Approval of the minutes of the Regular Commission meeting of November 11, 2002 Commissioner Waters requested that the following corrections be made to the minutes: (1) Page 4, Paragraph 5, change the paragraph to reflect that he had not visited the park, but had spoken with the park supervisor, who was willing to come..., (2) Page 10, the last paragraph, Item (2), add on Dutton Island, and (3) Item 8C, although he stated what was written, Commissioner Waters requested that the minutes reflect that it was his intent that the logic used to give the day off to the other employees was not sound logic, in his opinion. Motion: Approve the minutes of the Regular Commission Meeting of November 11, as amended. Closing of the Sailfish Drive JEA Office Mayor Meserve indicated that he was unable to attend the public meeting, but had written to the JEA concerning the. closing if this office. He further stated that he had spoken to the JEA regarding this matter and a representative will be present at the next Commission meeting to discuss the closing of this office. Update from Corps of Engineers on the Beach Renourishment Project Steve Ross, Project Manager for the Corps, stated that he was new to the project, but reported the project was expected to begin in mid-Janauary and would finish by the end of March. He indicated that approximately 200,000 cubic yards of sand would be placed on the beach from lst to 18th Street. Mayor Meserve inquired concerning the amount and placement of the sand and stated that the original survey was completed before a major storm, which had severely eroded the beach. Mr. Ross responded that a new survey re-establish- ing the erosion control line had been completed in September, and it was felt that the dune north of 18th Street had moved seaward and no sand was needed in that area. Mr. Ross and Tom Martin, Coastal Engineer for the project, responded to questions regarding core sampling procedures and the quality of sand to be placed on the beach. .. 'ty Manager Hanson inquired if the sand would be in place by April 1, 2003, _~e beginning of turtle nesting season. Mr. Ross indicated that the scheduling was up to the contractor and he hoped to have a more definite schedule for the project in two weeks. Keith Falt of 1840 Sherry Drive North disagreed with the findings of the Corps and stated that he had observed severe erosion on the beach from 15th Street north to Hanna Parka He felt the city should take a more active role in the project. J. P. Marchioli of 414 Sherry Drive submitted a petition with seventy-eight signatures requesting stop signs to be placed on Sherry Drive at 3rd and 6th Streets. The petition is attached and made part of this official record as Attachment A. Sally Clemens of 1638 Park Terrace West felt that if the city was being run like a business, it should take note that corporations were cutting benefits for their employees to save money. She also inquired if the setback requirements would be maintained if the waiver was granted in Item 8A. Mrs. Clemens was informed that they would be maintained. Alan Potter of 374 Second Street stated that in Monterey, California `destrians have the right-of--way. He also noted that in Clemson, South arolina, the city has "Stop for Pedestrians" painted in the middle of the street. Mr. Potter felt the city should provide office space for a JEA cashier to collect electric bills if the JEA office of Sailfish Drive is closed. Kelly Elmore of 1650 Beach Avenue spoke in support of the city providing a skateboard park and suggested it be built in Russell Parka Mr. Elmore stated that he had visited the park on Emerson Street and was very impressed with its operation. He indicated that the park was built for approximately $156,000 and "Tony Hawk" construction grants were available. Information on obtaining grants and a newspaper article on skateboarding from USA Today were given to City Clerk King for copying and distribution to the Commissioners. Stephen Kuti of 1132 Linkside Drive opposed the construction of a skateboard park and suggested the City Attorney investigate the liability associated with such a park. Lisa Harold of 659 Sherry Drive expressed concern for speeding on Sherry Drive and stated that it was so bad that her second grader could not ride her `''cycle to school. She felt speed bumps and/or stop signs were needed to slow affic. 