The two story structures were demolished with the exception of two walls exceeding fifty percent of the integrity of the building and can't hardly be considered a "minor structural alteration" as you've stated per Section 3401.7.2.2 of the Florida Building Code. In addition, the tax roll values the building at $186,000. The value at which the permit was applied for and was issued upon is $180,000, which exceeds fifty percent of the value of the structure. The following criteria applies to the Via Mare Condominium project under the 2001 Florida Building Code and must be adhered to regardless if the percentage of alterations were more or less than fifty percent; 1) Section 3401.4 2001 of the Florida Building Code states " An existing building SHALL NOT be increased in height unless the entire building is altered to meet the requirements of this code for a new building of such increased height and building area" and would apply. 2) Section 903.7.6 2001 Group R2 -Residential Occupancy. " An approved automatic sprinkler system SHALL BE PROVIDED throughout Group R2 occupancies three or more stories" 3} Section 903.8 2001 Buildings three stories or more in height and Section 903.8.1 2001 "Any building which is three stories or more in height SHALL BE equipped with an approved automatic sprinkler system installed in accordance with 903.1. The following are the areas in question. • The adoption of the 2004 Florida Building Code (FBC) was accomplished after being pushed back three times. The final adoption date was Oct. 1, 2005. • Vesting interest to allow a builder or developer use of a design under the 2001 code is addressed in Chapter 553.73(5) and states "The initial adoption of, and any subsequent update or amendment to, the Florida Building Code by the commission is deemed adopted for use statewide without adoptions by local government. For a building permit for which an application is submitted prior ro the effective date of the Florida Building Code, the state minimum building code in effect in the permitting jurisdiction on the date of the application governs the permitted work for the life of the permit and any extension granted the permit." • The existing bui, lding may be rebuilt under the existing code if the value of the building does not exceed 50% of the value of the structure. The 2001 FBC Section 3401.2 states "Alterations, repairs, or rehabilitation work maybe made to any existing structure, building, electrical, gas, plumbing, electrical, mechanical or gas system without requiring the building, structure, plumbing, electrical or gas system t o comply with all of the requirements of the technical codes, provided that the alteration, repair or rehabilitation work conforms to the requirements of the technical codes for new construction. The attomey general has determined that for the purpose of the fire protection sprinkler requirements in Section 553.895(2), Florida Statutes, townhouses that are three or more stories tall and consist of three or more units together are multiple-family dwellings. Therefore, these types of townhouses are not exempt from being considered for the requirements to provide fire protection sprinklers (even if there are any other definitions that define a townhouse as a single-family residence). When determining whether townhouses require fire protection sprinkler systems, the building official must consider in parallel:. (a) the attomey general's opinion defining the statutory language for townhouses; (b) the building code requirements, including all life-safety chapters, that provide additional determining criteria, such as construction types, fire-resistance, fire protection systems and egress; and (c) the NFPA 101 egress and protection determining criteria. See §407.1.3, §411.7.6 and §411.7.7. 5. Spray finishing booth, area or room shall comply with the Florida Fire Prevention Code. §903.6 Garages. Approved automatic sprinkler systems shall be provided in the following garages: 1. Enclosed parking garages over 65 ft (19.8 m) high and exceeding 10,000 sq ft (929 m^2) per floor. 2. Repair garages two stories or more high, and exceeding 10,000 sq ft (929 m^2) in a single floor area. 3. One story repair garages exceeding 15,000 sq ft (1394 m^2). 4. Basement garages or repair garages in a basement. EXCEPTION: Group R3 occupancies. §903.1 Approved equipment and layout. Only approved sprinklers and devices shall be used in automatic sprinkler systems, and the complete layout of the system shall be submitted to the building official for approval before installation. §903.2 Requirements. Every automatic sprinkler system required by this code shall conform to NFPA 13, as modified by NFPA 231 and NFPA 231C, except that a single water supply of adequate pressure, capacity and reliability, equal to the primary supply required by those standards, may be permitted by the building official. Automatic sprinkler systems installed in lieu of or as an alternate to other requirements, as permitted by this code, shall be considered required systems and shall comply with NFPA 13. 5. Garages used for the storage of commercial trucks and having an area exceeding 5,000 sq ft (465 m^2). 6. Bus garages when used as passenger terminals for four or more buses or when used for bus storage or loading of four or more buses. §903.7 Other oacupanay sprinkler requirements t r 0903.7.1 Group M. An approved automatic sprinkler system shall be provided in all mercantile occupancies as follows: 1. In all mercantile occupancies three or more stories in height. 2. In all mercantile occupancies exceeding 12,000 sq ft (1115 m^2) in gross area. 3. Throughout stories below the level of exit discharge where such stories have an area exceeding 2500 sq ft (230 m^2) where used for the sale, storage or handling of combustible goods and merchandise. 4. In mixed occupancies including a mercantile occupancy meeting any of the provisions of 1 through 3 above. §903.7.2 Group A X903.7.2.1 An approved automatic sprinkler system shall be provided in Group A-1 occupancies over areas which could be used for the display, sale or storage of combustible materials when such display, sale or storage floor area exceeds 15,000 sq ft (1394 m^2). X903.7.2.2 Stages shall be provided with an approved automatic sprinkler system. Such sprinklers shall be provided throughout the stage and in dressing rooms, workshops, storerooms and other accessory spaces contiguous to such stages. EXCEPTIONS: 1. Sprinklers are not required where stages are 1,000 sq ft (93 m^2) or less in area and 50 ft (15.2 m)or less in height and curtains, scenery or other combustible hangings are not retractable vertically. Combustible hangings shall be limited to a single main curtain, borders, legs and a single backdrop. 2. Sprinklers are not required under stage areas less than 4 ft (1219 mm) in clear height used exclusively for chair or table storage and lined on the inside with 5/8 inch (15.9 mm) Type X gypsum wallboard or approved equal. X903.7.2.3 Buildings or portions thereof used for the specific purpose of sound stages for motion picture or television productions and greater than 1,000 sq ft (93 m^2) shall be protected with an approved automatic sprinkler system. §903.7.2.4 In addition to sprinklers as may be required by Table 500, buildings containing assembly occupancies with occupant loads greater than 300 shall be protected by an approved automatic sprinkler system installed in accordance with §903.2 as follows: 1. Throughout the story containing the assembly occupancy; and 2. Throughout all stories below the story containing the assembly occupancy; and 3. In the case of an assembly occupancy located below the level of exit discharge, throughout all stories intervening between that story and the level of exit discharge including the level of exit discharge. EXCEPTIONS: 1. Assembly occupancies used primarily for worship with fixed seating and not part of a mixed occupancy. 2. Assembly occupancies consisting of a single multipurpose room of less than 12,000 sq ft (1100 sq m) and not used for exhibition or display. 3. Gymnasiums, skating rinks, and swimming pools used exclusively for participant sports with no audience facilities for more than 300 persons. 4. In stadia and arenas, sprinklers shall be permitted to be omitted over the floor area used for contest, performance, or entertainment; over the seating areas; and aver open-air concourses where an approved engineering analysis substantiates the ineffectiveness of the sprinkler protection due to building height and combustible loading. 5. In unenclosed stadia and arenas, sprinklers shall be permitted to be omitted in the fallowing areas: (1) Press boxes less than 1000 ft^2 (93 m^2) (2) Storage facilities less than 1000 ft^2 (93 m^2). (3) Enclosed areas underneath grandstands that are kept free of flammable or combustible materials, that are not greater than 300 ft^2 (28 m^2), of noncombustible material or fire resistive construction; or, are not greater than 1000 ft^2 (93 m^2) and of one-hour fire resistant construction. Such enclosed areas shall be in facilities not required to be sprinklered by other provisions of this code. §903.7.3 High-Piled combustible stock. An approved automatic sprinkler system shall be provided throughout buildings required by the Florida Fire Frevention Code to have sprinkler protection. EXCEPTION: Automatic sprinkler systems may be provided only in the storage area of the building when the storage is separated from the remainder of the building by a minimum 2-hour fire resistant separation. §903.7.4 Hazardous production material (HPM) facility. An approved automatic sprinkler system shall be provided throughout buildings containing Group H (HPM) facilities as defined in §408, shall be designed in accordance with NFPA 13 and not less than that required for the special fire hazard areas shown in Table 903.7.4. An approved automatic sprinkler system shall be provided throughout Group R1 occupancies three or more stories in height. §903.7.6 Group R2 - Residential Occupancy. An approved automatic sprinkler system shall be provided throughout Group R2 occupancies three or more stories in height. EXCEPTIONS: 1. Three-story buildings which are not required to have an automatic sprinkler system by other provisions of the code and provided with exterior exitway stairs complying with X1006.2. 