tMINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD AT THE CITY HALL ON MONDAY , DECEMBER 14 ,
1970 AT 8 : 00 P.M.

The meeting was called to order by the Mayor-Commissioner Mr .
Howell .
The invocation was given by Commissioner Minton , followed y
the salute to the Flag .
Upon motion of Mr . Minton , seconded by Mr . Rosborough , the
minutes of the meeting of November 23 , 1970 , were approved
as written . Motion carried .
Mayor Howell recognized visitors present and called for any
business from the floor not on the Agenda. There was none .
Bids were presented covering Petroleum products for 1971 .
Copy of certified Proof of Publication of "Call for Bids ', is
attached hereto and made a part hereof , Bids were received
from the following :
American Oil Company
McCall Service , Inc .
Mr . Minton moved bids be referred to Committee for tabulation
and report back at next meeting , seconded by Mr . Johansen ,
and carried . Commissioner Minton , City Manager Vogel and
Public Works Superintendent Hilliard were named as Committee .
Bids on Insurance for 1971 were next received . Copy of Proof
of Publications of "Call for Bids" is attached hereto and
made a part hereof . Bids were received from the following :

It was moved by Mr . Rosborough, seconded by Mayor Howell , that
it be turned over to Committee for report back to the next
meeting . The call vote was as follows :

Following a short discussion , wherein Mr. Minton stated that
he was sure that if the City Clerk sent out bid invitations
to others and the McNeill Insurance Agency was the only one to
reply , it was his feeling the bid should be awarded to them.
Mayor Howell advised that what is needed was to firm up the
bid as a matter of information for the City Commission due to
new raises in the' 1971 budget the Workmen ' s Compensation pre-
miums are due to be increased . It was moved by Commissioner
Rosborough , seconded by Mr . Minton , and carried , that the bid
'ie referred to committee to come back to the next meeting .
Mayor Howell presented Ordinance #20-70-20 for second and
final reading , and read same in full . Said Ordinance amends
Ordinance #20-69- 19 adopting the budget for the City of
Atlantic Beach , Florida for the fiscal year 1970 . Notice of
Public Hearing was posted in line with. Charter requirements .
Mr . Howell then declared the meeting in session for Public
Hearing on said Ordinance . As no one appeared either for or
against said Ordinance , to Mayor declared the Public Hearing
closed . Mr . Minton moved passage of Ordinance #20-70-20 on
second and final reading , seconded by Mr . Johansen and carried .
Mayor Howell presented Ordinance #20-70-21 for second and
final reading , and read same in full . Said Ordinance adopted
the budget for the City of Atlantic Beach , Florida for the
fiscal year 1971 and appropriates money to provide for the
debts and expenses of the City as therein shown . Notice of
Public Hearing was posted in line with Charter requirements .
Mr . Howell then declared the meeting in session for Public
Hearing on said Ordinance . As no one appeared either for or
against said Ordinance , the Mayor declared the Public Hearing
closed . Mr. Minton moved passage of Ordinance #20-70-21 on
second and final reading , seconded by Mr . Johansen and carried .
Resolution 70-24 was presented covering water and sewer service
outside the City, and read by Mayor Howell . Public Hearing
date was set for December 23 , 1970 . It was moved by Mr .
Rosborough and seconded by Mr . Johansen for passage and
motion carried . Copy of said Resolution is attached hereto
and made a part hereof .
Resolution 70-25 covering purchase of 9 Saltair lots for $200
each, was presented and read in full by Mayor Howell . It was
moved by Mr . Minton , seconded by Mr . Rosborough , that the
Resolution be passed with the funds coming out of Account 1051 ,
Emergency Fund . Motion carried . Copy of said Resolution is
attached hereto and made a part hereof .
Resolution 70-26 covering Rent Supplements Housing Urban
Development was presented and read by Mayor Howell . Commis-
sioner Johansen asked if it was not put in in time to get on

