MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD AT THE CITY HALL ON MONDAY, SEPTEMBER 11,
1972 AT 8: 00 P. M.
Present: W. S. Howell, Mayor-Commissioner
R. R. Rosborough
L. W. Minton, Jr.

F. W. Fogg, Commissioners

The meeting was called to order by the Mayor-Commissioner, Mr.
Howell.
The Invocation was given by Commissioner Minton, followed by
the pledge to the flag.
The minutes of August 28, 1972 were approved as written upon
motion of Mr. Speed, seconded by Mr. Rosborough and carried.
The Replat of acreage in Royal Palms Unit #2 to be prepared for
Mr. Fox is not ready. This item will be passed to the next
meeting.
The Ordinance for placing certain acreage in P.U.D. has not
been completed. Mr. George Bull advised he will be out of the
City for sometime after the first part of October and would
like to get as much accomplished as possible before he has to go.
He would like to personally make his presentation on this. The
Mayor stated this will be passed to the next meeting.
An Ordinance amending 1972 Budget Ordinance #20-71-23 was
presented in full in writing for passage on first reading by
title only. Mayor Howell read the title, following which Mr.
Rosborough moved passage of said Ordinance on first reading by
title only, seconded by Mr. Speed and carried. Public Hearing
will be September 25, 1972 at 8:00 P. Me
Ordinance #70-72-6 covering amendment to Utility Tax Ordinance
to include fuel oil was presented for second and final reading.
Mayor Howell read same in full, then declared meeting in session
for Public Hearing. Notice of Public Hearing was posted in line
with Charter requirements. AS no one appeared either for or
against said Ordinance the Mayor declared the Public Hearing
closed. Mr. Minton moved that Ordinance #70-72-6 be passed on
second and final reading, seconded by Mr. Speed and carried.
There was one bid received for drainage pipe as follows:

Mr. Minton moved that, pending passage of the Ordinance amending
the 1972 Budget, the awarding of this bid be postponed to the
next meeting, seconded by Mr. Rosborough and carried.

The semi-annual Water Department Audit was received.
Mr. Hilliard, Director of Public Works, reported on the condi-
tions around the Pic N' Save Store and it was advised that
we have made several attempts to contact the proper officials
without success to get the clean-up done. The Commission directed
that a letter be written to Pic N' Save to get cleaned up or we
will clean and assess against the property.
The Mayor advised that no further word has been received on the
cigarette tax allocation.
Mr. Ball outlined the situation as to the City of Jacksonville
and Occupational Licenses. The City of Jacksonville has levied
a Municipal Occupational License against our business people in
Atlantic Beach. He advised the City Attorneys of the Beach
Cities have discussed this and it is their opinion that we should
go to Court quickly on this illegal taxation. He asked approval
to go to Court for the City of Atlantic Beach with the other
Beach Cities and perhaps some individuals, and it should be done
before the next Commission meeting. There was discussion
following which Mr. Minton moved that we go along with the
recommendation of the City Attorney, seconded by Mr. Rosborough
and carried.
There being no further business, the meeting was adjourned by
the Mayor.