2. An automatic sprinkler system complying with NFPA 13R shall be permitted for buildings not exceeding four stories in height provided the automatic sprinkler system shall not be considered as an alternate to other requirements of the code. (See §903.2.) §903.7.7 Group R4 - Residential Care/Assisted Living Occupancies. An approved automatic sprinkler system shall be provided throughout all Group R4 occupancies in accordance with NFPA 13. Group R4 occupancies shall be protected with quick-response or residential sprinklers. EXCEPTIONS: 1. In Group R4 Small Occupancies an automatic sprinkler system installed in accordance with NFPA 13D or NFPA 13R in accordance with their scopes, shall be permitted provided the automatic sprinkler system shall not be considered an alternate to other requirements of the code. 2. Standard response sprinklers shall be permitted in hazardous areas in accordance with Table 410.2.2. §903.8 Buildings three stories or more in height. §903.8.1 Any building which is of three stories or more in height shall be equipped with an approved automatic sprinkler system installed in accordance with §903.1. EXCEPTIONS: 1. Single-family and two-family dwellings. 2. A stand-alone parking garage constructed with noncombustible materials, the design of which is such that all levels of the garage are uniformly open to the atmoshpere on all sides with the percentages of openings equal to or greater than those specified at §411. Such garages shall be separated from any other structure by not less than 20 ft. 3. Telecommunication spaces located within telecommunication buildings, if the spaces are equipped to meet an equivalent fire- prevention standard approved by both the Florida Building Commission and the State Fire Marshal. 4. Telecommunications spaces within telecommunication buildings, if the telecommunications space is equipped with: 1. Air sampling smoke detection. 2. Remote, propietary or central station fire alarm monitoring. 3. Automatic smoke exhaust system. 4. One hour fire resistance wall separating the telecommunications space from the adjacent areas on the same floor. 5. Two-hour floor/ceiling assembly separating the telecommunications space from adjacent floors. 6. All other portions ancillary to the telecommunications equipment area shall be provided with fire sprinkler protection. §903.8.2 The National Fire Protection Association Standard 101, as regarding the requirements for fire protection sprinklers, is applicable to all multiple-family residential buildings, whether designated as townhouses, condominiums, "apartment houses, tenements, garden apartments or by any other name." The Attorney General has determined that for the purpose of the fire protection sprinkler requirements in Section 553.895(2), Florida Statutes, townhouses that are three or more stories tall and consist of three or more units together are multiple-family dwellings. Therefore, these types of townhouses are not exempt from being considered for the requirements to provide fire protection sprinklers (even if there are any other definitions that define townhouse as single-family residences}. When determining whether townhouses require fire protection sprinkler systems, the building official must consider in parallel: (a) The Attorney General's opinion defining the statutory language for townhouses; and (b) The Building Code requirements, including all life-safety chapters, that provide additional determining criteria, such as construction types, fire-resistance, fire protection systems and egress; and (c) The NFPA 101 egress and protection determining criteria. The more restrictive criteria are then applied. §903.9 Supervision §903.9.1 Where an automatic sprinkler system is provided either as a requirement or as an alternate to another requirement of this code, the system shall be supervised by an approved central, proprietary, auxiliary, or remote station system in accordance with NFPA 72. EXCEPTION: Supervisory facilities in accordance with X903.9 shall not be required for extinguishing systems in one-and two-family dwellings. §903.9.2 In HPM Facilities, as defined in §408, all valves shall be provided with supervisory tamper switches. In addition to the requirements of §903.9.1, the closing of a valve shall activate an audible and visual signal at the emergency control station. §903.9.3 When a building fire alarm system is provided, actuation of the sprinkler system shall cause the building alarm to sound. CHAPTER 34 EXISTING BUILDINGS SECTION 3401 GEDiERAL _~~ Svc' §3401.1 Scope. Provisions of this chapter shall govern the application of this code to existing buildings. EXCEPTION: Buildings and structures located within the High Velocity Hurricane Zone shall comply with the provisions of §3401.5, §3401.8, and §3401.2.2.1. §3401.2 Applicability §3401.2.1 Alterations, repairs or rehabilitation work may be made to any existing structure, building, electrical, gas, mechanical or plumbing system without requiring the building, structure, plumbing, electrical, mechanical or gas system to comply with all the requirements of the technical codes, provided that the alteration, repair or rehabilitation work conforms to the requirements of the technical codes for new construction. The building official shall determine the extent to which the existing system shall be made to conform to the requirements of the technical codes for new construction. §3401.2.2 Change of occupancy X3401.2.2.1 If the occupancy classification or occupancy subclassifications of any existing building or structure is changed, the building, electrical, gas, mechanical and plumbing systems shall be made to conform to the intent of the technical codes as required by the building official. X3401.2.2.2 Changes in the occupancy of a building now existing or hereafter erected shall not be made until a revised certificate of occupancy has been issued by the building official certifying that the floors are suitable for the loads characteristic of the proposed occupancy. §3401.3 Existing building certificate of occupancy. A certificate of occupancy for any existing building may be obtained by applying to the building official and supplying the information and data necessary to determine compliance with the technical codes for the occupancy intended. Where necessary, in the opinion of the building official, two sets of detailed drawings, or a general inspection, or both, may be required. When, upon examination and inspection, it is found that the building conforms to the provisions of the technical codes and other applicable laws and ordinances for such occupancy, a certificate of occupancy shall be issued. §3401.3.1 Any existing building which complied with the code in effect at the date of issuance of the permit shall be permitted to continue in its approved occupancy group. Such continued approval shall not be construed to prohibit the inspection authority from at any time requiring that the minimum standards of safety be maintained during the period of use of the building in accordance with the building code in effect on the date of issuance of the permit. Such standards include, but are not limited to, strength, egress, fire resistance, openings in walls, electrical, plumbing, mechanical or elevator equipment or fire extinguishing apparatus. §3401.3.2 Minimum standards of safety shall be in accordance with this code or the Florida Fire Prevention Code, whichever standard offers the greatest degree of life safety or alternatives that would provide an equivalent degree of life safety and an equivalent method of construction. §3401.4 Height and area. An existing building shall not be increased in height unless the entire building is altered to meet the requirements of this code for a new building of such increased height and building area. §3401.5 Special historic buildings. §3401.5.1 The provisions of the technical codes relating to the alteration, repair, restoration or moving of buildings or structures shall not be mandatory for existing buildings or structures identified as qualified historic buildings or structures when such buildings or structures are judged by the building official to be safe and in the public interest of health, safety and welfare regarding any proposed alteration, repair, restoration, relocation or moving of buildings within fire districts. §3401.5.2 Qualified historic buildings or structures shall be: 1. Individually listed on the National Register of Historic Places; or 2. A contributing property in a National Register listed historic district; or 3. Designated as a historic property or landmark under the provisions of a local historic preservation ordinance; or 4. A contributing property in a historic district designated under the provisions of a local historic preservation ordinance; or 5. Determined eligible by the Florida State Historic Preservation Officer, either individually or as a contributing building or structure in a district, for listing in the National Register of Historic Places. §3401.5.3 When reviewing the proposed alteration, repair, restoration or moving of qualified historic buildings or structures the building official shall, pursuant to §103.7, consider alternative materials and methods which may be proposed for achieving equivalency with the requirements in the technical codes. Alternate methods for achieving equivalency with the requirements in the technical codes shall be guided by the recommended approaches to rehabilitation set forth in The Secretary of the Interior's Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings. (See Appendix D.) §3401.5.4 Non-Qualified Buildings - The provisions of §3401.5.1 - §3401.5.3 shall not apply to the following: 1. New buildings constructed in a historic district; 2. New additions to historic buildings; 3. Buildings that are reconstructed; 4. Institutional occupancies such as hospitals, nursing homes, mental hospitals, detoxification facilities, jails and correctional institutions. §3401.6 Maintenance. All buildings, structures, electrical, gas, mechanical and plumbing systems, both existing and new, and all parts thereof, shall be maintained in a safe and sanitary condition. All devices or safeguards which are required by the technical codes when constructed, altered or repaired, shall be maintained in good working order. The