Dezmond Waters III Call to Order/Pledge Mayor Meserve called the meeting to order at 7:15 p.m. The Invocation given by Commissioner Parsons, was followed by the Pledge of Allegiance to the Flag. Approval of Minutes 1. Approval of the Minutes of the Regular Meeting of January 12, 2004 Commissioner Waters stated that he would like the comments made by Chief Thompson relative to accident prevention in Town Center included under the last item on Page 10 of the minutes. Motion: Approve Minutes of the Regular Meeting of January 12, 2004 as amended to include comments by Chief Thompson under the last item on Page 10 of the minutes. Presentation relative to Bike Paths Utility Director Kaluzniak reported the city had budgeted $217,650 from the half-cent sales tax for the bike path project. She indicated that the path would be designed in-house and would run on the west side of Seminole Road from Garden Lane to the end of Seminole, and on the north side of Plaza from Parkside Road to Mayport Road. It was further reported that if funds were available, an additive alternate to the project would be to January 26, 2004 REGULAR COMMISSION MEETING Page 2 continue the path on the south side of West Plaza, from Mayport Road to Orchid Street. Commissioner Simmons inquired as to the width of the bike path. Utility Director Kaluzniak stated it would be 5' in width. Commissioner Beaver expressed concern for the future health of trees near the bike path and said it would be better to cut the roots than pull them. He then inquired as to who would oversee the project. Ms. Kaluzniak indicated that GAI would oversee the project, and she would make his concerns known at the pre-bid meeting. Commissioner Waters stated that past experience demonstrated that if the roots were disturbed on pine trees, they died within five years. Commissioner Beaver agreed, and suggested it might be better to remove any pine trees adjacent to the path and replant after completion of the project. J.P. Marchioli of 414 Sherry Drive felt t hat t he b ike p ath s hould b e 6' wide. He also commented on the annoying noises on Sherry Drive caused when cars drive on the reflective plastic street markers installed on the street or across the decorative crosswalks. He also requested that speed humps be "` installed on Sherry Drive, if the Commissioners approved their installation for traffic calming in the 300 block of Plaza (Item 3B). 3. Unfinished Business from Previous Meeting City Manager's A. City Manager's Follow-Up Report Follow-Up Report City Manager Hanson commented on each item of his written report, which is attached and made part of this official record as Attachment A. 5th Street and Sherry Drive Sidewalk City Manager Hanson reported that the sidewalk project was delayed because he was unable to obtain an appraisal of the property. Mayor Meserve stated that he had met with the property owner several times to discuss the purchase of a small piece of property and they could not come to a conclusion concerning the transaction. He suggested that the city forego the appraisal and reconfigure the corner to allow placement of the sidewalk entirely on the city right-of--way. f January 26, 2004 REGULAR COMMISSION MEETING Page 3 Selva Marina Medians Commissioner Waters inquired if city water was available in the medians and Utility Director Kaluzniak stated she was not sure if the water lines ran the length of the medians. Commissioner Parsons suggested informing the residents of the Selva Marina area of the city's beautification matching grant program. Commissioner Simmons suggested also informing residents of the watering schedule for trees planted under the city's Adopt A Tree Program. She noted that an oak tree planted by the JEA had died due to lack of water. Mayor Meserve thought the median area could become a beautiful park-like setting and suggested a meandering bike/pedestrian path be built in the median to dissuade traffic from using it as a crossover. He felt this could be discussed during strategic planning. Traffic Calming for the B. Commissioner Waters suggested narrowing the roadway and enlarging the median park. He thought this would eliminate the need for speed bumps and noise associated with them. Commissioner Beaver stated that the decision to install speed bumps on Plaza was made years ago. He reported that all but one of the citizens who contacted him favored replacing the speed bumps, and he was in favor of constructing speed humps. Commissioner Simmons reported that everyone who contacted her opposed speed bumps/humps. She felt that there were more serious speeding problems on Ocean Boulevard, East Coast Drive and Sherry Drive and if speed bumps were approved for Plaza, citizens living on the other streets would also want them. She indicated that she favored no more than one speed hump on each side of Plaza. Commissioner Parsons stated that he received more calls opposing the speed bumps than in favor of them. He concurred with the suggestion made by Commissioner Waters. January 26, 2004 REGULAR COMMISSION MEETING Page 4 ,, Mayor Meserve pointed out that if the park was enlarged, it would eliminate parking for the residents and he thought a public hearing should be held. Discussion of the design and cost of a speed hump and extension of the landscaping ensued. City Manager Hanson explained the speed hump design and stated they could be designed in-house. No action was taken. It was the consensus of the Commission that a design for the speed hump and extension of landscaping, with estimated costs, be brought back for review before a final decision is