A RESOLUTION OF THE CITY OF ATLANTIC BEACH
AUTHORIZING GLENN E. COHEN, ESQUIRE, TO
INITIATE LEGAL PROCEEDINGS IN REGARD TO THE
CITY'S PURCHASE OF THE OAK HARBOR WATER AND
SEWER TREATMENT PLANT, TO RECOVER POSSIBLE
DAMAGES SUFFERED BY THE CITY IN CONNECTION
THEREWITH, PROVIDING AN EFFECTIVE DATE.
WHEREAS, The City, on or about February 28, 1989, purchased
the Oak Harbor Water and Sewer Treatment Plant, and
WHEREAS, It has come to the City's attention that possible
damage has been incurred by the City as a result of said purchase,
and
WHEREAS, Alan C. Jensen, the current City Attorney, was a City
Commissioner at the time of said purchase and may have a conflict
of interest in representing the City in an action regarding the
purchase of the Oak Harbor Water and Sewer Treatment Plant,
NOW THEREFORE, be it resolved by the City Commission of the
City of Atlantic Beach as follows:
Section 1. Glenn E. Cohen, Esquire, is hereby directed and
authorized to initiate legal proceedings in order to recover any
damages incurred by the City in connection with the purchase of the
Oak Harbor Water and Sewer Treatment Plant.
Section 2 . The terms and conditions of said engagement of
Glenn E. Cohen, Esquire, are as set forth in the letter from Mr.
Cohen to Honorable William I. Gulliford, Jr. , dated May 30, 1991,
a copy of which is attached hereto.
Section 3 . Other offices, department heads, and employees of
the City are hereby directed to cooperate with Glenn E. Cohen,
Esquire, to the fullest extent to minimize the costs to the City in
said litigation and to insure the recovery by the City of any
damages suffered as a result of the purchase of the Oak Harbor
Water and Sewer Treatment Plant.
Section 4 . This Resolution shall take effect immediately upon
its final passage and adoption.