3. Unfinished Business from Previous Meetings A. City Manager's Follow Up Report on Issues from. Previous Meetings City Manager Hanson commented on each item of his written report, which is attached and made part of this official record as Attachment B. Commissioner Waters thanked City Manager Hanson for the improved visibility at the 11th Street and East Coast Drive intersection. B. Authorize the City Manager to sign a contract with Bluewater Environmental of Florida, Inc., in the amount of $81,370 to provide professional services as required in the EPA 319 Core City grant Motion: Reject all bids received and rebid the project to provide professional services as required in the EPA 319 Core City grant. Motion: Authorize the City Manager to sign a contract with Bluewater Ennvironmental of Florida, Inc., in the amount of $81,370 to provide professional services as required in the EPA 319 Core City grant. There was no further discussion and the motion carried by a three to one vote with Commissioners Waters and Parsons and Mayor Meserve voting aye and Commissioner Borno voting nay. 4. Consent Agenda: A. Acknowledge receipt of monthly report of Utility Sales B. Report from Cultural Arts & Recreation Advisory Committee Rusty Pritchett Mr. Pritchett reported that the first meeting of the new Cultural Arts and Recreation Advisory Committee was held on September 24th. He stated that the committee membership was balanced between recreational and cultural arts backgrounds and he had been chosen as Interim Chair. Mr. Pritchett indicated that three Vice Chairs had been chosen representing Cultural Arts, Recreation and Publicity and by-laws were drafted in October. °""°~`ammissioner Parsons inquired concerning the status sculpture mmissioned for the five-way stop by the fire station. Ordinance No. 95-02-78 Public Hearing & Final Reading AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, FLORIDA, AMENDING CHAPTER 5, BEACHES AND PARKS, ARTICLE I, IN GENERAL, ARTICLE II, BEACH SAFETY ZONE, ARTICLE III, PUBLIC PARKS, PROVIDING FOR SEVERABILITY AND PROVIDING AN .EFFECTIVE DATE (City Manager} Motion: Approve Ordinance No. 95-02-78 on final reading. Mayor Meserve opened the floor for a public hearing and invited comments from the audience. °"''"'ichard DeVane of 46 4th inquired if the ordinance contained the ranges he suggested concerning dogs being prohibited from the beach between 9:00 a.m. and 5:00 p.m. during June, July and August. Mayor Meserve stated that the change had not been included in the ordinance. No one else spoke and the Mayor closed the public hearing. Commissioner Waters reiterated his previous position and felt the entire ordinance needed further review and stated that he would be willing to work with Mr. DeVane and a committee to rewrite the ordinance. He indicated that he would like the following items to be included in the Chapter 5 revisions: (1) A definition section containing a definition for "motorized apparatus" and explaining where the measurement begins for ... "200 feet from the beach", (2) The ability to camp out overnight on Dutton Island, (3) The ability to authorize events such as a hayride on the beach, that may not be for a public purpose, (4) Horses on the beach during the winter season, and (5) Mr. DeVane's suggestion regarding dogs on the beach. Discussion ensued and Commissioner Waters offered to Chair a Committee to rewrite the ordinance. Commissioner Borno suggested holding a workshop to discuss the issue of dogs on the beach. ,~, Motion: Defer action until a committee can be formed to rewrite the ordinance. Action on the request of Amy and James (Rusty) Pritchett for a waiver from Section 24-255(a) of the City Code, seeking approval of a lot less than 75 feet in width and less than 7,500 square feet of lot size (City Manager) Motion: Waive requirements of Section 24-255(a) of the City Code, and approve a lot less than 75 feet in width and less than 7,500 square feet in lot size for Amy and James (Rusty) Pritchett. Community Development Director Doerr provided background information which explained the conflict between the city's Subdivision regulations and the minimum lot area for single-family uses found in Article III, Division 5. Her Staff Report explaining the inconsistency in Chapter 24 with respect to the issue is attached and made part of this official record as Attachment C. '~"s. Doerr indicated that the requested 5,000 square foot lot was consistent nth the requirements of the city's Comprehensive Plan. Mr. Pritchett commended Ms. Doerr and Building Official Ford for the courteous and professional manner in which they handled the review of his case. There was no further discussion and the amendment to the motion and the main motion carried unanimously. B. Authorize the Mayor to sign the Interlocal Agreement with the City of Jacksonville for the design, construction and maintenance of Church Road (City Manager) Motion: Authorize the Mayor to sign an