11-16-93 v MINUTES OF THE COMMUNITY DEVELOPMENT BOARD OF THE CITY OF ATLANTIC BEACH , FLORIDA NOVEMBER 16 , 1993 7 : 00 P.M. CITY HALL PRESENT Don Wolfson Ruth Gregg Robert Frohwein Mark McGowan Mary Walker Sharette Simpkins AND Alan Jensen, City Attorney George Worley, II , CD Director Pat Harris , Recording Secretary ABSENT Pat Pillmore Chairman Don Wolfson , called the meeting to order and asked for approval of the minutes from the meeting of October 19, 1993 . Upon motion duly made and seconded the minutes were approved. NEW BUSINESS : I . Application for Variance filed by Chris Hionides to construct a second floor addition to a nonconforming structure at property located at 47 11th Street . Mr . Hionides introduced himself to the board and explained that the variance was requested to allow the construction of a second floor addition to an existing nonconforming garage to create a secondary dwelling for use by family members and guests . After discussion of the age and the proposed size of the building , Mrs . Gregg moved to grant the variance and Mr . Frohwein seconded the motion. It was noted that the Section of Code from which the variance was sought should be Section 24-86(a) rather than Section 24-105(e) ( 2 ) & ( 3) reflected on the application. After discussion, Mrs . Gregg amended her motion to reflect the appropriate Section and the variance was approved by a vote of 6 - 1 . DISCUSSION ITEM: Mr . Worley presented two definitions of the term "hardship" to the board. One of the definitions was from Black' s Law Dictionary and the second was condensed to more simplified language . He asked the board to review the definitions and present their ideas at the next regularly scheduled meeting . Mr . Worley stated that City Attorney Alan Jensen also had a definition of "hardship" and a copy of this definition would be furnished to the members as soon as it was received. There being no further business to come before the board on motion duly made the meeting was adjourned. 411 SIGNED: ATTEST(, //\JCt S r ACTION OF THE COMMUNITY DEVELOPMENT BOARD OF THE CITY OF ATLANTIC BEACH REQUEST FOR VARIANCE TO PROVISIONS OF CHAPTER 24 OF THE CODE OF ORDINANCES OF THE CITY OF ATLANTIC BEACH REQUESTED: Structural addition to an existing nonconforming building at 631 Beach Avenue to provide an outside stair to second floor level . Building has a 2 . 2 foot rear setback and a 3 . 4 north side setback. WHEREAS, Thomas and Donnalea Goelz , owners of above described property, have applied to the Community Development Board for a Variance to the zoning regulations to allow an addition to an existing nonconforming building , and WHEREAS , the Community Development Board has considered the application and rendered a decision, and WHEREAS , It is the finding of the Community Development Board that the granting of such Variance will not be contrary to the public interest and owing to special conditions , a literal enforcement of the provisions of the zoning code will result in unnecessary and undue hardship not of the applicants creation, NOW THEREFORE, BE IT ORDAINED BY THE COMMUNITY DEVELOPMENT BOARD OF THE CITY OF ATLANTIC BEACH THAT: 1 . The requested Variance is granted subject to provisions and conditions described below. 2 . The owner of the real property described below is hereby granted a zoning Variance from the provisions of Chapter 24 , Section 24-85( 1 ) of the Code of Ordinances of the City of Atlantic Beach, specifically to allow construction of an exterior open stair to the north side of the nonconforming garage apartment within the existing 3 . 4 foot setback. This Variance shall run with the title of the real property described below. 3 . Owner and property description. The owners of the property to which this Variance is granted are Thomas and Donnalea Goelz . The property to which this Variance is granted is described as : Lot 2 with the north 1/2 of lots 3 and 4 , Stockton Broome' s Replat of Lots 1 and 2 , Block 31 , Atlantic Beach Subdivision, P.B 6 , Page 43 . 4 .
