Sarah Boren called the meeting to order. Anastasia Houston called the roll.

Chandler Poole, UNF student, introduced himself and said he will be helping the ESC with
projects.
Destiny Sanchez, UNF student, introduced herself and expressed her excitement to work with
the committee.
4. CHAIR REMARKS
Sarah Boren reported that members will need to do a Sunshine Law training. She thanked
members for their work and for attending public meetings. She reported ESC will give updated
to Commission in April, July, and October.

C. Concerned Citizen - Joan Horn regarding Marshes
Joan Horn spoke about protecting marshes and reducing wetland buffers.
Amanda Askew explained the purpose of wetlands and how they protect neighboring
land. She reviewed the areas that address wetlands in the Land Development Regulations
and Comprehensive Plan and said staff will be adding more language to the
Comprehensive Plan about wetlands. She said that a 25-foot buffer from wetlands line
is required from existing lots of record and a 50-foot buffer is required for newly platted
lots. She said that currently all properties in COAB adjacent to wetlands would require
a 25-foot buffer for new on-site development.
Sarah Boren asked if the buffer would increase if the property is sold. Amanda Askew
said no, the 25-foot buffer is still enforced.
Daniele Giovannucci asked what can occur in the buffer. Amanda Askew stated the area
is supposed to serve as a natural buffer where the lands shall not be disturbed in any way.
Sarah Boren asked ESC to provide ideas on how to protect marshlands.
Mark Gabrynowicz emphasized that the ESC's purpose is to protect the environment.
Daniele Giovannucci stated he believes the ESC should not make policy changes but
rather find ways to protect the wetlands.
Sarah Boren suggested coming back to the discussion at the March meeting.
D. COAB Staff Marshes next steps
This item was discussed under Item 10.D.
E. Earth Day tree giveaway
Bruce Andrews stated the tree giveaway was very successful and suggested increasing
the tree size.
Members discussed species and size.
MOTION: Based on the 100% placement and success of ESC’s 2024 Arbor Day 100 Tree Giveaway
and goal to plant 150 trees, the following motion is being proposed for another tree giveaway on April
21, 2024 at ESC’s Earth Day Festival:
“ESC would like to spend up to $3,500 for a giveaway of approximately 100 trees on April 21, 2024 at
ESC’s Earth Day Festival at the regular Sunday Farmer’s Market.”
Staff will work on sourcing more than one type of tree to offer variety if possible.

A. Chapter 23 update
Amanda Askew reported the updates to Chapter 23 were provided to the City Attorney
for review. She said after his review the proposed update will be presented to
Commission.
B. Howell Park Dredging Project
Amanda Askew reported the Howell Park dredging project is projected to begin mid-
March to April.
C. Parks Master Plan update
Amanda Askew reported another survey will be going out to the community to gather
idea on what to do with the property next to Veterans Park and the Gail Baker Center
expansion. Discussion about parks ensued.
D. Legislative update
Amanda Askew reported that staff is keeping an eye on Senate Bill 122 which would
repeal FSS 163.045.

A. Charter Review Committee
Sarah Boren spoke about next steps since the Charter Review Committee(CRC) voted
down the recommendation from ESC. She said they will include the next CRC meeting
in the ESC newsletter and encouraged members to attend the meetings to show their
support for the recommendation. Daniele Giovannucci volunteered to work on
condensing the language of the recommendation.
B. Mature Tree Inventory Contest
Sarah Boren reported that Mark Gabrynowicz was the only submittal. She asked for
feedback on the process. Anastasia Houston and Daniele Giovannucci expressed it was
too complicated to submit to the contest. Anastasia Houston said she thought the word
"contest" discourages people and suggested making it an "inventory". Amy Palmer
suggested removing the mature tree aspect and asking for all trees to be inventoried.
C. ESC self evaluation

Amy Palmer stated she is disheartened to see how many tree removal permits have come through
since joining the tree subcommittee in January. She proposed adding a space on the application
to ask the reason for tree removal. Members discussed and agreed with the idea.
Anastasia Houston asked what the ESC's roll is in addressing Joan Horn's concerns. Members
agreed that their job is to focus on how to protect the environment.
Sarah Boren said she was disappointed City Commission did not have any environmental
priorities but she is hoping the City Manager will add some environmental task to achieve the
priorities.
Bruce Andrews read an email he is asking members to send to their state legislators to support
Senate Bill 122.

