07-14-52 v MINUTII:S OF THE REGULAR MONTHLY MEETING OF THE ATLANTIC BEACH TOWN COUNCIL HELD AT THE TOWN HALL ON MONDAY, JULY 14TH, 1952 AT 8 P.M. Present: E. Gerry Adams D.W. Bremer R.S. Thames , Councilmen and - r . , G.L. Rosborough, Mayor J.D. Brotchie, Town Manager. • . Adele S. Grape, Lown Clerk - - The meeting was called to order by- the- President, Mr. Adams. Minutes-of the regular meeting-of June. 9, 1952•were read, and upon motion of Mr. Bremer, seconded by.Mr. Thames were approved. . . Minutes of the adjourned.meeting of June 13, 1952 were read and upon motion of Mr. Bremer, seconded by Mr. Thames were approved. Minutes of the adjourned.meeting_ of June 18, 1952, 7:30 P.M. were read and upon motion of Mr. Thames, -seconded by.Mr. .Bremer. were approved. Minutes of the adjourned meeting of 8:15 P.M., June 18, 1952 were read and upon motion of Mr. Thames, seconded by Mr. Bremer were approved. Mr. Adams next recognized visitors present and called for any business - from the floor. Mrs. Louid Silver requested that the Town take whatever action necessary to secure a traffic light at the intersection of Mayport Rd. and Atlantic Boulevard, as the traffic is constantly becoming heavier and more accidents are happening there every week. There was a discussion of this situation, and upon motion of Mr. Thames, seconded by Mr. Bremer theF Toren Manager was directed to take whatever steps were necessary to get an appropriate light at this intersection. • Mr. Glover Weiss Asked the Council again to see if something could be done to keep the beach cleared of bottles, cans, and other debris. There was a discussion, and it was decided to enforce the picnic law, and for the Town Manager have additional signs put on the seawall. Mr. McMillin asked if the lots on either side of his place could be included in the lot cleaning. It was reported that the owner of Lot 22, Block 6 was making plans for his lot to be cleaned, and that the owner of the lot on other side of Mr. McMillin is getting prices on getting it cleared. Mr. Robt. Stubbs asked that something be done to curb the speeding on Ocean Blvd. between 10th and 16th Sts. He was advised that definite attention was being given this situation. Mrs. Donald Smith asked if Mr. Russell was going to have any help this summer, and was advised that Mr. Hicks was to act as Deputy Town Marshall and help whenever needed. The paving of portions of First, Second, Eleventh, Twelfth Sts., East Coast Drive, and Plaza was next discussed, and upon motion of Mr. Thames, seconded by Mr. Bremer an Ordinance was passed by Title only covering this paving, on first reading. Upon motion of Mr. Thames, seconded by Mr. Bremer, it was passed on 2nd reading. The matter of mosquito control was discussed and Mr. Brotchie advised that it had been decided for all 3 beahces to fog at the same time, as this would be more effective, and since the others had not felt that fogging was necessary to date, that no fogging had been done. Grage, Town Cl; k • i • RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF ATLANTIC BEACH, FLORIDA, PROVIDING FOR THE PAVING AND IEPROVEMENT OF A PORTION OF CERTAIN STREETS OF SAID TOWN, AND PROVID- ING FOR THE PAYMENT OF A PART OF THE COSTS THEREOF BY THE TOWN FROM ITS GENERAL FUND, AND A PART OF SAID COSTS BY THE LEVYING AND IEPOSIN?G OF SPECIAL ASSESSMENTS AGAINST AND UPON ALL LOTS AND LANDS ADJOINING AND CONTIG- UOUS TO OR BOUNDING AND ABUTTING UPON SAID IMPROVEMENT. . BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF ATLANTIC BEACH, FLORIDA: Section 1. It is hereby ascertained, determined and declared that the public health, safety, order, convenience, comfort, and general welfare of the Town of Atlantic Beach in Duval County, Florida, require that the portion of those certain streets of said Town hereinafter described and designated be paved and improved in accordance with the plans and specifications adopted and approved and attached to and by reference made a part of Ordinance Number 1 .S0 ; and said improvement is hereby ordered to be made. Section 2 . It is hereby ordered that all the parts or portions of those certain streets of said Town of Atlantic Beach, viz: The street known and designated as First Street from said Beach Avenue to said East Coast Drive ; the street known and designated as Second Street from Beach Avenue to said Ocean Boulevard; the street known and designated as Eleventh Street from said Ocean Boulevard to said East Coast Drive; the street known and designated as The Plaza from said Ocean Boulevard to said Sherry Drive ; a portion of the street known and designa- ted as East Coast Drive between said Tenth Street and said Eleventh Street;; and a portion of the street known and designated as Twelfth Street between said Ocean Boulevard and said East Coast Drive. be paved and improved in accordance with said plans and specifications. 