Commissioners MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISS`CM HELD AT THE CITY HALL ON MONDAY, DECEMBER 14TH, 1959 AT 8 P.M. Present: Wm. S. Howell J.B, Claiborne W. Laney Whitehurst, Commissioners and J.F. Waggoner, Jr. , City Manager Adele S. Grage, City Clerk Absent: Preben Johansen, Commissioner Chas. R. Moore, Commissiiner Frank Thompson, City Attorney In line with the provisions of the charter of the City of Atlantic Beach, Florida, J.B. Claiborne was sworn into office as City Commissioner by the City Clerk, Adele S . Grage. The meeting was then called to order by the Mayor-Commossioner, Mr. Howell. Minutes of the meeting of November 23rd, 1959 were approved as written upon motion of Dr. Whitehurst, seconded by Mr. Claiborne. Minutes of the meeting of December 1st, 1959 were approved as written upon motion of Mr. Claiborne, seconded by Dr. Whitehurst. Mr. Howell recognized visitors present and called for any busi- ness from the floor. There was none. A letter was presented from Brigadier Emil Miller of the USO-SA asking that we donate $500.00 to-wards their program at the Beaches for immediate use, and to set up $1, 000.00 in 1960 budget for them. It was discussed and decided to defer action to the meeting of December 28th, 1959. A letter was read from the American Red Cross Life Saving Corps expressing thanks for our annual donation to their budget. Letters relative to our Resolution on State Roadsl0 and AlA were read from the State Road Department and Jacksonville Express- way Authority, expressing interest and co-operation. A letter was presented from Wm. N. Morgan advising that he pro- poses to build a duplex on North side of 16th St. which is just outside the City Limits and .requesting permission to connect to the City ' s sewer line. the matter was discussed and it was Oe- cided to defer action until December 28th meeting. Minutes 12-14-59, Page #2 Estimate #8 from Joe Reinertson of Jacksonville on the Sewage Collection System was received. Mr. Waggoner advised that the figures, etc. have been checked and that he recommends paying this estimate in amount of $23, 787 .87 which allows for 10% which is being withheld. Dr. Whitehurst moved that this Estimate be paid from the Sewer Fund as recommended, seconded by Mr. Claiborne and carried. Mr. Waggoner reported on progress of suggestions in the Garden Circle letter received by the Commission at the November 23rd meeting. Mr. Waggoner presented a Progress Report on Capital improvements and equipment for the City since 1955 and asked the Commissioners to study same and advise if they would like to have it printed for distribution. A letter was presented from Mr. & Mrs. Walter A. Murphy advising that the Courts have rendered a verdict in their favor entitleing them to Homestead Exemption for the years 1957 and 1958 while he was in overseas service and they therefore requested tax refund on this portion of the taxes they paid for those years. The matter has been referred to Mr. Thompson who advises that since the Court has decreed that the Murphys are entitled to Homestead Exemption for these two years, that it would appear that the Murphys are entitled to a refund of the excess paid by them, occasioned by the failure to allow the $5000. 00 exemption. The matter was discussed following which Mr. Claiborne presented Resolution #59-27 approving a refund to the Murphy ' s on their W 25ft of E 50 ft. of Lot 25 , Pt. of Lot 25, Block 2 & Pt. of Unnumbered Tract lying West of Block 2 as requested by them and covered by the Court decree, seconded by Dr. Whitehurst and carried. Copy of Resolution #59-27 attached hereto. Mrs. Grage announced that the officials for the Special Election of December 15th, 1959 will be Mrs. Charlotte Gorman, Clerk and Mrs. Margaret Goodling and Mrs. Donna Ross, Inspectors. The matter of deciding the charges for Selva Marina Sewer Con- nectionc was deferred to the December 28th meeting. The Commission next went into session for Public Hearing on the two Ordinances #20-59-3 covering the Budget for 1960 and #55-59-4 covering Lot Clearing, said Ordinances having been posted in line with charter requirements. Mayor Howell presented and caused to be read in full Ordinance #20-59-3, and no one appearing for or against said Ordinance and having been duly considered Dr.White- Minutes 12-14-59, Page #3 hurst moved its adoption on second and final reading, seconded by Mr. Claiborne and the vote was Aye: Claiborne, Whitehurst, Howell Nay: None Absent: Johansen, Moore. Whereupon the Mayor declared said motion carried and said Ordinance #20-59-3 adopted on second and final reading. Mayor Howell next presented Ordinance #55-59-4 being an Ordinance Requiring Owners of Property to Keep and Maintain the Same Free of Unreasonable Accumulation of Weeds or Trash, etc. and caused same to be read in full, and noone appearing either for or against, and having been duly considered Mr. Claiborne moved its adoption on second and final reading, seconded by Dr. Whitehurst and the vote was Aye: Whitehurst, Claiborne, Howell Nay: None Absent: Johansen, Moore Whereupon the Mayor declared said motiin carried and said Ordinance #55-59-4 adopted on second and final reading. The Committee recommended that the bid of the Aierican-LaFrance Co. be accepted for the new fire engine in the amount of S17 , 500.00. Dr. Whitehurst moved that the recommendation of the committee be accepted and the fire engine be purchased from the American-LaFrance Co. payment for same to be made $10, 000.00 upon delivery and acceptance, and $7 , 500.00 to be paid in 6 months @ 415% interest, all to be paid from the 1960 budget. The motion was seconded by Mr. Claiborne and unanimously carried. The Fire Department report for the month of November, 1959 was received and filed. RESOLUTION #59-27 WHEREAS, The Courts have rendered a verdict in favor of Mr. & Mrs. Walter A. Murphy entitling them to Homestead Exemption for the years 1957 and 1958, while he was in overseas service, on the W 25ft. of E. 50 ft. of Lot 25 , Block 2 & Part of unnumbered tract lying west of Block 2, Atlantic Beach, and WHEREAS the Murphys have made request for refund on their taxes for the years 1957 and 1958 in line with said Court Order, NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, DUVAL COUUTY, FLORIDA, that The City Treasurer be authorized to refund to the Murphys the excess tax paid by them for the years 1957 and 1958 due to the failure to allow them the $5000.00 Homestead 41/ Exemption. * * * * * * * * * * * * * * Passed by the City Commission on December 14th, 1959. Grage, City Cle- (SEAL) The court suit was brought by the Murphys against the County, and Mr. Thompson advised that since the Court had given a verdict in their favor against the County, that we should recognize the verdict and make necessary refund, also.
