the variance shall become null and void. (10) Avariance, which involves the development of land, shall be transferable and shall run with the title to the property unless otherwise stipulated by the community develop- ment board. (Ord. No. 90-01-172, § 2, 11-26-01) Sec. 24-65. Reserved. Sec. 24-66. Development, construction and storage within zoning districts. (a) Temporary construction trailers or structures. (1) Subject to the following provisions, any person may obtain a building permit for the construction and/or use of a temporary trailer or structure to be used as a construction shed and tool house for contractors and construction workers on the site. This temporary trailer or structure shall not be placed or erected on the property prior to the issuance of a building permit for the applicable construction, and shall be immediately removed upon completion of the construction project. (2) It shall be a violation of this section for any person to use the construction trailer or structure for sales purposes without first applying to and receiving written permission from the city commission. (3) Construction trailers and structures shall not be used for the purpose of living quarters, and the trailers or structures shall have upon the unit, or attached thereto, an identification sign designating the owner or company and the words "construction office" in full view. (b) Temporary storage structures and uses. (1) Within all residential zoning districts, enclosed portable structures and accommoda- tions intended only for the temporary storage of personal household belongings of occupants of the property may be placed on the property for a period not to exceed four (4) days or ninety-six (96) hours. In the event of damage to a residential dwelling by fire, storm, flood, or other such property loss, this period of time may be extended to ten (10) days upon request to and written approval of the city manager. Supp. No. 26 1435 § 24-66 ATLANTIC BEACH CODE (2) Within all non-residential zoning districts, enclosed portable structures and accom- modations may be used only for temporary storage of items related to the business located on the property, for a period not to exceed thirty (30) days. Such structures shall not be located within required front yards and shall not be used to store any chemical, hazardous, flammable or combustible materials. (c) All structures. All temporary and portable storage structures, construction trailers and the like, shall be constructed, altered, repaired, enlarged, placed, moved or demolished in accordance with applicable provisions of the Florida Building Code as well as all applicable federal, state and local regulations applying to the use and development of land. The issuance of building permits, where required, verifying such compliance shall be administered by the building official. (Ord. No. 90-01-172, § 2, 11-26-01; Ord. No. 90-02-176, § 1, 9-9-02) Sec. 24-67. Development review and issuance of development permits. (a) Purpose. The purpose of this section shall be to establish procedures for the submittal, review and approval of development plans, and the issuance of development permits. (b) Procedures. Development plans prepared according to the requirements set forth in this section shall be submitted to the community development director for distribution, review and comment from appropriate departments of the city. Plans may be denied if they do not meet the intent or the requirements of this section and this chapter. (c) Preliminary site plan required. A preliminary site plan, drawn at a clear and legible scale, shall be required for all development other than fences, and swimming pools and ornamental pools in accordance with the following provisions: (1) Single-family, two-family (duplex) or townhouse and structural alterations thereto. Each of the following items shall be addressed: a. All driveways and parking. b. All existing and proposed structures. c. Setbacks, any platted building restriction lines and height of buildings. d. Any jurisdictional wetlands or coastal construction control line, water bodies, any required buffers or significant environmental features. e. A pre -construction topographical survey, pursuant to below subsection (d), stormwater drainage requirements, unless waived in accordance with the provi- sions therein. (2) Multi -family, commercial and industrial uses and structural alterations thereto. A certified survey and composite site plan accompanied by the required application form and any review fee as established by the city commission shall be submitted the community development director. The site plan shall depict the entire tract proposed Supp. No. 26 1436 ZONING, SUBDIVISION AND LAND DEVELOPMENT REGULATIONS § 24-67 for development and shall be drawn at a scale sufficient to depict all required information in a clear and legible manner. Each of the following items shall be addressed: a. Project boundary with bearings and distances. b. Legal description, including property size. c. Location of all structures, temporary and permanent, including setbacks, build- ing height, number of stories and square footage. (Identify any existing struc- tures and uses.) d. Project layout, including roadways, any easements, parking areas, driveway connections, sidewalks, vehicular and pedestrian circulation. e. Existing driveways and roadways within three hundred (300) feet of project boundary. f. Existing and proposed right-of-way improvements. g. Conceptual stormwater management plan