made. Consent Agenda 4. Consent Agenda Commissioner Parsons requested that Item C be removed from the Consent Agenda for discussion. A. Extend the contract with Robert Lawrence Construction for concrete repairs (Bid No. 0102-10)(City Manager) B. He felt the repairs left too many bumps or sunken places in the streets. Utility Director Kaluzniak explained problems relating to sub-bases and soil compaction. Code Enforcement Board Report Curtis Sanders, Chair of the Code Enforcement Board, presented a comprehensive report on the duties and responsibilities of the Code Enforcement Board. A copy of Mr. Sander's report is attached and made part of this official record as Attachment C. Statistical data relative to Florida cities that license and perform annual inspections of rental properties was also presented. Mr. Sanders recommended that the Commission consider licensing and requiring regularly scheduled inspections of rental properties. He recommended that the City Commission schedule a workshop to discuss this issue. Commissioner Waters thanked Mr. Sanders for his report and inquired as to how he envisioned implementation of the inspection program. Mr. Sanders responded that the City of Gainesville used a lottery system for inspections. He stated he would support appointing a committee to look into regulation of rental properties. ,"' Mayor Meserve stated that many owner occupied homes, for various reasons, w ere in poor condition. He f elt this type of inspection was excessive. He stated that this request was not an agenda item, but the Commission could bring it back for action, if they wished. Resolutions 6. January 26.2004 REGULAR COMMISSION MEETING Page 8 • Reported that "Skate Into the Future," Oceanside Rotary Club's fundraiser for the skateboard park, would be held on Saturday, February 7th at Jack Russell Park. • Reported that representatives of the three beach cities, the Corps of En~ineers and Council Member Art Graham had met on January 20t c oncerning b each r enourishment, a nd i t a ppeared t here w ould be sufficient good sand from offshore sites for the 2005 project. Concern was expressed that federal funding may not be available for the project due to the size of the national deficit. • Reported that the work of the Town Center Parking Committee was nearing completion and a joint meeting of the elected officials in Neptune and Atlantic Beach would be scheduled in the near future to present the report. In addition to the written report, City Manager Hanson reported on the following items: • Reported that 539 citizens took advantage of the weekend household hazardous waste collection at the City Hall parking lot. • Reported that a workshop meeting with the Commission and the Community Development Board to discuss Comprehensive Plan amendments was tentatively scheduled for 5:00 p.m. on February Stn • Reported that the Town Center project had been delayed due to problems with relocating the historic palm trees. BellSouth has notified the city that the trees cannot be removed due to their location near a major telephone line conduit. Early Piety, the city's arborist, recommended cutting the trees down, grinding out the stumps and replacing them, but because of their designation as historic trees, the Tree Board must approve their destruction Discussion ensued and it was the consensus of the Commission that this matter should be considered an emergency and an amended agenda drafted for the meeting on the 28th. Reports and/or requests from City Commissioners and City City Commissioners Attorney City Attorney Commissioner Waters • Supported the suggestion expressed by Major Jack Quinn in a recent letter that checks issued to assist individuals with payment of their utility bills should be issued to the utility, not the individual. • Reported that a letter requesting matching funding from the city would be coming from citizens working on a beautification project on 10`" Street. • Felt the city should move ahead with the entire City Hall expansion and remodeling project. Commissioner Parsons • Reported that the Public Art Fact Finding Committee was in the process of incorporating as a 501(c)(3) corporation and was planning to hold a social event in April. A logo for the committee is being designed. Commissioner Beaver • Requested that staff check to see if the recently modified signs located at the Advanced Auto Parts on Atlantic Boulevard and the Save-A-Ton station on Mayport Road complied with the new sign ordinance. • Commented that the police cars being parked at various locations in the city provided an effective means for speed reduction. • Commented that he had listened to the tapes of the Comprehensive Plan Workshop Meeting he missed, and wondered if the zoning in the Old Atlantic Beach area could be changed to preserve its character. • Indicated that he had received inquiries concerning designating hours to allow dogs to run on the beach without leashes and requested that this be included on the next agenda for discussion. January 26, 2004 REGULAR COMMISSION MEETING Paee 10 .