MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY
COMMISSEO,N HELD AT THE CITY HALL ON MONDAY, OCTOBER 12TH, 1959
AT 8 P.M.

The meeting was called to order by the Mayor-Commissioner,
Mr. Howell.
Minutes of the meeting of September 28th, 1959 were approved as
written upon motion of Dr. Whitehurst, seconded by Mr. Moore and
carried.
Minutes of the meeting of October 6th, 1959 were approved as
written upon motion of Mr. Moore, seconded by Dr. Whitehurst and
carried.
Bids were received on the City Yard Fence as follows:
Reeves Fences, Inc. $2378.00
Anchor Post Products, Inc. 2482.00
Newsom Fences 2446.00
Upon motion of Mr. Johansen, seconded by Mr. Moore and carried
the bids were received for tabulation and study.
Mr. McTigue of the Volunteer Fire Department appeared on behalf
of the firemen rzquesting $250.00 for a social for them. It was
discussed and Mr. Moore moved, seconded by Dr. Whitehurst that
$250.00 be given the Volunteer Firemen for a social, same to be
from unallocated funds. The motion carried.
Mr. Kenneth Scudder appeared in regards to the Sewer Connection
charge against his property, and advised that he felt that the
City should negotiate with the Selva Marina Company as they are
the ones that have the contract with the company. His complaint
is on the inequality of the charge which the City made against him.
The matter was discussed at length in which it was agreed that the
matter should have more study, whereupon Mr. Johansen moved that
a committee be appointed to discuss with the City Attorney this
matter and determine if anything can be done, seconded by Mr.
Roberts and carried. The Mayor appointed Messrs. Johansen, Moore,
and Roberts as the committee.

Mr. Howell advised that he has again been contacted by Mr. Penman
relative to the City's accepting a deed from Beach Sales Corp.
for the little street that runs off Mayport Road to the east just
north of Atlantic Boulevard. He would like for it to be accepted
with the understanding that the City will not have to repair or
maintain it. The matter was discussed and Mr. Moore moved that we
get the recommendation of the City Attorney and go by his opinion,
seconded by Mr. Roberts and carried.
The matter of the sign which the Delicatessen would like to place
on the vacant lots at the northeast corner of Ahern and Ocean
Boulevard was next discussed. They have submitted a drawing to
the City Manager of the sign they wish to erect and want to place
it a different angle to where the posts were originally. Following
discussimn Mr. Johansen moved that they be given a temporary per-
mit for the sign subject to the re-action of the neighbors, second-
ed by Mr. Roberts and the call vote was

Whereupon the Mayor declared said motion carried.
The City Manager reported that the City of Jacksonville has in-
spected the wiring in the Ramos Bldg. and are condemning it. He
also advised that the owners have informed him through their
attorney that they are taking bids on tearing the building down,
and it was agreed that if not done in a reasonable length of time
that we will continue with our plan to condemn the building.
Mr. Waggoner advised that in line with our franchise with the
City of Jacksonville we are entitled to 19 additional street lights
and he would like any suggestions as to locations.
The City Manager advised that he thought we should determine what
is necessary to be done to provide those places on the Selva Mari-
na sewer system with laterals where they do not have them. He
would like to get figures from Joe Reinertson of Jacksonville for
this as believe should be done while they have the equipment here
to do the work with and would be more reasonable than at a later
date. He also advised that the money to pay for the laterals
would come out of the $500.00 connection charge and deducted when
settlement is made with Selva Marina Realty Co. It was the con-
sensus of opinion that we should go ahead with these laterals at
this time.

Mr. Waggoner suggested on connecting up to the sewer system that
if connection is not made in the 180 days as notified that billing
for the service begin as of that day anyway. It was suggested
that perhaps we should have waited until the system was complete
then allow everyone 180 days from that time. Whatever change may
be made it will be necessary to amend the Ordinance. Mr. Howell
suggested that the time be extended to those who are to hook into
the Selva Marina line according to the time taken to negotiate
by the committee.
Mr. Waggoner presented the financial report for the first 9 months
of 1959 copies of which were distributed to all Commissioners.
The Commission next went into session for a Public Hearing on
Ordinance #55-59-3 being an Ordinance Providing that No Building
Permit Shall Be Issued for the Construction of any Building or
Structure, Outside the Area Served by the Atlantic Beach Sanitary
Sewer System, in which Sanitary Facilities or Plumbing is required,
Until a Permit for the Construction of a Sanitary Disposal System
Shall Have First Been Obtained; etc. , which Ordinance was read in
full by the Mayor. The penalty was set at $100.00 and/or 30 days.
As no-one appeared either for or against the Ordinance, Mr. Johansen
moved its adoption on second and final reading, seconded by Mr.
Moore and having been duly considered the Mayor put the question
thereon and the vote was unanimous, whereupon the Mayor declared
said motion carried and said Ordinance #55-59-3 adopted.
A report for the month of September, 1959 was received from the
Fire Department and filed.
The matter of a Retirement Fund for the Police and Fire Departments
was discussed and Mr. Howell advised that he will have a full re-
port ready by next meeting to-gether with an Ordinance to cover.
Mr. Johansen advised that he felt something should be done to Beach
Ave, since the property along the narrow part is being improved,
and we should be thinking about the paving for that first two blocks.
It was brought out that we consider it as City property now, in fact
we have put our sewer line on it.
Dr. Whitehurst feels we might request the proper authorities to con-
struct a 4 lane boulevard from AlA at in to the Expressway as he
believes it is the right time to check on this matter. It was
discussed and it was brought out that the State Road Department is
making a study now for the next 20 year needs.