B. Climate Pollution Reduction Grant
The City has continued with the application process for 2 applications for the grant. One
regarding energy efficient and resilient buildings and the second focused on electric
vehicle (EV) transportation.
C. 18th Street tree-cutting update
Cutting was done to clear the view for the police cameras which were turning off when
the trees moved in front of them. Discussion of the erosion of the dune that supports the
trees. Staff was asked about native plantings that would help.
D. US DOT- JTA/Groundwork Jax received dollars for reconstructing the Emerald
Trail
E. Revised ESC budget deadline
Need to get a revised ESC budget to Staff by April 2024. Due before next agenda
deadline-2 weeks.
5. 90 DAY CALENDAR
A. ESC Planner/Calendar/Metrics
Chair Boren asked the Committee to look over the planner/calendar/metrics and provide
input.
6. COMMISSION AND/OR STAFF REPORTS
A. Chapter 23
Planner Broedell said that Chapter 23 was being reviewed by the City Attorney.
B. Parks Master Plan update
Planner Broedell said that Staff has put this on hold due to work load and will work on
when Staff time becomes available. Chair Boren asked what the next steps would be.
Planner Broedell said they need to proposed updated recommendations and take them
before Commission. Chair Boren asked if that would come before the Committee first.
Planner Broedell said he wasn't sure.
C. Commission 2024 Priorities
Commission voted on these on Monday. Chair Boren said she asked Director Askew
where the Committee might be asked to assist with this. Brian Broedell said that he
thought the Committee would be involved with the sustainability goals, preserving of
the marsh and the parks master plan. There was further discussion regarding the
Commission's priorities and the parks master plan.

D. Comp plan update and Chapter 24 update
Planner Broedell said that Staff is planning to take these before the Community
Development Board in April and the City Commission in May. Chair Boren asked if
there was a Staff recommendation for the marsh. Planner Broedell said they are planning
on adding a few objectives and policies regarding the protection and preservation of the
marsh and wetlands. He said he can email them out to the Committee.
7. OLD BUSINESS
A. Charter Review Committee
Verbiage proposed for charter to have “environmental stewardship” in City
charter. The amended motion passed – unanimously.
ESC to watch meetings to ensure environmental language makes it to ballot
through CRC and Commission meetings.
B. Marsh Priority
Discussion of Joan Horn’s policy proposals.
Decision - ESC to ask Staff for input on comp plan and responses on citizens
policy proposals
Tree cutting on the weekends
Decision - ESC Outreach to review options and come up with a course of action
C. ESC Self Evaluation
Bruce proposed Atlantic Boulevard and Seminole Road beautification projects. There
was lengthy discussion regarding recruiting members and entrance beautification.
Decision - Committee members to try and recruit new members and volunteers
Decision - Each Committee member to take Atlantic Beach entrances and think
about beautification

Chair Boren explained the share file she developed that lists different volunteer
opportunities. The Board discussed how to make it work. Chair Boren said she had a
discussion with Fletcher High School and how they could volunteer. The Board
discussed having a volunteer coordinator within the Committee.

E. Chemical Management Plan
Mark provided an update. He said he was going to try to develop the process
with Director Askew and other Staff members. Mark said he wanted to have
Town Hall meetings, develop a brochure explaining what the Chemical
Management Plan is, why it is needed, what the benefits are and what people can
do to better manage their chemicals.
Decision - ESC members to send any suggestions and edits to Mark
8. SIGNIFICANT MATTERS ARISING IN SUBCOMMITTEES
A. Tree Subcommittee
The Committee wanted to know why homeowners are allowed to remove trees in the
right-of-way. Director Broedell explained that trees were only removed if they were
dead or diseased. He said they try to be reasonable if a driveway is being put in or
something similar.
MOTION: To develop language to modify the tree ordinance to include language that allows
relocated trees to suffice as 1:1 mitigation for itself. Survival requirements to be consistent with
existing standards.