owner, or his designated agent, shall be responsible for the maintenance of buildings, structures, electrical, gas, mechanical and plumbing systems. §3401.7 Application to existing buildings §3401.7.1 Additions §3401.7.1.1 All except R3 occupancies shall comply with the following: §3401.7.1.1.1 When additions, or alterations increasing floor area, are made to an existing building, and the addition and existing buildings are separated by a fire wall, the addition shall conform to all the requirements of this code applicable to a building of the area of the addition. §3401.7.1.1.2 Where the existing building and the addition are not separated by a fire wall and the area of the addition is 25 percent or more of the area of the existing building, the existing building and the addition shall be made to comply with all requirements of this code for a building of area equal to the combined area of the addition and existing building. EXCEPTION: Existing buildings shall not be required to be upgraded to the structural requirements of the code in effect on the date of application of the permit for the addition. §3401.7.1.1.3 Where the existing building and the addition are not separated by a fire wall and the area of the addition is less than 25 percent of the area of the existing building, the addition shall conform to all requirements of this code applicable to the building of the combined area of the existing building and the addition; and the existing building shall conform to the requirements of this code applicable to facilities for means of egress and automatic fire- extinguishing systems for a building of the combined area of the addition and existing building. §3401.7.1.2 Group R3 Occupancies shall comply with the following: 3401.7.1.2.1 When additions, or alterations increasing floor area, are made to an existing building and the addition constitutes 25 percent or more of the area of the existing building, the addition shall be made to comply with all the requirements of the code and the existing building shall comply with the following: 1. G. F.C.I. outlets shall be installed where required by the code. 2. Smoke detectors shall be installed where required by the code. 3. In no case shall the existing building and the addition exceed the requirements of Table 500. §3401.7.2 Repairs and Alterations §3401.7.2.1 Repairs and alterations not increasing the area of the building, made within any 12 month period, shall be as set forth in this section. (See §202, VALUE.) §3401.7.2.2 Structural repairs and alterations, the cost of which does not exceed 25 percent of the value of the existing building or structure, shall comply with the requirements for new buildings or structures except that minor structural alterations, with the approval of the building official, may be made of the same material and degree of fire-resistivity of which the building or structure is constructed. §3401.7.2.3 Non-structural repairs and alterations exclusive of fixtures and furniture, the cost of which does not exceed 25 percent of ® the value of the existing building or structure and which do not affect egress or fire-resistivity, may be made of the same material of which the building or structure is constructed. §3401.7.2.4 The replacement of garage doors, exterior doors, skylights, operative and inoperative windows shall be designed and constructed to comply with Chapter 16 of this code. OPENING PROTECTION EXCEPTION: For one- and two-family dwellings constructed under codes other than the Florida Building Code and located in windborne debris regions, the replacement of garage doors and exterior doors with glazing, sliding glass doors, glass patio doors, skylights, and operable and inoperable windows within any 12 month period shall not be required to have opening protection, but shall be designed for wind pressures for enclosed buildings provided the aggregate area of the glazing in the replaced components does not exceed 25 percent of the aggregate area of the glazed openings in the dwelling or dwelling unit. §3401.7.2.5 Repairs and alterations amounting to over 25 percent but not exceeding 50 percent of the value of the existing building may be made during any 12 month period without making the entire existing building comply provided such repairs and alterations comply with the requirements of this code for a building of like area, height and occupancy. §3401.7.2.6 When repairs and alterations amounting to more than 50 percent of the value of the existing building are made during any l2 month period, the building or structure shall be made to conform to the requirements for a new building or structure or be entirely demolished. EXCEPTIONS: 1. Provided there is no change in occupancy, foundations, slabs, tie beams, tie columns, reinforced masonry and masonry walls erected in compliance with the code under which the building was constructed. 2. Those property improvements involuntarily altered by right of eminent domain need only to meet the requirements of the code in force at the time of original construction. §3401.7.3 Structural Determination. For purposes of §3401.7, structural shall mean any part, material or assembly of a building or structure which affects the safety of such building or structure and/or which supports any dead or designed live load and the removal of which part, material or assembly could cause, or be expected to cause, all or any portion to collapse or to fail. §3401.8 High Velocity hurricane zone application to existing buildings §3401.8.1 General §3401.8.1.1 Existing buildings or structures to which additions, alterations, repair or changes of group of occupancy are proposed or intended shall be made to comply with all the requirements for new buildings or structures of like area, height, type of construction or group of occupancy, except as provided in this Section. §3401.8.1.2 The requirements of this section shall not supersede specific requirements of the code for construction in Fire Zones. §3401.8.2 Additions §3401.8.2.1 Any addition or alterations increasing the floor area of the building, shall meet the requirements of this section. For purposes of this section, whether an addition falls within the stated percentages shall be calculated based on the cumulative increase of the building during the course of one calendar year. §3401.8.2.2 All except Group R3 occupancies shall comply with the following: §3401.8.2.2.1 When additions, or alterations increasing floor area, are made to an existing building, and the addition and existing building are separated by a fire rated wall, as defined in §704, the addition shall conform to all the requirements of the code applicable to a building of the area of the addition. §3401.8.2.2.2 Where the existing building and the addition are not separated by a fire rated wall and the area of the addition is 25 percent or more of the area of the existing building, the existing building and the addition shall be made to comply with all requirements of the code for a building of area equal to the combined area far the addition and existing building. §3401.8.2.2.3 Where the existing building and the addition are not separated by a fire rated wall or where the addition is vertically superimposed on an existing building, and the area of the addition is less than 25 percent of the area of the existing building, the following requirements shall apply: 1. The addition shall conform to all requirements of the code applicable to a building having the combined area and height of the existing building and the addition. 2. The existing building shall conform to all requirements of the means of egress for a building of the combined area and height of the addition and the existing building. 3. Rn approved detection, alarm and communications system, detecting products of combustion, shall be required for all public areas and means of egress within the existing building. §3401.8.2.3 Group R3 Occupancies shall comply with the following: §3401.8.2.3.1 When additions, or alterations increasing floor area, are made to an existing building and the addition constitutes 25 percent or more of the area of the existing building, the addition shall be made to comply with all the requirements of the code and the existing building shall comply with the following: 1. Impact resistance devices having a valid NOA shall be installed at openings to provide protection against storms. 2. Corners of buildings of masonry construction shall be checked for tie downs. If tie downs are not found in corners, testing shall be performed to locate tie downs in all walls. Proper installation of tie downs shall be done at 20 foot intervals and at each corner except that interior tie downs may be provided in each side not less than 2 feet on each side of each corner. 2.1 Tie down refers to the anchorage from the foundation to the tie beam and shall provide the equivalent strength of a vertical #5 reinforcing bar properly attached to the foundation and tie beam encased in concrete or mortar and lapped a minimum of 30 inches or otherwise spliced in a manner which will develop the full strength of the bar. 2.2 Alternate methods of providing anchorage of equivalent strength to that described in 2.1 may be used where design calculations which admit rational analysis are submitted by a Registered Engineer or Architect proficient in structural design. 3. Roof anchorage shall be checked at all walls where the addition connects to the existing building. If major deficiencies are found and the anchorage is not in compliance with the minimum requirements of the code, the roof anchorage shall be checked for all the existing roof. Minimum anchorage shall be provided to each member bearing on the exterior walls. 