A RESOLUTION OF THE CITY OF
ATLANTIC BEACH DEFINING CITY
POLICY FOR THE HOOKUP OF
EXISTING ONSITE SEWAGE
DISPOSAL SYSTEMS (OSDS) TO
AVAILABLE CITY SEWAGE
SYSTEMS.
WHEREAS, the City of Atlantic Beach requires, by City Ordinance, Sections 22-74 and
22-90, the connection of onsite sewage disposal systems to the City's sewer system within
ninety days of notification when the City's sewer system is within 100 feet of the property
line, and
WHEREAS, Section 381.0065 of the Florida Statutes requires residences to hook up to a
publicly owned or investor owned sewer system when said system is available in the right
of way, abutting the property line, and
WHEREAS, Section 381.0065 of the Florida Statutes requires commercial onsite sewage
disposal systems to hook up to a publicly owned or investor owned sewer system, when
within 500 feet of the property line, or with a change of ownership within an area zoned
for industrial or manufacturing, and
WHEREAS, the City of Atlantic Beach's sewer system is available to the majority of the
City's residences and business, and
WHEREAS, not all residences within the City of Atlantic Beach have connected their
onsite sewage disposal systems, as required by law, to the City's sewer system, and
WHEREAS, many failures of onsite sewage disposal systems in Atlantic Beach have
occurred, causing potential health hazards.
NOW, THEREFORE, be it resolved by the City Commission of the City of Atlantic
Beach, Florida, as follows:

SECTION 1. All residential and commercial properties served by an onsite
sewage disposal system, which are within one hundred feet of an available City sewer line,
shall hook up to the City's sewer system as required by existing City Ordinance, Chapter
22, Sections 22-74 and 22-90.
SECTION 2. The City Manager is directed to carry out the inspection provisions
of the City Ordinances, Chapter 22, Section 22-90.
SECTION 3. Upon a demonstrated hardship, a property owner required to hook
up to the City sewer system as a result of this policy, may apply to the City Manager for a
low cost loan from the City. Loan criteria will be established by the City Manager based
on the owner's net worth, income, and financial need. No loan will be made for more than
a five year period.
SECTION 4. The City Manager is directed to enforce Chapter 22, Section 22-
175 of the City Ordinance Code, which requires the City to charge for sewer service once
the ninety day notice given to property owners of the availability of the City's sewer