B. Outreach Subcommittee
Patrick discussed that Earth Day is approaching. He said the Committee has 11 vendors
and they are working with Staff to figure out the space and location for the event.
Director Broedell said the City was buying 200 trees in 2 different types. The Committee
discussed providing information for proper planting with each tree. They decided to
reach out to people who had previously planted trees to get pictures. The Committee
asked Planner Broedell to see if they could get 7 gallon trees this time.
Amy said she met with Deputy City Manager Hogencamp regarding the Welcome Kit
and it is back in action. She said there is a way to use the funds that are in the budget.
Amy said she will email the Committee.
C. Sustainability and Resilience Subcommittee
Chair Boren said attendance for these meetings was down and she wasn't sure if it was
timing or what.

We reviewed the staff-prepared tree report but didn’t understand certain aspects and had no
staff present to explain. We need to have Abrielle come explain it to us – applications, finaled,
closed timing, etc.
5. OLD BUSINESS
A. Ongoing discussion of changes to Chapter 23, Protection of Trees and Native
Vegetation.
We agreed that we would like to have staff look at how trees that are relocated within a
property are handled for mitigation purposes and that it seems they should be given 1:1
credit.
We discussed adding a requirement in the ordinance that the tree report information be
an actual requirement.
We would like cross reference added to the city website linking to the arborist letters that
have been submitted.
6. NEW BUSINESS
A. 2024 tree fund budget discussion.
We ran out of time and did not have additional discussion on the tree fund budget
template so this item is still open.

Mark shared that he is working directly with Amanda until we get more people
involved
Discussion about breaking down CMP into bite size sections to focus on one at a
time, targeted audiences, what to focus on first, and more ensued.
Conclusions
o CMP first focus: How to reduce biocides in yard/outside
o Targeted Audiences: City operations, residential & commercial
o Budget: Need to encumber budgeted $4k quickly
o Deliverables with deadlines:
Defined degree of problem – We have a solid understanding of
how bad the use of biocides is, their impact, and why it is
important that we focus on this issue

Heather looked for spaces around the city and contacted Overall Farms
Overall Farms does not have the capacity right now to start something in AB
Heather turned to what she could control and move forward with such as her
backyard with soil modification
Discussion ensued about liability, how to address food access at a community
level, what is actual degree of lack of food access problem in AB, who are the
potential partners, and concrete next steps.
Conclusions
o Heather continues on her path
o Need to understand and research food dessert issue for AB residents and
the true degree of the problem as well as possible right size approaches
to addressing (Sarah)
o Organize/host a listening meeting with key stakeholders (Sarah/Heather)
Make list of key stakeholders (e.g., ABUF, Eat It Jax, St. Johns
the Baptist Church)
Find place to meet

AGENDA ITEM:Marsh/Wetland Related Comprehensive Plan Policies

BACKGROUND: The ESC recommended information on marsh/wetland related policies within the
Comprehensive Plan. Below are existing and proposed objectives and policies that address the
wetlands/marsh.
Existing:
Objective A.1.1
Environmental Resources
Land development activities and project review procedures shall include requirements intended to protect
natural environmental features and improve the physical characteristics of the City so as to ensure the
conservation and protection of Environmentally Sensitive Areas, as defined by Policy D.3.2.8 of the Coastal
Conservation Element and any other natural resources including wetlands, wildlife habitats, estuarine systems,
and surface and groundwater resources.
Policy A.1.1.1
Land development within the City shall be permitted only where such development is
compatible with environmental limitations of the site and only when submitted plans
demonstrate appropriate recognition of topography, soil conditions, flooding
conditions, trees, vegetation and other Environmentally Sensitive Areas, including
wetlands and coastal resources, and habitat protection of rare, endangered or
threatened species and areas of unique natural beauty.
Policy A.1.1.2 The City shall maintain an inventory of lands, which possess significant environmental
features, habitats, and areas of unique interest or beauty. The potential for
development proposals to adversely impact such areas shall be considered prior to the
issuance of development permits.
Objective A.1.2
Wetlands, Environmentally Sensitive Areas and Estuarine Environments
The City shall protect, conserve and enhance the natural functions of existing wetlands, marsh and estuarine
systems, and other Environmentally Sensitive Areas in order to maintain the quality and function of natural
systems and wildlife habitats.
Note: The terms “wetlands” or interchangeably “natural wetlands” as used within this Plan shall mean those
wetland areas which have been created through natural means or through restoration or wetland creation
projects of government agencies having authority over these resources, and shall not be construed to include
stormwater ponds, or other manmade drainage facilities, which may be designated as jurisdictional for the
purpose of stormwater management, but which are not natural Wetlands.

