99-27 v RESOLUTION NO. 99-2 7 • A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, URGING THE JACKSONVILLE TRANSPORTATION AUTHORITY TO MEET WITH RESIDENTS AND OFFICIALS OF ATLANTIC BEACH FOR THE PURPOSE OF EXPLORING WAYS TO REDUCE CERTAIN NEGATIVE IMPACTS ON ATLANTIC BEACH AND ITS RESIDENTS RESULTING FROM THE CONSTRUCTION OF THE MAYPORT FLYOVER, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, although a majority of the Atlantic Beach City Commission continues to oppose the construction of the Mayport Flyover, the Commission is, as a result of advice from legal counsel, of the opinion that the authority granted to the Jacksonville Transportation Authority ("JTA") by the Legislature of the State of Florida allows the construction of the Mayport Flyover in the face of such opposition, and WHEREAS, additional meetings with the JTA and residents and officials of Atlantic Beach would be beneficial to explore ways to reduce certain negative impacts on the City and its residents, especially those who live in adjacent areas, resulting from the construction of the Mayport Flyover, and WHEREAS, certain negative impacts have already been identified, including, but not limited to, noise abatement before, during and after the project construction, retention pond • locations, beautification, and ways to reduce the necessity for commercial traffic to be routed through residential neighborhood streets as a result of restricted Mayport Road access. NOW THEREFORE, be it resolved by the City Commission of the City of Atlantic Beach as follows: SECTION 1. The City hereby urges the JTA to meet with residents and officials of Atlantic Beach in order to identify, address and reduce certain negative impacts on Atlantic Beach and its residents resulting from the construction of the Mayport Flyover. SECTION 2. This Resolution shall take effect immediately upon its final passage and adoption. PASSED by the City Commission this 13th day of Sept. , 1999.
