A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA,
ADOPTING REGULATIONS FOR PAID BASEBALL AND SOFTBALL
INSTRUCTORS CONDUCTING BUSINESS IN CITY PARKS; PROVIDING
FOR AUTHORIZATION FOR THE CITY MANAGER TO MODIFY THESE
REGULATIONS; PROVIDING FOR CONFLICTS; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Atlantic Beach desires to establish regulations for baseball and softball
instructors conducting business in City parks; and
WHEREAS, this Resolution establishing baseball and softball instructor regulations (Exhibit A)
as a matter of City policy seeks to balance numerous factors: Protecting the City's assets; protecting
students; safety and injury prevention; promoting qualified instruction; and consumer confidence; and
WHEREAS, these regulations provide the City a framework document that identifies procedures
used in permitting baseball and softball instructors to conduct business in City parks.
NOW THEREFORE, be it resolved by the City Commission of the City of Atlantic Beach as
follows:
SECTION 1. The City Commission hereby adopts regulations for baseball and softball
instructors conducting business in City parks (Exhibit A).
SECTION 2. These regulations provide the City a framework document that identifies
procedures used in permitting baseball and softball professionals to conduct business in City parks, and
the City Manager is hereby authorized to modify these regulations.
SECTION 3. All Resolutions or parts of Resolutions in conflict herewith are hereby repealed
to the extent of such conflict.
SECTION 4. This Resolution shall take effect immediately upon its passage and adoption.

Professional Baseball and Softball Instructor Regulations
Professionals who charge for instruction may use City of Atlantic Beach baseball and softball
facilities for that purpose under these guidelines. Unregistered instructors may be fined up to
$500.
1. An active City registration is required. The registration must be posted for public display,
and the instructor must post a City -issued snipe/yard sign outside of the area being
utilized.
2. The registration fee is $225 plus tax quarterly. Proof of liability insurance satisfactory to
the City's risk management guidelines is required.
3. Instructors must pass a City level 2 background check that may include criminal, driving,
reference and prior employment checks. Instructors also must complete the Sexual Abuse
Awareness Training course through Abuse Prevention Systems.
4. Professionals who charge for instructions must sign a hold -harmless agreement and must
have adult students and parents/guardians of minor students sign hold -harmless
agreements releasing the City from liability. Copies of those agreements for the
registration period must be submitted to City staff upon renewing registration.
5. No more than two half -batting cages may be occupied for paid instruction at one time;
thus, at least four batting cages must always remain open for public use.
6. There is no reservation of facilities; registration does not guarantee availability of facilities.
Instruction may only occur during times delineated by the Atlantic Beach Athletic
Association Board of Directors.
7. These regulations are subject to update.
8. The City reserves the absolute right to deny or revoke a baseball and softball instructor
registration for any reason deemed to be in the best interest of public safety, welfare, or
the orderly operation of City facilities.