Policy A.1.2.1 The City shall protect natural wetlands and other Environmentally Sensitive Areas, as may be
identified by Map A-5 and Map A-4 of the Future Land Use Map Series or as may be identified
by other accepted environmental survey methodologies, and their functions from the adverse
impacts of development by maintaining required upland buffers between wetlands and
adjacent development as implemented through the Land Development Regulations.
Policy A.1.2.2 The City shall protect wetlands and estuarine environments from the adverse impacts of
development and shall prohibit the establishment of incompatible land uses adjacent to
wetlands. Such incompatible land uses shall include all Industrial uses, but shall also include
uses, which have the potential to disturb, contaminate or degrade wetland functions or natural
systems associated with wetlands and estuaries.
Policy A.1.2.3 The City shall require that, as a condition of development approval, new construction projects
provide effective stormwater management, which avoids the contamination of Environmentally Sensitive
Areas, wetlands, marsh and estuarine environments in accordance with applicable water quality standards of
the St. Johns River Water Management District, the City’s National Pollutant Discharge Elimination Systems
(NPDES) permit and Stormwater Management Plan and the Land Development Regulations, as may be
amended.
Policy A.1.2.4 The City shall not issue development permits that would significantly alter wetland communities
and functions.
Policy A.1.2.6 The City shall enforce all applicable wetland regulations, including those as set forth within the
Conservation and Coastal Management Element of this Plan, and shall continue to develop and
implement comprehensive strategies to provide for the effective
protection of wetlands, marsh and estuarine systems, and other Environmentally Sensitive
Areas within and adjacent to the City.
Objective D.3.2
Conservation and Protection of Natural Coastal Resources
The City shall maintain or adopt provisions within its Land Development Regulations for private and public
development, which conserve and enhance soils, native vegetation, living marine and water resources and
wildlife habitats to the maximum extent possible.
Policy D.3.2.1 The City shall require applicants for development permits to submit appropriate environmental
surveys and reports prior to the issuance of development permits. All applications for development permits and
applications to rezone to Planned Unit Development and other zoning related applications shall be required to
identify environmental features, including any wetlands, CCCL, natural water bodies, open space, buffers and
vegetation preservation areas, and to sufficiently address any adverse impacts to Environmentally Sensitive
Areas.
Policy D.3.2.5 In accordance with Section 163.3202, Florida Statutes, the City shall establish and maintain
within its Land Development Regulations, all necessary requirements and restrictions to ensure
that land development, land disturbing activities, and land uses are managed in a manner
which protects and conserves the natural functions of soils, fisheries, wildlife habitats, rivers,
flood plains, wetlands (including estuarine marshes) and marine habitats including hatchling
turtles.