4. Permanent roof bracing shall be provided at all gable ends. 5. G.F.C.I. outlets shall be installed where required by the code. 6. Smoke detectors shall be installed where required by the code. §3401.8.2.3.2 The design professional shall conduct a site visit to ascertain the necessary work to be performed to comply with the requirements of this Section. §3401.8.2.3.3 The design professional shall provide an inspection report and indicate on the drawings all remedial actions to be performed on the building submittal as a part of the permit plans. §3401.8.3 Repairs and alterations §3401.8.3.1 Repairs and alterations not increasing the area of the building, made within any 12 month period, shall meet the requirements of this section. §3401.8.3.2 Structural repairs and alterations, the cost of which does not exceed 25 percent of the replacement value of the existing building or structure, shall comply with the requirements for new buildings or structures except that minor structural repairs and alterations may, with the approval of the building official, be constructed of the same materials and with the same degree of fire-resistivity as the original building or structure. {a) Window replacement is considered a major structural repair which shall meet the code requirements for new buildings. This means that existing windows shall be replaced with impact resistant windows or must be replaced with windows that are designed to resist the static pressure for an enclosed building and shall be protected with an impact resistant covering meeting the Miami-Dade TAS 201, TAS 202 and TAS 203. In addition the new windows must be anchored as per Chapter 17 of the code. (b) With regard to shutters as it relates to egress, existing windows which are used as emergency escape or rescue openings and at the same time protected with hurricane shutters shall be required to meet the code in effect at the time the building was permitted. OPENING PROTECTION EXCEPTION: For one- and two-family dwellings constructed under codes prior to September 1, 1994 the replacement of exterior doors with glazing, sliding glass doors, glass patio doors, skylights, and operable and inoperable windows within any 12 month period shall not be required to have opening protection provided the aggregate area of the glazing in the replaced components does not exceed 25 percent of the aggregate area of the glazed openings in the dwelling or dwelling unit. §3401.8.3.3 Non-structural repairs and alterations, the cost of which does not exceed 25 percent of the replacement value of the existing building or structure, and which do not affect egress or fire- resistivity, may comply with the requirements of the building code in effect at the time of original construction, except that repairs and alterations to plumbing, mechanical and electrical systems shall comply with the code in effect at the time the permit for such work is issued. §3401.8.3.4 Repairs and alterations amounting to 25 percent but not exceeding 50 percent of the replacement value of the existing building may be performed without making the entire existing building comply with all of the requirements for a new building, provided such repairs and alterations comply with the requirements of the code for a building of like area, height and occupancy. §3401.8.3.5 Where repairs and alterations amounting to more than 50 percent of the replacement value of the existing building are made during any 12 month period, the building or structure shall be made to conform to all the requirements for a new building or structure or be entirely demolished. §3401.8.4 Roofing. Not more than 25 percent of the roof covering of any building or structure shall be replaced in any 12 month period unless the entire roof covering is made to conform to the requirements of the code. §3401.8.5 Value determination. The value of a building or structure shall be the estimated cost of constructing a new building of like size, design and materials at the site of the original structure, assuming such site to be clear. Cost of additions, alterations and repairs shall be construed as the total cost of labor, materials and services based on current prices for new materials. §3401.8.6 Structural determination. For purposes of this section, structural shall mean any part, material or assembly of a building or structure which affects the safety of such building or structure and/or which supports any dead or designed live load and the removal of which part, material or assembly could cause, or be expected to cause, all or any portion to collapse or to fail. Provisions of this chapter shall govern the application of this code to existing buildings. ERCEPTI~T: Buildings and structures located within the High Velocity Hurricane Zone shall comply with the provisions of §3408. §3401.2 Applicability §3401.2.1 Alterations, repairs or rehabilitation work may be made to any existing structure, building, electrical,-gas, mechanical or plumbing system without requiring the building, structure, plumbing, electrical, mechanical or gas system to comply with all the requirements of the technical codes, provided that the alteration, repair or rehabilitation work conforms to the requirements of the technical codes for new construction. The building official shall determine the extent to which the existing system shall be made to conform to the requirements of the technical codes for new construction. §3401.2,2 Change of occupancy $3401.2.2.1 If the occupancy classification or occupancy subclassifications of any existing building or structure is changed, the building, electrical, gas, mechanical and plumbing systems shall be made to conform to the intent of the technical codes as required by the building official. X3401.2.2.2 Changes in the occupancy of a building now existing or hereafter erected shall not be made until a revised certificate of occupancy has been issued by the building official certifying that the floors are suitable for the loads characteristic of the proposed occupancy. See §106. §3401.3 Eaistinq buildiag certificate of occupancy. A certificate of occupancy for any existing building may be obtained by applying to the building official and supplying the information and data necessary to determine compliance with the technical codes for the occupancy intended. Where necessary, in the opinion of the building official, two sets of detailed drawings, or a general inspection, or both, may be required. When, upon examination and inspection, it is found that the building conforms to the provisions of the technical codes and other applicable laws and ordinances for such occupancy, a certificate of occupancy shall be issued. §3401.3.1 Any existing building which complied with the code in effect at the date of issuance of the permit shall be permitted to continue in its approved occupancy group. Such continued approval shall not be construed to prohibit the inspection authority from at any time requiring that the minimum standards of safety be maintained during the period of use of the building in accordance with the building code in effect on the date of issuance of the permit. Such standards include, but are not limited to, strength, egress, fire resistance, openings in walls, electrical, plumbing, mechanical or elevator equipment or fire extinguishing apparatus. X3401.3.2 Minimum standards of safety shall be in accordance with this code or the F3orida Fire Prevention Code, whichever standard offers the greatest degree of life safety or alternatives that would provide an equivalent degree of life safety and an equivalent method of construction, v 53401.4 Height and area. An existing building shall not be increased in height unless the entire building is altered to meet the requirements of this code for a new building of such increased height and building area. 53401.5 Special historic buildings. 53401.5.1 The provisions of the technical codes relating to the alteration, repair, restoration or moving of buildings or structures shall not be mandatory for existing buildings or structures identified as qualified historic buildings or structures when such buildings or structures are judged by the building official to be safe and in the public interest of health, safety and welfare regarding any proposed alteration, repair, restoration, relocation or moving of buildings within fire districts. 53401.5.2 Qualified historic buildings or structures shall be: 1. Individually listed on the National Register of Historic Places; or 2. A contributing property in a National Register listed historic district; or 3. Designated as a historic property or landmark under the provisions of a local historic preservation ordinance; or 4. A contributing property in a historic district designated under the provisions of a local historic preservation ordinance; or 5. Determined eligible by the Florida State Historic Preservation Officer, either individually or as a contributing building. or structure in a district, for listing in the National Register of Historic Places. 53401.5.3 When reviewing the proposed alteration, repair, restoration or moving of qualified historic buildings or structures the building official shall, pursuant to 5103.7, consider alternative materials and methods which may be proposed for achieving equivalency with the requirements in the technical codes. Alternate methods for achieving equivalency with the requirements in the technical codes shall be guided by the recommended approaches to rehabilitation set forth in The Secretary of the Interior's Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings. 53401.5.4 Non-Qualified Buildings - The provisions of §3401.5.1 - ~3401.5.3 shall not apply to the following: 1. New buildings constructed in a historic district; 2. New additions to historic buildings; 3. Buildings that are reconstructed; 4. Institutional occupancies such as hospitals, nursing homes, mental hospitals, detoxification facilities, jails and correctional institutions. 53401.6 Mainteaaace. All buildings, structures, electrical, gas, mechanical and plumbing systems, both existing and new, and all parts thereof, shall be maintained in a safe and sanitary condition. All devices or safeguards which are required by the technical codes when constructed, altered or repaired, shall be maintained in good working order. The owner, or his designated agent, shall be responsible for the maintenance of buildings, structures, electrical, gas, mechanical and plumbing systems. ti §3401.7 Application to eaistinq buildings 53401.7.1 Additions 53401.7.1.1 When additions, or alterations increasing floor area, are made to an existing building, and the addition and existing buildings are separated by a fire wall, the addition shall conform to all the requirements of this code applicable to a building of the area of the addition. 