MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMIS-
SION HELD AT THE CITY HALL ON MONDAY, SEPTEMBLR 14TM, 1959 AT 8 PM

The City Commission of Atlantic Beach met in regular• session,
pursuant to the law and the rules of said Commission, in the City
Hall of said City at 8 P.M. , September 14th,1$59 to canvass the
votes cast in the Special Referendum Election to adopt or reject
Chapter 59-1053 Laws of Florida, Special Acts of 1959 . Certificate
of' Proof of Publication of Notice of said special Ref erendua
Election is attached to these minutes and made a part thereof.
The meeting was called to order by the Hayor Commissioner, Mr.
Howell.
Mayor Howell and City Clerk Adele S. Grage presented to the
Commission copies of the certificate from the election officials
covering the Special Referendum•Election to approve or reject
Chapter 59-1053 Laws of Florida, Special Acts of 1959. Copy of
the Election OfficialstCertificate is attached to these minutes
and made a part thereof.
Mr. Moore presented Resolution #59-17 covering the canvassing of
the returns of the; Special Referendum Election and declaring
said Chapter 59-1053 Laws of Florida, Special Acts of 1959 as
rejected and directing that the Secretary of State of the. State of
Florida be so advised, and moved its adoption. Said motion was
seconded by Dr. Whitehurst and was unanimously carried.
The Commission next went into session to consider the order of
business .
Minutes of the meeting of -August 24th, 1959 were approved as
written upon notion of Mr. Johansen, seconded by Mr. Moore.
Minutes of the meeting of -August 31st, 1959 were! approved as
written upon motion of Mr. Johansen, seconded by Mr. Moore.
A request was received from the Community Presbyterian Church
to put a fence across the easment as they want to fence in that
area for the kindergarten children. Mr. Waggoner recommended that
permission be granted. The matter was discussed and Hr. Moore
moved that the recommendation of the City Manager be accepted with
the understanding that the fence can be taken down at anytime if
necessity demanded, seconded by Mr. Johansen and carried.

Mr. Waggoner advised that he had received a request from
E.B. Lester for the Commission to consider re-Zoning of the
tract of land lying north of Levy Road and west of Mayport
Rd. to Industrial area to permit the building of a small
plant for the fabrication of plastic and stainless steel pro-.
ducts. The matter was discussed and upon motion of Mr. Moore,
seconded by Mr. Johansen approval was given to start the nec-
essary machinery for the re-zoning of this area.
The audit report on the water revenue Utility Funds was re-
ceived at the last meeting, and upon motion of Dr. Whitehurst
seconded by Mr. Johansen this report was accepted.
Mr. Waggoner advised that Mr. Queen who has bought the property
at 645 Ocean Blvd. , which is the West half of Lot 4, Block 16,
has requested that he be permitted to make a duplex out of
this house. He does not plan to change the outside as to
dimensions. The two houses back of it are duplex, and the
house next door to it was built for a duplex, and the Commission
has gone on record as favoring considering re-zoning the corner
lots next to it for duplex when the owner is ready to build.
Mr. Moore moved that the re-zoning of this property be' included
in the advertisement for the re-zoning mn Mayport Road, second-
ed by Dr. Whitehurst and carried.
Estimate #1 from the McMullen Construction Co. on Sewerage
Pumping Station "D" and Force Mains was .Fr000nted for payment..
Mr. \laggoner• advised that the estimate had been approved by
the Engineer, Mr. Walter Parks, and that he recommends that it
be paid. Dr. Whitehurst moved that Estimate ;1 in amount of
$17,122.00 be paid the McMullen Construction Co. from the Selva
Marina Sewer Fund, seconded by Mr. Roberts and carried.
Mr. Waggoner presented a nap showing an enlarged area back of
the Fire Station to be considered for a Park and Playground.
He suggested that a committee be appointed to contact the owners
to see what can be done as to price on same. Dr. Whitehurst
moved that we consider this parcel of land and that proper steps
be taken to further investigate the possibility of acquiring
and developing of this property and that-the findings be 're-
ported to the Commission at a later date, seconded by Mr.
Johansen and carried.
Mayor Howell presented in writing an Ordinance covering the
locations of business handling alcoholic beverages. Tir. Johan-
sen moved its adoption on first reading, seconded by Mr. Moore,
and having been duly considered the Mayor put the question
thereon and the vote was:
Aye: Johansen, Moore, Roberts, Whitehurst, Howell
Nay: None
Whereupon the Mayor declared said Motion carried and said Ordi-
nance carried on first reading. The Public Hearing was set for
September 28th, 1959.

