MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, DECEMBER 28TH, 1959 AT 8 P.M.

The meeting was called to order by the Mayor-Commissioner,
Mr. Howell.
Minutes of the meeting of December 14th, 1959 were approved as
written upon motion of Mr, Johansen, seconded by Mr. Moore.
Minutes of the meeting of December 15th, 1959 were approved as
written upon motion of Mr. Johansen, seconded by Mr. Moore.
Mr. Howell recognized visitors present and called for any business
from the floor. Mrs. John M. McMillen and Mrs, Harry Howell, Jr.
appeared to complain about the dogs running loose in the City and
also in packs, which is very dangerous for pedestrians and drivers.
There is a genuine concern about this situation, and a general
discussion followed. Mr. Howell was called from the meeting due
to the fire at Morgan's Store at Jacksonville Beach, and Mr.
Johansen took over the chair. It was brought out that the City
had a dog ordinance at one time and repealed it at the request of
the Councty who said they would take care of the dog situation.
However at this time it was reported, the County does not come down
to the Beach Area as they have so much of the rest of the county to
look after. The Humane Society will not come into Atlantic Beach
unless we enter into an agreement with them. After further dis-
cussion it was decided for the City Manager to check with the Coun-
ty and see what they can do , and to also get the information as
to the Humane Society cost for coming into Atlantic Beach. Mr.
Russell was also directed to do all that he can to break up the
packs until something further can be done about this situation.
The letter from the USO-SA was again considered and it was the
unanimous opinion that since the City Attorney does not think we
can spend tax money for this use , that action will be deferred
until such a time as there will be a unanimous decision by the
entire Commission.

Mr. Waggoner presented the request from Mr. Wm. N. Morgan to
connect onto our sewer system for his lots on the north side of
16th St. which is just outside the City Limits. It was discussed
and upon motion of Mr. Moore, seconded by Mr. Claiborne it was
decided to hold action in abeyance until full commission was pre+
sent, as there is some question as to the amount of charges and
how determined.
The matter of tap charges to Selva Marina Sewer line for those
involved on 11th Street was discussed. Mr. Johansen advised that
he thought the matter had been settled with understanding that
they were to pay the $500.00 but could make the payment in install&
ments. Mr. Thompson advised that in any event we would have to
pay the Selva Marina Company the $500.00 and take our chances on
collecting the installments. The qudition was raised as to whether
we could pay the entire amount to the Selva Marina Co. and place
a lien against the properties involved, which it was agreed was
doubtful. An assessment becomes among the first liens to be paid
off, but a mortgage lien is paid off at the end of other liens.
It was finally agreed to let the matter stand as agreed in the
contract.
The City Manager suggested that an Ordinance be drawn up providing
that any person with sewer available and hasn't connected to same
within a year that the water service be discontinued. The matter
was discussed and the City Manager and City Attorney were directed
to prepare the necessary Ordinance and/or Resolution for study
and consideration.
Sewer Service charges not covered by present Ordinance will be
considered later in the meeting.
Mr. Moore moved that the City Manager have 2000 copies of the
Progress Report printed for distribution to citizens and other
interested parties, seconded by Mr. Claiborne and carried.
A bill was presented from Jce Reinertson of Jacksonville in amount
$1,037 . 95 to cover the laterals built in Selva Marina. It was
brought out that as the $500. tap charges are collected, we will
deduct the cost of these laterals before paying the Selva Marina
Company. Mr. Moore moved that the Bill of Joe Reinertson of
Jacksonville be paid from the Sewer Fund in the amount of $1,037.95,
seconded by Mr. Claiborne and carried.
Mr. Waggoner presented a bill from the Duval Engineering and
Contracting Co. for $10, 581.95 which is the actual cost of the
resurfacing done by them. This amount is less than the contract
figure. He advised that the paving has been tested and in all
instances found to be adequate, and most instances in excess of
requirements. Mr. Moore moved that this bill be paid, seconded

The City Manager presented a bill from the City of Jacksonville
in the amount of $1, 228.26 covering the installation of additional
street lights in Atlantic Beach, which amount is less than the
estimated price, Mr. Moore moved that said bill be paid, seconded
by Mr. Claiborne and carried.
Mr. Moore presented Resolution #59-29 covering fund transfers in
1959 budget and moved its adoption, seconded by Mr. Claiborne and
having been duly considered the Mayor Pro-tem put the question
the;eon and the motion was unanimously carried. Copy of said
Resolution #59-29 as adopted is attached to these minutes and
made a part thereof.
Rates for classifications not included in Ordinance covering Sewer
Service Charges were next discussed. Dr. Whitehurst presented
Resolution #59-30 setting the rate on 1,aunderettes at .300 per M
gallons of water used.,, on residence nurseey schools at $2.50 for
1st toilet plus $1.00 for each additional toilet, and on the
entry Club $8.25 per month as temporary fee for the existing'
-facility, and moved its adoption. The motion was seconded by Mg,
Moore and having been duly considered the question was put and
4s41 motion was unanimously carried. Whereupon the Mayor p;o--tem
de1ared said Resolution #59-30 duly adopted. Copy of said
Resolution. is attached to these minutes and made a part theteof.
