MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, OCTOBER 22, 1973, AT 8:00 P. M.

ABSENT : None
The meeting was called to order by Mayor-Commissioner, Mr. Howell.
The invocation was given by Commissioner Minton, followed by the
pledge to the flag.
The minutes of the meeting of October 8, 1973 were approved as
written upon a motion of Commissioner Fogg, seconded by Commissioner
Rosborough and carried. After discussion, a substitute motion was
introduced by Commissioner Fogg, seconded by Commissioner Minton
and carried that the minutes be approved as written with a correction
on Page Three - Re: Fox Garden Apartments. The minutes should read
"the vote was: Aye- Commissioners Minton, Rosborough, Fogg and
Mayor Howell. Nay - Commissioner Speed.
The minutes of the meeting of October 16, 1973 were approved as
written upon a motion by Commissioner Minton, seconded by Commissio-
ner Fogg and carried. A substitute motion was introduced by Com-
missioner Fogg, seconded by Commissioner Minton and carried that
Commissioner Speed' s name be deleted from those being present at the
meeting of October 16, 1973.
Mayor Howell recognized visitors and called for any business from the
floor not on the agenda.
At this time, Mayor Howell recognized Mrs. Blalock, who represented
Roland' s Red Barn, 375 Atlantic Boulevard. Mrs. Blalock stated that
Roland' s applied for a liquor license and had met all the require-
ments of the State of Florida, but not the requirements of the City
of Atlantic Beach. Mayor Howell stated that at the present time the
City of Atlantic Beach has an ordinance which prohibits the sale of
alcoholic beverages of not more than 14% by weight from a point 200
feet east of center line of a street designated Sylvan Drive, west to
the City Limits. (Chapter 2, Sec. 3-3 The Code of the City of Atlantic
Beach)

Mrs. Blalock requested that the ordinance be amended to allow the
sale of alcoholic beverages in connection with the sale of food.
The special license are now allowed by the State of Florida . After
discussion, and no objections from the City Commission, the City
Attorney was instructed to draw up the necessary ordinance for pre-
sentation at the next meeting.
Mr. George Bull, Sr. presented to the City Commission a check in the
amount of $23, 000.00 from RCBS and requested that the City Attorney
start the necessary paperwork for the exchange of the present city
yard to a new and larger site . Mayor Howell accepted the check for
the City of Atlantic Beach.
Advertisement - The Searchlight:
Mayor Howell stated that the City Commission had received a request
for an ad to be placed in The Searchlight ' s convention bulletin.
Commissioner Rosborough stated that if this request is not from a
local concern, he is of the opinion that the City should deny this
request. After discussion, it was moved by Commissioner Speed,
seconded by Commissioner Fogg and carried that the City Commission
disapprove this request for an ad in The Searchlight.
City of Jacksonville Beach - Fill Dirt in September:
Mr, Vogel stated that the City of Atlantic Beach received an invoice
in the amount of $4, 970. 35 to sustain the life of the landfill in
Jacksonville Beach until the end of the year. A discussion followed,
with Mayor Howell pointing out that the City of Atlantic Beach has
been paying its pro rata share of the bulldozer used at the landfill .
The City Commission instructed the City Manager to withold payment
until a determination can be made as to the status of the lease-pur-
chase bulldozer.
First Baptist Church:
Mr. Vogel stated that the City Commission had instructed him to write
the property owners adajacent to the land owned, by the First Baptist
Church, Section H, Block 208, Lots 1 through 6 . He wrote five letters
and received two replies with no one objecting . The City Commission
instructed the City Manager to contact the First Baptist Church and
request that they present the Commission with the plans they have
for this property .

Call for Bids - Garbage Truck Chassis and Body:

No other bids were received.
Commissioner Minton moved, seconded by Commissioner Fogg and carried
that the bids be referred to Committee for study and recommendation.
Mayor Howell appointed Commissioner Minton chairman.
Mr. Walter J. Parks, Jr. - Water System:
Mr. Parks stated that based on the operating experience through the
first eight months of the year, present committments and construction
underway, the existing facilities are not going to be adequate to
meet peak loads that are anticipated. The City is going to need
additional pumping capacity. An analysis of the situation will per-
haps indicate the need for an additional elevated tank. The next
move would be to determine what it is going to take to satisfy the
City' s immediate requirements and what it is going to take to satisfy
reasonable forseeable requirements for five to ten years. After
lengthly discussion, it was moved by Commissioner Fogg, seconded by
Commissioner Speed and carried that the City Commission authorize
Mr. Parks to move ahead to the next step to determine what it is
going to take to satisfy the City' s immediate requirements and what
it is going to take to satisfy future requirements.
Ordinance - 1st Reading: Change Section 28-14 Item (8) (b) :
Mayor Howell presented Ordinance 90-73-60 amending Ordinance 90-59-3
providing for the zoning of the City of Atlantic Beach, Florida, on
first reading by title only. Said ordinance was presented in full
and in writing. Commissioner Speed moved that the Ordinance be
approved on first reading by title only, seconded by Commissioner
Fogg and carried. Public Hearing to be held on November 12, 1973 °
Resolution No. 73-22:
Mayor Howell presented in full and in writing Resolution Noe 73-21.
entitled Budget Transfers and Changes to be made in the 1973 Budget.
't was moved by Commissioner Minton, seconded by Commissioner
Rosborough and carried that Resolution Noe 73-21 be adopted. Copy
of said resolution is attached hereto and made a part hereof.

Commissioner Rosborough asked for a report on the status of the
blinking light to be installed at Seventh and Ccean Boulevard. Chief
Stucki reported that the light has been ordered and that part of the
cable has been installed. Commissioner Rosborough stated that
through observation it is exceptionally dark between 7th and 10th
Streets on Ocean Boulevard. Mr. Hilliard stated that there are a
sufficient number of lights along Ocean Boulevard.
There being no further business Mayor Howell declared the meeting
adjourned.
