Item 10BAGENDA ITEM # lOB AUGUST 27, 2007 Provisions for Joint Agreement Between Cities of Neptune Beach and Atlantic Beach August 14, 2007 Purpose; The purpose of this Agreement will be for the cities of Atlantic Beach and Neptune Beach to jointly plan for zoning, public facilities and the provision municipal services in the commercial area known as Town Center which lies partially within the boundaries of both cities. This agreement will include, but not be limited to, planning, zoning, installation and maintenance of landscaping, sidewalks, benches and other streetscaping, parking, stormwater management, traffic safety, special events and displays. Neither city will give up any authority or control in their jurisdictions, but simply agrees to coordinate and cooperate with the other so that the governing rules, public facilities available, and governmental interface for citizens and businesses will be as seamless and efficient as possible. Description of area; To be provided in final agreement. Agreement; It is the intent to make the zoning and other municipal codes and regulations similar to the extent possible and insure that changes made by one city do not adversely affect the other city. Both groups of elected officials agree that neither city will adopt or make changes to the zoning provisions relating to the Town Center area in either city without first consulting the other. If changes are major, the matters may be assigned to either standing or ad-hoc committees for recommendations. Similarly, any major changes to the landscaping plan, addition of or changes to major public facilities including parking should be coordinated between the two cities prior to final decisions being made. Coordination on normal maintenance or minor changes should be between the two respective City Managers. Creation of Joint Committees; From time to time, the cities may jointly-create committees for specific purposes. These may be either continuing committees or have sunset provisions, depending on the needs at hand. Membership on these committees are to be appointed by elected bodies of each jurisdiction. Members may include elected officials from each city, staff members, representatives of business interests, city planning agency members, or citizens. Creation of Joint-Committee to study parking; • The first committee to be created under this Agreement will be to study parking. • Purpose; to explore possible ways to provide more and improved parking for customers, citizens, beachgoers and employees in the Town Center Area and provide written report to elected officials. Alternatives may include creation of new public or private parking facilities, AGENDA ITEM # lOB AUGUST 27, 2007 acquisition of existing parking, various financing options, regulation of publicly-owned on-street or other parking Timetable; to start upon adoption of this agreement by both cities and extend for six months or until final report approved by committee, whichever comes first. Each city to appoint four members to committee. The Chair of the committee will be appointed by the Mayor of Neptune Beach. Previous Town Center Interlocal Agreement; This agreement to acknowledge and support the continuation of the maintenance agreement signed by cities of Jacksonville, Atlantic Beach, and Neptune Beach and dated 2000. It covered joint maintenance of landscaping and streetscaping. Management; It will be up to the City Managers and their staff to manage the provision of services and enforcement of municipal codes and regulations. Permits will be required for any events that will occur on the public ROW, for all signs or banners placed on the ROW, and for all trash cans, benches, or other streetscape items placed on the ROW.
