MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD AT THE CITY HALL ON MONDAY, MARCH 22 , 1971
AT 3 : 00 P.M.

The meeting was called to order by the Mayor-Commissioner ,
Mr . Howell .
The Invocation was given by Commissioner Minton , followed _b'y
the salute to the flag .
Upon motion of Mr . Longo , seconded by Mr . Johansen , and
carried , the minutes of the regular meeting of March 3 , 1971 ,
were approved as written .
Mayor Howell recognized visitors present and called for any
business from the floor which was not on the agenda.
Mr . Ernest Davis stated that he would like to get permission
to continue construction of the building he started some
years ago , on Roberts Street . Mayor Howell asked if he was
going to request a beer license and upon an affirmative
answer , City Attorney Ball stated that the beer license could
be issued if the property was so zoned . Although , he stated ,
the building permit originally issued is expired and he would
need a new building permit to continue with the building ,
which permit would carry with it any new stipulations which
would be required by the City . Mr . Davis stated that inso-
far as the beer license was concerned , he had approached the
neighbors and had a letter signed by many of them of that
area who were not opposed to such a license being issued .
Further , insofar as the footage from the churches in that
area, which question arose in earlier discussion , City
Attorney Ball stated that the state would allow the license
to be issued , as it was strictly up to the Ordinances on the
books of the City of Atlantic Beach as to whether or not it be
issued . Commissioner Rosborough stated that if the neighbors
did not object to the issuance of the beer license , he could
see no reason why the City should . Mr . Davis was asked if he
was going to finish the building this time , and he answered
that he now had the required financing and upon his obtaining
a new building permit , he would get to work on the completion
of said building immediately .

Mr . Marvin Ganson stated that he owned property is the Ed
Smith sub-division and had submitted proposals for building
a townhouse apartment complex. Mayor Howell stated that this
had been discussed and no action taken on it as yet . He
further stated that the plans did not meet sideline or lot
size requirements and it would take a complete change in
the subdivision ordinance as lots would have to be replatted
smaller than they are presently platted . Sewers are in and
water would have to be put in on a per foot basis . Mayor
Howell also inquired as to what was going to be done about
street paving . It was advised the developers would pave .
The complex calls for 1 Buildings of >0 units to sell for
$15 , 000 to $18 ,000 , 2 and 3 bedrooms . Mayor Howell suggested
calling a special committee meeting to discuss this matter .
It was moved by Commissioner Longo, seconded by Commissioner
Minton that the Commission as a whole meet as a committee to
consider and discuss Mr . Ganson ° s proposal . The motion was
carried and the committee meeting was set for Thursday night ,
March 25th at 8 : 00 p .m.
It was ascertained that , since the project on Atlantic
Boulevard which was asking for permission to name streets
in the Atlantic Arms Apartments complex would not be public
streets , no formal action was needed on this request . The
streets are within the property of the project itself.
Commissioner Longo made a report on the Mobile Radio Unit
requested by City Manager Vogel , and he stated that he had
with several other agencies involved with securing
this communication system. He found that they were going
to UHF and we are now using VHF. The particular radio GE
was low on in bidding , would have to be changed . He asked
to hold the award in abeyance until he could talk to GE
and ascertain as to whether it was UHF or VHF, and asked that
it be carried over to the next meeting .
Mr . Vogel advised that we have been working for sometime on
getting relief to the traffic situation at Mayport Road and
Atlantic Boulevard . Main St . also comes into this inter-
section at an angle . He proposed that Main St . be abandoned
:rom West 1st Street to Atlantic Boulevard and the property
revert back to the owners on each side of the street . In
return the City would be deeded a portion of Block 23 Sec .
H which would help straighten out the curve at W . 1st Street
and Main Street . West 1st Street could then be stabilized
and traffic could be routed from Mayport Road down :gest 1st
Street to Begonia Street then to Atlantic Blvd . , thus relieving
some of the traffic jam at the above mentioned intersection .

Following discussion , it was moved by Mr . Longo , seconded by
Mr . Minton that the City Attorney proceed with any necessary
paperwork to conclude theproject and to do whatever is neces-
sary to abandon the recommended area. Motion passed unani-
mously. Rerjzolution # 71-5-A is attached hereto and made a part hereof,
Public Works Superintendent Dick Hilliard asked for and re-
ceived permission to call for bids for a 1/2 ton pickup
truck. He stated that it was getting close to lifeguard
season and they would be using one of the present available
trucks .
Commissioner Longo asked about Pleasant Acres . City Manager
Vogel stated that the owner had been contacted by letter and
had promised to have it cleaned up by meeting date . As of
today it was not cleaned up . City Manager Vogel then stated
that he would inspect the premises tomorrow (Tuesday) and if
the property was not cleaned , he would notify the owners that
if it was not taken care of property by the next Commission
meeting of April 12 , the City would do the work and a lien
would be assessed against the property .
Mayor Howell stated that he wanted to once again remind the
public that special meetings would be held March 29th ,
April 5th, and April 12th, 1971 , at 2 : 00 p .m. concerning the
coming sewer bond election , in an effort to explain to the
public the reasons behind the sewer bond issue coming up on
April 20 , 1971 .
There being no further business , the meeting adjourned at
8 : 30 P.M.

RE:SOLUTIO NO. 7/-- 5.- A
WI-:1 REE AS, this Resolution of the City Commission of the City of Atlantic
Beach, Florida, relates to the closing of a certain public street within the
City limits of the City of Atlantic Beach, Florida, and
WHEREAS, the City has reached an agreement with certain owners of real
estate properties in Section 'In", Atlantic Reach, in that the City will
abandon a portion of an undeveloped street in exchange for properties for
the purpose of the straightening and development of other streets, and
WHEREAS, the exchange of properties is of benefit to the City of Atlantic
Beach, and is of public purpose,
NOW, THEREFORE, BE IT RESOLVED BY TILE CITY COMMISSION OF TIE CITY OF ATLANTIC
BEACH, FLORIDA, AS FOLLOWS:
Section 1.
That piece, parcel or tract of land situate, lying and being within
the City of Atlantic Beach, County of Duval, State of Florida, to-wit:
All of Main Street in Section "II", Atlantic Beach, according to plat
thereof recorded in Plat Book 18, page 38, of the current public
records of Duval County, Florida, lying Southerly of the Southerly
right-of-way line of West First Street (as re-located) and Northerly
and Northwesterly of the Northerly right-of-way line of Atlantic
Boulevard and the Westerly rightrof-way line of Mayport Road.
Section 2.
That said street is hereby closed, vacated and abandoned; however,
this abandonment is not to be construed to affect any, if any,
existing easement in favor of any municipality or public utility,
the right of which should not be affected by this closing.
