AGENDA ITEM: Request for aUse-by-Exception for Heavy Automotive Repair within the Light
Industrial and Warehousing (ILW) Zoning District to allow McCormick Auto
Body to re-locate from 1198 Mayport Road (within the Commercial General
district) to a previously developed site with all business activity to be contained
within the existing enclosed building.

BACKGROUND: This Use-by-Exception is requested to allow McCormick Auto Body to relocate
from the West Plaza Center at 1198 Mayport Road to a ILW zoned site, which has been previously
used for industrial uses. AUse-by-Exception was approved in 2002 to allow this business to operate
at its current location, which is within the Commercial General Zoning District at the southwest corner
of West Plaza and Mayport Road. Mr. McCormick has stated that his business has outgrown the
current location, and the existing 20,000 square foot building at the Stewart Street site will provide
adequate enclosed work-space. No additional construction is proposed.
While there have been no significant problems associated with the current location, Staff finds the
'"~ proposed new location to be more appropriate for this type of use. (The West Plaza Center was
originally approved as a commercial office park.) This request is also consistent with recent
amendments to the Commercial General district regulations. Heavy Automotive Repair is no longer
permitted within CG Districts as a possible Use-by-Exception.
The Community Development Board considered this application at the November 19th meeting and
~" recommended approval with the following conditions:
• The Stewart Street frontage shall be landscaped with hedge type .shrubs extending from the
existing driveway to the east side property line.
• Business hours shall not exceed 7:OOam to 6:OOpm, Monday through Saturday.
• Any additional lighting, which may be installed, shall be shielded and directed such that
~„ properties on the north side of Stewart Street are not illuminated.
BUDGET: None.
RECOMMENDATION: Motion to approve UBE-2006-06, with suggested conditions, as set forth
herein, and as recommended by the Community Development Board.

allow McCormick Auto Body to re-locate from 1198 Mayport Road (Commercial General

Ms. Doerr summarized the request noting that this was an existing developed site in the
industrial zoning district, and that there is no construction planned, and also that this use was no
longer a permitted Use-by-Exception in the CG zoning district, where the business is now
located. Paul McCormick, 116 Jardemeir, Jacksonville, Florida introduced himself as the owner
of the business and reviewed his request for aUse-by-Exception. Mr. McCormick stated his
business has outgrown the current Mayport Road location, and he needs a larger space for his
operation. The existing 20,000 square feet building will provide plenty of room for his business.
Ms. Woods inquired if Mr. McCormick was going to purchase the property and asked him to
define his use. Mr. McCormick defined his business as auto-body repairs and painting. He
stated that under the current contract he would be leasing the property for five years. Ms. Woods
asked about the travel route that would be used to access this location. Her concern is the
moving of vehicles through residential areas. Mr. McCormick indicated the route to the property
would be Levy to Main to Stewart or Dutton Island and would not be through residential
neighborhoods and that his business generated very little traffic. Mr. Tim Shea of Jacksonville
Beach introduced himself as the property owner and provided background information on the
location. The building was originally built in 1983 for the Navy who occupied it in 1984. The
Navy vacated the building about one and half years ago due to relocating its operations on the
base for security reasons. This property is in an industrial area, and the building was built prior
to the Stewart Street duplexes that are near this location. The new business is required to have
permits and inspections from the City, the Fire Department and FDEP. Mr. McCormick has all
those permits and inspections in his current location and has always run his business in
compliance with regulations. Mr. Shea stated he felt his location for this business is better than
the current location on Mayport Road where the City is trying to eliminate auto types of uses.
Chairman Jacobson requested the hours of operation and type of noise his Pquipment makes.
Mr. McCormick stated his hours were Sam-Spm Monday thru Friday and occasionally on
Saturdays. The types of equipment used are compressors, paint machines, and hammers to
reshape fenders. Mr. Shea stated that the lease contract requires all work to be done inside the
building. Ms. Woods addressed other Board members indicating she would like to require that
the current building meet the landscaping code as part of granting the Use-by-Exception. Mr.
Shea noted that there are trees and shrubs on the site now, which will remain as they are, and
expressed concern to Ms. Woods over this proposed requirement because there is nowhere to
plant trees and landscape islands that would not be in the retention area or City right-of--way. He
felt this was an undue burden to require him to meet the complete landscaping code but agreed to
plant hedges along the Stewart Street frontage where there is not driveway. Ms. Woods asked
for clarification on planting in the City's right-of way. Ms. Doerr advised that planting in the
City's right-of--way may be done as long as there are no underground utilities and with
permission from the City. Chairman Jacobson stated that he felt Ms. Woods concern was the
issue of an "ugly building" that landscaping would not shield. Ms. Woods indicated the

