Stormwater Covenant 1 CITY OF ATLANTIC BEACH 800 SEMINOLE ROAD ATLANTIC BEACH, FL 32233 (904) 247-5800 Rev. 8.18.2020 CONDITION OF PERMIT APPROVAL DECLARATION OF RESTRICTIVE COVENANT The requirements for stormwater drainage, storage, and treatment are found in the City of Atlantic Beach Land Development Regulations, Section 24-68. Depending on the permit application and conditions of approval for this project, the owners of this property may be required to provide a certain amount of on-site stormwater storage. The requirement is due to one or both of the following: 1. The cost of the development or redevelopment project exceeds 50% of the market value of all improvements, if any, on the subject development parcel before the new development or redevelopment project is started. 2. The project will increase the impervious surface area on the development parcel by more than two hundred and fifty (250) square feet. If on-site stormwater storage is required, a declaration of restrictive covenant, in recordable form and approved by the City, identifying and describing the required on-site storage improvements to be maintained, shall be executed and recorded in the public records of Duval County, Florida, by the owner of the development parcel and shall be binding on successors and assigns, prior to permit closeouts or issuance of a certificate of occupancy.
