MINUTES OF THE SPECIAL MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD AT THE CITY HALL ON TUESDAY, JUNE 30TH, 1959
AT 8 P.M.

The meeting was called to order by the Mayor-Commissioner,
Mr. Howell .
Mr. Howell presented in writing an Ordinance Calling a Special
Referendum Election for the Adoption or Rejection of Chapter 59-
1053 Laws of Florida, Special Acts of 1959 as to the Enlarging
the Territorial Boundaries of the City of Atlantic Beach.
There was general discussion in which visitors present and the
Commissioners participated. Mr. Jimmy Landon requested that
it be made a part of the minutes that he protests the holding
of this election as it is a waste of taxpayers money. Hr.
R.P. Permenter also registered a protest as he advises that
of the 132• freeholders they contacted, 100 were against the
annexation, and he does not think it should be voted on. It
was brought out that this election is set up by the Legislatire
and has to be conducted in line with the Act as passed. It was
also brought out that the election is being paid for by the
City of Atlantic Beach. Dr. Whitehurst moved the adoption of
said Ordinance on first reading, seconded by Mr. Roberts and
having been duly considered the Mayor put the question thereon
and the vote was:
Aye: Moore, Roberts , Whitehurst, Howell
Nay: None
Absent: Johansen
Whereupon the Mayor declared said motion• carried and said Ordi-
nance passed on first reading. July 7th, -l959 was set as the
date for Public Hearing on said Ordinance .
Mr. Howell advised that Mr. Mallard, County Commissioner, has
agreed to send a crew in to shoot the Plaza and Levy Rd: with
RC-1 cutback provided the City will pay for the cutback, the
County will furnish the labor. It was the unanimous opinion
of the Commission that this be done and that the City pay for
the material.
Mr. Gerry Adams has requested permission for Mrs . Marcy Mason
to have a fireworks display' on the Hotel Reservation grounds '
on Saturday Night, July 4th, 1959. Upon motion of Mr. Moore,
seconded by Mr. Roberts this request was approved, provided a
City fireman stands by.

Mr. Howell advised that Frenchy LeGrande has requested permis-
sion to nova the upper stories from two houses being wrecked
at Jacksonville Beach to his location on Mayport Rd. to be used
as a warehouse. Mr. Waggoner inspected these buildings before
he wont on vacation and turned then down as they do not meet
the City' s building code requireuents . The matter was discussed
and Mr. Moore moved that the request be denied, seconded by
Mr. Roberts and carried.
A letter was received and read from the Selva Marina Realty Co.
advising that they are ready to begin development of the area
lying north of Solva Marina Unit ;;'2. They proposed that the
developer contract directly with the contractors for the gravity
sewers , storm sewers and catch basins , and 2 lanes of parkway
paving with curbing; and that the City contract in line with
their normal procedure for the sewerage lift station, 8" force
mains and 6" water mains with fire plugs, with payment being
made from funds loaned by developer to the City to be paid back
over a period of thiry years without interest from gross receipts
from sewer service charges imposed upon all properties served
by this lift station, The certificates of Indebtedness not
paid back within the 30 years will be considered of no further
force or effect, the same as if they had been paid in full.
The matter• was discussed at length and upon motion of Dr.
Whitehurst, seconded by Mr. Roberts it was referred to tithe
City Attorney as to the legality and for his recommendation.
It was suggested that a Resolution be ready by the next meeting
for a Resolution so that a Call for Bids can be made. Mr. ,Bull
advised that the Money will be ready when the City is ready to
let the contracts.
Mr. Robetts advised that the License Committee recommended that
the License Ordinance #45-58-1 be amended to change the license
fee on busses under 4000 pounds to - 15 .00 for the first bus
and $10.00 for each additional bus . Dr. Whitehurst moved that
the recommendation of the Committee be accepted and that the
Ordinance be so amended, seconded by Mr. Moore and carried.
There being no further business , the Mayor declared the meet-
ing adjourned.
