As discussed yesterday, the Federal Court preliminary injunction ordered yesterday basically changes the Form 6 requirement back to a Form 1 requirement. Below is a memorandum from the
Florida League of Cities, along with an attached letter from the Commission on Ethics. As you will see, for those of you who have already e-filed a Form 6 you are not required to also
file a Form 1, for 2023. You have already satisfied the requirement. For those who have not yet filed you will need to log into EFDMS (the new online system) and file the Form 1 for
2023 by July 1, 2024. From this correspondence it appears the State Ethics Commission is working quickly to reprogram the system to populate the Form 1 into your respective dashboards
on EFDMS.
You should be getting direct information from the State Ethics Commission as well.
Donna – there is also some helpful information for candidates qualifying, in the attached memo.

On June 10, the federal District Court for the Southern District of Florida issued a preliminary injunction in the case of Loper v. Lukis, et al., Case No. 24-20604 (S.D.Fla.). The court’s

further states that it “binds Defendants and their officers, agents, servants, employees, and attorneys—and others in active concert or participation with them—who receive actual notice
of this injunction by personal service otherwise.” As you may recall, SB 774 requires elected municipal officials and candidates seeking to qualify for municipal office to file full
financial disclosure (Form 6) with the Florida Commission on Ethics.
You may receive questions about this order from your municipal clients, including questions from elected officials and city clerks. At this point it is unclear what steps the state defendants
may take with respect to the order. In the meantime, municipal officials and candidates qualifying for municipal office remain subject to the limited financial disclosure requirement
(Form 1) and associated deadlines for filing.