• Commissioner Simmons • Requested that action be taken to change the area known as the "Core City" to "Old Atlantic Beach." • Inquired if sidewalks constructed from asphalt would be more durable and less expensive than those constructed with concrete. • Stated that she was aware of some problems with rental properties in her area and requested further discussion on this issue by the City Commission. Mayor Meserve • Indicated he did not support inspections of rental properties. • As the beaches representative to the Superbowl Committee, the Mayor stated it was uncertain if an air show would be held in conjunction with the 2005 Superbowl. A concern was expressed about the safety of the construction site and the ability of kids to get in. The owner of the site has advised that the delay was caused by a requirement from the State Department of Environmental Protection to resubmit the plans, and may take as long as four for months before fmal approval is received. As a result of an eazlier complaint about this site, the owner cleaned the litter, cut the weeds, posted the azea for no trespassing and secured the interior. Because of this most recent complaint, the owner has installed asix-foot security fence in front of the ,,, property until the project is restarted Selva Marina Medians; A complaint was received at the last commission meeting that people had been driving through the medians along Selva Mazina Drive leaving ruts and otherwise destroying the landscaping. Several alternatives exist to reduce or eliminate the problems. One would be the installation of curbs around the medians, although that option is estimated to cost a considerable amount of money. A second option would be to plant trees in the medians so that no traffic could drive through. However, this may take well over 100 trees and is beyond the current budget available in the landscaping fund. The most reasonable solution appeazs to be planting a few oak trees in the azeas where people have been specifically driving. This can be accommodated in the current landscaping budget. Adjoining owners will be asked if they would be willing to maintain the trees under the City's Adopt A Tree Program. Bellsouth Utility Projects; A complaint was also received at the last meeting about Bellsouth's crews doing work in the right-of--way in front of a citizen's home without letting them know that they would be there, when they would finish the work, or why the work was needed. Bellsouth has since sent a representative to speak with the owners about the project on Seminole Road. PendinE Follow-un Items. There aze several follow-up items from past commission meetings that city staff is currently working on, but reports are not ready for the January 26t'' meeting. They include the following; - Salary Related Questions; the cost to raise city police officer to equal JSO's salaries. This question is complex and .will take more time to prepaze a complete answer than available between the last two meetings. A staff report on this is expected in February. AGENDA ITEM #3A JANUARY 26, 2004 - Problems of Construction in Residential Neighborhoods; City staff has met to discuss the problems, reviewed various solutions from other Florida cities, and is preparing a staffreport for the next commission meeting. - Roundabout Study; currently underway with work being done by GAI Consultants. - Water Sewer Rates; As previously reported, Burton and Associates is preparing a revised calculation to answer several questions raised when the Commission last discussed the issue. - Acquisition ofRight-of--Way at 5`}' and Sherry for Reconstruction of Sidewalk; This issue has been delayed pending getting an appraisal of the value of the property needed for the sidewalk. Appraisers are very busy with other work at the time and staff has thus far been unable to get an appraisal completed. ~'""`'' ATTACHMENT B JANUARY 26, 2004 COMMISSION MEETING ~,,,„ STAFF REPORT City of Atlantic Beach Commission Meeting AGENDA ITEM: Traffic Calming for 300 Block of Plaza Drive DATE: January 19, 2004 `~. SUBMITTED BY: David E. Thompson, Chief ofPolice/DPS BACKGROUND: During the Core City Project, the 300 Block of Plaza Drive was repaved, and the speed bumps on the roadway were removed. When the paving was completed, the issue was raised as to whether or not the speed bumps should be replaced. A speed study was conducted to assess the level of speeding in the 300 block of Plaza Drive, and it was determined that the incidence of speeding remains high (close to 10%). This is consistent with historical information relative to speeding on this roadway. A review of the traffic crash data, on the same roadway, indicates that crashes are very rare. However, this may also be a consequence of the fact that the 300 block of Plaza ~"'' Drive has had speed bumps for many years. We do not have several yeazs of recent data, without speed bumps, with which we can make comparisons. The 300 block of Plaza Drive is unique in its character. It has a public park separating the east and west bound lanes of traffic, and the traffic lanes are very wide. The residential lots aze small, and the residents along Plaza Drive have very limited parking and they typically use the roadway for parking vehicles. These characteristics of the roadway and neighborhood tend to increase vehicular speeds, while encouraging pedestrians to compete with the moving vehicles. This combination creates a perception of endangerment for those who live on Plaza Drive. At the January 12, 2004 City Commission Meeting, a traffic engineering firm discussed the roadway and the concept of traffic calming. It was recognized that although the number of crashes on Plaza Drive aze very rare, there is a dramatic relationship between the speeds of vehicles and the fatality rate of pedestrians struck by vehicles. Elevated speeds are cause for concern, especially when pedestrians are involved. Traffic calming is a cost effective way to lower speeds and improve safety on a roadway. This may be accomplished through a vaziety of mechanisms, as discussed at the January 12, 2004 City Commission Meeting. Improvements can be achieved