The following are the areas in question. • The adoption of the 2004 Florida Building Code (FBC) was accomplished after being pushed back three times. The final adoption date was Oct. 1, 2005. • Vesting interest to allow a builder or developer use of a design under the 2001 code is addressed in Chapter 553.73(5) and states "The initial adoption of, and any subsequent update or amendment to, the Florida Building Code by the commission is deemed adopted for use statewide without adoptions by local government. For a building permit for which an application is submitted prior ro the effective date of the Florida Building Code, the state minimum building code in effect in the permitting jurisdiction on the date of the application governs the permitted work for the life of the permit and any extension granted the permit." • The existing building may be rebuilt under the existing code if the value of the building does not exceed 50% of the value of the structure. The 2001 FBC Section 3401.2 states "Alterations, repairs, or rehabilitation work maybe made to any existing structure, building, electrical, gas, plumbing, electrical, mechanical or gas system without requiring the building, structure, plumbing, electrical or gas system t o comply with all of the requirements of the technical codes, provided that the alteration, repair or rehabilitation work conforms to the requirements of the technical codes for new construction.