Policy D.3.2.6 The City shall cooperate with adjacent local governments and regulatory agencies to conserve
and protect, as may be appropriate, unique vegetative communities located within the City and
within adjacent jurisdictions.
Policy D.3.2.7 The City shall designate Environmentally Sensitive Areas requiring protection as a means of
implementing the Comprehensive Plan and shall include in its Land Development Regulations,
prepared in accordance with Section 163.3202, Florida Statutes, means of ensuring protection
of such lands from degradation.
Proposed (to be added to Comp Plan):
All language below is new/proposed
Policy A.1.2.7 The City shall encourage shorelines lacking wetland vegetation to be planted with native
vegetation in order to minimize potential flood damage, stabilize the shoreline and trap sediments and other
non-point source pollutants, and provide additional habitat for fish and wildlife.
Policy A.1.2.8 The City shall support and encourage the development of a strict flood plain management
program by state and local governments to preserve hydrologically significant wetlands and other natural flood
plain features.
Objective D.1.6
Marshes, Wetlands and Natural Flood Plain Features
The City shall conserve or improve marshes, wetlands, and aquatic resources and natural flood plain features to
maintain their environmental and recreational value.
Policy D.1.6.1 The City shall require new development to preserve native vegetation on site when applicable.
This should not be interpreted to allow development in wetlands or protected areas.
Policy D.1.6.2 The City shall take every effort to protect these resources as follows:
(a) Development and redevelopment shall be compatible with the surrounding environment;
(b) The clearing of trees and wetland vegetation shall be prohibited, unless a mitigation plan is
submitted and approved by the City, the objective being no net loss of wetlands and trees; and
(c) All applications for site development approval shall be subject to site plan review in accordance with
the land development regulations.
Policy D.3.2.10 The City shall seek to increase its conservation areas, through land acquisition, when possible,
incentives for protective easements, and other appropriate protective mechanisms to ensure the preservation
of natural resources and listed animal species habitat.
Policy D.3.2.11 The fragmentation of large wetland communities shall be avoided by encouraging density
transfers, conservation easements, clustering of development, and other land development tools to enhance
conservation.

Vacation Rentals (Oppose) – Passed
CS/SB 280 (DiCeglie) and CS/CS/HB 1537 (Griffitts) are comprehensive bills dealing with short-term
rentals. Here is a brief description of how the bills are different:
CS/CS/HB 1537:
•Pay a fee of no more than $150 per unit for processing an individual registration application and a
$50 per unit yearly renewal. A local government may impose a $300 fine for failure to register.
•State the maximum occupancy of the short-term rental based on the number of sleeping
accommodations for persons staying in the short-term rental.
•Requires the responsible party to respond to a complaint or emergency by 9 a.m. the next calendar
day.
•After five violations occur over a period of time, suspensions are set at 15 days, 30 days and 60
days, respectively.
CS/SB 280:
•Pay a “reasonable fee” per unit for processing an individual registration application and renewal. A
local government may impose a $500 fine for failure to register.

•State the maximum occupancy of the short-term rental is no more than two people per room plus
two, or at a minimum of 50 sq ft. per person.
•Display their individual registration number in a conspicuous location in the vacation rental.
•After five violations occur over a period of time, suspensions are set at 30 days, 60 days and 90
days, respectively.
•Adds in a grandfather clause for any county ordinance that was adopted prior to 2014 and amended
after 2016. Any county ordinances adopted during those timeframes are exempt from the
requirements of the bill.
Below are how the bills remain identical:
Impact on Local Governments
The bills maintain the current preemption on local governments from adopting zoning ordinances
specific to short-term rentals as well as regulating the duration of stays and the frequency in which
the properties are rented.
Local Registration Programs
The bills create a statewide process for the local registration of vacation rentals. Under the program,
a local government has 15 days after receiving an application for registration to accept the application
or issue a written notice specifying all deficiencies. Both parties may agree to extend the timeline. If a
municipality does not accept or deny an application within that 15-day window, that application is
deemed approved.
As a condition of registration, the local registration program may only require the owner or operator of
a vacation rental to:
•Charge a reasonable fee for inspections to ensure compliance with the Florida Building and Fire
Prevention Codes.
•Renew their registration no more than once per year per unit, unless the property has a change in
ownership.
•Submit identifying information about the owner or the property manager and the short-term rental
being registered.
•Obtain a license as a transient public lodging establishment by the Department of Business and
Professional Regulation (DBPR).
•Obtain all required tax registration, receipts or certificates issued by the Department of Revenue, a
county or a municipal government.
•Maintain all registration information on a continuing basis so it is current.
•Designate and maintain a property designee who can respond to complaints and other immediate
problems related to the property, including being available by phone 24 hours a day, seven days a
week.

