Bussey Call to Order/Pledge Mayor Wolfson called the meeting to order at 7:15 p.m. The Pledge of Allegiance to the Flag followed the Invocation, given by Commissioner Waters. Mayor Wolfson welcomed the audience and explained the process for public comments. Approval of Minutes 1. Approval of the minutes of the Regular Commission Meeting on February 12, 2007. Motion: Approve the minutes of the Regular Commission Meeting on February 12, 2007 as written with one correction to strike "and the COBRA Bill" on page 7, under Commissioner Fletcher's comments. Mayor Wolfson opened the floor to visitors and explained the process for public comments. Michael Hoffman, 176 Camelia Street, addressed noise and air pollution on the west side of Atlantic Beach. He stated he was against the decibel measurement system and believes that does not work because you can still hear the bass. He also summarized the study on air pollution that he had previously distributed to the Commission. Pat Pillmore, 995 Camelia Street, stated (1) the sidewalk looks good; (2) Jacksonville Beach is looking for a magistrate and eliminating the Planning Board, which she believes is a bad plan because the citizens need to be informed; and (3) she understands that two properties on Plaza were processed as one property which gave the two properties an average for the permeable surfaces and one house gained in square footage and the other lost and stated she hopes that it is not true. Mayor Wolfson informed Ms. Pillmore that he would have Sonya Doerr review this issue and asked Ms. Pillmore to provide them with the addresses. February 26, 2007 REGULAR COMMISSION MEETING Pane 2 Jack Robbins, 1435 Linkside Drive, stated he is for the approval of the Selva Marina Country Club application that will come before the Commission at the next meeting and urged the Commission to follow the staff and Community Development Boazd's recommendations to let the application~o through to the State. He also stated he is against the property at Linkside and 11 Street being developed because of the environmental reasons and requested any help the Commission can give, through the Community Development Board, to preserve this piece of land. Commissioner Fletcher stated he was recently informed that the permit was withdrawn on that piece of property, pending further information. Ralph Tiernan, Owner of Fly's Tie Irish Pub, stated he was here to request the Commission establish a decibel level they can conform to. He stated in the past year since the sound problem started, they have been policing themselves by dropping from 95 decibels down to 65 decibels, based on the bass levels. He stated if the Commission would determine a decibel level the Fly's Tie will abide by it. He stated they have also put in $3,000 of soundproofing in the past year. Rick Sichta,1833 Atlantic Boulevard, attorney for Fly's Tie, stated they are trying to get a reasonable decibel level that all businesses will have to abide by. Commissioner Borno questioned when the soundproofing was put in. Mr. Tiernan replied it was put in immediately after the original complaints. Commissioner Waters questioned what they have come up with that creates the least consternation in the neighborhood. Mr. Tiernan stated the nature of some of the bands was a problem, which he eliminated. He also stated the complaints have been inconsistent. No one else in the audience spoke and Mayor Wolfson closed the public portion of the courtesy of the floor to visitors. A. Steve Fouraker, Beaches Leader -Newspaper Rack Proposal Steve Fouraker, 387 6te Street, representing the Beaches Leader and The Publishing Group, summarized his written report on the modular newspaper racks in Atlantic Beach. He stated they are proposing that each location will have a combination of metal modulaz newspaper racks and plastic modular racks which will be the same height and color. The metal modular racks will be for coin vended publications like USA Today or the Times Union and the free publications, such as the car magazines and the digest of homes, would be in the more economical plastic units. The Times Union has offered to put up the modulars_ He stated he will be the contact person for any concerns regarding these newspaper racks. Commissioner Borno questioned who would supply the plastic racks. Mr. Fouraker stated those will be furnished by Publisher's Distribution Service. Commissioner Waters stated he does not like the look of the plastic rack and questioned why the racks cannot all be metal for consistency. Mr. Fouraker stated he is trying to assemble a group of different companies and different publications and believes in February 26, 2007 REGULAR COMMISSION MEETING Page 3 order for that to hold over time they have to take into consideration the economics of smaller publications are not those of lazger publications. The plastic racks that allow for multiple publications are much cheaper. From speaking with the different publishers, he stated in order to display their product they are going to need to be able to afford what they are offering them. If that becomes a problem, he