the Agenda, and Mr . Rosborough asked if this was expedient in
nature and received a negative answer . It was moved by Mr .
Minton , seconded by Mr . Rosborough , and passed , that this
Resolution be held over until the next meeting.
Mr . J. Patrick Michaels , Jr . , Vice President of T .M.Communica-
tions appeared on behalf of their desire to install their TV
cable in the Beaches area and Northern part of St . Johns County.
He stated that Mr . Vogel had been supplied with information from
their company and they brought with them to this meeting , a
proposed Ordinance . He showed two maps of Florida designating
the areas where their cables are now installed and the proposed
locations of further installations . He further stated that
this cable tv would not only bring in their programs , but
other programs as well . When asked by Mc . Johansen what the
anticipated revenue to Atlantic Beach was on their proposed
five percent , he estimated that with 1 , 000 subscribers , over
a four year period , they would gross approx. $60 , 000 . Mayor
Howell asked Mr . Michaels if he would be good enough to contact
Mr . Vogel , City Manager , and make a date with him to discuss
this further and in more detail .
City Manager Vogel reported Mrs . Drage ° s mileage for the month
of November to be 220 miles and his was 553 .
Police and Fire Chief report on Police Department was submit-
ted for information and filing for the month of November .
Mayor Howell requested that the rules be waived and he presen-
ted Resolution 70-27 to be addressed to the Army Corp of
Engineers objecting to the proposed outfall lines of ITT
Rayonier Corp . of Fernandino Beach where they intend to dump
affluents from their operations some 21/2 miles into the Atlantic
Ocean . He stated it was simply more pollution of the ocean
which need not be done because there are other methods avail-
able to Rayonier ° s dumping , if they would spend the money . It
was moved by Mr . Johansen , seconded by Mr . Minton , and passed
that the rules be waived and the Resolution passed at this
time . Copy of Resolution #70-27 is attached hereto and made
a part - hereof .

RESOLU'T'ION NO: 7,2 -- „.-
WHEREAS, the City of Atlantic Beach, Florida, pursuant to its duly
adopted Ordinance No. 80-65-8 (Sewer Service Charges) , Ordinance No.
80-59-3 and Ordinance No. 80-61-6 (Water Service Charges) , charges
its sewer and water customers outside the city limits of the City
of Atlantic Beach, Florida rates of 50% in excess of the rates
charged customers within the city limits of the City of Atlantic
Beach, Florida, and
WHEREAS, the Florida State Legislature at its recent Special Session
has adopted a Statute, being identified as Senate Bill No. 281, which
permits a municipality to charge its sewer and water customers outside
their municipal boundaries a rate of 50% in excess of the rates within
the boundaries of the municipality only after a public hearing, at
which all the users of the sewer and water system and owners, tenants
or occupants of property so served and all other interested persons
have an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OC1MMIISSICN OF THE CITY OF
ATLANTIC BEACH, FLORIDA, AS FOLLOWS:
1. The City Commission of the City of Atlantic Beach, Florida
will convene in Official Special Session for the purpose
of a public hearing at 8:00 O'clock P.M. on the 2day
of December, 1970.
2. The purpose of this Official Special Session is to hear all
interested parties in the matter of water and sewer rates
for service outside the boundaries of the City of Atlantic
Beach, Florida.

