1. CALL TO ORDER AND ROLL CALL
2. APPROVAL OF MINUTES
A. Approve minutes of the September 17, 2024 regular meeting of the Community
Development Board.
The minutes were approved.
3. OLD BUSINESS
There was no old business.
4. NEW BUSINESS
A. 1940 Beach Avenue ZVAR24-0013 (Nathan Bussey)
Request for a variance to deviate from measuring the height of the building from the
average calculated grade at 1940 Beach Avenue.
STAFF REPORT: Director Askew presented the information as explained in the staff
report. She also provided a PowerPoint presentation.
APPLICANT REPORT: Nathan Bussey introduced himself as the builder. He said
they are not trying to build a 4 -story mega mansion and block the view. Mr. Bussey said
they are just trying to stay on par with the neighborhood while working with a
challenging grade height.

BOARD DISCUSSION: Mr. Haynie said he didn't see any exceptional reasons why to
grant the variance. Mr. Beliles said without allowing the variance there could be a water
issue in the garage and he said the homes on either side seemed to be at grade with Beach
Avenue. He said the 12 -foot slope is pretty dramatic for this neighborhood.
MOTION. To APPROVE ZVAR24-0013 due to condition #1 that states "Exceptional
topographic conditions of or near the property".

Ms. Golombek agreed that if the variance wasn't approved there could be a water issue in the
applicant's garage. Chair Hansen pointed out another situation where the Board denied a
variance just north of this property and the City Commission overturned it in an appeal.

B. 299-1 Atlantic Boulevard UBEX24-0008 (Ed Malin/Angie's Subs Shop AB LLC)
Request for a use -by -exception to allow on -premises consumption of beer and wine
within the Central Business District at 299-1 Atlantic Boulevard.
STAFF REPORT:
Planner Genest presented the information as explained in the staff report. She also
provided a PowerPoint presentation.
APPLICANT REPORT: Ed Malin of Angie's Subs in Jacksonville Beach introduced
himself as the applicant. He said they want to build a small "sister" version of Angie's
Subs in Atlantic Beach. Chair asked if it will be a bar. Mr. Malin said it would not, he
said that currently beer and wine make up only 2% of their sales but anticipates it could
be a little more in Atlantic Beach. He said the menu will be the same. Chair Hansen
commended Mr. Malin for the help he has given to the hurricane victims in North
Carolina. Mr. Malin said it was a tiny bit of what the community did and said the
community really stepped up with 70,000 lbs. of supplies delivered to his parking lot.
Ms. Golombek asked about hours. Mr. Malin said he will be opening for lunch for
approximately 30-60 days and then they will add dinner. He said they might do breakfast
down the road.

5. REPORTS
Director Askew reported to the Board that the City Commission reviewed Chapter 24 on second
read and approved it with a couple of amendments. She said the Commission removed the
definition of artificial turf into Chapter 24. Director Askew said the Commission kept pools at
50% permeable. She said they added a definition of pervious paver to the Code. Director Askew
said they voted not to approve the section on the Commercial Corridor so it will revert back to
the current existing conditions.
Ms. Golombek asked if any language was added for maintenance of the interlocking pavers.
Director Askew said there was not. She said there was another change in the advertising section
for text changes to Chapter 24. It is changing the word "may" to "shall" reading "Staff shall use
other means to contact..." Chair Hansen said when it comes to pavers a lot of people are
concerned about maintenance and it was pointed out that even if you seal these it won't affect
the permeability. Ms. Golombek asked if it can be any artificial turf. Director Askew said there
were previous policies that will remain. She said that now that the section for mailing postcards
is removed from the Code, we can take smaller sections to work on changes.
Ms. Golombek asked if they had previously talked about streamlining some of the requests for
use -by -exceptions regarding on -premises consumption of beer and wine. Director Askew said
they had talked about it, but the Board decided to leave it in for now.

Chair Hansen opened the floor to public comment. There were no public comments.
7. ADJOURNMENT
There being no further discussion, Chair Hansen declared the meeting adjourned at 6:28 p.m.