expects they will break away from this group and at that point they will try to establish their first amendment position to display their products wherever they want to. Commissioner Waters questioned how the plastic racks were secured, to which Mr. Fouraker replied they are all bolted to the ground. Commissioner Waters expressed concern that the tops of the racks not be flat. Mayor Wolfson stated that Mr. Fouraker should work that out with the City when it gets down to that detail. Mr. Fouraker agreed and stated that when the time comes, Commissioner Waters should express his concern to the City Manager who will inform the Times Union who will be building the modular units. Commissioner Waters suggested that a letter be written to the Times Union thanking them for their consideration. Mayor Wolfson questioned who the City would deal with as the contact person should Mr. Fouraker leave or retire. Mr. Fouraker stated that as a City, Atlantic Beach would not be dealing with an organization as such. The power the Commission has is to say, we're not happy with this arrangement, we aze going to pass an Ordinance that restricts the ability and makes them conform. Mayor Wolfson stated that as this gets to finalization he believes there will be some communication to The Publishers Group from the Commission acknowledging what has been done and what expectations aze, as a matter of record, to be perpetuated in the future with changes in administration, etc. Mayor Wolfson questioned Mr. Fouraker's comment regarding the first amendment right to self expression and wanted to know, once this is established, could the City see another publication come in to set up shop, claiming freedom of expression, and put in a separate rack. Mr. Fouraker stated he hoped not, but he cannot guazantee that. His and the group's assessment is that the publishing people who operate in this area is quite small and they really control the outlets and have a good handle on who goes in where they have contracts. They have quite a bit of influence over other publications and feel they could convince a publication not to break out and be a renegade with regards to this, but the City has whatever power they want to exercise to come up with a solution. Mayor Wolfson asked if some new publication comes up, is there an ability to expand the racks. Mr. Fouraker stated yes, if there is room in that particulaz location. Mayor Wolfson stated, since the racks are made of metal and will rust, the color chosen should be something that would not show rust. Mayor Wolfson asked if there was any location in West Atlantic Beach for the newspaper rack modules to be installed. Mr. Fouraker stated there are not any newspaper racks currently on public property in West Atlantic Beach, except at the Commissary. Mayor Wolfson requested the City Manager look into locations for these racks in West Atlantic Beach_ B. Request from Marsh Preservation Society for additional funds to reimburse MarshFest 2006 expenses. There was no representative present regarding this request. Moved by Fletcher, seconded by Wolfson Commissioner Borno stated he is adamantly against any additional funding. He stated this was a group that came to the City wanting to put this festival on and they are looking for the City to be a bank. Commissioner Simmons agreed and stated, although she is a supporter of the marsh as a citizen, as a commissioner in charge of the people's money, she believes it is a bad practice to have a private group put on an event and then come to the City and state they would like reimbursement for the cost of the event. She believes this is a bad precedent. She would like to not make a decision without a representative present. She believes they need to come to us with a plan and a budget. Commissioner Waters disagreed and stated this is a private group with a very public service and if things work out, there will be a public park on the west side of the City like the one at the beach on the east side of the City. He said someone has to start the ball rolling. He believes the City's investment at this time is minimal and the reward in the end is very good, even if this is a sloppy way to do business. Commissioner Borno stated he appreciated everyone's comments but reiterated if you are going to plan something, you plan something and you come to the City and we work it out. Don't come to the City after the fact and want the City to be a bank to make the books look good. It is not a good way to do business, it's sloppy. Mayor Wolfson opened the floor to the public. Pat Pillmore, 995 Camelia Street, questioned whether there was any differentiation in fees for the people on contract with the City who use the building. Timmy Johnson stated yes those with contracts, such as ABET, pay a fee of $200 for the entire year so they do not fall under this Ordinance at all. They have a separate contract. No one else from the audience spoke so the Mayor closed the floor to the public. Motion: Aonrove Ordinance No. 95-07-93 as read. Moved by Borno, seconded by Waters. Mayor Wolfson explained some of the items he wanted