MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD AT THE CITY HALL ON MONDAY AUGUST 10TH, 1959
AT 8 P.M.

The meeting was called to order by the Mayor-Commissioner,
Mr. Howell.
Minutes of the meeting of July 27th, 1959 were approved as
written upon motion of Mr. Johansen and seconded by Dr.
Whitehurst and carried.
Mr. Howell recognized visitors present and called for any
business from the floor. There was none other than that
scheduled on the Agenda.
It was advised that the request for a pre-school to be located
at 335--4th Street has been withdrawn as the sponsors decided
that they did not wish to do anything that would make the
neighbors unhappy and they are therefore abandoning plans for
a pre-school at this location.
The question of tying on to the sewer system was again discussed
and upon motion of Mr. Moore, seconded by Dr. Whitehurst and
carried it was approved to require that either payment had been
made on the Special Sewer Assessment, or the owner be required
to sign an application requesting permission to connect and
agreeing to pay the Assessment when due.
A bill was presented from Mr. Walter J. Parks, Jr. , Engineer,
to cover services rendered in preparing plans and specifications
for sewage pumping station D and force main in the amount of
$1, 251. 54. Mr. Moore moved that this bill be paid from the
Selva Marina Sewer Fund. The motion was seconded by Mr. Johansen
and carried.
Mr. Waggoner advised that he had received a request from a Mr.
McKenzie to have a Pet Cemetery on his property located west
of Mayport Road. The matter was discussed and it was concluded
that since the Zoning Ordinance does not permit a cemetery in
any of the zones then it was prohibitive.

No reports were received from the Fire and Police Departments.
Mr. Howell presented Ordinance No. 80-59-3 entitled
"AN ORDINANCE FIXING AND ESTABLISHING RATES AND
CHARGES AND RULES GOVERNING THE SALE AND
DISTRIBUTION OF WATER BY THE CITY OF ATLANTIC
BEACH, FLORIDA, REGULATING THE SERVICE RENDERED
CONSUMERS THEREOF; PROVIDING A PENALTY FOR THE
VIOLATION THEREOF:
which was read in full, then declared the meeting in session as
a public hearing on said Ordinance and called for any discussion
on same. The Ordinance having been discussed Dr. Whitehurst
moved its adoption on second and final reading. Motion was
seconded by Mr. Johansen and having been duly considered the
Mayor put the question thereon and the vote was

Whereupon the Mayor declared said motion carried and said
Ordinance No. 80-59-3 duly adopted on second and final reading.
Dr. Whitehurst presented a Resolution o.n the death of M. V.
Ozborne, who at one time acted as Treasurer for the Town of
Atlantic Beach, and moved its adoption. The motion was
seconded by Mr. Moore and carried. Copy of said Resolution1 /5--
is attached to these minutes and made a part thereof.
The Mayor suggested the name of Mr. Roy E. Nelson to act as the
third member of the Board of Assessment Review to succeed Mr.
Roger Peden, who resigned due to moving from the City. Mr.
Moore moved that Mr. Nelson be appointed to this Board. The
motion was seconded by Mr. Johansen and carried.
It was reported from the Committee that McMullen Construction
Company was awarded the contract for Sewage Pumbing Station lb "
and Force Mains for Selva Marina Unit No. 5. Certified proof
of publication covering the call for bids on this contract is
attached to these minutes and made a part thereof.
It was advised that the Selva Marina Realty Company have signed
a contract with Smith and Crotty Construction Company to put in
Sanitary Sewer extentions for the Selva Marina Sub-Division
Unit No. 5. This contract has been approved as to form by
Mr. Frank Thompson, City Attorney.

The Committee reported that a water cut-in for the Selva Marina
Country Club has been approved.
Mr. Waggoner reported on the progress of the sewer work in the
City, advising that it was approximately 44% complete.
A letter was read from the newly formed Beach Methodist Church
thanking the City for the use of the City Hall for their first
meetings.
There being no further business the meeting was declared adjourned
by Mayor Howell.

City expresses its sincerest regret at the passing
of our friend and extends deepest sympathy to his
loved ones in their hour of sorrow,
AND BE IT FURTHER RESOLVED That a copy of this
Resolution be given to Mrs. Osborne.
