MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, APRIL 23, 1973, AT 8:00 P. Me

The meeting was called to order by Mayor-Commissioner, Mr. Howell.
The invocation was given by Commissioner Minton, followed by the
pledge to the flag.
The minutes of the meeting of April 9, 1973, were approved as
written.
Mayor Howell recognized visitors and called for any business from
the floor not on the agenda. There was none.
At this time, Mayor Howell turned the floor over to Mr. Stephen
B. Lewallen, representative of the owners of Pecan Grove. Mr.
Lewallen made the following request: that the Developers of Pecan
Grove desires to connect to the City water and sewer system; that
the City is willing to make available its utility system and to
operate such system so that all buildings and/or residences con-
structed on Developer' s Property by Developer or by any person, firm
or corporation holding may have furnished to them and to their
occupants an adequate utility system; the developer agrees to the
payment of sewer connection charged at the rate of $180.00 per unit;
payment for each sewer connection charge will be made within 15
days after sewer connection has been made to that unit; City agrees
that the Developer of Pecan Grove shall have the right to purchase
sewer hookups for 340 units. Mr. Lewallen stated that Phase II of
Pecan Grove is now under construction and the developers will need
72 sewer hookups and he requested that the Developer be allowed to
reserve 214 units for a given period of time. Mayor Howell stated
that the City Commission set up a policy on a first come, first
serve basis for reservation of gallonage, and he was of the opinion
that the City Commission could not make any guarantee for sewage
outside the City Limits. Mayor Howell pointed out that Pecan Grove
is two months in arrears for their present payment to the City and
suggested that Mr. Lewallen bring this bill up to date by the next
Commission Meeting before it can be discussed any further.

Mro Vogel presented a letter to the City Commission, signed by Mre
Charles F. Patterson, Agent for the Owners of Cavalla Arms wherein
he stated that he request the conveyance by the City of Atlantic
Beach of the title to the 25-foot drainage ditch running along the
south side of Lots 5 through ll, inclusive, Block 16, Royal Palms
Subdivision. The land to be conveyed is a portion of the lands
acquired by the City of Atlantic Beach for drainage and utility
easements by an instrument recorded in Official Records Book 2509,
page 568, Duval County records.
In exchange for the City' s conveyance of the title to this property
to Hertz Rotenstein and Milton Lionheart, owners of the above des-
cribed lands, the owners agree to construct a 36-inch drainage pipe
connecting to an existing 36-inch drainage pipe near the southerly
prolongation of the east line of Lot 5, Block 16, connect to the
36-inch drainage pipe running under Royal Palms Drive, and continue
a 36-inch drainage pipe to a connection with a drainage pipe lying
in a right-of'-way presently owned by the City of Atlantic Beach
running approximately north and south and abutting Lot 7, Block 26,
Royal Palms Subdivision.
The City of Atlantic Beach agrees to permit the owners to fill
around the drainage pipe to normal ground level, and to install an
area of paving upon the 25-foot strip for the purpose of providing
additional parking for Cavalla Arms. The City of Atlantic Beach
further agrees to undertake future maintenance of the 36-inch
drainage pipe after its installation, and the owner grants to the
City of Atlantic Beach a right of egress and ingress across the 25-
foot strip for the purpose of accomplishing such required mainte-
nance.
After a lengthly discussion concerning the above mentioned easement
and legal advice from the City Attorney, Mayor Howell suggested that
the City table this request and advise Mre Patterson that the City
Commission is unable to act on this matter at this time°
The next item on the agenda was a request from Mre Harold J. Rooks
for a change on her permit for the number of children she wishes to
keep in her home° Mr. Vogel stated Mrs. Rooks was not in attendance
and Mayor Howell suggested that the City Commission pass over this
item° There were no objections from the City Commission.

Commissioner Minton moved the bids be referred to Committee for
study and recommendation, seconded by Commissioner Fogg and carried.
Mayor Howell appointed Commissioner Fogg, the City Manager and the
Director of Public Works to study the bids and report back to the
City Commission at the next meeting.
Mayor Howell presented and read in full Resolution No. 5-73-14
appointing Gloria June Knight City Clerk effective May 1, 1973.
Commissioner Minton moved for passage of said resolution, seconded
by Commissioner Fogg and carried. Copy of Resolution No. 5-73-14
is attached hereto and made a part hereof.
Chief Carl Stucki stated that due to our growth the beaches are
beginning to have more people on them. The City normally has life
guards on duty when school is out, but due to the large crowds on
the beach Chief Stucki recommended that the City employ the life-
guards on a partime basis using them on weekends and holidays. He
anticipates that the cost will not exceed $1,000.00. It was moved
by Commissioner Speed, seconded by Commissioner Rosborough and
carried that the Chief of Police be given approval to hire life-
guards on weekends and holidays until the regular season begins.

Mr. Hilliard stated the Public Works Department have placed signs in
the City giving directions to Hanna Park. After discussion, it was
moved by Commissioner Fogg, seconded by Commissioner Minton and
carried that the sign be place at Atlantic Boulevard and Seminole
Road stating "Seminole Road Dead End - Next 2-3/10 Miles" .
Mr. Hilliard discussed the possibility of enlarging the sewer plant
due to the increase of population. Mayor Howell suggested that the
City get more information as to the City' s needs before the City
Commission discusses enlarging the sewer plant.
Mr. Vogel requested permission to call for bids on culvert pipes.
There were no objections from the City Commission.
Mayor Howell presented Resolution No. 5-73-15 commencing May 1, 1973 ,
Mrs . Adele S. Grage be engaged in an Advisory capacity at an annual
salary of $10.00 per year. Commissioner Minton moved for passage
of said resolution, seconded by Commissioner Fogg and carried. Copy
of Resolution No. 5-73-15 is attached hereto and made a part hereof.
Mayor Howell stated that April 17, 1973, the Cities of Jacksonville
Beach, Atlantic Beach, Neptune Beach and the Town of Baldwin filed
a brief with the First District Court of Appeals in Tallahassee,
Florida, on the case of Beaches Cities vs. H. S. Albury, et al.
There being no further business Mayor Howell declared the meeting
adjourned.