•Pay in full all municipal or county code liens against the property being registered.
June 1, 2011, Grandfather Provision
The bills maintain the grandfathering of ordinances that were adopted prior to June 1, 2011.
Additionally, the bills clarify that cities may amend grandfathered ordinances to be less restrictive
without voiding those ordinances.
Impact on Advertising Platforms and DBPR
Advertising platforms will now be required to:
•Collect and remit all required taxes.
•Require each person listing a property as a vacation rental to include in the advertisement the state
license number and, if applicable, the local registration number. They will also be required to attest
that the license and registration numbers are valid.
•By January 1, 2026, the advertising platform will be required to check and verify the license number
of all listings with DBPR prior to posting the advertisement. Additionally, license numbers must be
checked at the end of each calendar quarter with the department.
•Remove from public view an advertisement from their website within 15 business days after
notification by DBPR in writing that a vacation rental fails to display a valid license number.
•Adopt an anti-discrimination policy.
Revocation/Denial of License
A local government may revoke or refuse to renew a vacation rental registration:
•An owner’s vacation rental registration has been suspended three times.
•There is an unsatisfied municipal or county code lien, so long as the local government allows the
owner at least 60 days before the termination to satisfy the lien.
•The premises and its owner are the subject of a final order or judgment directing the termination of
the premises’ use as a vacation rental. (Wagoner)
CS/SB 280 passed the House (60-51) and the Senate (23-16) and is awaiting action by the Governor.

Release of Balloons (Support) – Passed
CS/CS/SB 602 (DiCeglie) and CS/HB 321 (Chaney) revise the current law prohibiting the release of
certain balloons. SB 602 deletes the specified timeframe and number of balloons subject to the
prohibition, making the intentional release of any number of balloons over any timeframe a violation of
state law. SB 602 also deletes the current law exemption from the prohibition for certain
biodegradable or photodegradable balloons. Both bills provide that a person who violates the
statutory prohibition commits the noncriminal infraction of littering, punishable as provided in Section

403.413(6)(a), Florida Statutes. CS/HB 321 passed the House (102-9) and the Senate (38-2) is
awaiting action by the Governor. (O’Hara)
Affordable Housing (Monitor) – Passed
CS/CS/SB 328 (Calatayud) and CS/CS/HB 1239 (Lopez, V.) amend various provisions of the Live
Local Act (act), passed during the 2023 Regular Session. The bills do the following:
•Adjust the height allowances for parcels adjacent to single-family residential uses within a single-
family neighborhood.
oProvides that if a proposed development is “adjacent to, on two more sides, a parcel zoned for
single-family residential use that is within a single-family residential development with at least 25
contiguous single-family homes, the local government may restrict the height of the proposed
development to 150% of the tallest building on property within one-quarter mile of the proposed
development or three stories, whichever is higher.”
•Prohibit qualifying developments within one-quarter mile of a military installation from utilizing the
act’s administrative approval process and exempt certain airport-impacted areas from the act’s
provisions.
•Clarify that a local government’s “currently allowed” density, height, and floor area ratio does not
include any bonuses, variances, or other special exceptions provided in their regulations.
•Modify parking reduction requirements for qualifying developments located near certain
transportation facilities.
•CS/CS/SB 328 and CS/CS/HB 1239 propose funding the Hometown Hero Program at $100 million.
Only in CS/CS/HB 1239
•Requires a county or municipality to authorize multifamily and mixed-use residential as allowable
uses on any site owned by a county or municipality, including any zoning district permitting
commercial, industrial or mixed uses.
•Provides that administrative approval of a proposed development does not require a public hearing
or any other action by a quasi-judicial board or reviewing body.
•Defines the term “commercial use” to mean activities associated with the sale, rental or distribution of
products or the sale or performance of services. The term includes, but is not limited to, retail, office,
entertainment and other for-profit business activities.
CS/CS/SB 328 Passed the Senate (40-0) and the House (112-1) and is now awaiting action by the
Governor. (Branch)
Local Government Actions (Monitor SB 1628/Oppose HB 1547) – Passed
CS/CS/SB 1628 (Collins) and CS/HB 1547 (McClure) revise exemptions from the application of SB
170, relating to local ordinances and business impact estimates, passed in the 2023 Legislative
Session. CS/CS/SB 1628 eliminates the exemption from the requirement to file a business impact
estimate for ordinances relating to a comprehensive plan amendment or land development regulation