Interlocal Agreement with the City of Jacksonville for the design, construction and maintenance of Church Road. There was no discussion and the motion carried unanimously. ~. City Manager Hanson explained that WEB demands were very time consuming and had become more than the city's current IT staff of two could handle, and would be more cost effective to outsource WEB development services. A. Report regarding Cable Television negotiations City Manager Hanson reported that the city was ten years into athirteen- year franchise agreement with AT&T Broadband (now Comcast), and the company had requested renewal of the agreement pursuant to Section 626 of the Federal Communications Act. The City Manager further reported that the city had retained the same independent communications counsel as the City of Jacksonville. Mr. Hanson's Staff Report with recommendations regarding these negotiations is attached and made part of this official record as Attachment D. The City Manager hoped to have Comcast's new manager present at the `' ~xt Commission meeting. 10. Reports and/or requests from City Commissioners and City Attorney Commissioner Waters • Stated that the planting of pansies in the various city gardens looked great and commended the city gardeners for their work. • Stated he would like to attend the Beach Preservation annual conference in Ponte Vedra Beach in February, but due to his work schedule, he would only be able to attend afternoon programs. Commissioner Borno stated that he would also like to attend, and he would make it a point to attend the morning programs. • Inquired if artwork would be displayed in the gallery at the ribbon cutting ceremony for the Adele Grage Cultural Center. City Clerk King indicated that historical paintings, photographs and other items would be on display. He indicated that public hearings relative to the improvements would be held over the next few months. Mayor Meserve reported that he would be signing a request for a grant for an additional $160,000 from the Town Center Initiative for the design phase of the project. I am the crossing guard for Atlantic Beach Elementary on Sherry Dr. This is my third school year at this position. A resident of Sherry Dr., as well as a mother of a student there came to me today and told me of the impending petition that she and other residents have signed to present to the city on Monday to plead to have something done about the excessive speeding on their road. As the crossing guard L can attest- to the problem of the cars on that road. I have to say that I was sorry to see the road work completed as it certainly while under construction was a sure way to keep the majority of vehicles traveling at usually. a much slower speed than what I witness every day upon its completion. Even while under construction and down to barely one lane many of the cars using the road did not adhere to the school zone limit, let alone a construction limit. The school zone distance is rather long, but it is well indicated with the flashing lights as well as signs. Most of the people traveling that road do not slow down until they see the orange Bones I place in the road and/or see me standing there. Some of those people fly by doing way over the posted 15 MPH as well as the posted 25 MPH.. My children and I usually walk home in the afternoons once I ara finished. Many of the cars traveling on Sherry after the lights have stopped flashing are going at rates of more than 35 MPH.. Speeding is a problem every where, but since the road has been. repaired it is now a speedway. The residents on the street as well as myself, since I step out into it daily are at a risk and they ,have a.jus~ifiable concern-to have this addressed. Thank you. B NOVEMBER 25, 2002 COMMISSION MEETING November 19, 2002 MEMORANDUM TO: The Honorable Mayor and Members of the City Commission FROM: Jim Hans Y anager ~" SUBJECT: Follow-up eport Decorative Crossings on East Coast Drive; The City Commission has asked staff to estimate the cost of decorative crosswalks to be put at various intersections along East Coast Drive. A previous report was made that brick stamped asphalt could be installed at approximately $3,000 per crossing. The Commission expressed concern that the asphalt would wear away-over time thus reducing the effectiveness and beauty of the intersection. Estimates have now been received from the City's Core City Project contractor (Petticoat) for both stamped concrete and brick crossings with a concrete base. The stamped concrete crossing has an estimated cost of $3,500 -each. The cost for brick with a concrete base is $5,300 per crossing. If the Commission wishes to add