Street sweeping is required to fulfill the requirements of the City's Municipal Separate Storm Sewer (MS4) Permit through the Florida Department of Environmental Protection (FDEP); and WHEREAS, throughout the term of the contract with SCA, Public Works staff have documented repeated instances of missed or incomplete sweeps, failure to provide required documentation, and billing errors. Public Works staff have met with SCA representatives on multiple occasions to discuss these deficiencies and provide the contractor with opportunities to correct them. Despite these efforts, the contractor has failed to achieve and maintain compliance with the terms and performance requirements of the contract. As a result, staff no longer have confidence in the contractor's ability to consistently meet the City's service expectations and contractual obligations; and WHEREAS, Public Works staff propose moving street sweeping services in-house and procuring a new Elgin RegenX Regenerative Air Vacuum Street Sweeper via a municipal lease -to -own program. This transition will dramatically improve roadway coverage, enhance localized quality control, and keep the City in strict compliance with state environmental mandates; and WHEREAS, Environmental Products Group, under Sourcewell Contract #093021-ELG, can provide the lease -purchased street sweeping truck with an estimated equipment delivery date by November 4, 2026 for $58,699.54 annually for seven years; and WHEREAS, the City currently pays $86,713.20 annually for contracted sweeping. Transitioning to an in-house model will require entering into a 7 -year municipal lease -to -own agreement at an annual cost of $58,699.54 starting in FY2026-2027. This option serves as the closest immediate match to current contract spending and saves $28,013.66 annually in capital costs; and WHEREAS, the internal Public Works budget will absorb ongoing operational overhead variables, including operator labor/benefits, fuel, potential night -shift overtime, and certified waste disposal fees; and NOW THEREFORE, be it resolved by the City Commission of the City of Atlantic Beach as follows: SECTION 1. The City Commission hereby approves the contract with Environmental Products Group to lease -purchase an Elgin RegenX Regenerative Air Vacuum Street Sweeper; Res.
