A RESOLUTION OF THE CITY OF ATLANTIC BEACH,
FLORIDA REQUESTING THE DUVAL COUNTY
LEGISLATIVE DELEGATION AND THE CITY OF
JACKSONVILLE TO SUPPORT THE EXPANSION OF
THE CITY OF ATLANTIC BEACH'S BOUNDARIES
TO THE NATURAL BOUNDARY OF THE INTRACOASTAL
WATERWAY.
WHEREAS, the Western boundaries of the City of Atlantic Beach do not extend to the
natural Western boundary, the Intracoastal Waterway, and
WHEREAS, the Cities of Jacksonville Beach and Neptune Beach extend Westerly to
the Intracoastal Waterway, and
WHEREAS, the City of Atlantic Beach's Fire and Police Departments are called to
provide service to the area West of Atlantic Beach to the Intracoastal Waterway,
NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF ATLANTIC BEACH, FLORIDA, AS FOLLOWS:
SECTION 1. The City Commission requests that the Duval Legislative
Delegation and the City of Jacksonville assist the City of Atlantic Beach in gaining
authorization from the Florida Legislature to expand its boundaries as follows: from
the existing Southwest boundary westerly along a line sixteen (16) feet North of
Atlantic Boulevard, parallel at right angles to the centerline of Atlantic Boulevard, to
the centerline of the Intracoastal Waterway, then North along the center line of the
Intracoastal Waterway to the Northwest corner of Section 18, then East, bounded by
the North lines of Sections 19 and 40, to the existing boundary line of Atlantic Beach.
SECTION 2. The City Attorney is authorized to take such action as
required to file the local bill attached with the Florida Legislature to accomplish the
incorporation of the area described in Section 1.
SECTION 3. The attached map serves as a visual representation of the area
to be incorporated.

A bill to be entitled
An act relating to the consolidated City of
Jacksonville and the City of Atlantic Beach:
excluding certain described areas, commonly
known as "Johnson Island", "the Radio Station",
"Dutton Island" and the "Marsh" from the
territory of the Consolidated City of Jacksonville
and annexing such areas to the City of Atlantic
Beach; providing for referendums; providing an
effective date.
Be It Enacted by the Legislature of the State of Florida:
Section 1. Notwithstanding the provisions of the charter of the
Consolidated City of Jacksonville and Duval County or the charter of the
City of Atlantic Beach, the following described areas, know as "Johnson
Island", the Radio Station", "Dutton's Island" and "the Marsh" is excluded
from the territory of the Consolidate City of Jacksonville and is annexed
to the City of Atlantic Beach:
All of the land starting at the Southwest corner of the boundary of the
City of Atlantic Beach, bound on the south by a line 16 feet North of
Atlantic Boulevard measured at right angles from the center line, to the
center line of the Intracoastal Waterway, then North on the center line of
the Intracoastal Waterway to the Northwest corner of Section 18, then
East bounded by the North line of Sections 18 and 40 to the existing
boundary line of Atlantic Beach.
Section 2. This act, except for this section which shall take effect
upon becoming a law, shall take effect July 1, 1994, if the act is approved
by the electors of the area described in section 1, each voting in
referendum elections which shall be called and held by the City of
Jacksonville in the City of Atlantic Beach and in the area described in
section 1 at the next general election of the Consolidated City of
Jacksonville in May of 1995. There shall be at least 30 days' notice of the
election as provided in s. 100.342, Florida Statutes. The election shall be
paid for by the City of Jacksonville, and the expenditure of funds for this
purpose is a proper county expense.