any of these decorative crosswalks to the Core City Project, funding should be provided in the mid-year budget adjustments. Traffic Visibility at 11th Street/East. Coast Intersection; A complaint was raised at the last meeting about poor traffic visibility caused by a palm tree at the intersection of 11th Street. and East Coast Drive. The Police Department has inspected the location and has recommended trimming of the palm tree, relocating the "stop ahead" sign and repainting the white stop lines the next time the road is resurfaced. Staff feels that the palm tree can be saved if these actions are taken. By the time of the Commission meeting, the tree should have akeady been trimmed and the sign moved. ,, ATTACHMENT C NOVEMBER 25, 2002. Subdivision Regulations seeking approval of a lot less than 75 feet in width and less than 7,500 square feet of Lot Area. SUBMITTED BY: Sonya Doerr, AICP S~ Community Development Director DATE: Novemberl4, 2002 BACKGROUND: Section 24-255 (a) of the Subdivision regulations requires all new lots to have a width of not less than seventy-five (75) feet and not less than seven thousand five hundred (7,500) square feet of lot area (unless approved as part of a Planned Unit Development.) This is not a new provision, but has been part of the City's. subdivision regulations since at least 1958. The subject property is an interior portion of a legal Lot of Record. This original "parent" parcel consisted of a roughly 300-foot wide by 100-foot deep parcel located at the southwest corner of 19th Street and Beach Avenue. The current owner purchased a 5000 square, foot portion of that original "parent" parcel in August of 2001, believing that the lot conformed to City regulations. Previous divisions of this larger parcel have occurred. There is, in fact, an inconsistency in Chapter 24 with respect to this issue.. Article III, Division 5 requires a Minimum Lot Area of 5000 square feet for single-family uses in all residential zoning districts, except the RS-1 district, which requires 7500 square feet of lot area. (A 5000 square foot lot is the typical platted lot size throughout much of the City, .and it is staff's presumption that the 5000 square foot minimum requirement was intended to relate to existing platted lots and to prohibit such lots from being further divided.) Article IV (the Subdivision regulations), however, requires that all new lots meet the 7,500 square feet requirement.. Again, this requirement has been in place for many years. It has, however, been the past practice to issue building permits for construction on new lots as long as they contained 5000 square feet of lot area. Over time, the 5000 square foot .lot apparently became the standard, and the subdivision regulations were disregarded in this respect. It is Staff's opinion that Section 24-255 (a) of the Subdivision regulations should be amended so that this inconsistency is eliminated and further, that the required size of lots should be based upon the density categories as established in the Comprehensive Plan with a minimum lot size for new single- family lots established at 5000 square feet of lot area rather than the 7500 square feet now required for new lots. In effect, -this would still require a 7500 square foot lot in low-density categories, but would allow for 5000 square foot lots in the medium and high-density categories. ,.~~-. With respect to this property owner's request for a waiver from the subdivision regulations, the subject property is located within a Residential, Medium Density category, which requires 3100 AGENDA ITEM #8A NOVEMBER 25, 2002 square feet of lot area per dwelling unit. Accordingly, a 5000 square foot lot is consistent with the :"°` Comprehensive Plan. Per Florida Statutes; and below Section. 24-5 of the .Land .Development Regulations, the provisions of the Comprehensive Plan take precedent over the zoning regulations. Given the requirements of the subdivision regulations, however,: staff does not .feel .authorized to administratively waive the 7500 square foot requirement, and has recommended that the property owner present this request to the Commission as a Subdivision Waiver. Sec. 24-5. Legal Status a~zd Consisteizcy with the Comprehensive Plan. Pursuant to Chapter 163.3194(1), Florida Statutes, all Development undertaken, and all actions taken in regard to Development, shall be consistent with the adopted Comprehensive Plan. Further, all Land Development Regulations enacted or amended shall be consistent with the adopted Comprehensive Plan, and in the event of inconsistency between the requirements of any zoning or Land .Development .Regulations, the provisions of the