addressing drainage patterns, retention/ detention areas, provisions for utilities, including a pre -construction topograph- ical survey, pursuant to below paragraph (d), stormwater drainage requirements, unless waived in accordance with the provisions therein. h. Environmental features, including any jurisdictional wetlands, CCCL, natural water bodies, open space, buffers and vegetation preservation areas. i. General notes shall include: total project area; impervious surface area; building square footage separated by type of use(s) if applicable; parking calculations; project phasing; zoning district classification and any conditions or restrictions. Other information as may be appropriate for the purposes of preliminary review. J. (d) Stormwater drainage requirements. All lots and development sites shall be constructed and graded in such a manner so that the stormwater drains to the adjacent street, an existing natural element used to convey stormwater (See section 22-303, definitions: Stormwater management system), or a city drainage structure. The city shall be provided with a pre -construction topographical survey prior to the issuance of a development permit and a post -construction topographical survey prior to the issuance of a certificate of occupancy. The surveys shall be prepared by a licensed Florida surveyor, and the requirement for either or both surveys may be waived by the director of public works if they are determined to be unnecessary. (e) Approval of preliminary site plans. Upon approval of preliminary site plans, construc- tion plans may be submitted to the community development director for distribution and review by the appropriate city departments. Construction plans shall demonstrate compliance with all applicable federal, state and local land development regulations and permitting requirements. Upon approval of construction plans by reviewing departments and payment of required fees, development permits may be issued, and construction plans shall be released for construction. Supp. No. 26 1437 § 24-67 ATLANTIC BEACH CODE (f) Expiration of approved construction plans. Approved construction plans shall be claimed within ninety (90) days of notice of approval, or said plans shall be considered to have expired. Upon expiration, a new submittal and review with applicable fees shall be required. (g) Expiration of development permits. Development permits shall expire on the one-year anniversary of the date such permits were issued unless development has commenced and continued in good faith. (Ord. No lands shall be cleared or grubbed, and no vegetation on any development site disturbed, prior to issuance of all required approvals and development permits authorizing such clearing. (Ord. Pursuant to section 24-46(4), the city commission for the City of Atlantic Beach hereby establishes the following fees related to the administrative costs of carrying out the require- ments of this chapter. These fees shall be payable to the city at the time such application or request is filed. Applications for planning and zoning related requests shall not be considered as complete applications until such time as required fees have been paid in full. Where uncertainty exists with respect to the boundaries of any of the zoning districts, as shown on the official zoning map, the following rules shall apply: (1) Unless otherwise indicated, the zoning district boundaries are indicated as approxi- mately following lot lines; center lines of streets, highways or alleys; shorelines of streams, reservoirs or other bodies of water; or civil boundaries; and they shall be construed to follow such lines. (2) Where zoning district boundaries are approximately parallel to the center lines of streets, highways or railroads; streams, reservoirs or other bodies of water, or the lines extended, the zoning district boundaries shall be construed as being parallel thereto and at such distance there from as indicated on the zoning map. If no distance is given, the dimensions shall be determined by the scale shown on the zoning map. (3) Where a zoning district boundary line, as appearing on the zoning map, divides a lot which is in single ownership, the zoning district classification of the larger portion may be extended to the remainder of the property subject to consistency with the comprehensive plan. (4) Where a public road, street or alley is officially vacated or abandoned, the regulations applicable to the property to which it has reverted shall apply to the vacated or abandoned road, street or alley. (5) In the case where the exact location of a boundary cannot be determined by the foregoing methods, the community development board shall, upon request of the community development director, determine the location of the boundary. (Ord. No. 90-01-172, § 2, 11-26-01) Supp. No. 26 1438.1 § 24-82 ATLANTIC BEACH CODE Sec. 24-82. General restrictions upon land, buildings and structures. (a) Use. No building or structure shall be erected, and no existing building shall be moved, altered, added to or enlarged, nor shall any land, building, structure or premises be used, designed or intended to be used for any purpose or in any manner other than a use designated in this chapter, as allowed in the zoning district in which such land, building, structure or premises are located. Further, no land shall be used except in compliance with the compre- hensive plan. (b) Number of buildings allowed on a single-family or two-family (duplex) lot. The total number of buildings on