AGENDA ITEM: Request for a Waiver from Section 24-252 of the City Code
requiring Paved Access before Construction on a Residential Lot

BACKGROUND: City Land Development Regulations (see attachment 1) require
every lot to have access to a paved city street and requires, prior to building
construction, that developers construct a street to City standards if the adjacent
street is not paved. Applicant is requesting a waiver to the requirement to have
the street constructed before home construction in order to avoid having the
newly constructed street damaged by construction deliveries and equipment and
proposes to post a cash bond sufficient to cover road construction costs to
ensure the road is built after home construction is completed. Applicant is also
requesting a waiver to the required pavement width, Section 24-252 (c) requires
20 feet paved surface for a local street without curb and gutter. Applicant is.
requesting to be allowed to construct a 16 foot roadway instead because of the
limited development and thus low traffic volumes expected on this road segment.
Applicant's request for abandonment of the Lily Street Right of Way requires
additional documentation and will be addressed at a later date.
RECOMMENDATION: Staff recommends approval of this waiver request. The City will
ultimately get a finished street without damage if constructed after all heavy
traffic associated with home construction is passed. Because this proposed
home construction is at ti a western end of W. Plaza Road, only one resident is
impacted. This resident is aware of the construction and has agreed to allow his
property to be used for construction parking. Reducing the required pavement
width will result in a 20% reduction in impervious surface being installed.

Land Development Regulations Sec. 24-252. Streets (Excerpt)
(c) Access to paved streets required. Every lot, development parcel or new
subdivision shall have access to a paved street dedicated to public use, which
has been accepted and maintained by the city. It shall be the responsibility of
the developer to design, construct and pave streets in accordance with the
requirements of division 5 of this article. A certificate of completion shall be
issued prior to acceptance of any public street by the city and prior to the
issuance of any building permit to develop individual lots or parcels.
(i) Minimum right-of--way and paving widths. Minimum street right-of-way and
paving widths shall be as follows, unless otherwise indicated or required by law:

Section 24-46 (d) permits the City Commission to authorize limited Waivers, on a case-by-case basis,
from a specific provision(s) of these Land Development Regulations when it is demonstrated that
compliance .with such provision(s) would be unreasonable, in conflict with the public interest, or a
practical impossibility. A Waiver from these Land Development Regulations may be approved only
upon showing of good cause, and upon evidence that an alternative to a specific provision(s) of this
Chapter shall be provided, which conforms to the general intent and spirit of these Land
Development Regulations. In considering any request for a Waiver from these Land Development
Regulations, the City Commission may require conditions as appropriate to ensure that the intent of
these Land Development Regulations is enforced. A Waiver shall not modify any requirement or
term customarily considered as a Variance or any requirement or term prohibited as a Variance, and
shall be considered only in cases where alternative administrative procedures are not set for the

LOCATED AT 1217 LILLY ST AND THE CLOSURE OF LILLY STREET
I Naaman Harrell am requesting a waiver from the requirement of Section 24-252 to have a
paved road completed and accepted by the city before issuance of a building permit. I am also
requesting a waiver to the paved width requirements (20 feet required, I am requesting 16 feet
instead) I am also seeking the abandonment of Lily St along with Joseph C Durante,The
Abdullah Trust and Paul Stanford who have interest in the adjoining properties to Lily. W. Plaza
which will then be a dead end street and will require a cul de sac turnaround or T end turn around
which we will provide with the extension of W Plaza. Our request will be guaranteed by a cash
bond based on the amount of civil engineering and actual cost of paving. Included is a copy of
the survey, site plan and map overview of the area to show how other streets are laid out .
Attached is a contract with Andrew May P.E. showing the amount of 15,000 on the high end with
SJRWMD permitting also attached is the cost of paving from Duval Asphalt for a total of
16,712.00 our proposed cash bond is in the amount of 31,712.00 .
