08-17-93 v MINUTES OF THE COMMUNITY DEVELOPMENT BOARD OF THE CITY OF ATLANTIC BEACH, FLORIDA AUGUST 17 , 1993 7 :00 P .M. CITY HALL PRESENT Gregg McCaulie Ruth Gregg Robert Frohwein Pat Pillmore Mary Walker AND Alan Jensen, City Attorney George Worley , II , CD Director Pat Harris , Recording Secretary ABSENT Mark McGowan Don Wolfson Chairman Gregg McCaulie, called the meeting to order and asked for approval of the minutes from the meeting of July 20 , 1993 . Upon motion duly made and seconded the minutes were approved. OLD BUSINESS : I . Application for Variance filed by Robert and Leona Lowther to enclose a porch which encroaches the rear yard setback at property located at 251 Ocean Forest Drive North. This application was remanded back to the Board by the City Commission after an appeal of the previous denial by the Board in April . Mr . Lowther introduced himself and stated that his wife had an arthritic condition and the proposed construction would allow his wife better mobility around the house . After discussion, Mrs . Pillmore moved to deny the application. The motion was seconded by Mr . Frohwein and the variance was unanimously denied. II . Application for Use-by-Exception filed by Pan Am Mini Storage, Inc . to allow outside, on-site storage of vehicles at property located at 2383 Mayport Road. Terence P . Kane introduced himself to the board and explained that the City Commission suggested he file an application for a use-by- exception instead of change in zoning which was originally requested. After discussion, Mrs . Gregg moved to defer the application until the next meeting to allow the board time to review further documentation. The motion was seconded by the Chairman and passed unanimously . NEW BUSINESS I . Application for Variance filed by Annabelle P . Wallace to construct an aluminum carport which will encroach the side yard setback at property located at 221 Seminole Road. The applicant ' s contractor , Floyd Cardin, introduced himself to the board and presented pictures to the board showing the residence in which the variance was applied for and the residence next door which had previously been granted a similar variance . He stated that Mrs . Wallace had consented to the variance. After discussion, Mr . Frohwein moved to deny the application, Mrs . Walker seconded the motion and the variance was denied by a vote of 3 - 2 . II . Application for Variance filed by Jerry Dorsch to construct an addition to the Tappin Book Store which is a non-conforming structure located at 705 Seminole Road. Mr . Dorsch introduced himself to the Board and explained that the variance was needed to enlarge the storage and indexing section of the bookstore . After discussion, Mr . Frohwein moved to grant the variance. The motion was seconded by the Chairman and unanimously passed. III . Application for Use-by-Exception filed by Ted Barrett to allow a home occupation license at his property located at 377 7th Street . Mr . Barrett introduced himself to the Board and explained that the use-by-exception was requested to allow him to conduct his contracting business at his residence and stated that there would be no outside storage or parking of equipment or supplies . After discussion, Mrs . Gregg moved to recommend to the City Commission that the use-by-exception be granted. Mr . Frohwein seconded the motion which passed unanimously . Mr . Worley mentioned to the board that due to a possible runoff election the meeting in October may need to be rescheduled.
