MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY 110 COMMISSION HELD AT THE CITY HALL ON TUESDAY, NOVEMBER 25TH, 1958 AT 7:30 P.M, Present: Wm. S. Howell Preben Johansen Chas° R. Moore - H'Ngh Roberts W0 Laney Whitehurst, Commissioners and J.F. Waggoner, Jr, , City Manager Adele Se Grego, City Clerk The City Commission of Atlantic Beach, Florida met in regu- lar session, pursuant to the law and the rules of said Commission, in the City Hall of said City at 7:30 P.M., November 25th, 1958 to canvass the votes cast in the Special Election to approve or disapprove the Ordinance granting Franchise to the Jacksonville Gas Corporation. Certthficate of Proof of Publication pf Notice of said Special Election is attached to these minutes and made a part hereof. The meeting was called to order by the Mayor-Commissioner, Mr. Howell 411 Mayor Howell and City Clerk Adele S. Grage presented to the Commission copies of the certificate from the election offi- cials covering the Special Election to approve or disapprove the Ordinance granting a franchise to the Jacksonville Gas Corporation for the distribution and sale of manufactured, liquefied petroleum or natural gas in. the City. Copy of the election officials ° certificate is attached to these minutes and made a part thereof Mb© Johansen presented Resolution #58-39 covering the canvass- ing of the returns of said. Special Election and declaring said Ordinance #40-58-1 approved and in full force and effect. Said Resolution #58-39 having been xead in full, Mr. Johansen moved its adoption, said motion was seconded by Mr. Whitehurst and having been duly considered the Mayor put the question thereon and the vote was: Aye : Johansen, Moore, Roberts, Whitehurst, Howell Nay: None Whereupon the N yor declared said motion carried and said Resolution duly adopted. The Mayor declared said meeting ad j ourne77 • Attests r � L • 4o, , �: or-Commis., Adele S. sooner ragez, C' t �. .k RESOLUTION NO 58-39 WHEREAS, an ordinance entitled "AN ORDINANCE granting the right, privilege and franchise to The Jacksonville Gas Corporation, A Corporation, to open the ground in the streets and highways in the City of Atlantic Beach, and to cross any bridges, viaducts, culverts, in the City of Atlantic Beach for the purpose of sinking, laying or repairing pipes, mains and conduits for the transmission, distribution and saleof manu- factured, liquefied petroleum or natural gas in said City: and providing for referendum election for the approval or disapproval of this ordinance by The Freeholders who are qualified electors residing in said City. ' was adopted by the City Commission on October 20th, 1958 and the same to be submitted to the electors of said City for their approval or disapproval, at an election to be held on the 25th day of November, 1958; and WHEREAS, the said election has been duly held in accordance with law on said date, and the votes cast thereat have, by the inspectors and clerks appointed to conduct said election, been read, delivered and canvassed, and the returns of said election have been delivered to said Commission for the purpose of canvassing said election returns and determining and certifying the result thereof; NOW THEREFORE, be it resolved, determined, found, de- clared and hereby certified by the City Commission of the City of Atlantic Beach, Florida, at a meeting of such Commission duly and regularly held, at which said official returns of said election have been duly and regularly canvassed according to law as follows, that: 1. The total number of qualified electors (freeholders)was 7 6 /q�J 2. The number of Ballots cast for approval was 3 ! 3. The number of Ballots cast Against approval was 4. The number of unmarked Ballots was 5. The total number of Ballots cast was Lfe / 6. The number of Ballots voided was • 7 .
