08-12-71 v • MINUTES OF THE SPECIAL MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON THURSDAY, AUGUST 12, 1971 AT 7: 30 P. M. Present: William S . Howell, Mayor-Commissioner Arthur J. Longo L. W. Minton, Jr. R. R. Rosborough M. F. Marvin and R. C. Vogel, City Manager Oliver Ball, City Attorney Absent: Adele S. Grage, City Clerk The meeting was called to order by the Mayor-Commissioner, Mr. Howell. Mr. Howell advised the Commission that this was a special called meeting for the purpose of hearing Chief Stucki' s complaints against Rexwood, Inc. , known as the Big "L" , at 1805 Mayport Road. Chief Stucki read the charges, incorporating in the complaint incidents occurring in and around this establishment for the past two years. In the opinion of Chief Stucki the presence of this beer tavern is the catalyst for the disturbances and incidents outlined in his complaint. Mr. Rex Thames, owner of the Big "L" was represented by Attorney John H. P . Helms. Mr. Helms asked for a continuation in that he had short notice of the hearing and felt that it was insufficient time to pre- pare an adequate defense. Mr. Howell advised that this was not a Court of Law nor were Court procedures to be used during the hearing. Also, the notice was in compliance with City law and Commission rules. Attorney Helms then proceeded to ascertain the scope of the charges which were based on Chapter 10, Section 10-4, of the Code of the City of Atlantic Beach. There was a discussion provided by several employees of the Big "L" outlining the type of operation and conduct of the patrons. There Were complaints from residents of the immediate vicinity, also positive expressions by others who felt that the operation should be continued. Mr. Howell allowed the meeting to continue until everyone present who wished to speak for or against the operation of this business was heard. He then called for a 10 minute recess for the purpose of conferring with Mr. Thames and his Attorney. • Minutes 8/12/71 Page #2 The meeting was then reconvened and Mr. Helms proposed that the decision be held in abeyance for two weeks, and for this period of time Mr. Thames would not allow any alcoholic beverages to be sold or consumed on the premises. The Commission concurred in this proposal by a vote of 4 to 1. Mr. Minton cast the dissenting vote.