put into this Ordinance were not included. After a lengthy discussion regarding fees and the reduced recurring use charge the Commission agreed to vote on the Ordinance as written. Ordinance No. 20-07-83, Introduction and First Reading AN ORDINANCE AMENDING THE OPERATING BUDGET FOR THE CITY OF ATLANTIC BEACH, FLORIDA FOR FISCAL YEAR BEGINNING OCTOBER 1, 2006 AND ENDING SEPTEMBER 30, 2007. Motion: Approve Ordinance No. 20-07-83 on first reading as presented Moved by Borno, seconded by Simmons. Commissioner Borno explained this is an adjustment to the 2007 budget and it is necessary to fund the cost of the new contract for sanitation for the remainder of the fiscal year. Votes: Aye: 5 -Borno, Fletcher, Simmons, Waters, Wolfson Nay: 0 MOTION CARRIED Miscellaneous 8. Miscellaneous Business Business A. Shangri La Sewer Improvements and Agreement with Beaches Habitat. Mr. Hanson explained that there is money in the budget this year to eliminate the lift station. He stated Donna Kaluzniak, Utility Director has worked a deal, in conjunction with the Habitat project, which saves the City a lot of money. Ms. Kaluzniak summarized her written report. Mr. Hanson explained the reason for eliminating the lift station is that a PVC sewer line is much less expensive to maintain than a sewer lift station with pumps, wet wells, controls, etc., so it is being done for savings in future maintenance. Motion: Approve Agreement with Habitat for Humanity to reimburse $16,476 92 for additional cost for construction of sewer improvements at the north portion of the Shan~ri La Lift Station proiect and Authorize the City's Annual Utility Contractor. Gruhn May, Inc., to complete sewer construction for the south portion of the Shan~ri La Lift Station proiect in the amount of $87,102 30 and Authorize the Mayor to sign the Agreement. Moved by Borno, seconded by Simmons. Commissioner Borno congratulated the staff for the $50,000 savings. Mandalay Pazk -Proposed Ocean & Seminole Intersection Improvement Mr. Hanson stated this is also in the budget this yeaz and asked Rick Carper to give an overview of his proposal. Rick Cazper gave a presentation on the proposed changes to the intersection to make turning easier, the addition of a bike path and the modifications necessary to include a sidewalk, which he does not recommend. Commissioner Borno questioned whether the reason this was put in the budget this year was a traffic safety issue. Mr. Carper stated that was correct. Commissioner Fletcher stated although this is a very difficult intersection, having checked with staff he has not heard of a lazge number of accidents. He requested that this be deferred pending traffic engineering analysis. Commissioner Waters stated that when cazs are turning onto Ocean, it causes a backup of cazs on Seminole but this does not eliminate that problem because there is no planned turn lane. He does not agree with the elimination of the proposed sidewalk. Commissioner Simmons stated she believes this is unnecessary money. She stated, although the turn is awkward, she feels if a left turn from Ocean onto Seminole and a right turn when traveling north on Seminole onto Ocean were prohibited, it would save a lot of money. She stated she also is against putting a bike path in until they know what path the bike path is going to take, as well as changing the sidewalk to an 8-foot sidewalk when there is already an existing sidewalk. She stated rather than spend the $50,000 to change the intersection, perhaps they could clean up the corner. Mr. Carper agreed that he gets more complaints about the maintenance and the appearance than he does about the safety. Commissioner Simmons agreed that if they put up no left turn and no right turn signs and put in a curb, if possible, depending upon the flow of the water, this would be far less expensive than $50,000. Mayor Wolfson asked Chief Thompson if there is a record of accidents at this location. Chief Thompson stated there have not been an excessive number of accidents at that location and the ones that occurred have been DUI-related rather than due to the intersection. Mayor Wolfson concurred and stated he is reluctant to support this as well. Commissioner Borno suggested considering installing curbs on the east and west sides of the sidewalk with some drainage cuts in it, which would deter vehicles from turning across the sidewalk. Mayor Wolfson suggested this be approached as a possibility of a volunteer beautification, deter the turning from a left and put some finish there such as shrubs or trees so people cannot turn through there. Commissioner Waters stated the intersection is dangerous and at night it is difficult to find the turn. He believes it would be better if it was changed to one-way traffic on Ocean. Commissioner Borno requested that staff take the Commission's suggestions, evaluate them and come back to the Commission with their recommendations. C. Request from Attorney for Fly's Tie Pub to Amend City Noise Ordinance David Thompson explained why decibel levels do not fix the sound problems and believes there are other ways to address