MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD AT THE CITY HALL ON MONDAY, SEPTEMBER 28, 1970
AT 8:00 P. M.

The meeting was called to order by the Mayor-Commissioner, Mr.
Howell.
The Invocation was given by Commissioner Rosborough.
The minutes of the meeting of September 14; 1970 were approved as
written upon motion of Mr. Longo, seconded by Mr. Rosborough and
carried.
Mayor Howell recognized visitors present and called for any busi-
ness from the floor not on the Agenda . There was none.
Mr. E. E. "Ace" McCartlin, Jr. , President of Aladdin Structures,
Inc. , presented their plan to erect modular homes in the Ed Smith
Subdivision. He advised these houses are factory built in 2
sections which are placed on required foundation and bolted to-
gether. He advised they meet and surpass the Southern Standard
Building, Plumbing and Electrical codes. He would like to
request us to change our Ordinances to accept the Southern Standard
Electrical code rather than the City of Jacksonville code. He
stated the reason being the City of Jacksonville Electrical code
requires work to be done by Duval County where their electrical
work is done in factory, and that F.H.A. inspects and it is all
first class work. Mr. Vogel advised that our inspections have
been made by the City of Jacksonville by our choice, but he has
been advised by the City of Jacksonville that we can do our own
inspections if we so choose, but this does not mean that we are
going to have shoddy work, but are going to have electricians with
same qualifications as before. Mayor Howell asked which Code we
are going to inspect by and also who will decide on qualifications
of electricians. Mr. Vogel advised he has not suggested changing
anything but for the inspection to be done by Atlantic Beach. He
stated what he wanted clarified at this meeting was the paving
guide lines to be used on these streets that have been accepted
by the City without being paved. In this subdivision the sewer is
in and water can be run on a front foot basis, but the paving has
to be determined. Mr. McCartlin advised they are willing to co-
operate with the City on this. The matter was discussed at length
in which it was brought out that F.H.A. does not require paved
streets, but prefer paved streets. Mr. Howell stated the City' s
policy as to paving new subdivisions and also as to streets which
have been accepted by the City without paving. The usual method

on the latter is 1/3 City and 2/3 property owners, however, the
formula should be worked out in each instance according to bene-
fits received. Mr. Harcourt Bull and Mr. Hilliard spoke on
the matter. There was further discussion in which it was brought
out that F.H.A. approval has not yet been received for this
project, but when received they would like to go to work. It was
agreed that this matter can be studied and some decision reached
at next meeting. Mr. Hilliard advised he does not have personnel
to do this paving and it will have to be contracted out, if we
decide to pave.
Bids were next received on the tractor mower as follows :

A representative of Florida Tractor Corporation asked if a bid
had been received from them. It was advised it had not, and he
stated it was mailed last Thursday. If comes in through normal
mail and postmark is as stated, it will be referred to Committee.
Mr. Rosborough moved bids be referred to Committee to report back
at next meeting, seconded by Mr. Longo and carried. Commissioners
Longo and Rosborough with Mr. Hilliard will be Committee.
Bids were next received on sewer facilities to serve Buccaneer
Trailer Park as follows2

Mr. Longo moved the bids be referred to Committee for report at
next meeting, seconded by Mr. Rosborough and carried. Mayor
Howell appointed Commissioner Johansen and Howell with City
Manager Vogel and our engineer, Mr. Walter J. Parks, as Committee.
Mr. Parks advised the reason for the Addendum was to determine
cost of a 6" line over a 4" line on Mayport Road portion. A 4"
line is of such limited capacity that it would not be feasible
for joint use by anybody. If anyone else wanted to join our
system it would mean another line and such space on Mayport Road
is limited.

Mr. Howell presented Ordinance 95-70-12 prohibiting the distribu-
tion of obscene material for passage on second and final reading
and read same in full. Notice of Public Hearing on said Ordinance
was posted in line with Charter requirements . Mayor Howell then
declared the meeting open for Public Hearing on said Ordinance.
Mr. Bull stated he was not for or against Ordinance but inquired
as to who was to decide if anything was obscene or not, and Mr.
Howell advised the Municipal Judge would make the decision. As
no one appeared either for or against said Ordinance, Mayor Howell
declared the Public Hearing closed. Mr. Longo moved passage of
Ordinance 95-70-12 on second and final reading, seconded by Mr.
Rosborough and carried.
Mr. Howell presented an Ordinance amending Section 7-B of Chapter
7 of the Code of the City of Atlantic Beach as to electrical
inspections. Said Ordinance was presented in full in writing for
passage on first readiny by Title only. Mr. Johansen moved passage
of said Ordinance on first reading by Title only, seconded by Mr.
Longo and carried. Public Hearing was set for October 12, 1970
at 8:00 P. M.
There being no further business the Mayor declare he meeting
adjourned.
