(1) Private regulated tree shall mean any tree on private property, except those species listed on the
Atlantic Beach Prohibited Species List, meeting the following conditions:

prior to or two (2) years subsequent to construction valued at over ten thousand dollars
($10,000.00);
b. Trees defined as legacy trees by this chapter;
c. A DBH of ten (10) inches or more, if zoned nonresidential.
Tree preservation. Existing onsite trees that are three (3) inches DBH or greater and which are
neither protected nor transplanted may be utilized as credit towards the assessed mitigation,
subject to the other conditions stated in this section, if preserved onsite.
A 10 inch and 5 inch oak were preserved on-site. Also, a 4 inch magnolia is on-site. This totals 19
inches of mitigation.
