01-03-39 v iINUTES OF THE REGULAR MONTHLY MEETING OF THE ATLANTIC BEACH TOWN COUNCIL HELD AT THE TOWN HALL AT 8 P.M. JANUARY 3 , 1939 Present: E. L. Chiasson MICROFILMED R. E. Sugg G. L. Rosborough Thos. W. Trout Mayor Geo. H. Smith and Attorney Howell were also present. The Clerk read the minutes of the regular monthly meeting of December 6 , 1938 , which were approved as read. The Clerk read the minutes of the woecial called meeting of December 13 , 1938, which with corrections end additions , were approved. The Clerk read the minutes of a special adjourned meeting held December 19, 1938 , which were approved. ear. Osborne , Town Treasurer, submitted his usual monthly financial reports , which were anoroved and ordered filed. upon motion of ear. Trout, seconded by Mr. Rosborough, and carried , the note at the Florida ,National Bank, in the sum of 4500.00 plus interest of 44.38, was ordered paid. upon motion of Mr. Rosborough, seconded by Mr . Pelot appeared before the council in reference to delinquent taxes on his property and in reference to the seawall construction account on Lot 8 , Block 36 . After considerable discussion , mr. Rosborough moved and Mr. Trout seconded, which motion was carried, as follows : That Mr. Pelot be allowed to pay: 1. His Seawall construction account in full , includ- ing all accrued interest on unassessed balances , and in view of full settlement, the penalty interest be cancelled , pro- le vided payment is made within thirty days , and, L . shat he nay his other seawall constriction account in full on the same basis Within a period of sixty to ninety days , and, 3. chat he nay all delinquent taxes on all of his property, the Town Attorney agreeing to accept the usual attorneys fee for collection without suit , vis. 10%, or to make such other arrangement as may be agreed upon between Mr. Pelot end the Town Attorney, in lieu of Httorney ' s fees for suit, and Mr. Pelot to pay the costs thus far accrued in the case , provided all payments now promised are made within thirty days from this date . Howell , Town Attorney, explained the ac- tion of Lilies Patterson, Bond Attorney, in rejecting the 'town' s bonds ; stating that the objection is based on an alledged irregularity in connection with affidavits obtained from registered nd ':ualified voters who became free-holders between the time of registration and iarch 11 , 1938. mr. Howell stated that he immediately got in touch with the Legal Department of the h. F.C. , which has accepted all Town Bonds and that he expect- ed momentarily to hear from them as to further stipulations required for the sale of the bonds to n.F.C. The matter of seawall delinquents was discuss- ed further. The Clerk read an ordinance entitled "In Ordinance Authorizing the Lithographing of certain Signatures on the "Town of Atlantic Beach Municipal Building Bonds , issue of 1938" , and the "Town of Atlantic reach streets improvement tsonds, issue of 1938" , and the "Town of Atlantic Beach Incinerator and Garbage Bonds , issue of 1938" . Thereupon mr. Trout moved the passage of this ordinance on third and final reading. Mr . Rosborough seconded the motion and the ordinance was unanimously passed. The Clerk read ordinance No 43, entitled an ordinance declaring that the -Town of Atlantic Beach municipal building Bonds , issue of 1538" , the "Town of Atlantic Beach streets Improvement Bonds , Issue of 1938" and the "Town of Ltlantic Beach Incinerator and Garbage Bonds , Issue of 1938" shall bear thereon the usual validation certificate. Thereupon mr. Trout moved , mr. Rosborough seconded the passage of this ordinance on third and final reading. The motion was put and unanimously carried. Discussion was had regarding the Zoning Ordi - nance. The Attorney advised that nothing could be done about the matter until after an amendment to the state Act could be had. Mr. Trout brought up the matter of remuneration for r4r. E. P. Barwald , Tax Assessor. r=_fter Considerable discussion, Mr. Rosborough moved, Nr. Trout seconded , which motion was carried, that Mr. Barwald be extended remuneration in the sum equal to the 1938 taxes on Lots 9 and 10, Block 14, provided mr. Barwald pays all other taxes now due. -S- in reference to clerk hire , it was decided to leave the matter to the judgement of the ulerk to deter- mine when the present reason for such employment has passed. Mr. Smith raised the question of the Municipal Building and discussion was had in reference to the project provided for. The Chair asked that the Mayor look into the matter of modification of the present rroject set-up to provide lesser buildings. upon motion of Mr. Trout, seconded by Mr. Sugg, the following were named as election officers to officiate at the hoecial franchise election of January 18 , 1939: Geo. A. Prichard Mrs . N. T. 'Welch Mrs . Elizabeth Hightower The matter of disposition of Trucks now in use in the 4.P.P . Projects was discussed end it was decided to determine the proper disposition to make of them. The Clerk was instructed to have all insurance cancelled on these trucks immediately they are discontinued in use . The matter of the deep ditches along rifth Street was discussed and the City Supervisor stated that it was his intention to undertake a remedy of this condition as soon as the W. H.