in the landscaping code, and she would like to see it required as part of granting the Use-by-
Exception. No other Board member supported this as a requirement. Mr. MacInnes raised
~* concerns regarding the possibility of wreckers pulling into the location all hours of the night
since most of the work done is insurance repairs. Mr. McCormick responded that vehicles could
be dropped off only during normal business hours. Ms. Woods recommended that the
""• installation of trees be required along Stewart Street. Chairman Jacobson indicated that requiring
trees be planted is pushing the envelope in this case, and that planting of a hedge would do more
to screen the building.
A motion was made by Mr. Burkhart and seconded by Mr. MacInnes to recommend
approval for aUse-by-Exception to permit Heavy Automotive Repair within the Light
Industrial and Warehousing (ILW) Zoning District for McCormick Auto Body to occupy a
previously developed site at 112 Stewart Street with all business activity to be contained
within the existing enclosed building, subject to the following conditions:
• The Stewart Street frontage shall be landscaped with hedge type shrubs extending
from the existing driveway to the east side property line.
• Business hours shall not exceed 7:OOam to 6:OOpm, Monday through Saturday.
• Any additional lighting, which may be installed, shall be shielded and directed such
that properties on the north side of Stewart Street are not illuminated.
The motion passed by a 5:1 vote with Ms. Woods dissenting.

The review of an application for aUse-by-Exception shall consider the following items. Please
address each of the following as applicable to your specific application.
1. Ingress and egress to property and proposed Structures thereon with particular reference to vehicular and
pedestrian safety and convenience, traffic flow and control and access in case of fire or catastrophe.
The Property has excellent ingress and egress via Levy Road to Main Street to Stewart Street and from
Stewart Street to Mayport Road via either Main Street or Dutton Island Drive.
2. Parking and Loading Spaces, where required, with particular attention to the items in (1) above.
The Property has more than sufficient parking and loading space. (See Site Plan for detail).
3, The potential for any adverse impacts to adjoining properties and properkies generally in the area resulting
from excessive noise, glare and lighting, odor, traffic and similar characteristics of the Use-by-Exception
being requested.
The proposed use would not have any adverse impacts on adjoining properties which include a wholesale
nursery and a cabinet manufacturer. All auto body repair work and storage will performed inside the
building and out ofsight.
4. Refuse, trash collection and service areas, with particular reference to items (1) and (2) above;
Dumpster will be located on site so as to provide easy access for collection vehicle.
5. Utilities, with reference to locations, availability and compatibility;
The Property has been continuously serviced by utilities for more than 20 years.
6. If adjacent uses are different types of uses, describe type of screening and buffering that will be provided
between your use and the adjacent use.
Adjacent uses include wholesale nursery and a warehouse complex that houses a cabinet manufacturer
along with other industrial type of uses. Existing vegetation and trees provide buffer/screening.
7. Signs, if any, and proposed exterior lighting, with reference to glare, traffic safety, economic effects and
compatibility and harmony with properties in the District; (See Signs and Advertising, Chapter 17.)
McCormick Auto Body will comply with sign ordinances and the intended use will require no additional
exterior lighting than is currently in place at the existing structure.
8. Required Yards and other Open Space. Show building setbacks and areas of open space on site plan.
9. General compatibility with adjacent properties and other property in the surrounding Zoning District as
well as consistency with applicable provisions of the Comprehensive Plan.
The Property is located adjacent to Mayport Industrial Park, an Industrial Light Warehouse complex, on Stewart
Street. The intended use of the property as an auto body repair location is compatible with the other industrial type
uses in the surrounding area.

Other information you may wish to provide:
McCormick Auto Body will be moving from a highly visible but much smaller facility located on the
corner of Mayport Road and Plaza to a much more compatible location on Stewart Street, adjacent to
Mayport Industrial Parr The 20, D00 square foot building will give Mr. McCormick 400% more space so
that all of their repair and storage can be located inside the building and out of sight. All paint and repair
activities are stringently regulated by the Environmental Protection Agency so as to ensure public safety.
McCormick Auto Body has been in operation at its Mayport Road location for over five years and has
enjoyed a stellar reputation for running a quality business. This move provides them the space they need
to grow their business and at the same time it helps in the effort to upgrade the look along the Mayport
Road corridor.