the sound issues. He stated he has spoken with other Police Departments who currently have ordinances with decibel levels. He reported he was told they were very disappointed with the results because there are still people disturbed by the music but when the police officer comes to that location and they check it with a meter, if it doesn't meet the decibel number nothing is done which then makes the citizens unhappy because the police aren't fixing their problem. He suggested they speak with some of the people who have made complaints to try to Februarv 26, 2007 REGULAR COMMISSION MEETING Page 8 resolve the sound problem and come up with some acceptable noise levels and stated if those people are willing to participate, he would be glad to facilitate that conversation to try to come up with some resolution everyone can agree to and get along with. Commissioner Fletcher stated he does not agree to changing a working ordinance because one business does not seem to be able to comply. Commissioner Simmons stated if the decibel level has already been lowered from 90 to 65 and they are still getting complaints, she is afraid they might not like the decibel level the Commission would have to go to if they chose to use a decibel level. She stated, although it might only be a few nights a yeaz when conditions aze such that there are complaints at 65, the lower decibel level would have to be maintained all yeaz long during all conditions and she believes this might hurt Fly's Tie more than it would help them. Commissioner Borno stated he is not going to change the Ordinance as it stands and stated nobody would like the decibel levels he would come up with. He encourages that an action and resolution be worked out in a very short time period. Mayor Wolfson concurred with the Commission and stated he does not see the need to change the ordinance but believes it is important for there to be the ability to cooperate between the business and the residents but in a situation like this the ordinance is very cazefully written and gives the guidelines to understand what the rights are to the surrounding neighborhood. He stated to the representatives of Fly's Tie that if the City is still getting complaints since the extra soundproofing was installed, then the Commission believes more needs to be done and can be done and he believes they can work with their neighbors in a cooperative spirit which will not be so cost prohibitive that it will drive them out of business. He stated the City does not want to see them leave and expressed he believes they provide a good business and a good venue for our community and the Commission is not telling them they do not want the Fly's Tie here. Mayor Wolfson stated he concurs with his fellow Commissioners and does not believe we need to go forward on this. He stated if they cannot find a resolution, then the Commission will have to readdress the problem. D. Annual Public Safety Report for 2006 David Thompson summarized the written Public Safety Report, which included violent crime statistics, property crime statistics, crime rate comparisons, drug arrest statistics, police workload, emergency response time, highlights of the Crime Suppression Unit, Fire/Rescue statistics, Code Enforcement statistics, and Animal Control statistics. He pointed out that the violent crime rate, which includes murder, rape, robbery and aggravated assault, has gone down considerably this year and has consistently gone down over the yeazs. Commissioner Simmons questioned whether the report related to Drug Arrests could separate the pot and pazaphernalia busts from arrests for drugs that drive crime, such as crack, heroin, etc. Chief Thompson stated these figures could be pulled out to reflect this and he will provide this to the Commission. Commissioner Fletcher stated he was proud of Chief Thompson, his force and Alex Sherrer of Code Enforcement for everything they have done. Mayor Wolfson questioned whether Atlantic Beach has a drug trafficking problem. The Chief stated there have been some instances in the past, including one in Oceanwalk where they seized 220 kilos of cocaine; however, he stated the vast majority of the distribution network comes in from sources in Jacksonville. He stated there aze some people in Atlantic Beach who are involved in the distribution, but said for the most part we are on the outside of that activity. Reports and/or requests from City Commissioners and City Attorney City Commissioners City Attorney A. Recommendation for new appointments to the Cultural Arts and Recreation Advisory Committee. Motion: Anarove Aaaointment of John Lon bottom and Mark Howard to comalete the terms of Alicia Paley and Darrell Prather on the Cultural Arts and Recreation Advisory Committee. Moved by Wolfson, seconded by Borno. Votes: Aye: 5 - Borno, Fletcher, Simmons, Waters, Wolfson Nay: 0 - MOTION CARRIED Commissioner Borno Stated he has had personal experience with Lori Gaglione in several other committees. Stated she is a real sharp lawyer and a good advocate for what she gets involved in and believes she will be an asset when the