by altering the path of the street, and by adding markings and landscaping to the area. It can also be accomplished with the installation of "speed humps." AGENDA ITEM #3B JANUARY 26, 2004 Speed humps are designed with a 6' gradual incline, a 10' flat top, and a 6' gradual decline. These mechanisms provide a comfortable crossing at low speeds, and they will accommodate bicycles without too much distress and disruption. The flat top surface may also be used as `pedestrian crossings." If the City Commission is inclined to install speed humps in the 300 block of Plaza Drive, then the Police Department recommends two (2) in the east bound lane, and two (2) in the west bound lane of traffic. Note: The installation of speed humps and speed bumps typically have unintended consequences, and they can be very disruptive and counterproductive in a community. For this reason, their use should be very limited. The fact that they are effective at one location, does not mean that their use should be promoted throughout the community. They should be used very sparingly, at locations with unique characteristics. Thompson, Chief of Police/DPS BACKGROUND: At the November 24, 2003 City Commission meeting, questions were asked relative to measures that might be considered to address the speeding traffic in the 300 block of Plaza Drive. Some of the Commissioners expressed concern with installing speed bumps, and the City Commission directed the Police Department to bring back other options and alternatives for consideration. The expertise in the Police Department is somewhat limited in this area. Although staff members are familiar with the concepts and principles of Traffic Calming, the Police Department does not have anyone on staff that has the expertise of a traffic engineer. However, through the efforts and contacts of Public Works Director Bob Kosoy, an engineering firm with traffic expertise has offered to provide a report to the City Commission, at no cost, relative to traffic calming options in the 300 block of Plaza Drive. Volkirt & Associates is planning to present a report at the January 12, 2004 City Commission to discuss Traffic Calming options for Plaza Drive. Relative to enforcement issues, it is significant to recognize that additional police enforcement is an option for reducing speeding on Plaza Drive. However, it is also important to recognize that the Police Department is currently training a number of new officers, and the manpower does not exist to dedicate traffic officers on this roadway for an extended period of time. Additionally, the only way that enforcement will bring the speeds down and keep the speeds down, is with frequent, ongoing speed enforcement. With other competing demands for policing services, and considering the costs of such services, Traffic Calming strategies will probably be more cost effective than simply writing traffic citations. Thompson, Chief of Police/DPS BACKGROUND: On October 13, 2003, the Police Department submitted a report relative to the request to re-install speed bumps in the 300 block of Plaza Drive. At that time, the data from the traffic study at that location was interpreted based on a 25 MPH speed limit for that roadway. The subsequent statistical results did not appear to indicate a significant problem with speeding. However, the preliminary data analysis was flawed due to the fact that the speed limit in the 300 block of Plaza Drive is 20 MPH. Due to the nature of the roadway, including the residential housing and the parking on roadway, 20 MPH appeazs to be a reasonable speed limit. When the data from the speed study was corrected and revised, the analysis indicated that there was a significant incidence of speeding in the 300 block of Plaza Drive. Many years ago, before the installation of the speed bumps, officers running radar found significant speeding problems along this roadway. Even after the assignment of police traffic units, speeding problems continued to be a problem. With the speed bumps in place, the traffic crash data has remained very low for this section of roadway. Although the Police Department does not usually endorse the installation of speed bumps, there are exceptional circumstances that sometime arise. After considering the history of speeding problems on this roadway, and recognizing that vehicle crashes and injuries have remained very low while the speed bumps were in place, the police department approves of the re-installation of speed bumps in the 300 block of Plaza Drive. BUDGET: The cost of the speed bumps is estimated at $1,600. RECOMMENDATIONS: To approve the re-installation of speed bumps in the 300 block of Plaza Drive. No action was taken on the report at this time. 8/11/03 Curtis Sanders said he had received a copy of an ordinance that had been adopted by Ponce Inlet, regulating rental properties. He suggested Atlantic Beach consider adopting similar legislation 5/12/03 Requested that the City Attorney provide information regarding existing laws pertaining to the regulation, monitoring, and inspection of rental properties and provide the City Commission with a plan that speaks to the general welfare of the city and its neighborhoods and to the safety and well-being of renters by the August 25 Commission Meeting. 2/10/03 Curtis Sanders, Chair of the Code Enforcement Board, presented a report on behalf of the board. He recommended that the City consider licensing and carrying out regularly scheduled inspections of rental properties. Commissioner Borno concurred with the recommendations of the Code Enforcement Board regarding rental properties.