initiated by a municipality or county. CS/HB 1547 is broader and would eliminate the exemption for
comprehensive plan amendments and land development regulations from both the business impact
estimate requirement and the suspension of enforcement requirement. CS/CS/SB 1628 has passed
the Senate (30-1) and the House (84-30) and is awaiting action by the Governor. (O’Hara)
Unauthorized Public Camping or Sleeping (Monitor) – Passed
CS/CS/SB 1530 (Martin) and CS/CS/HB 1365 (Garrison) prohibit counties and municipalities from
permitting public sleeping or camping on public property, at public buildings or on public rights-of-way
within their respective jurisdictions without a lawfully issued temporary permit. The bills authorize
municipalities and counties to designate certain public property for public sleeping or public camping
subject to the following conditions, the sufficiency of which must be determined by the Florida
Department of Children and Families: minimum sanitation levels, including access to restrooms and
running water; security present and onsite at all times; access to behavioral health services;
prohibition on drugs and alcohol; and the designated area may not be in a location that adversely and
materially affects existing residential or commercial properties. The bills authorize a person or
business to bring a civil action against any county or municipality to enjoin a violation of the
prohibitions and conditions and to recover their attorney fees and costs. The bills provide an
exception for a state of emergency declared by the Governor. CS/CS/HB 1365 has passed the House
(82-26) and the Senate (27-12) and is awaiting action by the Governor. (O’Hara)
Expedited Approval of Residential Building Permits (Oppose) – Passed
CS/CS/HB 665 (McClain) and CS/CS/CS/SB 812 (Ingoglia) are comprehensive bills dealing with the
expedited approval of residential building permits. Of concern to municipalities, the bills do the
following:
•Create a two-step application process that would include the adoption of a preliminary plat and a
final plat in order to expedite the issuance of building permits.

•Requires municipalities to establish a registry of three qualified contractors to assist with plans

•Require applicants to have a performance bond for up to 130%.
•Require applicants to indemnify local governments that issue the permit.
•Specify that upon an applicant's request, a local government must issue no less than 50% of the

Residential Building Permits (Oppose) – Passed
CS/CS/CS/HB 267 (Esposito) and CS/CS/CS/SB 684 (DiCeglie) are comprehensive building permit
bills. Of concern to cities, the bills do the following:
•Require a local government to:
•Approve, approve with conditions, or deny a building permit application after receipt of a completed
and sufficient application within the following timeframes, unless the applicant waives such
timeframes in writing:
•30 business days residential permits under 7,500 square feet
•60 business days residential associated permits over 7,500 square feet
•60 business days signs or nonresidential less than 25,000 square feet
•60 business days for multifamily residential not exceeding 50 units; site-plan approvals and
subdivision plats not requiring public hearing or public notice; and lot grading and site alteration
•12 business days for using a master building permit consistent with s. 553.794 to obtain a site-
specific building permit
•10 business days for a single-family residential dwelling who participates in a Community
Development Block Grant–Disaster Recovery program
•Provide framework for responding to insufficient application within 10 business days. The curing
process will provide 10 days for applicant to respond and final 10 days for local government to
approve or deny the permit.
•Require a local government to determine if a building permit application is complete within five
business days of receiving the application or the application is determined to be properly completed
and accepted.
•Allow local governments to use certain fees for technology upgrades.
Alternative Plans Review and Inspection by a licensed professional engineer or architect:
•Specifies a timeframe of 10 business days for local building officials to issue permits or provide
written notices regarding plan deficiencies.
•If the local building official does not provide specific written notice to the permit applicant within the
prescribed 10-day period, the permit application is deemed approved as a matter of law, and the
permit must be issued by the local building official on the next business day.
•Prohibits a local government from auditing the performance of building code inspections by a private
provider until the local government has created a manual for standard operating audit procedures.

