WEISS '^/ I RESOLUTION NO. 95-4 IN 'M l At J N £(13 I 1 S A RESOLUTION OF THE CITY OF ATLANTIC BEACH, ESTABLISHING A PROCEDURE FOR THE DESIGNATION AND USE OF A PORTION OF JOHANSEN PARK AS AN AREA,DOGS MAY RUN OFF LEASH, AND ADDING ENABLING LANGUAGE TO MUNICIPAL CODE CHAPTER 4, ARTICLE II. WHEREAS Section 4-21, et seq. of the Atlantic Beach Code regulating activities of dogs and animals running at large is adequately enforced within the City, and WHEREAS the opportunity for unleashed exercise for a dog is restricted to swimming in the waters of the Atlantic Ocean only, and then only together with the owner, and WHEREAS a moderate amount of vigorous exercise in a social context may be good for all animal species, including man and dogs, and WHEREAS careful thought and innovative planning may enlarge recreational facilities to include canines and their masters and mistresses, at minimal cost to the City, as is demonstrated in other cities, Austin, Texas, as an example NOW THEREFORE, be it resolved by the City Commission of the City of Atlantic Beach, as follows: Section 1. The City Staff is directed to: A. Research the possibility of enclosing the southern portion of the northern half of Johansen Park, about one and one half acres in area, for use by well- behaved dogs and their families, B. Consider such factors as, (at a minimum), fencing, parking, feces disposal, liability, expectations of dogs and their families, impact upon neighborhood, experiences of other municipalities, specifically the City of Austin, Texas, no cost to the City for construction and maintenance through volunteer participation and donation, response by sufficient dogs and their families to indicate worthwhile interest, and other prudent considerations, Section 2. Upon completion of research that indicates a positive impact upon the community will be achieved by such a project, Staff is directed to present language amending Chapter 4 of the Atlantic Beach Code establishing such an area for use by unleashed dogs in the immediate control of their owners to the Commission for review and action.
