characteristics: 1. Lots are maintained free from litter,trash,debris, discarded belongings, automotive parts, old
tires, construction materials, and broken and abandoned items.
This letter requests that the noted violation(s) be corrected by clearing all debris from the lot within ten
10) days of the receipt of this notice.
Thank you for your cooperation in this matter. Failure to correct the violation by the required date may result in
this case being referred to the Code Enforcement Special Magistrate resulting in fines up to two hundred fifty

STATEMENT OF CODE ENFORCEMENT OFFICER: A boat & trailer AND an RV are parked on
the property in violation of code. RVs, boats, and trailers must be parked so that they are at least 15 feet
behind the front lot line of the home. The boat is closer than 15 feet to the front property line. The
minimum lot size for a second vehicle of this type is 10,000 square feet. Your property is less than
10,000 square feet.
If the violation is corrected and then recurs or if the violation was not corrected by the time specified for
correction by the Code Enforcement Officer in the Notice of Violation that you received, the case may

for more than four(4)hours,except when authorized by the city manager or their designee provided that the
vehicle does not obstruct traffic as described in section 21-18.

Sec. 24-154. - Outdoor display, sale and storage of furniture, household items, merchandise and
business activities outside of enclosed buildings. - (c)Unless expressly permitted by this section or
elsewhere within these land development regulations, all business-related products services and
activities shall be conducted within an enclosed building, subject to compliance with applicable
licensing requirements.
Sec. 21-20. - Parking limitations. (c)No person shall stop, stand, or park a recreational vehicle, camper,
bus, flatbed truck, trailer or commercial vehicle upon any right-of-way, except for the purpose of
loading or unloading, for more than four (4) hours, except when authorized by the city manager or
their designee provided that the vehicle does not obstruct traffic as described in section 21-18.

c) Maintenance of fences. Fences that have been
allowed to deteriorate to an excessive degree have a
negative impact on property values and the quality of
neighborhoods. Fences that are in a state of neglect,
damage or disrepair, shall be repaired , replaced or
removed.
This letter requests that the noted violations be corrected by mowing the overgrown rear
yard, removing the junk boat and all junk stored in it, removing the inoperable Chevy
Corsica from the rear yard or make it operable, and repair the rear dilapidated wood
fencing within ten (10) days of the posting of this notice.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty ($250.00)per day for
continuing violations. Upon completing the corrective action required, it is your responsibility to
contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance.

administrative costs to the City incurred in prosecuting this case. The property
owner is responsible for contacting the City Code Enforcement Officer and
obtaining an inspection of compliance.

vehicles and a junk boat full of junk stored in rear yard, inoperable vehicle
stored in carport)

enumerations of which are merely indications of the nature
of the type of acts, occurrences and conditions, and shall

other than cultivated plants, shrubs or trees to exceed a
height of more than twelve(12) inches on any developed lot,
or within twenty (20) feet of any occupied residential

Sec. 24-157. Fences, Walls and Similar Structures
c) Maintenance of fences. Fences that have been
allowed to deteriorate to an excessive degree have a
negative impact on property values and the quality of
neighborhoods. Fences that are in a state of neglect,

violation and order that compliance be achieved by removal of ALL the junk,
unlicensed inoperable motor vehicles and boats stored on the property and in
carport, mow and clean yard and remove all junk stored in boat and yard and
remove, repair or replace all deteriorated/dilapidated chain link and wood fencing
by Ooq6sr 1, 2013 or a fine of$140.00 be imposed for the first day and $150.00
for every day thereafter the violation continues to exists. In addition, any fine
shall also include the administrative costs to the City incurred in prosecuting this
case. The property owner is responsible for contacting the City Code
Enforcement Officer and obtaining an inspection of compliance.

CONCLUSIONS OF LAW
THAT Rena Koenig is not in compliance and has failed to correct such violation as of this hearing date.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority grantedinChapter162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach, Florida it isOrdered:
THAT the Respondent is found in violation for non-compliance and must obtain compliance on
or before November 1, 2013 Failure to comply will result in fines of $200.00 for the first day and200.00 for every day thereafter while the violation continues to exist. In addition, any fine shall alsoincludetheadministrativecoststotheCityincurredinprosecutingthiscase.
THAT the Respondent is responsible for contacting the City of Atlantic Beach Code Enforcement
Officer and obtaining an inspection of compliance.
THAT failure to pay all accumulated fines will result in a lien being placed against the property at981SailfishDrforthetotalassessmentpluscostsincurredforthefilingofthelien. All lien amounts are
to be made payable at an interest rate of ten(10)percent per annum from date of certification until paid.
This Order becomes self-executing upon an Affidavit of Non-Compliance being filed with the CityClerk's Office.

Respondent as evidenced in this hearing.
IPMC Sec.302.8 - Motor Vehicles
No inoperative or unlicensed motor vehicle shall be parked
or kept or stored on any premises, and no vehicle shall at
any time be in a state of disrepair, major disassembly or
in the process or being stripped or dismantled".

CONCLUSIONS OF LAW
THAT Rena Koenig is not in compliance and has failed to correct such violation as of this hearing date.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted
in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach, Florida it is
Ordered:
THAT the Respondent is found in violation for non-compliance and must obtain compliance on
or before November 1, 2013 Failure to comply will result in fines of $200.00 for the first day and200.00 for every day thereafter while the violation continues to exist. In addition, any fine shall also
include the administrative costs to the City incurred in prosecuting this case.
THAT the Respondent is responsible for contacting the City of Atlantic Beach Code Enforcement
Officer and obtaining an inspection of compliance.
THAT failure to pay all accumulated fines will result in a lien being placed against the property at
981 Sailfish Dr for the total assessment plus costs incurred for the filing of the lien. All lien amounts are
to be made payable at an interest rate of ten(10)percent per annum from date of certification until paid.
This Order becomes self-executing upon an Affidavit of Non-Compliance being filed with the CityClerk's Office.
DONE AND ORDERED THIS September 10, 2013.
