MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, NOVEMBER 12, 1973, AT 8:00 P . M.
PRESENT: William S Howell, Mayor-Commissioner

The meeting was called to order by Mayor--Commissioner, Mr. Howell.
The invocation was given by Commissioner Minton, followed by the
pledge to the flag .
The minutes of the meeting of November 6, 1973 were approved as
written upon a motion by Commissioner Minton, seconded by Commissio-
ner Fogg and carried.
Mayor Howell recognized visitors and called for any business from
the floor not on the agenda.
Mr. George Bull questioned the Commission about the exchange of the
present city yard to a new and larger site . Mayor Howell stated
that at the present time the City Commission has nothing to report.
M . I . Bowan Re: Outside City Water and Sewer:
Mr. Bowan requested sewer and water service between 18th and 19th
Streets, East of Seminole Road. Mayor Howell stated that the City
Commission is studying the feasibility of running sewer and water
lines outside the city limits. After discussion, it was moved by
Commissioner Fogg, seconded by Commissioner Cook and carried that
the City Commission meet as a whole on Monday, November 19, 1973,
to discuss sewer and water outside the city limits and moving the
city yard site .
First Baptist Church:
Mr, Jack Proctor spoke in behalf of the First Baptist Church. The
church requested a variance on their property located in Section H,
Block 208, Lots 1 through 6 . He stated that the church would use
the property for a retreat and recreational area for their member-
ship. It was moved by Commissioner Cook, seconded by Commissioner
Minton and carried that a variance be granted on Block 208, Lots 1
through 6, Section H.

Ordinance No. 90-73-60:
Ordinance No. 90-73-60 amending Ordinance Noo 90-59-3 providing for
zoning of the City of Atlantic Beach, Florida, was presented in full,
in writing and read on second and final reading by Mayor Howell,
Said ordinance was posted in line with charter requirements , He
then declared the meeting in session for a Public Hearing on said
ordinance. As no one appeared either for or against the ordinance,
Mayor Howell declared the Public Hearing closed. Commissioner
Minton moved for passage of Ordinance 90-73-60 on second and final
reading, seconded by Commissioner Fogg , During discussion, Mayor
Howell objected to the change in the ordinance which would allow
outside storage of stocks, supplies or equipment in a Business A
District. A substitute motion was introduced by Commissioner Foag,
seconded by Commissioner Minton and carried that the Public Hearing
cn Ordinance Noo 90-73-60 be postponed until the next meeting at
which time the City Attorney will bring the necessary changes in
order to clarify the ordinance.
Ordinance No , 10-73-9:
Ordinance No. 10-73-9 regulating hours for the sale of alcoholic
and intoxicating beverages in the City of Atlantic Beach, Florida;
restricting the location wherein a vendor of alcoholic beverages
shall be permitted to conduct his place of business was presented in
full, in writing and read on second and final reading by Mayor
Howell. Said ordinance was posted in line with charter requirements.
He then declared the meeting in session for a Public Hearing on said
ordinance. As no one appeared either for or against the ordinance,
Mayor Howell declared the Public Hearing closed. Commissioner
Minton moved for passage of Ordinance No, 10-73-9, seconded by
Commissioner Fogg and carried.
Ordinance No. 90-73-61 :
Ordinance No. 90-73-E:1 amending Ordinance No. 90-59-3 being "an
ordinance providing for the zoning of the City of Atlantic Beach"
was presented in full, in writing and read on second and final read-
ing by Mayor Howell. Said ordinance was posted in line with charter
requirements . He then declared the meeting in session for a Public
Hearing on said ordinance . As no one appeared either for or against
the ordinance, Mayor Howell declared the Public Hearing closed.
Commissioner Cook moved for passage of Ordinance Noo 90-73-61 on
second and final reading, seconded by Commissioner Minton and
carried,

Resolution Noe 73-25:
Mayor Howell presented in full and in writing Resolution Noo 73-25
requesting the State of Florida Department of Community Affairs tc
include Atlantic Beach in its application to the U. S . Department of
Housing and Urban Development for local planning assistance funds
for the fiscal year beginning July 1, 1974. It was moved by Com-
missioner Minton, seconded by Commissioner Fogg and carried that
Resolution Noo 73-25 be adopted. Copy of said resolution is attach-
ed hereto and made a part hereof.

Week.
There being no further business Mayor Howell declare• e meeting