WHEREAS, the City of Atlantic Beach, Florida, is the owner of and is
responsible for a certain major drainage ditch adjoining the herein-
after described real estate, and
WHEREAS, that certain drainage ditch, over a period years, has
broadened and encroached upon the hereinafter described real estate,
and
WHEREAS, the owners of the hereinafter described real estate have
agreed to sell these bordering and adjoining undeveloped lots to the
City of Atlantic Beach, Florida, at the negotiated figure of $200.00
each, and
WHEREAS, the seller's price of the hereinafter described real estate
appears reasonable and is less expensive than the oost of repair and
replacement of the parts of the encroadunent of the hereinafter des-
cribed real estate, and
WHEREAS, it is determined that the acquisition of this hereinafter
described real estate is necessary and proper and for the public
purpose of maintaining adequate drainage for the community,
N(XJ, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
ATLANTIC BEACH, FIDRIDA, AS FOLLOWS:
1. That the City of Atlantic Beach, Florida, purchase from C. T. Boyd,
Jr., individually and as trustee joined by his wife, the following
described real estate:
Lots 85, 86, 87, 88, 89, 91, 92, 93 and 94, SALTAIR, Section 3,
according to a plat thereof recorded in Plat Book 10, page 16,
of the current public records of Duval County, Florida.
2. That the City of Atlantic Beach, Florida, pay to C. T. Boyd, Jr. ,
individually and as trustee joined by his wife, the sum of
$1,800.00 as and for the purchase price of the above described
real estate.

RESOLUTION # 70-26
RESOLUTION APPROVING APPLICATION OF THE
RENT SUPPLEMENTS PROVISIONS OF THE HOUSING
AND URBAN DEVELOPMENT ACT OF 1965 TO
ATLANTIC BEACH, FLORIDA.
WHEREAS, under the provisions of Title I of the Housing and
Urban Development Act of 1965 (Public Law 89-117, 12 U.S.C. 1701s) ,
the Secretary of Housing and Urban Development is authorised to
make rent supplements in the form of annual payments to certain
housing owners on behalf of tenants who are disadvantaged as eat
forth in the criteria of that Act; and
WHEREAS, it appears desirable and in the public interest that
such rent supplements provided in that Act be made available within
Atlantic Beach, Florida.
NOW, THEREFORE, be it resolved by the City Commission of
Atlantic Beach, Florida, as follows :
The application of the provisions of Title I of the Housing and
Urban Development Act of 1965 to Duval County, Florida is hereby
approved.

RESOLUTION NO: 70-27
WHEREAS, it appears that the Rayonier Corporation, a corporation
owned and operated by International Telephone and Telegraph Company,
is planning to build two ocean outfalls to pump its paper mill wastes
into water 25 to 30 feet deep, 2 . 5 miles offshore from Fernandina
Beach, and
WHEREAS, this disposal of waste matter would be subject to ocean
currents, winds and tides which could have serious, dangerous and harm-
ful effects on marine life within the tidal and off-shore waters of
the City of Atlantic Beach, Florida, and
WHEREAS, the citizens and City Commission of the City of Atlantic
Beach, Florida, have deep concern not only in regards to marine life,
but also in regards to the affect of depositing such waste matter so
close to the shores of the City of Atlantic Beach, Florida, thus per-
haps causing harm to human life, and
WHEREAS, the United States Department of the Interior has recom-
mended against building any such ocean outfalls, and the National
Water Quality Act requires that applications for them may not even be
considered unless approved by the States, and
WHEREAS, initially, the Florida Air and Water Pollution Control
Board rejected such a proposal, and
WHEREAS, the President , s Council on Environmental Quality has
specified that ocean dumping of sludge "should be phased out and no
new sources allowed", and
WHEREAS, the United States Army Engineers appear to have gone
against the best interest of the public in advising that this plan to
build these two ocean outfalls by the Rayonier Corporation be allowed
to be put into force as it "is an improvement on what is now being
done",
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COl'2 SSION OF THE CITY OF
ATLANTIC BEACH, FLORIDA, AS FOLLOWS :
That a copy of this Resolution be sent to Colonel A. S. Fullerton,
District Engineer for the United States Army Engineers, that he
may be appraised of the attitude of this Commission and the peo;le
of Atlantic Beach. The economic consideration balanced against
ecological aspects should be taken into consideration and a method
of disposal be found that would be acceptable to the President's
Council on Environmental Quality, as well as other agencies charg-
ed with the protection of the environment, and that all necessary
steps be taken to nulify any recommendation which has been made in
regards to the plan of building two ocean outfalls.
