10-14-41 v MINUTES OF THE REGULAR MONTHLY MEETING OF THE ATLANTIC BEACH TONN COUNCIL HELD AT THE TO:N HALL AT 8 P.M. OCTOBER 14, 1941. r • Present: H. G. Isaacs, Fred C . Allen E. L. Chiasson S. S. Jacobs. The Mayor , G. L. Rosborough and Town Attorney, C . C . Howell , Jr. were also present. Upon motion of Mr. Jacobs , seconded by Mr. Allen, the minutes of the regular monthly meeting of September 9th were approved as read with the exception that amendments are to be made to the budget to conform to the revenue from taxation. Minutes of the Special Meeting of September 17 were pnroved as read. nnutes of the special meeting of October 2 were approv- ed as read. The report of the Town Treasurer, Mr. James I . Cranford, was approved and ordered filed. The Town Treasurer delivered to the Town Clerk the Seven Seawall bonds retired on October 1 , 1941 , together with 91 coupons. Upon motion of Yr. Allen, seconded by Yr. Jacobs , the Town Clerk was authorized and directed to accept the cancelled bonds and coupons and give the Town Treasurer a receipt therefor. Upon motI4n of' Mr . Mr. F . E. Suggs appeared before the Council to ask that he be given further time in which to oay his Seawall Construc- tion account , which has already been certified to the Town Attorney for collection. By unanimous consent , the Town Attorney was authorized to hold the matter in abeyance for a period not exceeding thirty days . Upon motion of Mr. Jacobs, seconded by Mr. Allen, an Ordinance entitled, "AN ORDINANCE to Approve and Adopt the Tax Assessment Roll for the Year 1941 , and to Determine and fix the Rate of Taxation and Make the Annual Tax Levy of the Year 1941" , was unanimously passed on Third and Final Read- ing. Reference was made to the account of the Town of Neptune for $155.93 covering their share of the cost of install- ing traffic lights on Atlantic Boulevard. This matter was referred to the Mayor and President of the Town Council to take up with the Neptune Town Council at their next meeting. Upon recommendation of the Mayor and by unanimous consent, the Town Clerk was authorized to purchase a drum for the sum of 0.50 for the Fletcherettes at the Fletcher High School. The Mayor reported that he had had a conference with Commissioner Pierce in reference to the allocation of current for street purposes and Mr. Pierce had agreed to recommend to the City Commission of Jacksonville that such allocation be made upon an annual basis instead of a monthly basis. A letter from the State Fire Marshal enclosing a copy of State regulations together with a suggested Ordinance was referred to the Laws and Rules Committee for study and recommenda- tions. This raised the subject of fighting fires in the Town of Atlantic Beach as well as the supply of water for this purpose and much discussion was had in reference thereto. Each member of the Council advised that he had had numerous complaints regarding the availability of water for fire fighting purposes, that much of the Town is unprotected from this standpoint and that the water system at the hotel is not sufficient to adequately cope with any major situation that may arise. Thereupon, Mr. Jacobs introduced the following Resolution, which Resolution was seconded by Cdr. Chiasson and unanimously adopted: RESOLUTION. WHEREAS, it is general knowledge of all the people living in the Town of Atlantic Beach that the water works system in the Town is wholly inadequate and completely in- efficient if called upon to cope with a major fire ; that the system is antiquated, does not extend over sufficient territory, is not according to the specifications of the National Board of Fire Underwriters and in many other ways entirely unsatisfactory for the Proper protection of the property of residents of the Town of Atlantic Beach, and WHEREAS, there has been some complaint, indicating that the pressure is not sufficient in some localities to furnish the required supply of water to second floors of residences and that the health of the citizens is thereby impaired, and WHEREAS, some sections of the Town are not supplied by this system and cannot be supplied under the present arrangements, thereby necessitating many tax payers within the Town securing water from the Town of Neptune, and WHEREAS, it is commonly believed that the Home Utilities , Incorporated are nothing more than squatters in the Town of Atlantic Beach, that they are at this time making use of mains and other property belonging to the Town, and 41/ WHEREAS, other conditions exist which are not conducive to the best interest of all the property owners in the. Town, NOV; THEREFORE, BE IT RESOLVED by the Mayor and Town Council of the Town of Atlantic Beach, that it is the findings of the said Mayor and Town Council that the methods by which property owners are furnished with water for domestic consumption and the Town as e whole furnished with water for fire flatting purpose s are entirely unsatisfactory, that the President of the Town Council is hereby authorized and directed to appoint a Fact-finding Committee to immediately , thoroughly investigate the water situa- tion as a whole and to report back at the earliest possible date to the Town Council their findings, together with their recommendation for such action as is deemed proper in the matter. Thereupon, the President of the Council appointed Mr. G. L. Posborough, Mayor , Mr. F. L. Chiasson and S. S. Jacobs, Members of the Town Council as members of this Committee. Upon motion of Mr. Allen, seconded by Mr. Chiasson, the Clerk was directed to pay to the Southern Bell Telephone Comnany the sum of 4"3.9l per month for the ensuing fiscal year on behalf of the Health Center located in the Arnot Building, Jacksonville Beach, the Clerk to make such payment without further authoriza- tion during the present year and to charge these payments to the contingent fund. The Town Attorney discussed the case of Oltrogge Vs. the Town of Atlantic Beach and upon his recommendation, it was unanimously agreed that the services of Dr . Kenneth Morris should be obtained for examination and then for testimony in the case; his fee to be x'25.00 for examination and .$25.00 for each day in court.
