AGENDA ITEM: Shangri La Sewer Improvements and Agreement with Beaches Habitat

~* BACKGROUND: This is a project to eliminate an existing lift station on Shangri La Drive in
Jacksonville by deepening and extending a gravity sewer. The project was originally bid as an
additive alternate to a large sewer project several years ago, but deleted due to insufficient budget.
Removing the old lift station will eliminate future costs and liabilities of its operation, maintenance
and repair. Engineers recommended the removal of the lift station in 2001, noting an approximate 10-
'~" year payback with the reduction in operation and maintenance. With the increased costs for
equipment and electrical over the last six years and the lower cost for the project, this payback would
be even sooner. Staff also obtained the 2006 costs for operating the station of approximately
$15,000, which would be about aseven-year payback.
~, Part of the project will be completed by Beaches Habitat's contractor, DNS Contracting. Beaches
Habitat will be building new homes on the north end of Shangri La Drive and their contractor will be
installing gravity sewer to serve the homes. In order to accommodate additional gravity flow when
~,,, the City's lift station is removed, Habitat will need to install a larger, deeper line and deeper
manholes.
Habitat's contractor provided bids with and without the larger, deeper sewer. The additional amount
required for Atlantic Beach to eliminate the Shangri La lift station is $16,476.92. Habitat is willing to
enter an agreement in which they would pay their contractor for the complete project and be
reimbursed by the City at job completion. Habitat is on the fast track for their project, and wishes to
begin house construction in March 2007.
The south portion of the project includes conversion of the existing lift station to a manhole and
installation of gravity sewer. The City requested a cost to complete the work from our annual Utility
Contractor, Gruhn May, Inc. Gruhn May's cost for the south portion of the project is $87,102.30.
The prices from both Habitat's contractor and the City's annual contractor are extremely reasonable.
As a comparison, the chart below shows the current costs compared with the low bid received when
the project was advertised in 2001. (We adjusted the 2001 low bid to include two items--lining an
existing manhole and converting the existing lift station to a manhole that were not included in the
original bid-an added $9,245).

BUDGET: A total of $365,400 was budgeted for sewer system improvements in the Sewer Fund
under account number 410-5506-535-6300.
RECOMMENDATION:
1. Approve an agreement with Habitat for Humanity (Beaches Habitat) to reimburse them for
$16,476.92 for additional costs for construction of sewer improvements at the north portion of
the project.
2. Authorize the City's Annual Utility Contractor, Gruhn May, Inc. to complete the sewer
construction for the south portion of the project in the amount of $87,102.30.

CONTRACT BETWEEN
THE
CITY OF ATLANTIC BEACH
AND
~„ HABITAT FOR HUMANITY OF THE JACKSONVILLE BEACHES, INC.
THIS AGREEMENT, made and entered in duplicate as of this _ day of February,
2007, by and between the CITY OF ATLANTIC BEACH, FLORIDA, a municipal
corporation, hereafter referred to as the "City", and HABITAT FOR HUMANITY OF THE
JACKSONVILLE BEACHES, INC., a Florida nonprofit corporation, hereafter referred to as
"Habitat".
WITNESSETH:
WHEREAS, Habitat is the owner of the parcel of land located in Duval County, Florida
described on ExJiibit "A"attached hereto and made a part hereof (the "Property"); and
WHEREAS, Habitat has planned a new subdivision on the Property to be known as
Shangri La Subdivision, hereafter referred to as the "Project", as shown on the Habitat's Utility
Plan prepared by Connelly & Wicker, Inc. Consulting Engineers; and
WHEREAS, the Project requires for certain sewer infrastructure improvements in the
right of way of Shangri La Drive; and
WHEREAS, in conjunction with the Project, the City intends to extend Habitat's
proposed new gravity sewer main in order to eliminate an existing lift station at 2891 SR AIA;
and
WHEREAS, in order to eliminate said lift station, Habitat's sewer main and manholes
must be constructed four (4) feet deeper than planned resulting in extra costs to Habitat; and
~' WHEREAS, in connection with the extension of the sewer main larger pipes will be used
and as a result the City has required Habitat to line the existing manhole at Gavagan and Shangri
La Drive; and
WHEREAS, the City and Habitat have agreed on performance of the work how the costs
of such improvements are to be paid; and
WHEREAS, it is in the best interest of the City and Habitat to enter into a special
contract for this purpose;
NOW, THEREFORE, in consideration of the mutual premises and covenants, the parties
agree as follows:

ARTICLE I
S_c_ope of Service And Funding
1.0 The City agrees to construct and pay for the extended portion of the sewer main in
Shang,ri La Drive and elimination of the lift station at 2691 SR A 1 A.

1.1 Habitat agrees to construct and pay for sewer infrastructure work required for the

1.4 Habitat agrees to provide the City copies of bid documents from its contractor,
DNS Contracting.
1.5 The method of payment shall be according to the financial procedures established
by the City.
ARTICLE II
Indemnification
2.0 Habitat shall act as an independent contractor, and not as an employee of the City.
Habitat shall be liable, and agrees to be liable for, and shall indemnify, defend and hold the City
harmless from all claims, suits, judgments, or damages arising from the services required by this
Contract to the extent allowable under the Florida law.
ARTICLE III
Contract Period and Termination
3.0 This Contract shall be effective for the period beginning the day and year first
above written and shall terminate upon Habitat's receipt of reimbursement from the City, unless
canceled sooner with or without cause, by either party by giving thirty (30) days prior written
notice of such cancellation.
ARTICLE IV
Transfer of Utility Lines
4.0 Upon completion of the Project, Habitat shall transfer title to the sewer lines for
the Property to the City, and the City agrees to accept ownership and maintenance of such lines.