time comes. Stated the sanitation press release is exceptional and concise. He believes it will alleviate the misunderstandings. Responded to the Fletcher High School letter on the science facility, stating he and Commissioner Simmons had the opportunity to attend the School Boazd Open Meeting last Thursday night with Art Graham. He stated the School Boazd committed to give them a feedback in approximately two weeks on what the immediate quick fixes could be and what fixes could be in place by August for the next school yeaz. Commissioner Simmons • Stated one of the big problems is there are a lot of students who should not really be attending Fletcher High School but are coming from other school districts and aze fudging their way in. She stated the Superintendent is using multiple methods of verification to track down where students really do live. She stated, according to information given at the meeting, Fletcher is overcrowded as a whole, not just in the science azea, but Sandalwood and Terry Pazker aze under their student level ability. Mayor Wolfson stated they will address this issue at the next beaches Mayors meeting. • Stated she understands the new trash containers are 96 gallons compazed to the 33-gallon standazd trashcan. February 26.2007 REGULAR COMMISSION MEETING Pace 10 Commissioner Fletcher Attended US Navy's public hearing last Friday on the potential environmental impact of a possible new sonar range off our coast. The first proposed site is in Norfolk but we are second in line as an alternative for this permanent sonar training installation. He stated there are serious concerns about placing the sonar site directly offshore from Atlantic Beach, in particular, in terms of potentially devastating impact on marine life. He stated the National Oceanographic and Aerospace Administration has determined sonar at various frequencies does indeed kill marine life, causes mass teachings, and other forms of harm to the marine life. He stated the U.S. Navy has publicly agreed to the position that sonar does cause harm to marine life. Currently an environmental impact study (EIS) is being conducted, which is why they were at the Sea Turtle having a public hearing. Commissioner Fletcher stated he requested a copy of the EIS. He stated that while the decision as to where to place the sonar training site will not be made for a year or two, he will carefully monitor the situation because of the potential economic impact and quality of life in Atlantic Beach and may ask the Commission to take some action on this issue at a later time. Commissioner Waters • Suggested sending a letter to the news publishers who are involved in the news rack issue, showing the Commission agrees with the position and thanking them for their participation. Mayor Fletcher agreed to this and asked Mr. Hanson to draft the letter. Mayor Wolfson stated the letter is a good way to express, for our records, what our expectations are. • Stated the JFK is being decommissioned and questioned if invitations have been sent out yet. Mayor Wolfson stated the invitations have not gone out yet but is confident invitations will be going out for officials in the City. Mayor Wolfson • Reminded the Commissioners that the Strategic Planning is this Tuesday and Wednesday nights from 5:00 - 9:00 p.m. in the Ocean Room at the Sea Turtle. He stated the public and the press are invited to attend. • Stated, at the end of March, Commissioner Waters, Mr. Hanson and he will be attending the Florida League of Cities Conference and Jacksonville Day in Tallahassee. He stated he is concerned about the Legislative Alert regarding property tax reform and asked that the Commissioners review it. He also stated that he will put this item on the agenda for the next Commission Meeting and would appreciate the Commissioners' feedback so when he attends the conference in Tallahassee he can speak for all of the Commission. • Stated the Palms Apartments has changed owners and they are intending to redevelop this property. He wants to raise awareness that it will be unacceptable for this property to be left in its current condition for any length of time. February 26.2007 REGULAR COMMISSION MEETING Page 11 Commissioner Borno • Regarding the sonaz range, he stated it is not detrimental all the time they use the range. He stated it is a passive (listening) and active range, but being an ex- diver, nothing will make you come out of the water any faster than someone lighting off sonaz anywhere neaz you. • Stated he will miss the next meeting. Bussey, CMC City Clerk ATTACHMENT A FEB~ xYEb 200 February 20, 2007 MEMORANDUM TO: The Honorable Mayor and Members of the City Commission FROM: Jim Hans SUBJECT: Follow-up eport Continued Traffic Enforcement in Selva Linkside Subdivision; At the last City Commission meeting on 2/12/07, a resident from the Selva Linkside subdivision said that the Atlantic Beach Police Department had not lived up to their commitment to provide continuing traffic enforcement in the Linkside subdivision. Specifically, he said that the residents "have not seen police" in the neighborhood. Attached