Comprehensive Plan shall prevail.. The City Commission shall have the authority to amend the adopted Comprehensive Plan in accordance with the process established within Chapter 163.3184, Florida Statutes. BUDGET: No budget issues involved in this request. Per Sec. 24-107, of the Atlantic Beach Code of Ordinances, single-family dwellings zoned RG-2 must have a minimum lot size of five thousand (5000) square feet and, a minimum lot width of fifty (50) feet. See Chapter 24, Article III, entitled "Zoning Regulations". Per Sec. 24-255, residential lots must be at least seventy five (75) feet in width and' no less than seven thousand five hundred (7,500): square feet unless approved as a part of a planned unit development. See Chapter 24, Article IV, entitled "Subdivision Regulations". - Our lot, purchased 8/24/01, measures fifty feet by one hundred feet (50' x 100') for a ,.,. total of five thousand (5000) square feet. The zoning is RG-2. It does not appear to be in a defined "Subdivision". We are submitting our request for a waiver based on the following: (1) At time of purchase we were unaware that the lot was potentially non- conforming. (2) When we inquired about zoning regulations at the Building and Zoning Dept. we were assured that our lot met the minimum requirements for construction of a single. family home. The Building Clerk looked up our zone and determined it to be RG-2. She then referred us to Sec. 24-107, read us the lot size requirements, compared them to our survey, and verified that the lot met the minimum requirements for construction of asingle-family residence. A copy was provided for us for our records. The property wassurveyed, deeded, and recorded. .Over the last year or so since our closing, we have met with builders, come up with a design plan, hired an architect, and began the process of developing plans for our new home. In October of 2002 we received a call .from. a neighbor who was investigating the possibility of selling a portion of their property which included a rental unit.. During their investigation they had been told about an ordinance concerning the parceling of property. We told them that we had already reviewed the ordinances with the Building dept., but since they were getting their information from a different source, we decided to double check our findings... -cont.- AGENDA ITEM #8A NOVEMBER 25, 2002 -2- ,,. We immediately scheduled another meeting with Building and Zoning as well as the Community Development Director. At this meeting we discovered for the first time, some fourteen months after our closing date, the existence of a discrepancy in the code. . (3) The hardship in our situation is due to our inability to build, based on the physical dimensions required by the code. We have a significant investment at stake. The purchase was made in good faith on our part, with the expressed intention of construction of a single family home. (4) During their review of our case, the Building Official and Community Development Director were courteous and professional.. At the same time they both appeared sympathetic to our situation. Both agreed that the code contained areas that could be made less ambiguous. Sec. 24-107, in Article III, clearly states the minimum lot width (50') and size (5000 s.f.) for Zone RG-2. On the other hand, Article IV, entitled "Subdivision Regulations" has different minimum requirements, i.e. 75' width and 7,500 total s.f. (Sec. 24-255). Furthermore, although Article IV of Chapter 24 is entitled "Subdivision Regulations" the Director affirmed. that the code does not clearly define "Subdivision", which makes it even more difficult for a citizen to determine which code is appropriate. (5) If this request for waiver is granted, there would be no increase in density to the area than prior to .the creation of the new lot. The existing structure on the originally platted lot is currently a 2-family rental structure. If the waiver request is granted, one, single-family residential home is planned for each parcel, Furthermore, both property owners have agreed, if it should please the commission, as a condition of the waiver, to guarantee in writing, that construction of new dwellings on each parcel would not exceed single family dwelling units. (6) Although neighboring lots may have been platted prior to current regulations, only a small percentage of them in the immediate vicinity meet the current size requirements. Most are less than 75 feet wide, and less than 7,500 square feet. The point here is that if the request for waiver is granted, the size of the lot and type of home to be built would not be atypical for the. neighborhood. Thank you