53401.7.1.2 Where the existing building and the addition are not separated by a fire wall and the area of the addition is 25 percent or more of the area of the existing building, the existing building and the addition shall be made to comply with all requirements of this code for a building of area equal to the combined area of the addition and existing building. EXCEPTION: Existing buildings shall not be required to~be upgraded to the structural requirements of the code in effect on the date of application of the permit for the addition. 53401.7.1.3 Where the existing building and the addition are not separated by a fire wall and the area of the addition is less than 25 percent of the area of the existing building, the addition shall conform to all requirements of this code applicable to the. building of the combined area of the existing building and the addition; and the existing building shall conform to the requirements of this code applicable to facilities for means of egress and automatic fire- extinguishing systems for a building of the combined area of the addition and existing building. $3401.7.2 Repairs and Alterations X3401.7.2.1 Repairs and alterations not increasing the area of the building, made within any 12 month period, shall be as set forth in this section. 53401.7.2.2 Structural repairs and alterations, the cost of which does not exceed 25 percent of the value of the existing building or structure, shall comply with the requirements for new buildings or structures except that minor structural alterations, with the approval of the building official, may be made of the same material and degree of fire-resistivity of which the building or structure is constructed. 53401.7.2.3 Non-structural repairs and alterations exclusive of fixtures and furniture, the cost of which does not exceed 25 percent of the value of the existing building or structure and which do not affect egress or fire-resistivity, may be made of the same material of which the building or structure is constructed. 53401.7.2.4 The replacement of garage doors, exterior doors, skylights, operative and inoperative windows shall be designed and constructed in accordance with Chapter 16 of this code. 53401.7.2.5 Repairs and alterations amounting to over 25 percent but not exceeding 50 percent of the value of the existing building may be made during any 12 month period without making the entire existing building comply provided such repairs and alterations comply with the requirements of this code for a building of like area, height and occupancy. 53401.7.2.6 When repairs and alterations amounting to more than 50 percent of the value of the existing building are made during any 12 ` month period, the building or structure shall be made to conform to the requirements far a new building or structure or be entirely demolished. BXCLPTI0~i3 1. Provided there is no change in occupancy, foundations, slabs, tie beams, tie columns, reinforced masonry and masonry walls erected in compliance with the code under which the building was constructed. 2. Those property improvements involuntarily altered by right of eminent domain need only to meet the requirements of the code in force at the time of original construction. X3401.7.3 Structural Deteim3.natioa. For purposes of ~34p1.7, structural shall mean any part, material or assembly of a building or structure which affects the safety of such building or structure and/or which supports any dead or designed live load and the removal of which part, material or assembly could cause, or be expected to cause, all or any portion to collapse or to fail. zoo / ~~ L CHAPTER 34 EXISTING BUILDINGS SECTION 3401 GENERAL 340].1 Scope. Provisions of this chapter shall govern the application of this code to existing buildings. Exception: Existing buildings shall not be required to be upgraded to the structural require- ments of the code in effect on the date of appli- cation of the permit for the addition. 3401.7.1.1.3 Where the existing building and the addition are not separated by a fire wall and the area of the addition is less than 25 percent of the area of the existing building, the addition shall conform to all requirements of this code applicable to the build- ing of the combined area of the existing building and the addition; and the existing building shall con- form to the requirements of this code applicable to facilities for means of egress and automatic fire- extinguishing systems for a building of the com- bined area of the addition and existing building. 3401.7.1.2 Group R3 Occupancies shall comply with the following: 3401.7.1.2.1 When additions, or alterations increas- ing floor area, are made to an existing building and 3401.5.4 - 3401.7.2.5 the addition constitutes 25 percent or more of the area of the existing building, the addition shall be made to comply with all the requirements of the code and the existing building shall comply with the following: 1. G.F.C.I. outlets shall be installed where required by the code. 2. Smoke detectors shall be installed where required by the code. 3. In no case shall the existing building and the addition exceed the requirements of Table 500. 3401.7.2 Repairs and Alterations 3401.7.2.1 Repairs and alterations not increasing the area of the building, made within any 12 month period, shall be as set forth in this section. Smoke detectors shall be installed where required by the code. 3401.8.2.3.2 The design professional shall 'conduct a site visit to ascertain the necessary work to be per- formed to comply with the requirements of this Section. 3401.8.2.3.3 The design professional shall provide an inspection report and indicate on the drawings all remedial actions to be performed on the building sub- mittal as a part of the permit plans. 3401,8.3 Repairs and alterations 3401.8.3.1 Repairs and alterations not increasing the area of the building, made within any 12 month period, shall meet the requirements of this section. 3401.8.3.2 Structural repairs and alterations, the cost of which does not exceed 25 percent of the replacement value of the existing building or structure, shall comply with the requirements for new buildings or structures except that minor structural repairs and alterations may, with the approval of the building official, be con- structed of the same materials and with the same degree of fire-resistivity as the original building or structure. (a) Window replacement is considered a major structural repair which shall meet the code requirements for new buildings. This means that existing windows shall be replaced with impact resistant windows or must be replaced with win- dows that are designed to resist the static pres- sure for an enclosed building and shall be pro- tected with an impact resistant covering meeting the Miami-Dade TAS 201, 202 and 203. In addi- tion the new windows must be anchored as per Chapter 17 of the code. (b) With regard to shutters as it relates to egress, existing windows which are used as emergency escape or rescue openings and at the same time protected with hurricane shutters shall be required to meet the code in effect at the time the building was permitted. Opening Protection Exception: For one- and two-family dwellings constructed under codes prior to September 1, 1994 the replacement of exterior doors with glazing, sliding glass doors, glass patio doors, skylights, and operable and inoperable windows within any 12 month period shall not be required to have opening protection provided the aggregate area of the glazing in the replaced components does not exceed 2S percent of the aggregate area of the Glazed openings in the dwelling or dwelling unit. 3401.8.3.3 Non-structural repairs and alterations, the cost of which does not exceed 25 percent of the replacement value of the existing building or structure, and which do not affect egress or fire-resistivity, may comply with the requirements of the building code in effect at the time of original construction, except that repairs and alterations to plumbing, mechanical and electrical systems shall comply with the code in effect at the time the permit for such work is issued 3401.8.3.4 Repairs and alterations amounting to 25 percent but not exceeding 50 percent of the replace- ment value of the existing building may be performed without making the entire existing building comply with all of the requirements for a new building, pro- vided such repairs and alterations comply with the requirements of the code for a building of like area, height and occupancy. 3401.8.3.5 Where repairs and alterations amounting to more than 50 percent of the replacement value of the existing building are made during any 12 month period, the building or structure shall be made to conform to all the requirements for a new building or structure or be entirely demolished. 3401.8.4 Roofing. Not more than 25 percent of the roof covering of any building or structure shall be replaced in any 12 month period unless the entire roof covering is made to conform to the requirements of the code. 3401.8.5 Value determination. The value of a building or structure shall be the estimated cost of constructing a new building of like size, design and materials at the site of the original structure, assuming such site to be clear. Cost of additions, alterations and repairs shall be construed as the total cost of labor, materials and services based on current prices for new materials. 3401.8.6 Structural determination. For purposes of this section, structural shall mean any part, material or assembly of a building or structure which affects the safety of such building or structure and/or which supports any dead or designed live load and the removal of which part, material or assembly could cause, or be expected to cause, all or any portion to collapse or to fail. SECTION 3402 DEFINITIONS For definitions, see Chapter 2. 34.4 FLORIDA BUILDING CODE -BUILDING ~G 903.8 - 904.2.2 NFPA 13D or NFPA 13R in accordance with their scopes, shall be permitted provided the automatic sprinkler system shall not be consid- ered an alternate to other requirements of the code. Standard response sprinklers shall be permitted in hazardous areas in accordance with Table 410.2.2. • • • • • • • • • • • • • • • • • • • • • 903.8 Buildings three stories or more in height. 903.8.1 Any building which is of three stories or more in height shall be equipped with an approved automatic sprinkler system installed in accordance with 903.1. Exceptions: 1. Single-family and two-family dwellings. 2. A stand-alone parking garage constructed with noncombustible materials, the design of which is such that all levels of the garage are uniformly open to the atmosphere on all sides with the per- centages of openings equal to or greater than those specified at 411. Such garages shall be sep- arated from any other structure by not less than 20 ft. 3. Telecommunication spaces located within telecommunication buildings, if the spaces are equipped to meet an equivalent fire-prevention standard approved by both the Florida Building Commission and the State Fire Marshal. 4. Telecommunications spaces within telecommu- nications buildings if the telecommunications space is equipped with: 1. Air sampling smoke detection. 2. Remote, proprietary or central station fire alarm monitoring. 3. Automatic smoke exhaust system. 4. Two-hour floor/ceiling assembly separat- ing the telecommunications space from adjacent floors. 6. All other portions ancillary to the telecom- munications equipment area shall be pro- vided with fire sprinkler protection. 903.8.2 The National Fire Protection Association Standard 101, as regarding the requirements for fire protection sprinklers, is applicable to all multiple-family residential buildings, whether designated as townhouses, condomini- ums, "apartment houses, tenements, garden apartments or by any other name." The Attorney General has determined that for the purpose of the fire protection sprinkler require- ments in Section 553.895(2), Florida Statutes, townhous- es that are three or more stories tall and consist of three or more units together are multiple-family dwellings. Therefore, these types of townhouses are not exempt from being considered for the requirements to provide fire pro- tection sprinklers (even if there are any other definitions that define townhouse as single-family residences). When determining whether townhouses require fire protection sprinkler systems, the building official must consider in parallel: (a) The Attorney General's opinion defining the statutory language for townhouses; and (b) The Building Code requirements, including all life-safety chapters, that provide additional determining criteria, such as construc- tion types, firea-esistance, fire protection systems and egress; and (c) The NFPA 101 egress and protection deter- mining criteria. The more restrictive criteria are then applied. 903.9 Supervision 903.9.1 Where au automatic sprinkler system is provided either as a requirement or as an alternate to another requirement of this code, the system shall be supervised by an approved central, proprietary, auxiliary, or remote station system in accordance with NFPA 72. Exception: Supervisory facilities in accordance with 903.9 shall not be required for extinguishing systems in one-and two-family dwellings. 903.9.2 In HPM Facilities, as defined in 408, all valves shall be provided with supervisory tamper switches. In addition to the requirements of 903.9.1, the closing of a valve shall activate an audible and visual signal at the emergency control station. 903.9.3 When a building fire alarm system is provided, actuation of the sprinkler system shall cause the building alarm to sound. (2) Local enforcement agencies, local building officials, state agencies, and the commission shalt interpret provisions of the Florida building Code in a manner that is consistent with declaratory statements and interpretations entered by the commission, except that conflicts between the Florida Fire Prevention Code and the Florida building Code shall be resolved in accordance with s. 553.73(9)(c) and (d). (3) The following procedures may be invoked regarding interpretations of the Florida building Code: {a) Upon written application by any substantially affected person or state agency or by a local enforcement agency, the commission shalt issue declaratory statements pursuant to s. 120.565 relating to the enforcement or administration by local governments of the Florida building Code. (b) When requested in writing by any substantially affected person or state agency or by a local enforcement agency, the commission shall issue a declaratory statement pursuant to s. 120.565 relating to this part and ss. 515.25, 515.27, 515.29, and 515.37.. Actions of the commission are subject to judicial review under s. 120.68. {c) The commission shall review decisions of local building officials and local enforcement agencies regarding interpretations of the Florida building Code the local board of appeals has considered the decision, if such board exists and if such appeals process is concluded within 25 business days. 1. The commission shalt coordinate with the building officials Association of Florida, Inc., to designate panels composed of five members to hear requests to review decisions of local building officials. The members must be licensed as building code administrators under part XII of chapter 468 and must have experience interpreting and enforcing provisions of the Florida building Code. 2. Requests to review a decision of a local building official interpreting provisions of the Florida building Code may be initiated by any substantially affected person, including an owner or builder subject to a decision of a local building official or an association of owners or builders having members who are subject to a decision of a focal building official. In order to initiate review, the substantially affected person must file a petition with the commission. The commission shall adopt a form for the petition, which shall be published on the building Code Information System. The form shalt, at a minimum, require the following: a. A statement of the provisions of the Florida building Code which are being interpreted by the local building official. e. A statement of the interpretation given to provisions of the Florida building Code by the local building official and the manner in which the interpretation was rendered. f. A statement of the interpretation that the petitioner contends should be given to the provisions of the Florida building Code and a statement supporting the petitioner's interpretation. g. Space for the local building official to respond in writing. The space shalt, at a minimum, require the local building official to respond by providing a statement admitting or denying the statements contained in the petition and a statement of the interpretation of the provisions of the Florida building Code which the local jurisdiction or the local building official contends is correct, including the basis for the interpretation. 3. The petitioner shalt submit the petition to the local building official, who shall place the date of receipt on the petition. The local building official shall respond to the petition in accordance with the form and shall return the petition along with his or her response to the petitioner within 5 days after receipt, exclusive of Saturdays, Sundays, and legal holidays. The petitioner may file the petition with the commission at any time after the local building official provides a response. If no response is provided by the local building official, the petitioner may file the petition with the commission 10 days after submission of the petition to the local building official and shall note that the local building official did not respond. 4. Upon receipt of a petition that meets the requirements of subparagraph 2., the commission shall immediately provide copies of the petition to a panel, and the commission shall publish the petition, including any response submitted by the local building official, on the building Code Information System in a manner that allows interested persons to address the issues by posting comments. 5. The panel shall conduct proceedings as necessary to resolve the issues; shall give due regard to the petitions, the response, and to comments posed on the building Code Information System; and shalt issue an interpretation regarding the provisions of the Florida building Code within 21 days after the filing of the petition. The panel shall render a determination based upon the Florida building Code or, if the code is ambiguous, the intent of the code. The paneCs interpretation shall be provided to the commission, which shall publish the interpretation on the building Code Information System and in the Florida Administrative Weekly. The interpretation shall be considered an interpretation entered by the commission, and shalt be binding upon the parties and upon alt jurisdictions subject to the Florida building Code, unless it is superseded by a declaratory statement issued by the Florida building Commission or by a final order entered after an appeal proceeding conducted in accordance with subparagraph 7. 6. It is the intent of the Legislature that review proceedings be completed within 21 days after the date that a petition seeking review is filed with the commission, and the time periods set forth in this paragraph may be waived only upon consent of all parties. 7. Any substantially affected person may appeal an interpretation rendered by a hearing officer panel by filing a petition with the commission. Hearings shall be conducted pursuant to chapter 120 and the uniform rules of procedure. Decisions of the commission are subject to judicial review pursuant to s. 120.68. The final order of the commission is binding upon the parties and upon all jurisdictions subject to the Florida building Code. 8. The burden of proof in any proceeding initiated in accordance with subparagraph 7. is on the party who initiated the appeal. 