The City Clerk recommended the following to act as officials
for the Primary Election of October 6th, 1959:
Mrs. Charlotte Gorman, Clerk
Mrs. Leura Shugart, Inspector
Mrs. Margaret Goodling, Inspector
and .
Mrs. Donna W. Ross , Alternate
Mr. Johansen moved that the recommendation of the City Clerk
be accepted and that these bo' named as the officials for the
Election of October 6th, 1959, seconded by Mr. Roberts and
carried.
Mr. Howell advised that Mr. Penman would like for the Commiss-
ion to accept as a dedicated street that little road running
off of Mayport Rd. just north of Atlantic Blvd. with the 'pro-
vision that the City would not have to do anything to it. It
was discussed and decided that Mr. Howell will look into the
matter further before the Commission takes any action.
The condition of the streets was discussed and it was estimated
that it would- cost approximately 581000.00 to re-surface
Sherry Drive . It is one of the through streets going north
and south and needs to have something done soon. Streets and
drainage were discussed and the City Manager is to get esti-
mates on Sherry Drive as to the cost of chopping up and then
shooting with paving material.
There being no further business the meeting was declared
adjourned, upon motion of Dr. Whitehurst.

RESOLUTION # 59-17
WHEREAS, the Inspectors and the Clerk of the Special Referendum
Election Held in the City of Atlantic Beach on Monday, September
14th, 1959 for the purpose of approving or rejecting Chapter
59-1053 Laws of Florida Special Acts of 1959 as to the First
and Second Territorial Areas, canvassed the votes cast and
did make the returns on the same in words as follows:
NOW THEREFORE BE IT RESOLVED, That it is hereby unanimously voted
that said returns be accepted as reported.
AND BE IT FURTHER RESOLVED by the City Commission of Atlantic
Beach, Florida, acting in the capacity of a Canvassing Board,
that it is hereby found and determined as follows:
1. The City of Atlantic Beach:
The total number of votes cast in said election was 124. The
number of votes cast in favor of the proposed Chapter 59-1053 ,
Laws of Florida, Special Acts of 1959 as to the First Territorial
Area was 90. The number cast against said proposed Chapter 59-1053
as to the First Territorial Area was 32. The number of votes
cast in favor of Chapter 59-1053, Laws of Florida, Special Acts
of 1959 as to the Second Territorial Area was 89. The number of
votes cast against said proposed Chapter 59-1053 as to the Second
Territorial Area was 33.
2. The First Territorial Area:
The total number of votes cast in said election was 41; the number
of votes cast in favor of the proposed Chapter 59-1053, Laws of
Florida, Special Acts of 1959 as to the First Territorial Area
was 15; the number cast against said proposed Chapter 59-1053 as
to the First Territorial Area was 26.
3. The Second Territorial Area:
The total number of votes cast in said election was 47 ; the number
of votes cast in favor of the proposed Chapter 59-1053, Laws of
Florida, Special Acts of 1959 as to the Second Territorial Area
was 11; the number cast against said proposed Chapter 59-1053 as
to the Second Territorial Area was 36; and that,
THE SAID ELECTION was conducted and held strictly in accordance with
the manner provided by said Section 2 of said Chapter 59-1053, Laws
of Florida, 1959, and that,
WE DO HEREBY Declare that the said Chapter 59-1053, Laws of Florida,
Special Acts of 1959, was therefore duly rejected as to each of the
Territorial Areas in said referendum election.

14th, 1959.