for you consideration. SUBDIVISIONREGULATIONS Sec. 24-255. Lots. (a) General. Lot size, width, depth, shape and orientation, and the minimum Building Setback lines shall be appropriate for the location of the Development and for the type of development and Use proposed. Lot arrangement and design shall be such that all Lots will provide satisfactory and desirable Building sites. In no event shall a residential Lot created after the initial effective date of these Land Development Regulations have a width of less than seventy-five (75) feet at the Building Restriction Line, or shall it contain less than seven thousand five hundred (7,500) square feet unless approved as part of a Planned Unit Development. (b) Dimensions. Lot dimensions shall conform to the requirements of Article III of this Chapter, and the depth and. width of properties reserved or laid out for commercial and industrial purposes shall be adequate to provide for the off-.Street service and parking facilities required by the type of Use and development proposed. (c) Residential Corner Lots. Corner Lots for residential Use shall have extra width, greater than a corresponding interior Lot, to accommodate the required Building Setbacks from any orientation to both Streets. (d) Street access. The Development shall provide each Lot with satisfactory and permanent access to a public Street. (e) Double frontage Lots: Creation of new residential Lots having double Street frontage .shall be avoided. (f) Building Restriction Lines. The Developer shall establish Building Restriction Lines in accordance with approved Final Subdivision Plat, and such Building Restriction Lines shall be shown on the recorded Plat. (1) Lot or Site Area: i. Single-family Dwellings: 5,000 square feet. ii. Two-family Dwellings or Townhouse: Lands designated as Low Density by the Future Land Use Map: 14,500 square feet Lands designated as Medium Density by the Future Land Use Map: 6,200 square feet Lands designated as High Density by the Future Land Use Map: 4,350 square feet iii.. Multi-family Dwellings: Minimum 5000 square feet, with allowable additional units determined by the Density limitations as set forth in the Comprehensive Plan. (2) Lot width in the RG-2 and RG-3 Zoning Districts: i. Single-family Dwellings: Fifty (50) feet. ii. Two-family Dwelling or Townhouse: Fifty (50) feet. iii. Multi-family Dwellings: Seventy-five (75) feet (3) .Lot depth in the RG-2 and RG-3 Zoning Districts: One hundred (100) feet: (e) Minimum Yard Requirements. The minimum Yard Requirements in the RG-2 and RG-3 Zoning '"'~ , Districts shall be as follows. (1) Front Yard:. Twenty (20) feet. (2) Rear Yard: Twenty (20) feet._ (3) Side Yard: i. Single-family Dwellings: Fifteen (15) total feet and five (5) minimum feet on either side. In the case of an existing Nonconforming Structure that does not comply with Required Side Yards, any new Development shall provide for a combined total Side Yard of fifteen (15) total feet. For example, where an existing Structure is located three (3) feet from the side Lot Line, new Development on the opposite side Yard shall provide a minimum Required Side Yard of twelve (12) feet, thereby providing for a combined total side Yard of fifteen {15) feet. ii. Two-family (Duplex) Dwellings and Townhouse. Seven and one-half (7.5) each side. iii. Multi-family Dwellings: Fifteen (15) feet each side. (f) Building Restrictions. The Buildings Restrictions for the RG-2 and RG-3 Zoning Districts shall be as follows. (1) Maximum Impervious Surface: Fifty (50) percent. (2) Maximum Building Height: Thirty-five (35) feet. (RMH) Ordinance Number: 90-01-172 Effective Date: January 01, 2002 Adopted: November 26, 2001 45 ATTACHMENT D NOVEMBER 25, 2002 COMMISSION MEETING CITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Cable TV Franchise Renewal SUBMITTED BY: ~ Jim Hans Cit DATE: November 18, 2002 BACKGROUND: As the Commission is aware, the City has retained the services of the same law firm that represents the City of Jacksonville in their negotiations with AT&T. The Commission is aware of the ongoing difficulty between the City of Jacksonville and AT&T in reaching an acceptable compromise to AT&T's past performance with respect to customer service. As AT&T has submitted a letter dated October 15, 2002, which constitutes a request for a franchise renewal pursuant to Section 626 of the .Communications Act (Formal Renewal Proceeding). The -City is now obligated to commence the first phase of the renewal process within six (6) months of receipt of the cable operator's request by initiating a public inquiry to ascertain (1) future cable related community needs and interest, and (2) the performance of the cable operator under the existing franchise. The City's independent communications counsel has recommended that the City undertake the. following, as is consistent with Phase I of the Formal Renewal Process and the Informal Renewal Process: A. Operator. Performance and Compliance 1. Request, review and analyze all reports and.records required by the Ordinance to be submitted to the City by the Franchisee. 