HELD AT THE CITY HALL ON TUESDAY, DECEMBER 15TH, 1959 AT 7 : 30 P.M.

The Mayor called the meeting to order and the Commission immediately
went into session as a Canvassing Board to receive the report of
the Election Officials covering the Special Election on the Initia-
tive Ordinance covering the closing hours for sale of alcoholic
beverages. Certified copy of Proof of Publication covering this
election is attached to these minutes and made a part thereof.
Copies of the Certificate of Result of the election were presented
to the Commission by the Mayor and City Clerk. Resolution #59-28
was presented by Mr. Claiborne who moved its adoption. Said moti3On
was seconded by Dr. Whitehurst and having been duly considered the
Mayor put the question and the motion was unanimously carried.
Copy of Resolution #59-28 is attached to these minutes and made a
part thereof. Said Resolution declares the initiative ordinance
adopted.
There being no further business the meeting was declared adjourned.

RESOLUTION 59-28
WHEREAS, a proposed ordinance entitled
"AN ORDINANCE regulating hours for the sale
of alcoholic and intoxicating beverages in
the City of Atlantic Beach, Florida, and
repealing Ordinance No. 10•-58--3 and all
ordinances and parts of ordinances in ccn-
flict herewith ",
was initiated pursuant to the provisions of Article X of the
Charter of the City of Atlantic Beach, Florida, and submitted
to the City Commission, and the City Commission, after consider-
ing the same, failed to pass or adopt said proposed ordinance,
and ordered the same to be submitted to the electors of said
City for their approval or disapproval, at an election to be
held on the 15th day of December, 1959; and
WHEREAS, the said election has been duly held in
accordance with law on said date, and the votes cast thereat
have, by the inspectors and clerks appointed to conduct said
election, been read, delivered and canvassed, and the returns
of said election have been delivered to said Commission for the
purpose of canvassing said election returns and determining and
certifying the result thereof;
NOW THEREFORE, be it resolved, determined, found,
declared and hereby certified by the City Commission of the City
of Atlantic Beach, Florida, at a meeting of such Commission duly
and regularly held, at which said official returns of said election
have been duly and regularly canvassed according to law as follows,
that:

We, the undersigned, being the Inspectors and Clerk appointed to
conduct the Special Election in the City of Atlantic Beach, on Tuesday,
December 15th, 1959, on the question of the adoption of the Ordinance
regulating hours for the sale of alcoholic and intoxicating beverages
in the City of Atlantic Beach, Florida and repealing ordinance No. 10-58-3
and all ordinances and parts of ordinances in conflict herewith, hereby
certify that we conducted said election on said date, and counted the
ballots cast for and against the question as printed on the ballots and
find the results to be as follows:
