MINUTES OF THE MEETING IF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, MARCH 28TH, 1960 AT 8 P.M.

The meeting was called to order by the Mayor-Commissioner,
Mr. Howell.
Minutes of the meeting of March 14th, 1960 were approved as
written upon motion of Mr. Moore, seconded by Mr. Johansen and
curied.
The Mayor recognized visitors present and called for any business
from the floor.
Mr. Kenneth Scudder was present and advised that he had not re-
ceived any further information as to the $500.00 connection
charge which he considered inequitable, and that he is willing to
pay the normal assessment as was charged the balance of the City
for the same size lot, and that it is a matter of principal with
him. The matter was discussed at length being participated in
by members of the audience present. The Commission again advised
that they were willing to give him the benefit of partial payments
as allowed those on the Assessment Roll. It was brought out in
the discussion that the line was carried to this property by the
Selva Marina Company because the former owner agreed that he want-
ed it, then changed his mind. Mr. Scudder advised that he is in-
terested in making partial payments of this fee, but that he still
is not satisfied. It was brought out that even if the City could
reduce his fee, they would have to pay the Selva Marina Co. the
difference which would not be fair to other taxpayers to have to
pay a part of the Scudder connection fee, as our contract with
the Selva Marina Company is for a payment of $500.00 connection
fee on the lots covered by the contract. The City will be glad to
work out a partial payment plan with Mr. Scudder.
The Commission next considered action on the Public Hearing con-
tinued from the meeting of March 14th, 1960 covering the Re-Zoning
of Lots 728 through 734, Saltair from Residence "C" to Business
"A". Since there is a deed restriction which would not permit
this property to be used for business purposes, Mr. Johansen moved
that the Ordinance not be adopted on second and final reading,
seconded by Mr. Claiborne and carried. Whereupon the Mayor de-

Glared said motion carried and said Ordinance not approved.
Dr. Thos. Morgan , Duval County Health Officer has advised that
he is attempting to get some of our police officers appointed
Deputy Dog Catchers. Mr. Joe Mallard, County Commissioner
advises that he will see that the appointments are made.
The City Manager presented a list of Lots which in his judgement
} need clearing for the health and welfare of the City, and recom-
mended that he be authorized to proceed in line with the Lot
Clearing Ordinance. Mr. Johansen presented Resolution #60-5
covering the cleaning of the lots as listed and moved its adop-
tion. The motion was seconded by Dr. Whitehurst and carried.
Copy of Resolution #60-5 is attached to these minutes and made
a part thereof.
Mr. Waggoner requested that he be authorized to get an appraisal
on Lots 37 , 38,47 , and 50, Saltair so that we can have a basis
for considering whether we want to go ahead with a plan for a
playground in back of the Fire Station. The owner of the balance
of the lots, which are not already owned by the City, has given
verbal assurance that his lots will be available at no cost to
the City for use as a park and playground. The matter was dis-
cussed following which Dr. Whitehurst moved that the City Man-
ager be authorized to the the lots appraised for information
purposes with additional fee to be paid if have to go to court,
seconded by Mr. Moore and carried.
Mr. Waggoner asked approval for his purchasing the pipe for the
mains on Mayport Road as we can save money if the City buys the
pipe and before April 1st. It was discussed whereupon Mr. Johan-
sen moved that the City Manager be authorized to buy the pipe,
seconded by Dr. Whitehurst and carried.
Mr. Waggoner advised that the figures on and certification of
the Special Sewer Assessment Roll was received from Mr. Parks
this afternoon, and if we can get the Notice published by Wed-
nesday, March 30th, that the Public Hearing can be held on
April 11th to confirm the Special Assessment Roll on sewers.
Mr. Thompson advised that he would take the notice in and get
in the paper by Wednesday.
There was a lengthy discussion of the parking at Atlantic Blvd.
and Ocean Blvd. Mr. P.H. Campbell advised that the parrellel
parking by his drug store is hurting his business , and it was
brought out that the parking area is wider at this section of
the block and could have angle parking there. The City Manager
was directed to put signs for angle parking by the drug store,
but parallel parking in remainder of block.

There being no further business the meeting was declared
adjourned by Mayor Howell.

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
ATLANTIC BEACH, DUVAL COUNTY, FLORIDA, THAT
The lots and plots listed below, all located within the
City of Atlantic Beach, Florida, dq, because of -excessive
growth of weeds, thickets, brush and/or accumulated trash,
constitute a health hazard to the citizens of the said
City:

BE IT FURTHER RESOLVED That, in accordance with Ordinance
No. 55-59-4 of the City of Atlantic Beach, Florida, the
owners of the above listed lots are ordered to remove such
weeds, thickets , brush and/or accumulated trash and that
the procedure and provisions of Ordinance No. 55-59-4 be
carried out.