any lot zoned only for single-family or two-family (duplex) use shall not exceed three (3) including the principal use structure, detached garages and any other detached building. Supp. No. 26 1438.2 ZONING, SUBDIVISION AND LAND DEVELOPMENT REGULATIONS § 24-163 (17) Schools and educational uses: a. Elementary and junior high schools: Two (2) spaces for each classroom, office and kitchen; b. Senior high schools: Six (6) spaces for each classroom plus one (1) space for each staff member. (18) Vocational, trade and business schools: One (1) space for each three hundred (300) square feet of gross floor area; (19) Day care centers: Two (2) spaces for each employee, plus a clearly designated drop off and pick up area; (20) Shopping centers: Four (4) spaces for each one thousand (1,000) square feet of gross • leasable area. (h) Off-street loading spaces: Off-street loading spaces shall be provided and maintained for hospital, institutions, single occupancy commercial or industrial building, or similar use requiring the receipt or distribution by vehicles of materials and merchandise as follows: One (1) space for the first ten thousand (10,000) square feet of gross floor area and one (1) additional space for each twenty thousand (20,000) square feet of gross floor area, or fraction thereof, over and above the first ten thousand (10,000) square feet. (i) Applications to vary from the requirements of this section shall follow the procedures set forth in section 24-63. (Ord. No. 90-01-172, § 2, 11-26-01) Sec. 24-162. Parking lots. Off-street parking lots may be a permissible use -by -exception in all nonresidential zoning districts where such lots are within four hundred (400) feet of the property requiring off-street parking and provided such parking lots shall also conform to the following: (1) A wall, fencing, shrubbery or as otherwise required by the community development board and the city commission shall be erected along edges of portions of such parking. (2) No source of illumination for the parking area shall be directly visible from any window in any residence in an adjoining residential zoning district. (3) There shall be no sales or service activity of any kind in any parking area unless a permit is applied for and granted by the community development board. (Ord. No. 90-01-172, § 2, 11-26-01) Sec. 24-163. Storage and parking of commercial vehicles and recreational vehicles and equipment in residential zoning districts. (a) The storage and parking of commercial vehicles greater than twelve thousand five hundred (12,500) pounds gross vehicle weight shall be prohibited in all residential zoning districts. Commercial vehicles of less than twelve thousand five hundred (12,500) pounds gross Supp. No. 26 1481 § 24463 ATLANTIC BEACH CODE vehicle weight, recreational vehicles, and trailers of all types, including travel, boat, camping and hauling, shall not be parked or stored on any lot occupied by a dwelling or on any lot in any residential zoning district, except in accordance with the following requirements: (1) No more than one (1) commercial vehicle of less than twelve thousand five hundred (12,500) pounds shall be permitted any residential lot, and such commercial vehicle shall be parked a minimum of twenty (20) feet from the front lot line. Such commercial vehicle shall be used in association with the occupation of the resident. (2) In no case shall a commercial vehicle used for hauling explosives, gasoline or liquefied petroleum products or other hazardous materials be permitted to be parked or stored either temporarily or permanently in any residential zoning district. (b) Recreational vehicles stored or parked on any residential lot shall be subject to the following provisions: (1) Not more than one (1) recreational vehicle, boat or boat trailer, or other type of trailer shall be stored or parked on any residential lot which is five thousand (5,000) square feet in lot area or less. Minimum lot area of ten thousand (10,000) square feet is required for storage or parking of any second recreational vehicle, boat or boat trailer, or other type of trailer. (2) Recreational vehicles, boats or boat trailers, or other type of trailer shall not be parked or stored closer than fifteen (15) feet from the front lot line of any residential lot. (3) Recreational vehicles, travel trailers or motor homes shall not be inhabited or occupied, either temporarily or permanently, while parked or stored in any area except in a trailer park designated for such use as authorized within this chapter. (4) Recreational vehicles parked or stored on any residential lot for a period exceeding twenty-four (24) hours shall be owned by the occupant of said lot. (c) A junked or abandoned vehicle, or one that is inoperable, as defined in section 21-24, shall not be parked or stored in any residential zoning district. (d) No materials, supplies, appliances or equipment used or designed for use in commercial or industrial operations shall be stored in residential zoning districts, nor shall any home appliances or interior home furnishings be stored outdoors in any residential zoning district. (e) The provisions of this section shall not apply to the storage or parking, on a temporary basis, of vehicles, materials, equipment or appliances to be used for or in connections with the construction of a building on the property, which has been approved in accordance with the terms of this chapter or to commercial or recreational vehicles parked within completely enclosed buildings.
