Regarding tree #8, we will need record from JEA stating they removed the tree. We cannot accept letters from neighbors attesting to the removal by JEA. The chart below shows the ratios used when calculating mitigation. This property is classified as “New Construction” and will be charged with double mitigation. Upon receipt of mitigation calculations, you have the option to submit an appeal to the ESC Tree Subcommittee or a variance to the Community Development board. Below is information on both of these processes. APPEAL · Request to appeal must be filed in writing within 5 business days of receipt of mitigation calculations. · The ESC Tree Subcommittee will review the application for compliance with Chapter 23. For example, they will review how the mitigation calculations were applied, if the DBH of trees were properly assessed, species were properly identified, etc.) · The Tree Subcommittee will vote to approve the appeal (chapter 23 was not correctly assessed), deny the appeal (staff correctly applied chapter 23), or approve with conditions (certain parts of chapter 23 were applied correctly). VARIANCE · Chapter 23 Variance application must be submitted · Request will be placed on the regularly scheduled meeting date for the CDB (3rd Tuesday of each month) · The CDB must find that one of the following hardships are present to grant a variance. The property owner has the burden of proof to show that the application fits into one of the 4 criteria: A .Existing topographic elevation changes that would result in the likelihood that preserved or planted materials would not survive. b. Existing electrical lines or utility easements that prevent or restrict the preservation or planting of landscape materials. c. Barrier island or dune ecosystem planting conditions that cannot support certain hardwood species. d. Designs and plans that, to the greatest extent feasible, avoid encroachment upon preservation areas and/or trees. · The CDB will vote to approve the variance (find that criteria is met), deny the variance (criteria was not met), or approve with conditions (criteria was met, but additional conditions shall be applied). For example, you request to have no mitigation. The CDB finds that criteria is met, but place a condition that you must meet ½ of the required mitigation. Since this permit was submitted after trees were removed, this is considered after-the-fact and will require double permit fees ($125 X2) and double mitigation. The check included with the application was processed, so $125.00 is the remaining balance. Payment can be made over the phone via Visa or Master Card at 904 247 5837 or a check can be dropped off at City Hall (800 Seminole Rd). In addition, page 2 of the permit application was not signed. This page explains the permitting process. The submitted site plan did not include 2- 14” trees removed in the front yard and within the foot print of the house. These will be included in the mitigation calculations. What to expect moving forward: · Staff will complete the mitigation calculations based off the trees removed. · Staff will send the applicant calculations and mitigation details/requirements. · The applicant will send a proposed mitigation plan that accounts for all inches owed. · With receipt of a successful plan, staff will approve the permit. From reading online it appears that once the remediation plan is approved, we can obtain our C.O. and have 30 days to implement the plan and have it inspected by COAB. Is that correct? In this case, the code does not allow staff to deviate on the required mitigation. As Abrielle mentioned below you do have two options available: 1. Apply for a variance to reduce the required mitigation (Section 23-25 (b)of the code). This is a public hearing and is heard before the Community Development Board. 2. Appeal the administration interpretation of the code (Section 23-25 (a)(1). Technically, this process does not grant relief from the code it deals with staff’s administration of the code. If you want to move forward with either option we’ll be happy to help you out. The permit was passed by zoning because a Tree and Vegetation Affidavit was submitted by you certifying that no trees were removed or will be removed. Please also refer to the emails with Brian Broedell on February 2, 2021 confirming a permit is needed for trees that “will be or were removed”. You are in violation of this affidavit and Chapter 23, therefore double mitigation and permit fees are assessed with the after the fact permit. It does not matter if the trees were removed by the builders or a separate entity. Trees were removed without a permit and approval, therefore this is an after the fact permit and meeting the requirements is the responsibility of the property owner. You have the option to submit a variance application to the CDB or appeal to the ESC tree subcommittee. I provided Robert with information on these processes, but please let me know if you would like more information. In this, it is stated that no trees were removed or were being removed from the property. Additionally, the builders submitted a tree and vegetation affidavit (attached) which affirms no regulated trees will be removed from the property. Any regulated trees planned for removal requires a tree removal permit application to be submitted and approved prior to tree removal. That was not done for the palms removed from the property, therefore the tree removal permit application is after-the-fact for all trees. Section 23-51(d) “Sanctions for failure to obtain a permit” enforces a double application fee and double mitigation assessment for after the fact permits. The property is classified as new construction. As shown below, the normal rate for trees that are “equal to or greater than 14” and less than 30”” is 1:2 (inches removed : inches owed). Per the normal rate, a 14” tree = 28” of mitigation owed. Since this is an after the fact permit, mitigation ratios are doubled, and the rate for removal of a 14” tree is 1:4. Section 23-33(f)(2) states “Incentive credit shall be granted for the use of Designated Maritime Species when replacing regulated trees that are not a Designated Maritime Species. The incentive credit is equal to two (2) times the normal replacement credit”. A 5” live oak shall receive double credit when replacing a palm, therefore you received 20” of credit for planting 2- 5” live oaks.