9. In any review proceeding initiated in accordance with this paragraph, including any proceeding initiated in accordance with subparagraph 7., the fact that an owner or builder has proceeded with construction may not be grounds for determining an issue to be moot if the issue is one that is likely to arise in the future. This paragraph provides the exclusive remedy for addressing requests to review local interpretations of the code and appeals from review proceedings. (d) Local decisions declaring structures to be unsafe and subject to repair or demolition are not subject to review under this subsection and may not be appealed to the commission if the local governing body finds that there is an immediate danger to the health and safety of the public. (e) Upon written application by any substantially affected person, the commission shall issue a declaratory statement pursuant to s. 120.565 relating to an agency's interpretation and enforcement of the specific provisions of the Florida building Code which the agency is authorized to enforce. This subsection does not provide any powers, other than advisory, to the commission with respect to any decision of the State Fire Marshal made pursuant to chapter 633. (f) The commission may designate a commission member who has demonstrated expertise in interpreting building plans to attend each meeting of the advisory council created in s. 553.512. The commission member may vary from meeting to meeting, shalt serve on the council in a nonvoting capacity, and shall receive per diem and expenses as provided in s. 553..74(3). (g) The commission shall by rule establish an informal process of rendering nonbinding interpretations of the Florida building Code. The commission is specifically authorized to refer interpretive issues to organizations that represent those engaged in the construction industry. The commission shall immediately implement the process before completing formal rulemaking. It is the intent of the Legislature that the commission create a process to refer questions to a small, rotating group of individuals licensed under part Xli of chapter 468, to which a party may pose questions regarding the interpretation of code provisions. It is the intent of the legislature that the process provide for the expeditious resolution of the issues presented and publication of the resulting interpretation on the building Code Information System. Such interpretations shalt be advisory only and nonbinding on the parties and the commission. (4) to order to administer this section, the commission may adopt by rule and impose a fee for binding interpretations to recoup the cost of the proceedings which may not exceed $250 for each request for a review or interpretation. For proceedings conducted by or in coordination with a third-party, the rule may provide that payment be made directly to the third party, who shall remit to the department that portion of the fee necessary to cover the costs of the department. All buildings, structures, electrical, gas; mechanical and plumbing systems, both existing and new, and all parts thereof, shall be maintained in a safe and sanitary condition. All devices or safeguards which are required by the technical codes when constructed, altered or repaired, shall. be maintained in good working order. The owner, or his designated agent, shall be responsible for the maintenance of buildings, structures, electrical, gas, mechan- ical and plumbing systems. the addition constitutes 25 percent or more of the area of the existing building, the addition shall be made to comply with all the requirements of the code and the existing building shall comply with the following: 1. G.F.C.I. outlets shall he installed where required by the code. 2. Smoke detectors shall be installed where required by the code. 3. In no case shall the existing building and the addition exceed the requirements of Table 500. 3401.7.2 Repairs and Alterations 3401.7.2.1 Repairs and alterations not increasing the area of the building, made within any 12 month period, shall be as set forth in this section. (See Section 202, VALUE.) 3401.7 Application to existing buildings 3401.7.1 Additions ' 3401.7.1.1 All except R3 occupancies shall comply with the following: 3401.7.1.1.1 When additions, or alterations increas- ing floor area, are made to an existing building, and the addition and existing buildings are separated by afire wall, the addition shall conform to all the requirements of this code applicable to a building of _' the area of the addition. 3401.7.1.1.2 Where the existing building and the addition are not separated by a fire wall and the area of the addition is 25 percent or more of the area of the existing building, the existing building and the addition shall be made to comply with all require- ments of this code for a building of area equal to the combined area of the addition and existing building. Exception: Existing buildings shall not be required to be upgraded to the structural require- ments of the code in effect on the date of appli- cation of the permit for the addition. 3401.7.1.1.3 Where the existing building and the addition are not separated by a fire wall and the area of the addition is less than 25 percent of the area of the existing building, the addition shall conform to all requirements of this code applicable to the build- ing of the combined area of the existing building and the addition; and the existing building shall con- form to the requirements of this code applicable to facilities for means of egress and automatic fire- extinguishing systems for a building of the com- bined area of the addition and existing building. 3401.7.1.2 Group R3 Occupancies shall comply with the following:' 3401.7.1.2.1 When additions, or alterations increas- ing floor area, are made to an existing building and 3401.7.2.2 Structural repairs and alterations, the cost of which does not exceed 25 percent of the value of the existing building or structure, shall comply with the requirements for new buildings or structures except that minor structural alterations, with the approval of E the building officiate maybe ma e of the same mated- .---- al and degree of fire-resistiv of whic-Ii fhe buildin_g_or s ructure is constructed. I 3401.7.2.3 Non-structural repairs and alterations exclu- sive of fixtures and furniture, the cost of which does not exceed 25 percent of the value of the existing build- ing or structure and which do not affect egress o ~ ~ - resis~tivi~, mmay be made o t e same material of which the building or structure is constructed. 3401.7.2.4 The replacement of garage doors, exterior doors, skylights, operative and inoperative windows shall be designed and constructed to comply with Chapter 16 of this code. Opening Protection Exception: For one- and two- family dwellings constructed under codes other than the Florida Building Code and located in wind- borne debris regions, the replacement of garage doors and exterior doors with glazing, sliding glass doors, glass patio doors, skylights, and operable and inoperable windows within any 12 month period shall not be required to have opening protection, but shall be designed for wind pressures for enclosed buildings provided the aggregate area of the glazing in the replaced components does not exceed 25 per- cent of the aggregate area of the glazed openings in the dwelling or dwelling unit. 3401.7.2.5 Repairs and alterations amounting to over 25 percent but not exceeding 50 percent of the value of e the existing building may be made during any 12 month period without making the entire existing build- ing comply rovided such repairs and alterations com- plv with the re 'rements t is code or a ut mg o likeike a~eig~d occupancy. 5 34.2 FLORIDA BUILDING CODE -BUILDING zoo/ ~~ L CHAPTER 34 EXISTING BUILDINGS SECTION 3401 GENERAL 3401.1 Scope. Provisions of this chapter shall govern the application of this code to existing buildings. • Exception: Buildings and structures located within the ~ High Velocity Hurricane Zone shall comply with the pro- . visions of Sections 3401.5, 3401.8, and 3401.2.2.1. 3401.2 Applicability 3401?.1 Alterations, repairs or rehabilitation work may be made to any existing structure, building, electrical, gas, mechanical or phnnbing system without requiring the buildin~~- structure, phimbing. electrical, mechanical or gas system to comply with all the requirements of the technical codes, provided that the alteration, repair or rehabilitation work conforms to the requirements of the technical codes for new construction. The building official shall determine the extent to which the existing system shall be made to conform to the requirements of the tech- nical codes for new construction. 3401.2,2 Change of occupancy 3401.3.2.1 If the occupancy classification or occupan- cy subclassifications of any existing building or struc- hire is chanced, the building, electrical, gas, mechani- cal and plumbing systems shall be made to conforn to the intent of the technical codes as required by the building official. • • • • • • • • 3401.2.2.2 Changes in the occupancy of a building now existing or hereafter erected shall not be made until a revised certificate of occupancy has been issued by the building official certifying that the #7oors are suitable for the loads characteristic of the proposed occupancy. 3401.3 Existing building certificate of occupancy. A cer- tificate of occupancy for any existing building may be obtained by applying to the building official and supplying the information and data necessary to determine compliance with the technical codes for the occupancy intended. Where necessary, in the opinion of the building official, two sets of detailed drawings, or a general inspection, or both, may be required. When, upon examination and inspection, it is fotimd that the buildine conforms to the provisions of the technical codes and other applicable laws and ordinances for such occupancy, a certificate of occupancy shall be issued. e 3401.3.1 Any existing building which complied with the - code in effect at the date of issuance of the permit shall be permitted to continue in its approved occupancy group. Such continued approval shall not be constnied to prohib- = it the inspection authority from at any time requiring that = the minimum standards of safety be maintained during the period of use of the building in accordance with the build- ing code in effect on the date of issuance of the permit. Such standards include, but are not limited to, strength. egress, fire resistance, openings in walls, electrical, plumbing, mechanical or elevator equipment or fire extin- guishing apparatus. 3401.3.2 Minimum standards of safety shall be in accor- dance with this code or the Flor•idn Fire Prevention Code, whichever standard offers the greatest degree of life safe- ty or alternatives that would provide an equivalent degree of life safety and an equivalent method of construction. 3401.4 Height and area. An existing building shall not be increased in height unless the entire building is altered to meet the requirements of this code for a new building of such increased height and building area. 3401.5 Special historic buildings. 