public works project from requiring a contractor to do the following:
•Pay employees a predetermined amount of wages or prescribe any wage rate
•Provide employees a specified type, amount or rate of employee benefits
•Control, limit or expand staffing
•Recruit, train or hire employees from a designated, restricted or single source.
CS/HB 705 passed the House (80-32) and the Senate (28-12) and is awaiting action by the Governor.

Annual Inflation Adjustment to Homestead Exemption (Oppose) – Passed
CS/HJR 7017 (Buchanan) proposes an amendment to the constitution to authorize the Legislature to
require an annual adjustment to the value of certain homestead exemptions. The constitutional
amendment must be approved by at least 60% of electors at the November 2024 general election
and will take effect on January 1, 2025. CS/HB HJR 7017 was amended to clarify that the annual
inflation adjustment to the $25,000 exemption on assessed value for all levies, other than school
district levies, and any future similar exemptions added to the constitution must be adjusted only
when the inflation growth is positive. CS/HJR 7017 passed the House (86-29) and the Senate (25-15)
and is headed to the Secretary of State’s Office to be prepared for the November ballot. (Chapman)
Local Regulation of Nonconforming or Unsafe Structures (Oppose) – Passed
CS/HB 1647 (Roach) and CS/SB 1526 (Avila) restricts local governments from prohibiting, restricting,
or preventing the demolition of nonconforming or unsafe structures. The bills authorize the demolition
of a structure and automatic replacement without requiring the new structure to have historical
features or characteristics. The bills also prohibit local governments from imposing additional
restrictions on the demolition or redevelopment that depart from existing requirements for a similarly
situated parcel. The bills specify the provisions do not apply to a structure individually listed in the
National Register of Historic Places or a contributing structure listed prior to 2000, a single-family
home, or a structure located on a barrier island in a municipality with a population less than 10,000,
which has at least six city blocks that are not located within flood zones V, VE, AO or AE, as identified
in Flood Insurance Rate Map issued by FEMA. CS/SB 1526 passed the Senate (36-2) and the House
(86-29) and is awaiting action by the Governor. (Cruz)
Workplace Heat Exposure Requirements (Oppose) – Passed

CS/CS/HB 433 (Esposito) and CS/SB 1492 (Trumbull) preempt the regulation of heat exposure
requirements to the state. The bills prohibit local governments from providing preference for
contractors on the basis of employment benefits offered by the contractor. The bills provide that
starting September 30, 2026, a political subdivision cannot require a minimum wage for certain
employees under the terms of a contract. CS/CS/HB 433 passed the House (74-36) and the Senate
(24-15) and is awaiting action by the Governor. (Wagoner)
Millage Rates (Oppose) – Failed
CS/CS/HB 1195 (Garrison) and CS/SB 1322 (Ingoglia) would require local government to have two-
thirds vote of the membership of the governing body to increase the millage rate. CS/HB 1195 was
amended to clarify that the two-thirds vote does not apply to existing millage rate increases that
require a three-fourths or unanimous vote of the governing body or voter approval in a referendum
under current law. CS/CS/HB 1195 was amended on the floor to clarify the language of a two-thirds
majority vote is required to increase the millage rate from the previous year’s millage rate. (Chapman)
Local Business Taxes (Oppose) – Failed
CS/CS/HB 609 (Botana) and SB 1144 (DiCeglie) would repeal local governments' ability to levy a
local business tax (LBT). CS/HB 609 was amended to no longer repeal the LBT. However, the
amount of revenue generated from the collection of the LBT is being capped using fiscal year 23/24
as the base year. Local governments may not generate more revenue in any year moving forward
above the base year of 23/24. Rates for the fees may be lowered, but not increased. CS/CS/HB 609
was amended to not apply to fiscally constrained counties or a municipality located in a fiscally