2. Review any reports compiled by the City during the term of the agreement. 3. Review any issues related to the cable system brought before the City .including, but not limited to; customer service issues. 4. Determine the design and capacity of the existing cable ""~ system including, but not limited to, identification of AGENDA ITEM #9A NOVEMBER 25, 2002 products and benefits available to subscribers in the City compared to subscribers in other communities served by the system. After consultation, consider whether performing a technical audit, possibly jointly with other cities, is warranted. 5. Review Franchisee's level of compliance with Ordinance terms and conditions. . 6. Perform an analysis of franchise fee payments to the City and perform an audit of fee payments if one has not been performed for each of the. five (5) years ending : September 30, 2001, the date the new Florida Communications Simplified.Tax Act went into effect. 7. Review status of any and all pending notices of violation served on Franchisee and if warranted, place Franchisee on notice with respect to any other violations of which the City is aware. 8. Renewal Questionnaire. In order to assist the City in its evaluation of the cable operator's performance and compliance with all provisions of the Ordinance and the. ,. Franchise, the law firm would prepare a questionnaire to be issued by the City and completed by the cable operator. This will provide a written record of an element of the ascertainment process. B. Community Cable .Related Needs and Interests 1. Survey interested parties including, but not limited to, representatives of the public, community groups and City staff and officials to determine the level of equipment, facilities and support currently being provided and the adequacy of same to satisfy current needs and to assess future needs and interests. 2. Consider development. of questionnaires to be sent to City staff/off~cials and to the residents and businesses that subscribe to the cable services of Franchisee. 3. Research the manner in which similar communities are .satisfying cable related needs and interests. C. Public Hearing. In addition to reviewing subscriber input and other information related to Franchisee's performance, the City. should conduct a public hearing that provides members of the AGENDA ITEM #9A NOVEMBER 25, 2002 .community with an opportunity to be heard on cable related issues relevant to the renewal. D. Analysis of Existing Ordinance and Franchise Agreement. The Law Firm and the City should review the current documents to ensure 1) the Ordinance is in compliance with Federal law and is comparable to other municipal Ordinances; and 2) AT&T's ..compliance with the Ordinance. BUDGET: Franchise Agreement negotiations only involve stafftime at this point. However, settlement with AT&T over possible past franchise violations may result in the same type of payment to Atlantic Beach from AT&T that has xecently been announced in the agreement with the City of Jacksonville.: RECOMMENDATION: Atlantic Beach should begin the first steps of the. formal renewal process as outlined by our Attorney. For several reasons, I do not recommend that we begin separate, informal renewal proceedings with AT&T at this time. The City should defer until we see if the City of Jacksonville and AT&T were able to conclude their .negotiations, in which the City of Atlantic Beach-would be in more beneficial position to extract similar concessions from AT&T. The. sale of AT&T assets to COMCAST is expected to close within the next several weeks and Jacksonville's agreement should be completed within 90 days. While the City is obligated to commence Phase I of the Formal Renewal Process within six (6) months after receipt of AT&T's request for a Formal Renewal Process, the City's independent. communications counsel recommends that at the very minimum, the City should 1) begin its review of AT&T's performance and compliance during the past ten (10) years; 2) request various information- from AT&T; 3) determine the .design and capacity of the current cable system; 4) review the status of all notices of violations writ to AT&T; and 5) prepare. a renewal questionnaire for distribution to AT&T.