3401.5.1 The provisions of the teclulical codes relating to the alteration, repair, restoration or moving of buildings or stnicttires shall not be mandatory for existing buildings or stnichires identified as qualified historic buildings or stnictures when such buildings or structures are judged by the builcling official to be safe and in the public interest of health, safety and welfare regarding any proposed alter- ation, repair, restoration, relocation or moving of build- ings within fire districts. 3401.5.2 Qualified historic buildings or structures shall be: 1. h~dividually listed on the National Register of Historic Places; or 2. A contributing property in a National Register listed historic district; or 3. Designated as a historic property or landmark under the provisions of a local historic preservation ordinance; or 4. A contributing property in a historic district desig- nated under the provisions of a local historic preser- vation ordinance; or 5. Determined eligible by the Florida State Historic Preservation Officer, either individually or as a cotl- tributing building or structure in a district, for listing in the National Register of Historic Places. 3401.5.3 When reviewing the proposed alteration, repair, restoration or moving of qualified historic buildings or structures the building official shall, pursuant to 103.'7, consider alternative materials and methods which may be proposed for achieving equivalency with the requirements in the technical codes. Alternate methods for achieving equivalency with the requirements in the technical codes shall be guided by the recommended approaches to reha- bilitation set forth in The Secretary of the Interior's Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings. (See Appendix D.) FLORIDA BUILDING CODE -BUILDING 34.1 3401.8.2.3.2 - 3402 3. Roof anchorage shall be checked at all walls where the addition connects to the existing building. If major deficiencies are found and the anchorage is not in compliance with the minimum requirements of the code, the roof anchorage shall be checked for all the existing roof. Minimum anchorage shall be provided to each member bearing on the exterior walls. 4. Permanent roof bracing shall be provided at all gable ends. 5. G.F. C.I. outlets shall be installed where required by the code. 6. Smoke detectors shall be installed where required by the code. 3401.8.2.3.2 The design professional shall 'conduct a site visit to ascertain the necessary work to be per- formed to comply with the requirements of this Section. 3401.8.2.3.3 The design professional shall provide an inspection report and indicate on the drawings all remedial actions to be performed on the building sub- mittal as a part of the permit plans. 3401.8.3 Repairs and alterations 3401.8.3.1 Repairs and alterations not increasing the area of the building, made within any 12 month period, shall meet the requirements of this section. 3401.8.3.2 Structural repairs and alterations, the cost of which does not exceed 25 percent of the replacement value of the existing building or structure, shall comply with the requirements for new buildings or strucriires except that minor structural repairs and alterations may, with the approval of the building official, be con- structed of the same materials and with the same degree of fire-resistivity as the original building or structure. (a) (b) Window replacement is considered a major structural repair which shall meet the code requirements for new buildings. This means that existing windows shall be replaced with impact resistant windows or must be replaced with win- dows that are designed to resist the static pres- sure for an enclosed building and shall be pro- tected with an impact resistant covering meeting the Miami-Dade TAS 201, 202 and 203. In addi- tion the new windows must be anchored as per Chapter 17 of the code. With regard to shutters as it relates to egress, existing windows which are used as emergency escape or rescue openings and at the same time protected with hurricane shutters shall be required to meet the code in effect at the time the building was permitted. Opening Protection Exception: For one- and two-family dwellings constructed under codes prior to September 1, 1994 the replacement of exterior doors with glazing, sliding glass doors, glass patio doors, skylights, and operable and inoperable windows within any 12 month period shall not be required to have opening protection provided the aggregate area of the glazing in the replaced components does not exceed 25 percent of the aggregate area of the glazed openings in the dwelling or dwelling unit. 3401.8.3.3 Non-structural repairs and alterations, the cost of which does not exceed 2~ percent of the replacement value of the existing building or structure, and which do not affect egress or fire-resistivity, may comply with the requirements of the building code in effect at the time of original construction, except that repairs and alterations to plumbing, mechanical and electrical systems shall comply with the code in effect at the time the permit for such work is issued 3401.8.3.4 Repairs and alterations amounting to 25 percent but not exceeding 50 percent of the replace- ment value of the existing building may be performed without making the entire existing building comply with all of the requirements for a new building, pro- vided such repairs and alterations comply with the requirements of the code for a building of like area, height and occupancy. 3401.8.3.5 Where repairs and alterations amounting to more than 50 percent of the replacement value of the existing building are made during any 12 month period, the building or shucture shall be made to conform to all the requirements for a new building or structure or be entirely demolished. 3401.8.4 Roofing. Not more than 25 percent of the roof covering of any building or structure shall be replaced in any 12 month period unless the entire roof covering is made to conform to the requirements of the code. 3401.8.5 Value determination. The value of a building or structure shall be the estimated cost of constructing a new building of like size, design and materials at the site of the original structure, assuming such site to be clear. Cost of additions, alterations and repairs shall be construed as the total cost of labor, materials and services based on current prices for new materials. 3401.8.6 Structural determination. For purposes of this section, structural shall mean any part, material or assembly of a building or structure which affects the safety of such building or structure and/or which supports any dead or designed live load and the removal of which part, material or assembly could cause, or be expected to cause, all or any portion to collapse or to fail. The addition shall conform to all requirements of the code applicable to a building having the combined area and height of the existing build- ing and the addition, 2. The existing building shall conform to all requirements of the means of egress for a building of the combined area and height of the addition and the existing building. 3. An approved detection, alarm and cozntnunica- tions system, detecting products of combus- tion, shall be required for all public areas and means of egress within the existing building. 3401.8.2.3 Group R3 Occupancies shall comply with the following: 3401.8 High Velocity hurricane zone application to exist- ing buildings 3401.8.1 General 3401.8.1.1 Existing buildings or shuchires to which additions, alterations, repair or changes of group of occupancy are proposed or intended shall be made to comply with all the requirements for new buildings or smictures of like area, height, type of constriction or group of occupancy, except as provided in this Section. 3401.8.1.2 The requirements of this section shall not supersede specific requirements of the code for con- smiction in Fire Zones. 3401.8.2 Additions 3401.8.2.1 Any addition or alterations increasing the floor area of the building, shall meet the requirements of this section. For purposes of this section, whether an addition falls within the stated percentages shall be cal- culated based on the cumulative increase of the building during the course of one calendar year. 3401.8.2.2 All except Group R3 occupancies shall com- ply with the following: 3401.8.2.2.1 When additions, or alterations increas- ing floor area, are made to an existing building, and the addition and existing building are separated by a ftre rated wall, as defined in Section 704, the addition shall conform to all the requirements of the code applicable to a building of the area of the addition. 3401.8.2.2.2 Where the existing building and the addition are not separated by a fire rated wall and the area of the addition is 25 percent or more of the area of the existing building, the existing building and the 3401.8.2.3.1 When additions, or alterations increas- ing floor area, are made to an existing building and the addition constitutes 25 percent or more of the area of the existing building, the addition shall be made to comply with all the requirements of the code and the existing building shall comply with the following: 1. Impact resistance devices having a valid NOA shall be installed at openings to provide protec- ton against stones. 2. Corners of buildings of masonry construction shall be checked for tie downs. If tie downs are not found in corners, testing shall be performed to locate tie downs i1 all walls. Proper installa- tion of tie downs shall be done at 20 foot inter- vals and at each corner except that interior tie downs may be provided in each side not less than 2 feet on each side of each corner. 2.1 Tie down refers to the anchorage from the foundation to the tie beam and shall provide the equivalent strength of a ver- tical #5 reinforcing bar properly attached to the foundation and tie beam encased it concrete or mortar and lapped a mini• mum of 30 inches or otherwise spliced it a manner which will develop tine fill] strength of the bar. 2.2 Alternate methods of providing anchor- age of equivalent strength to that des- cribed in 2.1 may be used where design calculations which admit rational analy- sis are submitted by a Registered Engineer or Architect proficient in stivc- tural design.
