MINUTES OP THE REGUTAU ME3TING OF THE CITY COMMISSION OF THE CITY or ATLAITTIC BEACH, FLORIDA MLD AT THE CITY HAIL ON MON- DAY, FEBRUARY 23RD, 1959 AT 8 P.M. Present: n. S. Howell -Preben Johansen Chas. R. Moore Hugh Roberts W. Laney Whitehurst, Commissioners and J.F. Waggoner, • Jr. , City Manager Adele S. Grage, City Clerk • The meeting was called to order by the Mayor Commissioner, IIr. Howell. Mr. Howell recognized visitors present and called for any business from the floor. There was none. IIr. Waggoner announced that the Federal Department of Health, Education ane: Welfare would• m:ake their final inspection of the Sewer Plant, etc. to-morrow, February 24th, 1959. Mr. Waggoner advised that he has hired Arthur J. Craig to stake out the correct places for the laterals in connection with the sewer system and to also act as Resident Inspector laying of the gravity lines, and recuested the Commissions approval of his action. Upon motion of Air. Johansen, seconded by Dr. Whitehurst approval was given to the hiring of Hr. Craig for this work. Mr. Waggoner reported that he has written a letter to all users of our garbage service giving information on the new Garbage - 1 Ordinance. He has also had tags made to be used after March 15th on cans located in wrong place or in bad condition. Dr. Whitehurst -:resented and caused to be read Resolution 59-1 being a Resolution accepting the biei of Joe Reinertson of Jacksonville, Inc. for the construction of the Sanitary Im- provements and moved its adoption. The motion was seconded by Hr. Moore and having' been duly considered the Mayor put the question thereon and tbe vote-,was : Aye: Johansen, Moore, Roberts, Whitehurst, Howell Nay: None Whereupon the Mayor declared said motion carried and said Resolution 59-1 duly adopted. Copy of said Resolution is attached to these minutes and made a part thereof. Mr. Moore presented and caused to be read in full Resolution setting; up contemplated special assessments on Sanitary Sewer Improvements and directing; the City Treasurer to send statements covering same, and moved its adoption. Said motion was seconded by Mr. Johansen and ha vin;_.• been duly considered Minutes 2-23-59,Page #2 the Mayor put the question thereon and the_ vote was: Aye:Moore, Roberts , Whitehurst, Johansen, Howell Nay:None :'hereupon the Mayor declared said motion carried and said Resolution L59-2 duly adopted. Copy of said Resolution is attached to these minutes and made a part thereof. Mr. Johansen presented and caused to be read in full Resolution # 59-3 requesting the Florida State Road Boar' to pave, gutter and sidewalk certain portions of Highway ^1A, and moved its adoptiofl. Motion was seconded by Mr. Moore and having been duly condidered the Mayor put the question thereon, and the vote was: Aye: Roberts, Whitehurst, Johansen, Moore, Howell Nay: None Whereupon the Mayor declared said motion carried and said Resolution # 59-3 duly adopted. Copy of said Resolution is attached to these minutes and made a part thereof. Mr. Moore presented and caused to be read Resolution „59-4 requesting the Duval County Board of Commissioners to support the eiTort to'get Highway ^.1A (Section of State Highway #10) paved, guttered and sidewalked, and moved its adoption. Motion was seconded by Mx. Johansen and having been duly considered the Mayor put the ques- tion thereon and the vote was: Aye: Whitehurst, Johansen, Moore, Roberts , Howell Nay: None ,'hereupon the Mayor declared said motion carried and said Resolution '- 59-4 duly adopted. Copy of said Resolution is attached to these minutes and made a part thereof. The matter ' of a Board of adjustment on Zoning was next 7onsidered. Mr. Johansen presented Resolution 1 59-5 appointing the following men for 3 year terms: W.H. Bitzer Stephen Ilinckley Connie Cody Roy H. Nelson W. Ray Willis and moved its adoption. Motion was seconded by Mr. Moore and having been duly considered the Mayor put the ques- tion thereon and -the vote was: Aye: Johansen, Moore , Roberts , Whitehurst, Howell Nay: None Minutes 2-23-59,Page �3 Whereupon the Mayor declared said motion carried and said Resolution 59-5 duly adopted. Copy of said Reso- lution is attached to these minutes and made a part there- of. A request was read from the Beaches Civil Defense Coun- cil requesting that we give `;v200.00 to-wards their bud- get for this year. We made a similar appropriation last year. The matter was discussed and Mr. Johansen present- ed Resolution ;'59-6 authorizing the appropriation of ;200.00 to be paid to Beaches Civil Defense Council from Unallocated Funds in 1959 budget. Motion was seconded by Mr. Moore and having been duly considered the Mayor put the question thereon and the vote was: Aye: Moore, Roberts, Whitehurst, Johansen, Howell Nay: None Whereupon the Mayor declared said motion