ADOPTION, DEDICATION and RESERVATIONS
THIS 15 TO CERTIFY CAPE CHARLES CDL, LLC, A FLORIDA LIMITED LIABILITY COMPANY 15 THE LAWFUL OWNER OF THE
LANDS DESCRIBED IN THE CAPTION HEREON KNOWN AS LAMBO'S PLACE UNIT 2, HAVING CAUSED THE SAME TO BE
SURVEYED AND SUBDIVIDED. THIS PLAT BEING MADE IN ACCORDANCE WITH SAID SURVEY IS HEREBY ADOPTED AS A TRUE
AND CORRECT PLAT OF THOSE LANDS.
OWNER IRREVOCABLY DEDICATES AND GRANTS A PERPETUAL AND EXCLUSIVE EASEMENT TO THOSE LANDS DELINEATED AS
"20' UNOBSTRUCTED EXCLUSIVE EASEMENT" TO THE CITY OF ATLANTIC BEACH, FOR THE PUBLIC PURPOSES OF DRAINAGE
AND COLLECTION AND STORAGE OF STORMWATER, TO CONSTRUCT AND MAINTAIN PERMANENT INLETS, WEIRS, PIPES, LINES
AND OTHER EQUIPMENT, AS WELL AS RECREATIONAL, PUBLIC ACCESS, PARK AND TRAIL PURPOSES, OVER, ACROSS, UPON
AND THROUGH SUCH LANDS, TOGETHER WITH THE RIGHT, EASEMENT, PRIVILEGE AND LICENSE TO DO ALL THINGS
NECESSARY, USEFUL OR CONVENIENT TO EFFECT AND ENJOY SUCH LANDS FOR THE PURPOSES ABOVE—DEDICATED;
SUBJECT TO, THE RESERVATION OF OWNER, CONFIRMED BY THE CITY, THAT — DESPITE THE EXCLUSIVE OCCUPANCY AND

DRAINAGE REQUIREMENTS; PROVIDED FURTHER THAT, OWNER SHALL ERECT AND MAINTAIN IN GOOD CONDITION IN
PERPETUITY A WALL OR FENCE, TO BE CONSTRUCTED OF WOOD, ALUMINUM, IRON, RESIN OR OTHER LIKE SUITABLE
MATERIALS, TO A MAXIMUM HEIGHT IN COMPLIANCE WITH THE CITY'S CODE OF ORDINANCES, ON THE EASTERN BOUNDARY
LINE OF THE DEDICATED 20' EASEMENT PARCEL LANDS
AS TO THOSE LANDS LOCATED ON THE NORTHERNMOST 7.5' OF LOT 6 ON WHICH AN EXISTING DRAINAGE EASEMENT HAS
BEEN CONVEYED TO THE CITY OF ATLANTIC BEACH BY THAT INSTRUMENT RECORDED AT BOOK 17408, PAGE 2453, 0 R.
DUVAL C2, THE CITY GRANTS TO OWNER A REVOCABLE LICENSE TO INSTALL WALKWAYS AND PAVERS IN SUCH 7.5'
AREA, AND TO INSTALL HVAC EQUIPMENT IN THE SOUTHERN 2.5' OF SAID EXISTING DRAINAGE EASEMENT, SUBJECT TO
LOT COVERAGE/IMPERVIOUS SURFACE AND OTHER REQUIREMENTS OF THE CITY'S CODE OF ORDINANCES, PROVIDED
HOWEVER, OWNER HEREBY AGREES ANY AND ALL SUCH PLACED IMPROVEMENTS SHALL BE REMOVED IN ORDER TO
ACCOMMODATE THE CITY'S REPAIR, IMPROVEMENT OR UTILIZATION OF THE AREA FOR DRAINAGE PURPOSES, AND WHICH

FURTHER, OWNER RESERVES, AND THE CITY CONFIRMS, A PERPETUAL RIGHT AND NON—EXCLUSIVE EASEMENT FOR
DRAINAGE OVER, UPON, ACROSS AND THROUGH LOT 10, FOR THE BENEFIT OF LOTS 6 THROUGH 9, SO LONG AS THE
FIRST FIFTY PERCENT (50%) OF STORMWATER ATTRIBUTABLE TO SUCH LOTS 6 THROUGH 9 IS CONTAINED AND TREATED
ON SUCH LOTS IN COMPLIANCE WITH THE CITY'S CODE OF ORDINANCES, SECTION 24-68, AS MAY BE AMENDED FROM
TIME TO 11ME.