411 Section 3. The total estimated cost of constructing said improvement and completing the said work contemplated hereunder is the sum of 66 0/. 40f- , and the proportion of such total estimated cost, which shall be borne and paid by the Town of Atlantic Beach, is the sum of 01-9- e , which shall be paid in cash from the funds appropriated and available for the purpose from the Town' s general fund, and the balance of said estimated total cost remaining in the sum of $ '+DO. shall be 410 financed, paid and defrayed by the imposition and collection of special assessments to be levied and assessed against and upon all lots and lands adjoining, contiguous to or bounding and abutting such improvement ( exclusive of public-owned property) specially benefited by reason of the construction of said improve- ment . Section 4. It is hereby ascertained, determined and declared that all lots and lands adjoining and contiguous to or bounding and abutting upon said above described parts or portions of said • several streets will be specially benefited by the improvement provided in said Ordinance to an extent greatly in excess of the estimated amount of the special assessments to be distributed and prorated among the said several lots and lands to be assessed. To pay and defray such portion of said cost of said improvement as will not be borne by said Town, special assessments, in the manner hereinafter provided, shall be imposed, levied and assessed against and upon all such lots and lands ( exclusive of public-owned property) adjoining and contiguous to or bounding and abutting upon said improvement to be specially benefited by reason of the construction of said improve- ment, in an amount which shall in rio event exceed the special benefit accruing to the property assessed, the unit or basis for distributing the special assessment to be so imposed, levied and assessed shall be according to the front footage of such property fronting or abutting upon said improvement in the proportion that the particular lot or parcel of land to be assessed bears to the total front foot- age of ell such property fronting or abutting upon said improvement . 2 + 4 The estimated amount of cost per front foot as special assessment to be levied and assessed against and upon such lots or parcels of land fronting or abutting upon said improvement is as follows: The sum of 4.75 per front foot for each foot of property abutting on said improvement to be made on said First, Second, and Eleventh Streets, and The Plaza from Ocean Boulevard to East Coast Drive; 41.00 per front foot for each foot of property abutting on said improvement to be made on said Twelfth Street and East Coast Drive ; and till.25 per front foot for each foot of property abutting on said improvement to be made on the Plaza from East Coast Drive to Sherry Drive. The Town shall have and assert a lien superior to all other claims except taxes against and upon the aforesaid property for the amounts of such special assessment, together with in- terest and all costs of collection. Section 5. The plans and specifications for the estimated cost of the said proposed improvement are on file with the Town Clerk of said Town, and are open to the inspection of the public at the Town Hall of said Town. Section 6. The Town Clerk, as soon as practical hereafter, shall make a special assessment roll and in the preparation of said roll said costs shall be determined and prorated among all the lots and lands aforesaid specially benefited by said improve- ment, according to the method and upon the basis prescribed in said Section 4 hereof. Section 7. Said several special assessments against the said several lots and lands shall become payable to the T avn immedi- ately upon the adoption and final approval of said special assessment roll and may be paid in two equal installments, the first of which said installments shall be due and payable thirty days after said special assessment roll shall have been approved and confirmed, and the second of said installments one year thereafter . Said installments shall bear interest at the rate of eight per cent per annum from the date payment thereof, respectively, becomes due until paid. Section $. The Town Clerk is hereby directed to cause this Le:;olution to be published once a week for a period of two weeks 3 .