carried and said Resolution r59-6 duly adopted. Copy of said Reso- lution is attached hereto and made a part hereof. Mr. Hog11 appointed the following committee to make a study of water rates for outside of city customers: Commissioner Chas . Moore (Chairman) Comriissioner Hugh Roberts , Ui°toyr5anaer t mP.S1.7aganlr, Jr. He would like for them to report back to the Commission their findings and recommendations as soon as possible. A RESOLUTION ACCEPTING THE BID OF JOE REINERTSON, INC. FOR THE CONSTRUCTION OF THE SANITARY SEWER IMPROVEMENTS TO BE CONSTRUCTED AS COQ .' MPL TED BY RESO- LUTION NO. 58-38. BE IT RESOLVED by the City Commission of the City of Atlantic Beach, Florida: WHEREAS, by rcasolution No. 58-38, adopted by the City of Atlantic Beach on the 24th day of November, 1958, it was ordered that the sanitary sewer improvements particularly de- scribed in said resolution be constructed, and that the lots and lands to be served by the said sanitary sewer improvements be assessed for the benefits in the manner as particularly set forth in said resolution; and WHEREAS, Walter J. Parks, Engineer for said City, did prepare in duplicate plans and specifications for said improve- ments and an estimate of the cost thereof, and did also prepare in duplicate a tentative apportionment of the estimated cost as between the City and each lot or parcel of land subject to special assessment under such resolution, and did file with the Clerk of the City one copy of such plans and specifications and one copy of such estimated cost and such tentative apportion- ment; and WHEREAS, at a regular meeting of the City Commission held on the 22nd day of December, 1958, after the publication . of notice as provided in said resolution and by law, the said Resolution No. 58-38 was duly confirmed by said City Commission; and WHEREAS, the Clerk of the City did publish, in accord- ance with law, notice calling for sealed bids for the construc- tion of said work and bids therefor have been received by the City Commission, and the said Commission has found and determined that the hid of $248,993.45, submitted by Joe Reinertson of Jacksonville, Inc. , a corporation, for the doing of said work is the best low bid for the doing of said work, and that said Joe Reinertson of Jacksonville, Inc. is the lowest responsible bidder; and WHEREAS, said Joe Reinertson of Jacksonville, Inc. has also agreed in writing on file with the City Clerk to accept a contract for the doing of said work containing a provision as follows: m Y PROVIDED, HOWEVER, that upon payment to Contractor for Area "A" in accordance with said proposal, award, plans, and specifications, and the said contract documents, the Contractor agrees to defer any further payments that become due until Owner collects the special assessments against benefited properties imposed for the improvements being made hereunder by Contractor, it being expressly understood and agreed that Owner shall use due diligence in collecting said special assessments when due and that Owner will do all things necessary to assess and reassess said benefitted properties until a valid assessment is obtained, and that upon request of Contractor the Owner will assign the liens for said special assessments to Contractor to further secure any payments that have otherwise become due to Contractor under this contract. The said special assessment liens shall bear interest at rate of 6% per annum and the Contractor shall be entitled to receive interest at the same rate for all such time as payments due the Contractor under its contract shall be deferred pending the collection of such assessment liens. Such interest to be paid solely from the proceeds of said assessment liens. NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Atlantic Beach, Florida: 1. That the bid submitted by Joe Reinertson of Jackson- ville, Inc. , a corporation, for the construction of said sanitary sewer improvements, contemplated by said resolution No. 58-38, and as shown aad contemplated by said plans and specifications for said improvements prepared by said Walter J. Parks, be and the same is hereby accepted, and that upon the furnishing of bond of the character provided in said specifications and approved as to form and correctness and as to surety by the City Attorney, the proper officers of this City be and they are hereby authorized and directed to execute on behalf of the City a contract with said Joe Reinerteon of Jacksonville, Inc. for the construction by it of said sewer improvements. Said contract is to be approved as to form and correctness by the City Attorney and to contain the following provision: PROVIDED, HOWEVER, that upon payment to Contractor for Area "A" in accordance with said proposal, award, plans, and specifications, and the said contract documents, the Contractor agrees to defer any further payments that become due until Owner collects the special assessments against benefited properties imposed for the improvements being made hereunder by Contractor, it being expressly understood and agreed that Owner shall use due diligence in collecting said special assessments wh-n due and that Owner will dr+ all things necessary to assess and reassess said benefited properties until a valid assessment is - 2 - f obtained, and that upon request of Contractor the Owner will assign the liens for said special assessments to Contractor to further secure any payments that have otherwise become due to Contractor under this contract. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, DUVAL COUNTY FLORIDA, THAT WHEREAS, the contract for the construction of the Sanitary Sewer Improvements, ordered to be made by Resolution No. 58-38, has by Resolution No. 59-1 been awarded to Joe Reinertson, Inc. of Jacksonville for the sum of $248,993.45 and, WHEREAS, it is now contemplated that special assessments will be levied and assessed against property to be benefited by said improvements in the sum of $3.30 per front foot plus the sum of $50.00 per each lateral laid to each lot or parcel, and that the City shall bear all costs in excess of the aggregate sum of said special assessments and, WHEREAS, it is contemplated that the said special assessments shall be payable in three installments as follows: (a) First Installment - $1.70 per front foot plus the sum of $50.00 for each lateral laid to each lot or parcel of land on or before thirty days from and after the confirmation of the special assessment roll. (b) Second Installment - the sum of eighty cents per front foot on or before one year from the date said first installment becomes due. (c) Third Installment - the sum of eighty cents per front foot on or before two years from the date said first installment becomes due. All installments shall bear interest at the rate of 6% per annum from and after thirty days from the date of confirmation of said special assessment roll until paid. NOW THEREFORE, the City Treasurer is hereby directed to send a statement to the respective owners of each lot or parcel of land to be benefited by said improvements showing the amount of the contemplated special assessment and a request for payment forthwith of the same. V/7- 3 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA TO THE FLORIDA STATE ROAD BOARD REQUESTING THE JOB OF PAVING, GUTTERING AND SIDEWALKING STATE HIGHWAY AIA THROUGH ATLANTIC BEACH, NEPTUNE BEACH AND JACKSONVILLE BEACH BE COMPLETED. BE IT RESOLVED BY THE City Commission of the City of Atlantic Beach, Florida: WHEREAS, all the municipalities and organizations in the Jacksonville Beaches area united in 1956 to present to the State Road Board the urgent need of paving and guttering State Highway AIA thru Atlantic Beach, Neptune Beach and Jacksonville Beach, and WHEREAS, the Board of County Commissioners of Duval County concurred in the reasonableness of the request and supported our appeal to your honorable body, and, WHEREAS, a delegation from the Beach was most graciously received at your Lake City meeting in April of 1956, and, WHEREAS, the need for this section of primary road paving was thoroughly acknowledged by your board but because of funds then available, our delegation was requested to allow the project to be divided into two phases and to accept one phase at that time, namely that portion of AIA lying between and connecting State Highway 10 with State Highway 212 and to wait a year or two for the balance, and, WHEREAS, the first phase of the road has been completed and is a most complimentary monument to the State Road Department and an object of great pride to the Beach area and a wonderful addition to the roads Florida invites visitors to enjoy, and, WHEREAS, your forthcoming fiscal year will be the third since the one that included the first phase of this project and since the need has continued greatly to increase since that time NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Atlantic Beach, that your honorable body be respect- fully requested to include in your forthcoming primary road budget the item of pavingyguttering and sides,v king the section of State Highway #10 from Penman Road to Third St. This proposed job being an extension of the AIA paving through the Beaches in the Atlantic Beach, Neptune Beach area. Then to complete the job from the southern terminus of the newly finished paving in Jacksonville Beach - an extension of the paving, guttering and sidewalking from Beach Blvd. (road 212) on south to the St. Johns County line. FURTHER BE IT RESOLVED that the support and backing of this request be asked of the Duval County Commission. Passed by the City Commission on February 23rd, 1959.