for your review is a log of all police calls in the Linkside subdivision for the period of January 1 ~` through February 12~'. During that time, there were a total of 24 traffic stops made on several different days. .Complaints from Resident at 680 Palm Avenue; A resident living at 680 Palm Avenue appeared before the City Commission at the January 8~' meeting to voice several complaints about conditions along her street and criminal activity. Public Safety Director David Thompson met with her a couple of days later to understand her complaints and then worked with various city departments to get them resolved. She lives at 680 Palm Avenue in Atlantic Beach, and she voiced a number of concerns that involve various departments in the City govei-mnent. Before she left the meeting, she met with the Police Chief to exchange contact iiformation so that they could meet and discuss these issues. Chief Thompson met with Ms. Gilpin on the afternoon of January 12, 2007 at her address on Palm Avenue. This report is intended to summarize the concerns expressed by Ms. Gilpin, and the notations in blue fonts are the city staff members' ideas relative to her concerns. Aesthetics: The City of Atlantic Beach has invested significant funding into beautification projects around the city. Palm Avenue is ii great need of some beautification. The inserted photographs show that the roadway and the adjacent properties are unsightly, unkempt, and in need of some attention. The fence at the iltersection of Palm Avenue and Seminole Road is unsightly. Public Worlcs: Public Worls offered to remove the fence, but Ms. Gilpin said that s.l1e would rather paint the fence and leave it there. Public Worlcs has also agreed to reniove.etisting, unsightly plants, and take over the maintenance of the area between the curb and the property line. 2. Maintenance: There are trees and foliage overhanging the roadway, and there is evidence of erosion on the roadway near the intersection of Seminole Road and Palm Avenue. Motorists tend to cut the confer and run off of the pavement when turning from Seminole Road onto Palm Avenue. It would be helpful to place something attractive near the comers to encourage motorists not to cut the corner. Public Works: Pavement repair patclung has been completed, and the trees and sluubs around the lights Dave been trinln7ed. Lighting: There is heavy foliage, and only one street light on Palm Avenue. The foliage blocks most of the light emanating from the streetlight, and additional streetlights near the parking area at tlZe east end of the street are needed. At the present tune, people utilizing the parking area must do so ii the dark, which sometimes encourages bad behavior. Public Worlcs: Tree Master to trimn.ied around lights at Palm & Seminole, mid block of 1?al.m a.~~d at first light south on Magnolia.. Public Safety/Parks and .Recreation: A streetlight will be recommended at the northeast corner at Palm Ave at the intersection. with. Magnolia Street. This will improve the lighting in the area and in the parking lot area. AGENDA ITEM # 3A FEBRUARY 26, 2007 4. Pedestrians: This roadway is heavily traveled by pedestrians, especially in the afternoons. Many young people cut through Palm Avenue going to or coming from Hov~ell Park. The pedestrians and vehicles aze forced to share the same roadway. Additionally, there is no clear delineation of where the public right-of- way ends and where private property begins. As a result, pedestrians often walk through the yards of the homeowners living on this street. Residents would like to have a sidewakc to provide a safe place for pedestrians, and they suggested a pedestrian crossing at Palm Avenue and Seminole Road. Ideally, they would like the sidewakc on the north side of t'~e roadway (across the street from the homes). Public Worlcs: The proposed sidewalk has been. evaluated using standard scoring form -scores 53, which vJOUId be #5 belwld Main Street (on hold pending bike path decision, W. 9t" W 1St (disapproved by Commission) and Aquatic Drive. Therefore it is likely to be constructed in the next budget year. If funds are available, it may be constructed this .fiscal year. A pedestrian. crossing on Seminole, if appropriate, will be added after the sidewall: is colvpleted. Public Safety: Supports the idea of adding a sidewalk to keep the pedestrians out of the roadway with the vehicles. If a sidewalk is added, then adduig a pedestrian CroSSing at Pahi~ Avenue and Seminole Road would be appropriate. 5. Crime: Ms. Gilpin and some of her neighbors have experienced some criminal incidents at their houses. Specifically, they have had some burglaries and attempted burglaries. It is evident that there are some environmental factors that make their houses more likely targets for burglars as compared to other areas of the city. Police Department: Cringe Prevention Officer Tiffany Layson has contacted Ms. C~ilpil~ to provide guidance relative to burglaries. Officer Layson will also offer. her services to the neighbors and. encourage neighbors to take some measures to reduce their I-islc of burglaries.
